Councilman Farrington, Chairman of the -Finance Committee, presented the offe~ of H. E. Cully for clients, Henry P. and ~rances E. Kubicek, $150.00, $50.00 cash and the balance at $5.00 pen mdnth plus interest at a% for Lot 59, ./ Foster"'s Addition wi th the commi ttee-'s recommendation that the offer be a.ccept'ed. 3 Upon motion made and seconded the recommendatio~ was unanimously approved. Chairman Farrington also presented the offer of Margaret E. Thompson $100.00, $20.00 cash and the balance at $5.00 per month plus interest at 6% for the West 75 feet of Lot.s 3, and 4, Block 6, Walnut Park Addi tion wi th the commi ttee' s 4../ recommendation that the offer be accepted. Upon motion made and seconded the recommendation was unanimously approved., The offer of Margaret E. Thompson, $120.00, $25.00 cash and the balance at $5.00 per month plus interest at 6% for Lot 3 and the North 10 feet of Lot 4, , Block 2, Kiser Addition was presented to the Council with the committee's recommenda tiont that the offer' be accepted. Upon motion made and seconded the recommendation of the Finance Committee was unanimously appr'oved. (However, this offer was, re jecte during the latter part of the meeting as Superintendent gramer and G. D. MacLaren,. members of the Schooh Board, guaranteed the purchase of this property for School 5L%District #4 after the next budget meeting..) The offer of Edi th Gardiner for cl ients, A. F. Mariott and M-yr'tle Mariott, $450.00 cash for the West 75 feet of Lots 24 and 25, Block 1, Hendrick's Amended I Addition, was presented to the Council with the recommendation that the offer be rejected and a counter offer of $500 be made and a request to save the west five 6./ f'eet for an alley. Upon motion made and seconded the Recommendation of the Finance Committee was unanimously approved. The offer of Carl W. Robberson,. $300.00 cash for the north one-half of Lot 6, Block 6, Huddleston Amended Addition WE!S rejected by the Finance Committee and a counter offer' of $500.,00 made. This offer was in turn recommended to the coun il ./ and upon motion made and seconded the committee's recommendation was unanimously 7 approved. The offer of Edith F. Gardiner for Client, O. H. Bogan, $250.00 cash for that part of Lots 1 and 2, Block 6, Lizzie Luckey Addition which lies north of the Amazon was presented by the Finance Committee with the recommendation that the offer 8/ be rejected. Upon motion made and seconded the recommendation was unanimously approved. The offer of Sam Rugh Realty Company for client, Edith C. Davis, $300, 150.00 down and $250~QO, payable April 3, 194Q at 2% for that part of Lots 1 and 2, Block 6, Lizzie Luckey ~ddition lying north of the Amazon was presented by the , Finance Commi ttee with the recommendat ion that the offer be re jected., Upon motion made and seconded the recommendation of the Finance Gommittee was uannimously approv d 9 and the offer was rejected. I The offer of H. E. Cully for clients, Fred E. Williams and Willie Mae Williams for Lots, 1, 2, and 3, Block b, Lizzie Luckey Addition to the City of Eugene, Lane County, Oregon, lying north and south of Amazon Slough was presented to the council by the Finance Committee with a recommendation that the offer be accepted; terms as follows: the sum of $50.60 as hereby receipted for and the sum of $350.00 upon approval of sale by,the Common Council of Eugene and,the issuing of proper deed of transfer and ample evidence that title to said property is free and clear 10/ of all encumbrances. Upon motion made and seconded the recommendation of the Finane Committee was unanimously approved. . I The Finance Committee recommended that the $100.0'0 refund requested by lIt! Elmer Smith at the last council meeting be re~urned to nim. Upon motion made and seconded the recommendation of the Finance Committee was unanimously approved. . The r-e.quest from J. D. Campbell for a refund of $100.00 on a contract in Iwhich he agreed to start bUilding wi thin thirty days was pre.sented by the Finance Fommittee with the recommendation that the r-equest be granted. Maltman and L,izzie Maltman that in exchange for a deed to the public covering Har~is Street extension and Quit Claim deed covering ~ the 24 f'oot str'ip lying in 24th Avenue and south thereof that the City cancel -I ' " the charges against the 36 x 160 feot strip south of 24th and east of Harr-is Str'eet ,',C'" '"'-'" was presented to the council with the recommendation that the request be rejected. C' Upon motion made and seconded the recommendation of the Finance Committee was 14 unanimously apprDved. Chairman Farrington brought up the property-exchange offer' existing between the School District