Page 1 and Louis Koppe; absent: none. . . 2/ The minutes of the previous meeting, August 28, 1939 were presented and ordered placed 1 on file. Councilman Farrington, Chairman of the Finance Committee, presented the property offer of Gertrude Brown, $350.00 cash for Lot 4,B1ook 10, Hendrick's .Amended Addition, stating that '\he Finan'Oe Committee reoommended the rejection of this offer. Upon motion made and seconded the 3"'- reoommendation of the Finance Committee was unanimous ly- approved. Chairman Farrington also presented the offer of Sam Rugh Realty Company, in behalf of clients,' Lyle K. Hastings and Naomi Hasting's stating that the Finanoe Committee reoommended the. rejec~ion of this offer. Upon motion made and seconded. the recommendation of the Finance Coimni ttee 41/ was nnanilnously approved. At this tinw Councilman Farrington presented 'the city bills for the month of August, . 1939 with a recommenda~ion that warrants .be drawn for the same. Upon motion made and seconded A the recommendation was approved. Chairman Carlson reported that the Street Committee and the City Attorney had investigated I the possibility of an annual fee for the curb cut servj,ce and asked the CiW Attorney to make t.he. report. City Attorney Calkins reported that the proposed charge for curb cuts should be taken I I care of in the same ordinance as the contemplated parking meter ordinance because in both instances &1 a regulatory ordinance and not a revenue ordinance would have to be enforced. The committee was granted additional time in vmich to prepare the combined ordinance. Councilman Koppe, Chairman of the Health Committee, reported that there was an old dilapidated barn located at 16th and Columbia Streets which was a definite menace and nuisance to the immediate neighborhood. Chair.man Koppe further ,stated that University officials, represent- ~ing the University of Oregon, o\vners of the ,building, h~d been contacted and they promised to 7 commence removal of said barn, starting September 15. Councilman Page, Chairman of the Parks Committee requested additional time in designating the location for the Boy Scout Cabin in Spencer B~~j.:;e Park. Upon motion .made and seconded the 81 request was unanimously granted. , 0 .. ' ...-iI,' Councilman Page further reported tha t outsid~ pirties were constructing a road in 9 Hendrick's Park and the Park Committee had ordered a fence constructed across the road. The Chairman of the Police Committee, Sam Bond, reporting on the replacement of the Id burned out traffic lights, requested an additional two ,weeks time in whi~h to make a recommendation in the servicing of the lights. Chairman Bond presented the application for a transfer of Retail Beer Class "BIf License at the New Deal Cafe, 962 Willamette Street, from H. H. Weiss & V. M. Hanks to H. H. Weiss & Roy Northam, with a recommendation that said license be granted and upon motion made and seconded the recommendation was unanimously approved. Chairman Bond also presented the application for a 1 transfer of Retail Beer Class "Bit License at Frank' sPla-ee, 47 West 8th Street, from Frank & JMa.rion Gibbs to Clifford Mackey with a recommendation that said license be granted and upon motion 11 made and seoonded the recommendation was unanimous ly approved. , , The Ci~ Recorder presented communication from Elmer Smith requesting a refUnd of ~he $100.00 deposit for the east 97 feet of the South 90.9_feet of Lot 3, Block 17, Fairmount Addition. Mr. Smith felt unable to go through with the contract and wished to withdraw his offer., The me. t ter ~s referred to the Finance Connnittee for study ,,'lith a request for a report at the next camcil I 12 meeting. Communication was presented from the Girl SC~lUts in which they thanked the members of l3J the City Council and expressed appreciation for the aid in securing the new, Girl Scout house. Gardner regarding Haven Boomer, stated that Dr. Gardner had examined Mr. Boomer, and enclosed the report. 'The report was ordered 14 placed on file. ^ " > . City Attorney 'Calkins_ reported that the Yates Hotel bad been torn dovm and therefore / requested that the f-ile for condemnation proceedings be closed. Upon motion made and seconded 18 the request was unanimously granted and the fi Ie was ordered olosed. The ordinance rfor the special election on the proposed Glenwood annexati on, -which had-----/ its second and third readings by title under suspension of the rules. There being a tie Mayor Large voted aye to break the tie and the ordinance was 19 declared passed and numoered 8616. (See end of minutes for correction in first two lines) , Application for a dance hall license in behalf of William Martin's orchestra ( a group of NYA University boys) ~s presented. As the application had been approved by the Chief of Police, 20v motion was made and seconded that a lioense be granted and it was so ordered. Connnunication from the Planning Connnission was presented with attached r esoluti. on and proposed ordinanoe providing for the zoning classific~tion of unolassified areas arising through vacation of streets, alleys, railroads, public places, or through any other source, as single ~ily residence districts~ until such time as the Planning Commission shall have determined their true class ification. The council approved the recommendation of the Commission in passing -the resolution and the ordinance had its first reading and passed to its second and third readings qy title under suspension of the rules. I RES 0 L UTI 0 N "WHEREAS, vacation of streets, alleys, railroads~ public plaoes and various areas are at times aocomplished before the attention of the authorities is directed thereto~ with the possible resul~ that the same may be subjected to a non-conforming use under the zoning plan of the City of Eugene, thereby dislocating the plans of ' the City Planning Commission and of the city itself; THEREFORE BE