E October 9 , 1939 I t'" :~; The minutes of the regular meeting of the Common Council held at the hour ex: of 7:,30 otclock p.m. October 9,1939. Mayor Elisha Large presided over the ..11 meeting. Councilmen present were: Messrs. A. A.. Reid, Sam Bond, Fred Carlson, 1 P. J. Hanns, C. C. Page and Louis Koppe; absent: Fred 1amb and A. C. Farrington. The minutes of the previous meeti ng, September' 25, 1969, were presented I 2'1 and ordered placed on file. In the absence of A. C. Farrington, Councilman ~age presented the report of the Finance Committee beginning wi th the property offer of F'. M'. Bennet for client, Marshall Fields, $80.00 down and $50.00 per' year, total offer' $400.00 for the east 70 feet of the north 65 feet. of Lot 4, Block 25, Fairmount Addi tion. The Committee recommended that this offer be rejected and stated that their counter offer' of" $550.00 be approved. Upon motion made and seconded the recommendation ;5./ of the Pinance Committee was unanimously approved. The offer of W. K. Striker for client, W. A. Sherer, $700.00 cash for Lot 12, Block 8, E'airmount Addition known as 1395 Or'"chard Street was recommended ./.i for acceptance by the Finance Committee and upon motion ,made and seconded the 4 recommendation was unanimously approved. The offer of W. K. Striker for client, Glen D. Bolin, $800.00, $25.00 down; $25.00 October 10th; $50.00 November 10th; $50.00 December 10th; and the balance at $15.00 or more per month including interest at 6% for Lot 5, Block 3, Blair Street Addition known as 1455 West Second Avenue was recommended for acceptance J by the Finance Committee and upon motion made and seconded the recommendation was 5 unanimously approved. Upon the recommendation of the Finance Committee, the offer of J. W. Brown and Gertrude Brown $400.00 cash for Lot 4, Block 10, Hendrick's Amended - Addition (120 feet north of the northeast corner of 16th ex Lincoln), motion was I made and seconded that the offer be rejected an~ a counter offer made of $480.00 However, the client says he will build about a $3000 home so the committee } recommends a refund of $80.00 when the house is started. Upon motion made and 6 seconded the recommendation of the Committee was unanimously approved. The offer of F. J. Berger for clients O. H. and J~nnie E. Bogen, $385.00 cash for part of Lots 1, 2, and 3, Block 6, Lizzie Luckey Addition was, upon the recommendation of the Finance Committee rejected, as the council had accepted \ an off'er on the same piece of property at its last meeting. Upon motion made and 7 seconded the recommendation of the Committee was unanimously approved. The offer of Rugh Realty Company for client, Edith Davis, $375.00 cash for Lots, 1, 2, and 3, elock 6, Lizzie Luckey Addition was, upon recommendation ) of the Finance Committee, rejected as the council had accepted an offer on the 8 same piece of property at its last meeting. The $400.00 cash offer of McCully Realty Company for client, Carl Robber- son, for the north 60 feet of Lots 6 and 7, Block 6, Huddleston Addit~on, was recommended by the Finance Committee provided the client builds in sixty days J after receipt of deed. Upon motion made and seconded the recommendati on of the 9 Finance Committee was unanimously approved. Upon recommendation of the Finance Committee, the offer of Rugh Realty Company for client, O. J. Hull, $675.00 cash for Lot 1, Block 6, Kelsey's Second I Addition, motion was made and seconded that the offer be rejected and a counter offer made of $750.00. However, the client intends to build a $4000 or $5000 home and the Finance Committee recommended a $75.00 refund when the house is started. j Upon motion made and seconded the recommendation of the Finance Committee was 10 unanimously approved. The $475.00 cash offer of H. E. Gully for clients, Fred Walter Fischer and Rachael Brown Fischer for Lot 12, Block 8, C,ollege Hill Park Addition was recommended by the Finance Committee and motion was made and seconded unanimously I ll~ approving the recommendation of the Finance Committee. ( The Finance Committee recommended a counter offer of $900.00 including sewer, on the offer of H. E. Cully for client, T,. S. Peterson, $800.00 cash for the south 1/2 of Lot 5 and all of Lot 6, Block 32, Gross Addition and motion was 12J.i made and seconded approving the recommendation of the Finance Committee. The Finance Commi ttee also recommended a counter of $950.00 on the off'er of W. K. (See end of minutes for list of Sept. bills) I Councilman Hanns, Chairman of the Fire and Water Committee, recommended the installation of a street light at the intersection of Emerald and Inavale Street and a street light installation at the intersection of 5th and Filmore Streets. Upon motion made and seconded the recommendation of the committee was unanimously 16v.iapproved. The Fire and Water Committee reported that the street lights at the folIo - ing intersections were in a poor condition: 7th & Madison, 8th & Polk, 15th & Washington, 3rd & Pearl, 21st & Agate, 21st & Emerald, 23rd & Emerald, 19th & Mill, Broadway & Polk and 15th & Villard and the committee recommended that the lights be . replaced by larger lights or have the lights cleaned. The committee also reported that the street lights were burned out at the following intersections: 20th & Agate, 21st & Alder, 21st & Lincoln, and 17th & Patterson. The Recorder was instructed to notify the Eugene Water Board of these intersections and ask them to make proper repairs. It was further reported that it might be necessary to