M4 and the City of Eugene, proposed at tha 'Council meeti g of June 26, 1939. He explained that at the time of the c:fifer, the Finance Committee had recommended the transfer of the property on the basis that the School Hoard I pay the difference of $5240.00 and now it appears that the intention of the School Board Committee at the time the report was made, was with the understanding that an even exchange of property be made. Comments w.ere received from members of the counc iI, J. F. Cramer, Superinte'ndent of Schools, and G. D. MacLaren, member of the School ffoard. A recess was called to discuss the matter' and upon reconvening, the City' At~orney ruled that the property had been appraised and the council would have to abide by 'the appraised value. However, upon motion made, seconded, and duly approve , it was recommended that the School Board have an appraiser appraise the property involved (both the School property and the City property) and the City of Eugene have an appraiser appraise thE? property 1nvol ved (both the School prop'erty and' the vi City property): and then the School Board meet with the Finance GommJ ttee to discus 15 the proposed apprai~als in an attempt to r~ach a decision. Councilman Farrington wished to reopen the property offer ~ Miss Margaret E. Thompson (descripti-on omitted here} and requested that the offer be rejectep. inasmuch as the School Board wanted to purchase this property from the City for l6il School purposes. Upon motion made and seconded the request was granted. (See Par'. 5,) Councilman Page, Chairman of the Printing and Parks Committee, reported that the School' Board had made a study of the traffic conditions existing at the intersection of 13th and Willamette Stbeets and had called for bids upon suspension of a four way stop light to be manu~lly operated during the school hours of the day. The cost of this light was in the neighborhood of 1150.00. Councilman Hanns stated that he did not feel a flash~rl light wou~~"pe satisf~ctory. Mr. A.~E. Barette" I who lives close to this intersection alsQ,stated that the light should be one commanding a complete stop. Superint,endent Cramer stated that the School Board had agreed upon a complete stop light as the answer and would recommend trying it. Upon motion made and seconded permission was granted to the School Board to install said light, being understood that they pay for the installation and the City of l~Eugene to pay for the maintenance and_ operation and it was so ordered. Councilman Reid, Chairman of the Sewer Committ~e, requested that the \ petition filed with the budget committee requesting the installation of a storm sewer on Onyx between 24th and 25th Streets, be referred to his committee for ~investigation. The Mayor granted the request and asked the sewer committee to 18 report back at the next council meeting. . Councilman Bond, Chairman of the Police Committee, stated that it was the committee's recommendation to accept the $10.00 offer of Mr. Charles, Farnham to ~eplace all traffic signal lights; lights to be furnished by the City of Eugene and 19 upon motion made and seconded the committee report was unanimously approved. eJommunication from the Board of Appeals presented the request of Bert iT. Williams asking for a permit to build an apartment house'Qat the southwest corner of the intersection of Lawrence-street_and Tenth Avenue waiving the requirements of the Set-back'Ord1nance._ He wishes to build within fourteen feet of the property line on each street. The Board would recommend ,that this request be granted on condition that he file the written consent of the property owners to the south and _west of his lot in the same block. Upon motion duly made and seconded, the recommen a- I 20 tion of the Board of Appeals was unanimously approved. A request was received by the Board of Appeals from Eyler Brown asking permission to use an ordinary window in the end of his new garage at 1953 Garden Avenue which is less than three feet rrom the property line. The Board r'ecornmended that his request be granted on condition no other bUilmng be erected within six &feet of his garage and upon motion made and seconded the recommendation of the 21 Board of Appeals was unanimously approved. Communication from the Board of Appeals presented the request from George "I ID. Graves asking for permidsion to engage in the business of making a product on the same order as potato chips on his property at 1236 Agate Street. The Board vilrecommended that this request be denied "and upon motion made and seconded the 22 recommendation of the Board of Appeals was unanimously approved. The communication of the Board of Appeals further revealed