T-he meeting was nerewi th calle d to ordert; I A committee of citizens from the Glennwood District appeared before the council and presented petitions requesting the Eugene Common Council to call a spe~ial election to vote on the proposed annexation of the dlennwood ~erritory to the City of Eugene. After considerable discussion this matter wasreferred to the Judiciary Committee and City Engineer for investigation and study wi th a request that they prepare an/l ordinance giving tne exa'ci bounds of the terri tory to be annexed and present such ordinance to the Common Council at its next me~ting which 31 is to" be held ~:m June 26,. The terr~ tory to be viewed by various counC?ilinen, June 13. Tom Garrett addressed the council in benalf of his previous offer for the following described property Nor.th 16.,6'of Lot 12 and the .South ;)3.4' of Lot 13, l:Hock 4 Fairmount Kmended addition. Mr. Garrett requested the reconsideration of his previous offer in the nopesthat the Council mignt see its way clear to 'I accept the same so that the sale. could be made and a new home built. After conside - able discussion motion was made. and Eeconded that the council instruct the Mayor and Recorder to execute a bargafn and sale deed only to Mr. Garrett upon payment of 4 the $400.00 as offered and it w~s so ordered. At this time Mr-. Reid arrived. Mr-., Oharles Doan, a resident of N.orth B'end but a property owner of the City of Eugene, addressed the council concerning a special offer for payment of assessments against his Eugene owned property. Mr. Do~n was requested to make his 5 offer' in writing to the Finance Commi ttee and L.ien Department of the City of Eugene The Judiciary Committee reported that it: had studie.d the conditions surrounding the car.damagex dlaim in the amount of $22.50 presented py Mrs. H. L. Hilliard at the last council meeting and recommended that the claim be paid. Upon 6 motion made and seconded the recommendation of the Judiciary Committee was approved I Councilman Farrington, Chairman of the Finance Committee presented the o~ I' of C,ordelia Evans for client-, Robert L. .Jones, $900.00; .$100.00 down, $125.00 on delivery of ti:tle, balance payable $225.00 on June 1, 1940 and $225.00 per year with interest at 6% included in this amount for Lot 1, Block 1, Rughfs Add.ition. After a short discussion, the council recommended a counter offer of $1200.00 for the property and if the purchaser tigrees to begin construction of a $6000. 00 residence within six months, the price would be $900.00. Upon motion made and 7 ,. seconded the recommendation was a.pproved. The offer of ~. J. Casey, $600.00, $50.00 down and $50.00 a month with interest at 5% for the pro~rty at the Northeast corner of 8fu. Avenue and Polk Street was presented. The ~inance Committee recommended a counter offer of $1000.0 interest at 6% for this property and upon motion made and seconded the remmmendatio 8-1 of the Finance Commi ttee wa.s approved. The offer of Cashman & Proudfit for client, C. D. Quinn" $200.00 cash for the property 60~x133.68' just north of the alley on the East side of Tyler Street between Broadway and 10th Avenues was recommended by the Finance Committee and presented to the Council. Upon motion made and~conded the recommendation 911 of the Finance Committee was approved. I I 10 The Finance Committee recommended that the council reject the offer of Sam Rugh Realty Company for client, O. J. Mc1\:eegan, $750.00, $75.00 down, $.25.00 by July 15, 1939 and $12.00 per month including interest at 0% for the property at 185 Jefferson Street. Upon motion made and seconded the recommendation the Finance Committee was approved. A request for reaffirmation of acceptance of offer by M. G. Howard; offer made September 9, 1938 on Lot 10, block 2 and Lot 1, Block 3, Hollenbeckts addidtion to pay all city liens and taxes and penalties at 6%. The request was for Lot 1, block 3, only and was upon the recommendation of the ~'inance Committee rejected. I 11 " A. C. Upon motion made and seconded the Recorderls recommendation was approved. The ayes and nays were called, Councilmen voting aye~ ~amb, Heid, bond, Carlson, Farrington, Hanns, Page and Koppe; nay: none, absent: none. ~ ~ 204 ~ Councilman Carlson, Chairma.n of the Street Committee stated that the installation of the traffic signal lights by the ~ugene :::itreet Department had coat approximately :jp1200.00 in labor and material and now that the project had been comple.ted, there was a refund due the -C.i ty of 1!;ugene from thebta te for- ~585.19. Inasmuch as t:he Power. Barco Hammer used in said installation belonged to the City ~ and had been pract;ically worn out, the replacement of the Barco Hammer for the Street Department. U.pon motion made and !:Seconded the Hecorder was instructed, upon the receipt of the tioove refund, ~o handle the same as follows: deduct trom the principal amount -received the amount of the purchase price of the new hammer to replace the one which was used in the installation of said lights and credit the balance to the general fund. I " '.. ....~ ~ ,....''''. ;t\.? 14 I Councilman Koppe, Chairman of the Health Committee reported that the owner of the premises at First and Van Buren on- whose prop-erty there is an old pen tank which is a health menace, had agreed ~o fill the tank or else remove it 15- al together. 2. The Health Committee further reported that at 95-1- West Broadway there was an old building located at the back of the .lot that was badly in need of repair and was also considered a fire menace and recommended that it be condemned. Upon II/~otion made and seconded the council ordered the building to be condemned and the 16.