I ~' "'i a;:- The minutes, of -the adjourned mee~ing of the Co~on Council held at the hour of 7:~0 "o-..D\ o'clock p.m. August 28, 19~9. Mayor Elisha large presided over the meeting. CounCilmen present were: Messrs. Fred Lamb, k.A. Reid, Sam Bond, Fred Carlson, P. J. Hanns, C.,C. Page and Louis Koppe; absent: A. C. Farrington. . on file. The minutes of the previous meeting, Aug~st 14, 19~9,were presented and ordered placed - I 1.1 JaJIles H. Tierney addressed the council compliIDenting the members upon the very fine services that they were renderin~ and pledged his support. Mr. E. U. Lee addressed the council requesting their cons~deration of his request for the moving of a small house from the old Luckey property to the rear of his lot at 1040 High Street, waiving the one hoUr fire resistive requirements for Zone 2, which the Board of Appeals reconnnended for denial. rCouncilman Carlson addressed the council explaining the situation wherein he pointed out that Mr. Lee had assumed that if the committee considered the approval of moving said house to another, piece of property that he could see no reason why it couldn't be moved to this location and asked that Mr. Lee's request be granted. Upon motion made and seoonded Mr. Lee's request was 2 Y unanimously approved. Counoilman Carlson, acting as Chairman of the Finanoe Committee, in the absenoe of A. C. Farrington, presented the offer of Peter F. Peterson, $400.00 cash, for Lot 6, Blook 2, Walnut Park Addition, stating that the oommittee reoommended a prioe of $475.00 for this property 3 J if olient begins construotion of a house within sixty days. Upon motion made and seoonded th~ reoommendation of the Finanoe Committee was uanimously approved. > Counoilman Carlson presented the, offer of E. H. Hall, $100.00, $20.00 cash and the balanoe to be paid when the title is ready for Lot 6, Blook 25, College Hill Park Addition. The Finanoe Ai Committee recommended a counter offer of $~50.00. Upon motion nade and seconded the re6'onnnendation 4 of the Finanoe Comlni ttee was unanimously approved. The offer of E. H. Peterson for client, Plato MoFee, $475.09, $75.00 cash and balance at $15.00 or more per month with $.% interest included in payments for Lot 8, Block 10, Hendrick's I / Addition was presented to the Council with a reconnnenda tion of approval from the Finance Committee. 5. Upon motion made and seoonded the reoonnnendation of the Finance Committee was un.animously.appro~d. The Finance Committee recommended the offer of E. H. Peterson for olient, J. C. Watts, $700.00, $25.00 oash and the balance when title is obtained for Lots 5 and 6, Block 6, Lizzie Luokey Addition (50 feet north from t'he northwest corner of 16th Avenue and Olive Street). This offer is made on the condition that Mr. Watts be permitted to build a multiple dwelling on eaoh lot. Upon motion made and seoonded the reoommenda ti on of the Finanoe Committee was unanimous ly 6..% approved. The Finance Committee also reoommended the offer of Oregon Settlement Association for client, Elmer Smith, $1985.00, $100.00 with offer; $~OO.OO when contract is prepared; balance at ! t25.00 per month plus interest at 6% interest to be paid semi-annually; for the east 97 feet of the south 90.9 feet, of Lot 3, Block 17, Fairmount Addition. Upon motion made ~d seconded the 7'"' recommendation of the Finanoe Committee was unanimously approved. The offer of W. K. Striker for olient John Snellstrom $250.00, $50.00 dawn and the balanoe of $200.00 upon aoceptance of offer and delivery of title was presented to the oouncil wi th the 8v1 recommendation of the Finanoe ColDlIIdlttee. Upon motion I1Bde and seconded the reoommendation of the Finance Committee was \m8.nimous ly approved. Councilman Iamb, Chairman of the Judiciary Committee, requested that the City Reoorder present conmunication from the City Attorney, S. M. Calkins, upon the request of George T. Hall, in which Mr. Hall asked cooperation of the City of Eugene in having the alley at 5th Street extending to the Southern Pacific property again opened to traffic. Communication was presented in whioh I City Attorney Calkins stated that in his opinion the Southern Pacific Complny had a right to close the end of the alley f'unning from Fifth Street to the point where it enters -their property. It was v the recommendation of the Juiiciary Committee that the report be approved and upon motion made and 9 seconded the recommendation was unanimously approved. Councilman hanna, Chairmim of' the Fire and Water Committee recollI[OOnded the placeIrent of a or street light at the intersection of 23rd Avenue ani ,_Lincoln Street. Upon motion nade and seconied 1 the recommendation was unanimously approved. Councilnan Carlson re-newed the request of the Scherer Motor Complny for a curb out at I 9CIJ Olive Street which had beendenied at the last council meeting. Mr. Clubb briefly explained that as the company was looated directly on an alley, it would appear that the oompany could nake use of the alley thus preventing the cutting of the curb. Councilman Carlson stated that he believed the curb cut problem in this area could be worked out With satisfaction to all concermd. 