I July 24, 1939 .-. ~. ,......:;, .-~ ,. t.,F The minutes of the adjourned meeting of the Common Council held at the hour of 7:30 Otclock P.M. July 24, 1939. M~yor'Elisha Large presided over the meeting. Councilmen present were: Messrs. Lamb,. Reid, Sond, Farrington, Hanns, Car sor Page, and Koppe., Absent: none. I The minutes ,of the previous meeting, July 10, were presented and ordered placed on file. Special order of proceedings was called for by Mayor Large and the first matter presented to the Council was the pr~posed annexation of Glenwood. Mr. Morton of the annexa ti on cOIIlilli ttee for om Glenwood addre ssed the counc i 1 pre'senting an itemized statement of ownerships within said area stating that the assessed valuation total was $101,130.00. M~. Morton also presented the ~titions favoring and opposing the annexation, stating that the petition favoring annexation had names of one hundred and eighteen legal voters from_that district while the petitio s opposing the annexation, although it had some one. hundred and thirty odd names to begin with, had only forty seven legal voters f!tOm the district. .At this time Mr'. Houck addressed the council pointing out that the population in the proposed ar'ea was in the neighbor;lOod of six hundred people. Statements 'II' ere made citing various needs for annexation, but it was decided that the chief. needs were adequate water supply and sewer regulations. There had been distrihuted to the Mayor and Council and other city officials, statements prepared by the Bureau of Municipal Research concerning concerning the proposed consolidation and, inasmuch as the counc 1 had not had an opportunity to study them, and upon motion made and seconded the discussion to call a special election was deferred and upon motion made and r/ seconded the discussion to call a special election was deferred to the first counci meeting in August, at which time definite action would be taken and it was so order d. The next special order of business concerned the Jungle question. The Recorder presented the communication from the City-County Health Doctor, Dr'. E. L. I Gardner, after WIlich Louis Koppe, Chairman of the Health Commi ttee reported the t a meeting had been held by the following people: County Judge Clinton Hurd" Dr. Gardner, Mayor Elisha Large" C. C. Page and Louis Koppe to s.tudy this problem and further reported that part of the property was"owned by Mr. McNutt and McNutt was willing to cooperate with the situation as was recommended. County JUd,e Clinton Hurd addressed the council ple'dging the complete support of the county in this matter. It was the recommendation of the above corr~ittee that the Jungle be done aJNay wi th and completely cleaned out. _U.pon motion made and seconded the recomrr:.endation of the committee was unanimously approved and the Chief of Police instructed to take necessary s.teps to completely clean up not only this Jungle, but, 2 other Jungles in and adjacent to the City of Eugene. The Recorder prBBent~d the report of the retail merchants division of the Eugene Chamber of Commerce in which they recommended the trial of penny parking meters. Statements and 'suggestions were made by var-ious councilmen a s to the numbe and location of meters to be tried and upon motion made and seconded it was ordered that, penny parking meters be given a trial in r~gulating the traffic problems. It was agreed that not less than two hundred meters be installed for a period of not less than six months and' it was so ordered. ,T.h!?n upon motion made and seconded the Police Committee was instructed to completelY,ew6rk out the proposal in detail and the City Recorder instructed to secure information froDm various parking meter companies concerning their meters, and this joint commi ttee to report back to the council at its meeting on August 14. At this time a resolut'ion was proposed to thank M~. Brenne, iIh behalf of the Eugene Chamber of Gommerce and Mr. Roy Morse in behalf of the merchants cOIIlillittee, for their assistance in the matter and' I 3- it was unanimously approved.C-du: Jr..-1!..--(...1--r:.,,;::t;:..rv\..JJ ~7 J,(.i~) The next special order of business was that concerning the traffic control problem near the Ellgene Fruit Growers Association. Councilman Bond reported that the request for limited parking on Eagt Eighth Street had been investigated and recommended that one hour p-arking .on both sides of the street east to the railroad track be incorporated in the proposed ~ rking ordinance. At this time the City Recorder presented the proposed ordinance which was discussed very fully section I .by section showing the new classification of zones in 15 minute parking areas, 30 minute parking areas and one and two hour parking areas. ~he ordinance had its first reading and passed to its second and third readings by title under suspension of the r'ules by unanimous consent of the council. The ayes and nays were called. 4 Councilmen voting aye: Lamb, Reid, Bond, Carlson, Farrington" Ranns,. Page and Koppe, nay: none, absent: none. The ordinance was '0.eclared p.assed and numbered 861 ." At, this time Councilman Carlson presented the question of the purchasing of traffic signs to comply with the new traffic ordinance. It was pointed out tra,t the continued use of money by the Street Department was not money that had been budgeted for that purpQse~ The Street Corp.mittee agreed to continue the purchase and installation of the street signs providing the council would allow them to offset these expenditures, if need be, from the emergency fund. Councilman Carlson reco~~ehded the , ., purchasing of the signs in standar.d model and color and in order to be purchased r~ economically they should be purchased in lots of not less than five hundred. Upon I ~""fI! motion made and seconded the Street Co~nittee was granted the privilege of purchasin ~, standard signs and in any quantity that they deemed advisable and it was.. so ordered. At this time the council proceeded with, the regular order of business. Councilman Farrington, Chairman of the Finance COID.'Ei ttee, 'recomn;ended the offer of R. D. 