% 6i ty A.ttorney, S. M. Calkins,. was instructed to. instigate condemnation proceed'ing's. Councilman Hanns reported the t the residence immediately south of the proposed medical building at the corner of 13th and Willamette Streets was a aetrim nt to tha~ part of the city as well as a fire hazard, and a health menace. The matter was referred to the Heal th- Commi ttee for study wi th a request that they r epor t at the neKt meeting of the council. Mr. A. E. Barrett, spoke briefly to the council . x on the, matter and unan-imously endor,sed. Counci Iman Hannsrt, recommendat ion that some- l~ thing be done. Councilman Rage, Chairman of the Parks Committee, reported that the house on Cheshire Street adjacent to Skinner Butte Park had been investigated in regard to their Sewage Disposal facilities as the owners had constructed outside toilets, one of which was constructed on the ~ark Property. The matter' was referred tothe L-Ci ty Engineer with a request tha't he enfor ce proper action in accordance with la Ordinance No. 8603. I Councilman Reid, Chairman of the Sewer Committee reported that the Sewer Committee had made a trip to Seattle, Ellensburg and Yakima to study various types' of Sewage Disposal plants and reported that the.~rip was successful as they had learned many things to do and many things not to do in the matter of constructing the proposed sew~ge plant. Councilman Bond, Chairma of the Police Committee recommended the grantin of the. transfer of Package "An Beer License at the Lawrence Street Grocery fro m L. H. & J. E. Williams to Thomas L. Lawhorn. Upon motion made and seconded the 20 --I /recommendation was unanimously approved. - ,At this time there was a general discussion concerning the weed situation I in the. City of Eugene and it was reported that-the Street Department was doing everything they could to remove the worst of the weeds and that they were cut';ting 21~ the parking strips and one strip inside the sIdewalk as had been done in the past . Upon motion made and seconded the ~treet Department was requested to vpaint !'NO PARKING" signs on' ooth sides of the curb on 13th titreet and Kincaid 22 Streets ajdacent to the stop signs and it was so ordered. -""' 19 Councilmen Koppe and Farrington were requested to c all on Dr. James A. y Flanigan and ask him to carry out his agreement to remove the old barn located on- 23 his premises at-739 High Streetl J 24 Communication from the Finance Committee to the Eugene Realty Board- recommending the property, Purkerson and Quimby-Addition the North one-half of Lot Block 4, for reappraisal at ~250.00 was upon motion made and seconded, approved upon the recommendation of the Finance Commi ttee.- I ,. Communication was presented in oehalf of Roy C. Andrews asking for a waiver.of the Set-Back Ordinance in order to reeonstruc~ his garage at 1591 Sylvan Street. As Sixteenth Avenue at this location 1s a gully with no prospects of ever being improved, the Board recommended that this-request be granted. Upon motion made and seconded the recommendation of the Board of Appeals was unanimously app- roved. I 25 . Communication was presented from the Office Machinery and Supply Company and also from the Druggists of Eugene complaining of the electrical license fee within the City as unjust and unfair. A statement from the ~ugene Water Board giving the amount of sewerage charges billed and collected from January 1, 1939 to May 31, 1939, was presented. The total billing as of May 31, 1939 was $7,677.25 and the total collections as or M'ay 31, 1939 were $.6,4'Z'Z.,95, leaving a balance. carried forward June 1, 19;59 of Il,199~30. The report was ordered placed on file. ~.....,~~ 29/ 30 -- The Ci ty Recorder presented a copy of the sewage dispos al statement which had been prepared oy the Judiciary Commi ttee and a copy maiiled to the various water- users living outside the city limits taking water from the City of Eugene. The statement was approved and ordered placed on file. The monthly reports for the month of May, 1939, from the offices of the Englneer.s Department, Police Matron and the Eugene Public Library were presented 31 ./' and ordered placed on file. The City Recorder ~esented the proposed airport contract between the City of Eugene and Joseph Harrell and Mammie Helle Z-umwalt. After a discussion on the 32 ~ matter motion was made and seconded that the contract be issued as presented. Upon further discussion the construction of additional buildings at the airport for waiting room facilities in the amount of ~500.00 to $550.00 was ordered, 33 / the money to be expended from the emergency fund. - The Ordinance amending ~ection 8 of Ordinance No. 7709, an Ordinance regulating the use, conduct and control of vehicles upon the streets and. alleys of the City of Eugene, and prescrioing penalties for the violation thereof, which had its first reading at the council meeting of May 22, was presented for its second rea inE 34~ and held to the next meeting of the council for its third reading. An Ordinance fixing office hours of all city offices in the City of Eugen which had its f~st reading at the council meeting held on May 22, was presented to the council. It had its second reading and under suspension of the rules was placed for its third reading by title by unanimous consent of the council and was p~ced for final reading. OF AMERICA (hereinafter for brevity sometime called "C.ompanyU) issued t.o said C1 ty of Eugene (hereinafter for brevity some times called "City"} a certain insurance policy, and within the time required by