IT RESOLVED BY THE PLANNING COMMISSION of the City of Eugene that it 'is necessary to the orderly development of the City Planning within the City of Eugene that vacated areas such as streets, alleys, railroads and public places and various other areas shall automatically be deemed zoned as single family residence districts pending further action and exa.mina tion by the Planning Commission. And the Planning-Commission therefore recommends to the Common 00uncil &~ the City of Eugene that it pass an ordinance directing that upon the vacation of any street, alley, railroad, public place or other area that the same shall automatic6'ally be zoned as a single family residence district zone and that no non-con,froming use be permitted therein until the City Planning Commission shall have taken up, recommenied to the Council~ and the Council shall have established its status under the city zoning ordinances in conformity wit-h the zoning plan of the City of Eugene. If I Further communication from the Planning Commission was pre sented stating that the Commiss- ion had passed a resolution suggesting certain redistricting of the zones of the city, placing them 22 VI under different classifications. Upon motion made and seconded the resolution was unanimously approved. RES 0 L UTI 0 N BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF EUGENE: that . I WHEREAS" there has been suggested certain changes in the zoning of certain areas in the city of Eugene to the Council that the Council does hereby require the City Plann,ing Commission to recommend the boundaries of such districts as have been suggested, together with appropriate regulations and restrictions to be enforced therein; before doing so they shall make a tentative report and hold a pubJic hearing thereon on Tuesday, September (1:9, 1939, notice of -which public hearing shall be given by the Planning Commission by publication in a newspaper and by posting three of the notices upon bulletin boards in the City of Eugene. That after such hearing the City Planning Commission shall either adopt, modify or am:lnd their former proposal and file the same with the City Recorder and thereupon the Council shall hold a hearing thereon as provided by law and either adopt or reject said report. ~ rz32 ---~ - --- --- ~ '- '. - -- ~ - - - - -- -- ~ Upon presentation of a statenent from the Eugene Water Board showing sewerage charges <./I billed and collected for the month of August, 1939, it was pointed out that the total collections for the month of August were $1,583.10, bringing the total oollections for the year ~3.:. from January 1, 1939 to August 31, to $1l,l41.5;1.. Page. 612 West 24 10th Avenue, No. 680, (approved). . At this time the City Recorder requested permission to make a partial refund of the fine imposed, on C. H. Tharp for driving while under the influence of intoxicating liquor. It was learned that C. H. Tharp was mentally ill at the time of the complaint. and though he pleaded guilty' to the I charge, was not wholly responsible for his conduct. The Recorder pointed out that Mr. Tharp was now in the State Hospital and it was his desire to credit Mr. Tharp wi th $2.00 for each day that he ~ served in the State Hospital; said money to be returned to Mr. Tharp's daughter, who is in need 25 I of financial assistance. Upon motion made and seconded the request was unanimously approved. A resolution was presented in Which the council directed the Recorder's office, in preparation of the annual budget, to assemble and tabulate the material necessary for an intelli- gent consideration of the city's affa,irs and the preparati,on of its buiget, and to have the sans ~readY for use qy the local budget committee when it is appointed and shall assemble. RES 0 L UTI 0 N , WHEREASF heretofore for many years the office of the City Recorder has assembled the infonmtion and tabulated it, for use by the Budget Committee in preparing the annual budget for the city, and WHEREAS, the State local budge~ law in direoting the preparation ,of a budget, has merely provided that the City shall prepare its arinual budget without designating particular department with reference to its preparation, t < t , Therefore e In order to conform to the practice heretofore followed in "the prepara ti. on of the annual buiget, the Council directs the Recorder's office for this $nd~,JE~n~uing I budgets, to assemble and tabulate the material necessary for an intelligent considera- tion .of the city's affairs and the preparation of its budget, and to have the same ready for use by the local budget committee Whe~ it is appointed and shall a~semble. The City Recorder at this time read the notice for bids for ptrking Ireters and proceeded with the opening and reading of bids for ~he same. Bids were presented from the foll~dng companies: Pacific Parking Meter Corporation, (Mark-Time); Dual Parking Meter Company, (Dual Me-ter) K. E. Erickson Company, Inc. (Tri-Coin meters); Graybar Electric Co., Inc. (Karptrk meters); / Duncan Meter Corporation ( Miller Meter) and Oregon Parking Meter Company (Electric Parking Meters) Mayor Iarge referred the bids to the Police Committee to make their decision and stated that he 27 would call a special meeting of the council to act upon their recommendation. At this time Mayor large named the follovling individuals to comprise the Budget Connnittee for the 1940 Budget: John Snelstrom, Julio W. Silva, Walter Swan, Merril H. Kendall, wm. Bartle, E. U. Lee, J. D. Hamlin, and Ben Perlich. Upon mbtion made and seconded the council unanimously 2 affirmed the above as members of the Budget Committee. Councilman Hanns requested that a study be made of the traffic hazard at 13th and d9 Wi 1 lamette Streets. The matter was referred to the Police Committee to investigate and report back at the next council meeting. Upon motion made and seconded the meeting of the co~cil was adj ourned. C. M.