'Shipman to wrBck the shed and clean the lot on Lot 5, Block 1, Mounta'n View Park Addition (23rd Avenue and Onyx Street) together with a $2.00 cash payment _for the building. Upon motion made and seconded the recommendation was unanimously I 6 approved. The $425.00 cash offer of E. Franswa for Lot 1, Block 3, Hollenbeck Additi n ~was recommended by the Finance Committee. Woolwine to wreck the house at 2411 Potter Street for the material and cleaning wp the premises. _Upon motion made and seconded the recommendation of the Finance Committee was 8 unanimously approved. Councilman Farriniton also recommended the offer' of Edi th Gardiner for client Ed Walder, $175.00,35,00 down and balance when title is delivered for Lot 3, Block 3, Whitney Addition (2nd Lot from Southeast corner of 16th Avenue and - 01 i ve street,). Upon motion made and seconded the recorr~endation of the Finance 9 CD~mittee was approved. The Finance Committee recommended the rejection of the offer of H. E. Cully, $100.00 cash for a snaIl strip of land in Fairmount Addition between extensi lIT of Longview Avenue and the South line of the property recently sold to R. A. Babb. Upon motion made and seconded the recommendation of the F,inance ComITi ttee was approv The offer of Fay M. Bennett for client J. C. Upon motion made and second I 11 the recommendation of the Finance Committee was unanimously approved. The offer. of Cordelia Evans 1100.00, $20.00 down and balance when title is delivered for part Lot 11, Block 2, Fairmount Heights Addition was recomrr,ended ./ by the Finance Committee. Upon motion made and seconded the recommendation of the 12 Finance Committee was unanimously approved. . The offer of.,,,Lane County Abstract Company for client, A. E. Hulegaard, $350.00.,. $200.0.0 cash and the 1:alance at $10.00 per month including interest at 6% lfor Lot 8, Block 10, Hendrickts .Amended Addi tion was re jected by the Finance Commi tt /However, a counter offer of $450.00 was extended. Upon motion made and seconded the 13 recommendation of the Finance Committee was unanimously approved. The Finance Committee reported that the VVPA request for the use of the cit A?wned property at 1307 West 11th, at Polk Street, t,o be used as a 'nursery, be denied 14 by reason of the fact that the city had very good pro?pects of selling the same. Councilman Farrington brought up the question governing the new hangars lat the Eugene airport stating that it would be some tillie before'they could get rPA help to build the pI'oposed hangars. To secure the hangars without WPA heIr it would be necessary to increase the amount appropriated rrom $700.00 to $1000.00. ~t was ag~eed that the Finance Committee furnish specifications to the City Recorder 15 ror the pI'oposed hangar, at which time the Recoeder would call for bids. It~ was also pointed out that M-rs. Mamie Zurnwal t, Joseph Harrell 'os mother .1 had not signed the new contract for the Eugene airport because she felt t~t the ~ityrS request to pay 5% of the gross in addition to the $15.00 monthly rent was too uch and wished to strike out the con-,rcission clause and raise the rent to $25.00 ~er month. Theyre~uested of the city to furnish a suitable stove and fuel for the raiting room for the comfort of public use. After considerable discussion and upon recommendation of the Finance Committee the above requests were unanimously granted. ~ity Attorney Calkins was requested to rule as to whether or not the Aviation Field Levy Fund could be used for this work and he said it could be; therefore the costs I 16> of these improvements will come from this account. At this ti~e Councilman Carlson was excused by the Mayor, Elisha Large. Councilman Farrington presented the question of furnishing City Directories r~r the City of Eugene stating that the City of Eugene could satisfactorily use six hity directories. R. L. Polk & Company offered the directories at $10..00 each and !the Valley Prin"t.ing Company offered them at $12.,5.0 -each. ,It was the recomm.endation of the Committee to buy from the Valley Printing Company if they would meet the ~olk Company prices, if not, the PolkdirBctories were to be purchased. The ayes ~nd nays were called, councilmen voting aye= Farrington, Hanns, and Page, nay~ Lamb, Reid, Bond and Koppe, absent: Carlson. ""Jr-" .,.....'