that a request had been received from R. O. Suttles asking for permission to use a trailer house as an office on the parking lot just south of Edward's Market ~t Tenth and Olive s.treets. "~'1 The Board of Appeals c.ommunication presented a request to conduct an autowrecking yard at 196,3 Franklin .l:!oulevard. As this yard will be completely obscured from Franklin Boulevard by the buildings facing the street, the Board . ,/' recommends that' this permit be granted and upon motion made and seconded the 25. r'ecommendat ion 'was unaniij),ously approved. I The Board of Appeals communication also reported that an agent of M.P. Bonnett had made a request to convert an old garage at '(54 Lincoln Street into an apartment, the construction to conform in all respects to the Code. The Board would recommend that the condemnation proceedings instituted against this property be 26/ withdrawn and the permit granted. Upon motion made and seconded the recommendation of the Board of Appeals was unanimouslY granted. The Board of Appeals re,commended that the request of Mrs. Mi Idred Ryan to be permitted to waive the set-bac.k ordinance on her property on Eleventh Avenue West between Adams and Jackson Streets be uenied. Mr. John Snelstrom addressed the counc 1 in behalf of Mrs. Ryan's request, after which, Ci ty Engineer' Clubb addressed tae council stating that West 11th Street has~seven feet set-back~ The construction as it now stands provides for only six and one-half fleet set-back. Further, that the drawings on file in the Engineer,f:s office show that the construction was to have a 21'" sixteen foot set-back. After a lengthy discussion, motion was made and seconded tha the recommendation of the Board of Appeals be approved and it was so ordered. At this time the Recorder was requested-to read the report of the Police Committee concerning parking meters. The Police Committee communication stated that the commt:ttee',nad held a number of meetings for demonstrations of the following meters :: Trl-Goin, Marktime, Dual, Karpark, Miller and Oregon Electric meters and it is theirrecommendation that parking meters be, located on both sides of Willamette Street from Sixth to Eleventh; Eighth Street east one-half block to the corner of Park and West one block to the corner of Olive; Broadway two blocks east tu Pearl I and west~o blocks to Charnelton; Tenth Street east one block to Oak and west one bl to Olive. It is the committee's recommendation that the City of Eugene enter into a contract for the instal~tion of Oregon Electric parking meters on Broadway west fr'om Willamette to Charnel ton. Also that the City cf Eugene enter into a contract the installation of the Miller meter on the east side of Willamette Street from Sixth to Eleventh; Eighth Street east from Willamette to Park; Br"oad way, east from Willamette to p'earl; Tenth Street east fromWillamette to Oak. Further, that the , City of Eugene enter into a contract for the installation of the Dual P'a~king meter on the west side of Willamette Street from ,?ixth to Eleventh; Eighth Street west fro Willamette to Olive and Tenth Street west from Willamette to Olive. Upon motion mad and seconded the report and recommendations of the Police Committee were unanimously 28v approved. At this time George McMorran, representing the Dual Parking Meter Company, addressed the council expressing appreciation for the very fine manner in which the Mayor and Police Committee had accepted demonstrations and made investigations of th parking mete~s and expressed his appreciation for the order. He further extended his personal approval of installing a small number of the Electric meters as a trial because, after all, there is the possibility of developing a local industry. Mr. Vel turn, who is the manufacturer of the Electric meter addressed the council express- ing, in behalf of the company, his appreciation for the opportunity to put the elec~ ic meters to a fair trial. Mr. Stocker, representing the Miller Parking Meter Company, addressed the council expressing his appreciation fGr the very fine IIlEinner in which the council considered the meter problem and endorsed M'r. McMorran's statement 29v concerning the installation of the electric meter. I The City Recorder presented the communication from the East Side Neighbor- hood Club in which the women of the club strongly protested the cutting of the big, old walnut tree on Eleventh and Pearl to make way for a service station. The commun ca- 30/ tion was ordered placed on file and the Recorder instructed to notify the club that the city had ~ no authority in the matter. Communication was presented from Dr. E. L. Gardner', regarding the unsani- 31./ tary