1 The matter was referred to the Street Committee with power to act and it was so ordered. Council man Page, Chairnml of the Printing and Parks Connnittee reported that his J2 cOlll1llittee was in favor of granting a location in the Spencer's Butte Park to the Active Club for a Boy Scout Cabin but requested two weeks time to run the property lines so as to s tipula te the exact location. Furthe r, I he would request that the City Recorder advertise for bids upon multiple ooin parking meters; ~ / said bids to be sealed and opendd before the Common Council on above date.' Upon motion made and p,;;) 13 seconded the requests were unanimously granted. .;;} Counoi lman Bond further reported that the Police Committee recommended the issuing of a Second-Hand Dealers License to Saul Paul of the Eugene Exchange.. The ayes and nays were called: 14v' councilmen voting aye: Lamb, Re id, Boni, Hanna, nay: Carlson, P age and Koppe, absent: Farrington The reoommendation was deolared approved and Saul Paul will be granted a license. I Communication was presented from the Board of Appeals in whioh C. L.'Bessonette requested a permit to erect a flue which' does not meet with the requirements of the Building Code, but passes the Underwriters' speoifioations. As the Board recommends that the permit be granted, provided he meet the conditions imposed by the City Building Department, motion was made and seconded'that 15 ../ the r~cgmriJ.endationof the Board.be approved and it was so ordered. 'The Board af Appeals oommunication also presented a request from LeRoy D. Peterson, aocompanied by plans' and a letter from citizens waiving objecti ons to fue proposal; asking for a permit to convert the large residence at the northwest corner of the intersection of Potter , Street and Twentieth Avenue into an flpartment house. One resident of the block appe~ring personally to: object to this project, the Board again. recommended that the'request be.denied. Upon motion 1$ made and seconded the recommendation of the' Beard was unanimously approved. Further communication from the' Beard of Appeals stated that a'letter had been received from the E. H; Peterson Compa~ in behalf~ client J. C. Watts, stating that in the,client's offer"to purchase Lots 5 and 6, Block 6, Lizzie Luclooy Addition he would do so an condition that he be permitted to erect multiple residences on each lot. The Board reoommends that the council I extend the present. R-2 Zone to the alley west of Charnelton Street and south to Seventeenth,Avezme. 17 Upon ~otion made and seconded the recommendation of the Board of Appeals was unan~ously approved. " The request of E. U. Lee asking permission to move a small house from fue old Luckey Property to the rear of his lot at 1040 High Street waiving the one hour fire resistive requirements 11 for Zone 2, although denied by the Board of Appeal s, was presented and action taken at the beginn:iJo:g of the council meeting. (See paragraph 2) I The Board' of' Appeals reported the. t Carl Washburne had asked for a permit to erect a one story building 50 feet by 22 feet of brick veneer on the east side of Olive Street between Broadway and Tenth Avenue. The Board recommended that this request be denied and upon motion made 19./ 'and seconded the recommendation of, the Board was unanimously approved. A further request recammended by the Board of Appeals was that received from H. D. Ryan for a permit to erect a duplex residence at 954 'Eleventh Avenue West. As the Boord of' Appeals 20J 'recommended the granting of the request, motion was made and seconded that the recommendation of the Board be unanimously approved~ Communication was presented from the Allied Art'Studios of Portland in which they requested the cooperation of the City of Eugene to place a banner in the city to advertise the approaching annual Oregon State Fair to be' held in Salem in September. Upon motion made and seconde 21./ the request was granted with the provision that the placement of the banner will be supervised by City Engineer Clubb. 