!to... Councilman Paoe, Chairman of the Parks Committee, requested the purchase 18/ of ten tons of hay at 115~00 per ton. Upon motion made and seconded the request was unanimoualy approved. City Engineer Clubb reported that in regard to the sewer conditions on I Clark Avenue, which had been referred to his department at the last council meeting for investigation, recommended that six inch tile be used instead of four inch tile and at very little extra cost between the four inch and the six inch. H~ VIO uld recommend that the166 feet of necessary tile b,e installed and the six inch tile be' used rather than four in~h and the: Oi ty of Euqene to pay the difference, of four cents per foot, a total of i6~65. Upon motion made Bnd seconded the city voted to 19./1 install six inch sewer tile and it was so ordered. The Mayor and several cou'ncilmen complained about non enforcement of the bicycle ordinance and upon mot'ion made Bnd seconded the Chief of rolice was instruct d 20- to see- that his departrr.ent endorce the bicycle ordinance and it was so ordered. Communication was presented to the council from AI's Transfer Company asking to have painted a yellow strip for a parking zone at'his place of business at 30 West Seventh Street. The matter was referred to the Police Committee for 21 investigation with a request that they report at the next me~ting of the,council. - R~quest was presented from the Eugene Playground Commission asking that the Director of Recreation and Supervisor-At-Large be furnished with gasoline and oil 22/ from the citylfs s,ervices and they will approve the payment of said bills from the Playground funds. Upon motion made and s,econded the request was unaniI!iously approve . Communication was presented from George'hT.. Hall complaining of the closing of the North end of the alley, which extends from 5th Street to the SF pr operty , in the back extending East from Charnelton str~et, ~nd asked cooperation I of the City of Eugene in having this crossing again open to traffic. The matter' was referred. to the JUdiciary Committee and Ci ty Attorney for investigation and 23 report. at the next council meeting. Communicati on was pre'sented from Dr. Alma Cannon Mi 11 er complaining of the tremendous fire hazar~ property surrounding her residence at 2996 Kincaid Street ror six city blocks. She stated that there were approximately forty acres and demanded that the city remove the grass and bruth surrounding her prDperty. The matter was I'Bferred to the Fire and Water Committee asking that they take ~are of 24- the same. Communication'was presented from the Board of Appeals in behalf of George Chenault for a special permit to erect a portable house, 12f x 24f on the rear of xhis lot at 1609 W.. 5th Avenue in which to house his parents. As he agrees to compI with all sanitary regulations, the Board would recommend that this request be gr'anted. Upon motion made and seconded the recommendation of the Board of ~ppeals 25 was unanimously approved. Communication lITas also presented from the Board of Appeals in behalf of A. L. Williamson stating that he had sold the front eighty feet of his lot at Tenth and Pearl Streets ~nd asked for a permit to move the resid~nce to within six feet of his present shop and VIai ve the requirements of "Earagraph E of Section 1602 of the Building Code'. The Board recommended that this request be granted and upon motion made and seconded. the recommendation of the. Board of Appeals was unanimous ly 26--1 appr.oved. I The Library report for the month of June, 1939, was presented a"nd ordered placed on file. The Fire Department monthly report for the months of May and June 2 7 ---- were presented and ordered placed on file. An application for a second-hand dealers license was presented in behalf of R. T. Thomas at 875 Olive Street (Service Cleaners). As the application had been approved by the Chief of Police the council approved the recommendation of the 2a Ch~~f of Poli~e and upon ffiotion made and seconded the license was granted. I The City Recorder was instructed to n'ot-ify'Saul Paul that his application for a second-hand dealers license had been denied. The recorddr was further instructed to' inform him that the council would hold a hearing on the subject, if 2g-; it was his desir~, cit the next meeting of the council, August 14. At this time Mayor Large rBcommended the appointment of Donald Powell as Assitanzt Sewe~ Tender in the street Department; the appointment to become effective' July 1, 1939. Upon motion made and seconded the recommendation was 30 unanimously approved. The Ordinance to prohibit the sale and use of fir'ecrackers, sky rockets,. torpedos, bumbs, cap pistols and other similar explosives, or the sale or use of .... An ordinance repealing Ordina,nce No. 8275 entitled~ "An ordinance rBgula- ting traffic on the streets and highways of the City of Eugene, providing for traffi signs and signals, repealing all former ordinances in conflict herewith, and providi g a general code of traffic rules for said city, and declaring an emergency, and providing penalties~, was ~rBsented to the council~ It had its first reading and I passed to its second and third readings by title under suspension of the rules by unaniu:ous consent of the council and was placed for its final reading. Adopted by the Common Council July 24, 1939 I RESOLUTION (2) r-tJ 33 WHEREAS, heretofore, one Florence Handsaker made a claim upon the City pf Eugene with respect to an alleged defect in the city's sidewalk, claimed by her ~o have been the result of a misplaced water cover and claimed by the city to ~ve [:en a mere inequality in the sidewalk, and I ,WHEREAS, Florence Handsaker commenced an action against the city of I B gene based on said alleged defect and secured a judgement in the sum of $1300.00 rnd filed a cost bill in the sum of $91.00, all bearing interest at six per cent, bhiCh judgement was docketed at rage 292 of volume 10 of the Judgment Docket of the II ircui t Court of the State of Oregon for Lane County in the Office of the County Clerk of Lane County, Oregon, and ~ WHEREAS, the "Eugene Water Beard carried insurance in the General Casualty po~pany of America, indemnifying it against any loss or damage because of its operat .ons, ~nQ .