conditions at 1600 Columbia Street. This matter had been prE?viously presented I' and the communication was ordered placed on file. ~ Communication from the City Attorney revealed the sugge~tion of the Build- ing~with respect to limiting the number of residences that can be ,erected on a city lot,-in the single family district. A resolution was presented directing the City lAtt,o,rney to prepare an ordinance embodying the suggested ch~nge and upon motion mad and seconded the resolution was unanimously adopted. The commb nication further revealed City Engineer'Clubb's suggestion providing an amendment to the ordinance (Nio. 8617) requiring unclassified properties to come into the zoning plan as single family residence districts, having particular reference to Glenwood, the idea being that they could then be properly classified without uses being established contrary to the city's plan. The City Attorney remarked that on'a studw of the ordinance, b~ the Planning Commission, it was disclosed that this proposed amendment was not 32'\11" necessary. A petition for rerouting the Fairmount Line bus route was presented and I ..~~ referred to the Street Committee to report back at the next meeting of the council. r A stat'ement was presented from the Sacred Heart General Hospi tal in behalf ". .,. of Mr-. T. H. Crawford who had been confined in the hospital with a communicable po....... disease. It was pointed out that this was a welfare uase and the City Attorney ........01 explained that under the State Lawall cases of this nature arising within the City of Eugene and ordered isolated by the Health officer, are charged to the City of Eugene and ~XDyxttDex~~x~~~JtlOX~~~ I mDd. r-ecommended that the bill be paid. Upon motion made and seconded this statement 35 was ordered placed in the file to be paid with the September bills. The City Recorder presented a resolution authorizing and directing the Mayor and Recorder to enter into an agreement with Maurice Vitus and Loretta F. Vitu , respecting the following described propertyk to-wit: (omittea here) permitting the said~Maurice Vitus and Loretta F.-Vitus to erect a building up to the property line of Fifth Avepue ~ast, with a provision that at aRY time the City of Eugene sha 1 widen Fifth Avenue that the buildings shall be dismantled back for seven feet, and J that no damages shall be claimed by said, Maurice Vitus and Loretta F. Vitus, or thei successors in interest, except for the land taken. Upon motion made and seconded 36 the resolution was unanimously approved and adopted. Moffett was presented with the approval and recommendation of the Chief 37 of Police. Upon motion made and seconded the license was unanimously granted. The following curb cuts were presented and recommendations of the qity Engineer approved. L. H. The City ftecorder called attention to the condemnation proceedings agai'nst the Frasier- Building at 57 East 6th Street, commonly known as fI~oe's Place"" and made . note of the fact that Frasier'.s had agreed to remove the bu[lding by October 1, 1939 The City Attorney was instructed to contact the owners with regard to the agreement 39 and ask them to comply with the same without further delay. At this time Mayor Large presented the quest,ion of the proposed placement I of the Lien Department under the supervision of the City Treasurer and asked for a complete discussion of the same. Upon motion made by Councilman Lamb and seconded by Councilman Bond that no change be made in the administrative set-up, practically all members of the couneil entered the discussion relating to the typ'e 'of work and the amount of work in order to keep the records in proper shape. The City Treasurer stated that any proposed change would be entirely up to the council; he had not aske for the change and he had no intentions of asking for it. The City Attorney address d ~he council expressing the opinion that it might be well for the City Treasurer to I acquaint himslef with the~Lien Department wor~ by doing what he could do during his free time from his duties. Question was called for and the motion was unanimously 4f approved and it was so ordered. It was the recommendation of Louis Koppe, Chairman of the Health Committee that the property at 1600 C,olumbia Street be condemned. Upon motion made and second d Xthe recommendation was unanimously approved and the City Attorney instructed to take 42 necessary condemnation proceedings. At this time Mayor Large brought up the question concerning the necessity of Eugene to provide a more modern 1:1 nd larger airport. It was the suggestion of Mayor' Large to appoint a committee to work together with representatives of the ~\Chamber of Commerce.