install a light at the northwest corner of Jefferson coming into 13th Street from the north. After a short discussion the Recorder was instructed to contact the Eugene Water Board and ask them for a rep~t concerning the possibility of placing a light at this inter- 17v: sec tion., Councilman Hanns recommended the investigation o-f a portable boiler that is being sold to garages and servicex stations. It was his understanding that the City of Portland prohibited such an installation because it increased the Fire Insurance rates to adjacent properties. After a short discussion the City Recorder was requested to write to the City of Portland regarding their reaction to the in- I stallation of the boiler, and W. A.. Nusbaum, Fire Chief requested to check on garages and service stations, making a report on all such proposed installations 18~and it was so ordered. With regard to the condemnation proceedings of the Frasie~ p~operty, City Attorney Calkins stated that he had contacted Mr. H. VI. Lombard, -A ttorney 19J for the Frasier property, and also Miss Jennie Lee Frasier and the Frasiers had agreed to remove the building immediately. The question was brought up concerning the congested traffic situation on Willamette Street adjacent to the new football field when the field is in use, 20) and the Chief of Police reported that the School Board .was working out a solution to this problem. Communication was presented from the Rostein Realty Company asking the council to open the road in Hendrick's Park which has been graded and gravelled to his south property line, in order that he might connect his scenic Drive, known as Skyline Boulevard, with the drive through the Park. Mr. Rostein personally appeared before the council supporting this request, After a discussion, the matter was referred to the Park Committee with a request that they study the situation and 21 make a report at the next council meeting. Communication was presented from I. G. Kjosness asking that the following sidewalks be included in the WPA Sidewalk Program: A.. The west ,side of University Street between 22nd & 25th Avenues I B. The east side of Miami Lane between 24th and 25th Avenues C. The east side of Potter Street between 23rd and 25th Avenues. D. The west side of Potter Street between 24th & 25th Avenues E. The west side of Harris Street between 24th & 25th. > I The matter wasreferred to the City Engineer for investigation and a ~equest that he 22 report back at the next council meeting. Communication was presented from Hugh H. Earle, giving a descriptive I report of the inspection survey in Eugene completed early in the summer. The report was referred to the Fire and Water Committee with a request that they report 23Jat the next council meeting. Communication was presented from Bertha M. Furrow, presenting a sewerage claim in the amount of $7.00 and asked the City to take eare of the same. The matte was referr.ed to the Sewer Committee with a request that they report at the council 2,4 meeting October 23. The Board of Appeals communication presented a request received from Charles Coral Holcomb asking for a permit to use an unfinished basement on the east side of Lawrence Street between Fifth and Sixth Avenues for the purpose of raising ..... As the Board recommends that this r-eqm st be granted, motion was made and seconded unanimously approving the recommendation of the Boardof .Appeals. \.",.) The communicat,ion also revealed the request from M'rs. Myrtle Kidwell I 1'::~ ,p~ for a permit to convert her residence at 1630 High street into an apartment. As ,.."~."",, similar recommendations have been made in this same block, the Board of Appeals -- .recommends that, this reCluest, be granted on condition that no outside stairway be 26lV erected. Upon motion made and seconded, the recommendation was unanimously approve. A. request was recleved from W. A. Monge to remodel a port ion of his house at 590 Tyler Street into an apartment. The Board of Appeals recommends that this r'equest. be granted on condi tion no exterior changes be made to the heuse. I 27VUpon motion made and seconded the recommendation was unanimously approved. The communication further revealed the request: from O. H.. Bogento purchas th~ city owned lot at the southwest corner of the intersection of Olive Street and Fifteenth Avenue--a triangular piece of property on the Amazon-- on condition that " he be allowed a waiver of the "set-back" ordinance. The Board of Appeals recommend that he be granted a ten foot set back on F~teenth and a fifteen foot set back on ;, Olive Street. Upon motion made, seconded, and duly approved, the recommendation 28 of the BOard was unanimously approved. A request received from Loretta R. Vitus asking for a waiver of the j "Set-Back" Ordinance on east Fifth Avenue. As the regular contract covering set- babk waivera has been filed, the Board recommends that this request be granted and 29 upon motion made and seconded the r'ecommendation was unanimously approved. Mrs. Vitus also made an additional reqmst to be permitted to erect a storage shed at the rear of the building and extending to the west property 1 ine, said shed to be frame construction and covered with corrugated iron, said west wall to be constructed of masonry at such time as a building is erected on the adjoining property. A majority of the members of the Board recommended that this request be denied, but after a discussion motion was made and seconded granting the 30~ request and it was so ordered. 