law said Company made an appearance in said Court in the name of said City with the view of defending said action, and on the assumption that the alleg.ed fact situation .set for h I in said complaint was covered by the said insurance policy, but it is not -yet. aef-ini ely determined whether said fact situation does in truth come within the terms of said policy; and W~REAS" it appears that in view of existing circumstances and the ~act that said Company has by its attorney already appeared in the name of City, and it now seems that it is advisable for said Company by its said attorney to continue in the defense of said action in said Circuit Court; NOW, THEREFORE~ it is agreed between said Company and said City as foll~s 1. That said Company shall at its expense, as to its attorney and witnesses, cause said action to be defended in said Court but by so doing said Comp- any shall not be deemed to have waived its right to claim that said policy does not cover said fact situation and action in said Bourt and does not obligate said Company to pay any claim made by the plaintiff or to pay any judgment that may be obtained in said action; and said company reserves all rights to disclaim any liabil ity to said City under said policy and the fact situation, whatever it may be, and said action. 2. If it is determined that the actual fact situation and the aforesaid action come within the terms of and are cov~red by said policy said Company shall in all'Tespects conform with the terms of said policy. 3. If it is determined by the parties hereto, or is otherwise lawfully determined, that the fact situation and the action and claim for damages made by said Florence A. Handsaker do not come within the terms of said policy and a judgmen. is obtained against said City in said action, then said Company shall not be liable for the payment of such judgment, and said City shall pay said judgment, if any such judgment, and said City shall pay said judgment, if any such ~udgment is obtain d. I 4. Said City may, if it elects to do so, cause S, M. Calkins, its attorS ney, to be associated in the aefense of said action; but if said City of Eugene elects not to cause its said attorney to be associated in said defense~ such electio shall not. be deemed to be an admission that said policy dows not require said Comp- any to defend said ~ction and pay any resulting judgment, and such election whall not be deemed to be a waiver by said. WAIVER WHEREAS~ heretofore the Common Council of the City of Eugene, upon application of the owners of the following described property, to-wit~ Beginning at the Southwest corner of Lot 7, in Block? of that part of the City df Eugene, Lane County, Oregon which was originally I ~ ~ 207 I donated to said Lane County by Eugene F. Skinner and wife for county purpose and running thence North along the West line of said Lot 7 a distance of 4 feet and 5 inches, thence East 80 feet to the East line of said Lot 7,thence South 38 feet and 5 inches to the North 1 ine of Nor th Park Street in said City of Eugene, "thence West along the Nor th line of saie. North Par&: Street 80 f'eet to the East line of Oak Street in said city and thence N~th along the East line of said Oak Street 34 feet to the place of beginning, all in City'of Hugene, Lane County, Oregon. permitted the owners of said property to place in the paved portion of Park Street abutting on said property a large scale for weiching trucks, wagons, etc. and subsequently the scale was sold by the owners to a person other than the owner of the real estate and at this time, at the instance of th owners of the real estate, the scale is being removed as being an obstacle to the proper use of their real estate and the Common Council is acquiescing in said removal provided that the owners of the real estate will replace the pavement in the sane condition it 'IV as before they were permitted to install the scales. And Whereas, the Common Council of the City of Eugene, Oregon by 0rdinanc Number 8605 passed by the Common Council on the 12th a ay of June, 1939 and approved by the Mayor on the 16th day of June, 1939 e.eclared its intention to constru.ct and declared it to be expedient that the situs of said scales be fi~led in and covered with pavement and that theproperty abutting upon said improvement is the property above first descrioed. I NOW, THEREFORE, the undersigned owners of the above-described property hereby consent that the City of Eugene, Oregon may fill in and reconstruct the pavin~ in the scale pit and let the contract therefore in any manner it deems most advantag eious and without advertising for bids therefor, and we hereby waive notice to build such sidewalk and pavement and also notice of the assessment against said property for the construction of the same, including engineer's charges, and hereby expressly waive any and all irregularities in the proceedings and hereby ratify and confirm all that may be done in the premises and consent that the costs of the construction of said improvement, inc1ud ing engineert's charges for superintendence and inspection not to exceed fifteen per cent of the cost of construction of said wmprovement may be tissessed against said described property and shall constitute a lien thereon as provided by the charter of the City of Eugene. Peebles /s/ Charlotte Peeblea An Improvement Ordinance for repairing Park street where scales had been removed was presented to the council for its first reading, and passed to its second and third readings by title under suspension of the rules by unanimous consent of the council and was placed for final reading.