22\../ A monthly Library report for the month of August, 1939 was presented and after noting its contents, was ordered placed on file. An ordinance submitting the question to the electors of the City of Eugene and to the electors of that portion of the Glenwood hereinafter described, the question "For Annexationll or IIAgainst Annexation" of such area and ordering a special election be held in such area and in the City of Eugene on the 5th day of OctOber, 1939, designating polling places, appointing clerks and judges of election, and 'all acts necessary for the carrying on of said election, ahd declaring, an I 23J emergency was presented to the council for its first reading and failing to secure a unanimous vote for suspension of the rules was held to the next 'council meeting for its passage. The following' cur~ cuts were presented~nd upon motion made a,nd seconded the ~ecammendatio s of the City Engineer approved: Mrs. Ella A. Day, 55 West Sixth Awnue, No. 672 (approved); A.. Krosche11~ 950 West Eleventh Avenue, No. 673, (approved); C. F. Wright'1 2343 Olive Street, No. 674, (approved) Russel D. Evanst 515 West Tenth Avenue, No. 675, (approved). The GilmorEf-" Oil Compa~ requested curb cut permits at the northeast corner of 10th and Charnelton Streets and the northwest corner of 10th and Pearl Streets, Nos. 676 and 677. City Engineer Clubb reported I that the cuts as requested and the service station as laid out takes five parking places out of the street and would recommend that these two be referred to the Street Committee with power to 'J' act. Upon motion made and seconded the recommendation of the City Engineer was unanimously 24 approved. At this time the question was presented in connection with making an annual charge for J curb cuts. After a short discussion the matter was left in the hands of the Street Committee and 25 City Attorney to bring in a recommendation at the next meeting of the council. An ordinance amending Section 30f Ordinance No. 8600, Second-Rand Dealers Ordinance was presented to the council for its first reading and passed to its second and third readings by title under suspension of the rules by unanimous consent of the council. BE IT RESOLVED by the Common Council of the City of Eugene that the report of the Water.Board and of the City Recorder, directing that the' sewage 'disposal I ..Y rates charged upon water users be'maintained at present as they now are established' 27 by,Ordinance No~ '8589, be and the same is hereby adopted and approved. t At this time the City Recorder reported that Perr,y Price, serving as City-County Juvenile Officer for a number of years, had been appointed to the State Parole Board and asked the council's approval in the appointment of Lloyd Mattison, to succeed Mr. Price. The Recorder further reported that the le.neCounty Court was paying Mr. Price a full month's salary for the month of August, by reason of the fact. that Mr. Price had given his' time in training the new o'fficer for his duties, and asked the council's permission to carry out the same plan in thepaym.entof his salary from the city. Upon motion made and seconded, the Recorder wa~ instructed to issue the full xsalary for the month of August and' Lloyd :Mattison's salary for two weeks in August, adjustment to be made from the Emergency Fund. Further the Recorder was instructed to write a letter of 'A commendation for the 'Very fine se11Vices rendered by Mr. Price and it was so ordered by the 28 council members. . , . , The Recorder reported that the Signal traffic lights were beginning to burn out and' asked Mr. Stocker of Castelloe and Stocker Electric Company to report on the same. Mr. Stocker stated that it would be more economical to replace all the lights before they burn out instead of ),f replacing them one by one as they burn out. . The matter was referred to the Police COlIDD.ittee to 29 report at the next meeting of the council. . At this time councilma n Hanns asked, consideration for Hart Larsen in his req~st to continue the use of the sign at his place of business. The request had been.denied at the last council meeting because the sign did not conform to the permit issued. Mr. Hanns paointed out that an error had been made in the calculations of'preparing the sign and that the sign was I eleven inches lower than requirements but as there was a clearance of eighteen feet, recommended lVthat the'request be granted. The ayes and nays were called, councilmen vpting aye: Reid, Hanns. 30 Page, and Koppe; nay: Iamb, Bond and Carlson; absenT: Farrington. The request was declared granted. . . The Recorder reported that he ha d received a number of telephone calls and complaints concerning the failure to-have lights in Hendrick's Park and stated that between the stealing and ),/the breaking of lights and fixtures in the park that it had. been diffioult to keep the park lighted. 31 A discussion was had on the subjeot but no aotion was taken at th.is time. Counoilman Page reported that some work was being dona in Hemrick's Park on the road ~ near Dr. Miller's residenoe and asked that the matter be referred to the City Engineer for 32 investigation to protect the city's interest and it was so ordered. \ Upon motion made and seconded the meeting of the council was adjouI"n$3d.