31\ . j The monthly reports from the Police Department, City Engineer and Police I MatronJs office were presented and after noting their contents, wer~ ordered placed on file. The sewer'age report from the Eugene Water Board, was presented and it was revealed that. the total collections for the month of September, 1939, were 32) $.1,509.81, making the total collections from January 1, to September 30, inc. an amount of $12,651.32. The repor t was ordered placed on fi Ie. An ordinance initiating the vacation of certain parts of Ferry Street, which chad its fir.st reading at the last council meeting, was presented to the council for its second reading by title, and under suspension of the rules was read the third time by title. The ayes and nays were called, councilmen voting . aye: Reid, Bond, Carlson, Hanns, Page and Koppe, nay~ none; absent:: Lamb and 33 v. Farr'ington. The ordinance was declared passed and numbered 8618. An ordinance vacating the~fiQilowing described street in the City of Eugene, to-wit: 1'- All that portion of Ferry Street in the City of Eugene, Lane County, Oregon, lying north of the north line of Eighth Street and south of the south line of the Southern Pacific Rei lroad 33~was presented to the council for its first reading and held to the next meeting of the council. A $1.00 refund was requested by George D. Heitzman, Jr. for plumbing I permit No. 8767. It was learned that although he had taken out the permit, he had not done the work and upon motion made and seconded the council approved the 34/ refund. A $1.00 refund was also requested by R. E. Buck for plumbing permit No. 88 8. It was learned that this permit was simply a duplicate of a previous permit so upon 3511I motion made and seconded the council allowed the refund. The City Recorder called attention to a request having been received I from the ASSoCiated Students of the Uni vers i ty of Oregon for permiss! on to place banners across Willamette Street for the purpose of advertising their "Greater J!}Joncert Ser-iesft and upon motion made and seconded the request was unanimously 36 approved. Curb cut applications were presented and upon motion made and seconded ...... the recommendations of the Ci ty Engineer were unanimously approved. Safeway Stores, JNos. 663, and 692, (approved); A. L. Williamson, No. 691, (approved) and Mrs. S. A. 37 McDowell, N.o. 693, (approved). RES 0 L UTI 0 N BE IT RESOLVED that the Common Council of the City of Eugene does hereby transmit to the Planning Commission of the City Qf Eugene, a proposal to change the West side of Oak Street from Ilt~ Avenue to 13th A venue, to a business district; to adopt a tentative report; and to hold a hearing thereon at the Council Chambers in the City Hall in the City of Eugene on Tuesday, October 17, 1939, at 7:30 o'clock P.M. after giving due notice by publication once in the Eugene Register Guar'd, and shall thereafter make a final report and transmit the same to the Council with its recommendation. Communication was presented from the Planning Commission submitting tentati ve zoning changes in the r'eaistri ct ing of areas upon west 6th Street. Attached thereto was a resolution recommending that the report be adopted and the same be enacted into an ordinance. Upon motion made and seconded the resolution I was unanimously adopted and the ordinance upon having its first reading was 4c(held to the next meeting of the council. RES 0 L UTI 0 N WHEREAS, heretofore the Common Council has submitted to the Planning Commission certain changes in the zoning of areas upon West Sixth Street and the Planning Commission has held hearings, adopted a tentative report and converted the same into a permanent and final rep~t and re-submitted it to the Common Council with the recommendation that the same be enacted into an ordinance and the council has prepared and given its first reading of an ordinance enacting said permanent report, Now, Therefore, the City Recorder be and he is hereby directed to ; prepare and cause to be published not less than three times in the Eugene Register Guard in Eugene, Oregon, a notice of hearing to be held at the regular Council Meeting on October 23, 1939 at 7~30 o'clock P.M., said notices to be published within the week commencing October 16, 1939. An ordinance amending Ordinance No. 8611 by adding thereto sections numbered 26 to 42 inclusiv.e, providing for the installation and maintenance of and relating to the use of parking meters upon certain streets and avenues was presented. A general discussion was had, after which Councilman Bond made a motion, seconded by Councilman Koppe, that the Saturday parking hours be from 8 o'cl ck a.m. to 8 o'clock p.m. but the motion was not carried. The ordinance had its first I / reading but was held over for its second and final readings until the next council 41 meeting. An ordinance granting a permit to the Duncan Meter Corporation to install and place parking meters, (Miller Meters) in a certain parking meter district in the City of Eugene was presented to the council for its first reading, and passed to its second and third readings by title under suspension of the rules. S. M. Calkins, City Attorney, presented a $100.00 statement to'the counci for services from the law firm of Teal-Winfree-McCulloch-Shuler & Kelley in Portlan , I regarding the sewer- bonds and recommended that the ci ty -cake care. of the bill. . It was declared that the bill b 45- placed in the file to be paid with the October bills. At this time Mayor Large appointed the airport committee to modernize 46 the airport.
