October 23, 1939. Mayor Elisha Large presided over the meeting. Councilmen present were: A. A. Reid, Sam Bond, Fred Carlson, P. J. Hanns, C. C. Page and Louis Koppe; absent: Fred E. Lamb and A. C. Farr'ington. Mr. l' Farrington absent because of illness. I The minute~ of the previous meeting, October 9, 1939, were presented and 2' ordered placed on file. In the absence of A. C. Farrington, Councilman Page presented the report 0 the Finance Committee beginning with the property offer of E. D. Alger, $300..00 cash for' that part of Lot 7.7, Eoster LS. Addi tion lying north of the pavement on Railroad !Boulevard. The Finance Committee recommended that this offer be accepted and upon 3Jmotion made and seconded the recommendation was unanimously approved. The acceptance of the offer of E. H. Peterson for client, Mona E. Snell- strom, $900.00 cash for the East 103 feet of Lot 3, Block 28, Fairmount Addition was recommended by the Finance Committee and upon motion made and s' econded the recommend - ..J 4 tion was unanimously approved. . Upon the recommendation of the Finance Committee, the offer of Alvin Parke $10.00 per month on a lease with option to buy for Lots 1 and '16, Block 7, Fairmount Addition was rejected by the Council. The alternative of1"er of ,Alvin Parker,. $600.0 , $100.00 cash and $10.00 per month with interest at 6% for Lots 4 and 5, Block 8, yFainnount Addition was also rejected by the Council, upon the recommendation of the 5 Finance Committee. The acceptance of the offer of Vancel Knight, $200.00, $40.00 cash and the balance at $4.00 or more per month plus interest at 6% for the lot at the south- I east corner of Clark and Monroe Streets 54 feet by 160 feet, was recommended by the Ffnance Commi ttee, and upon motion made and seconded the recommendation w as ~unanimously approved. The offe~ of George F. Houghton, $500.00 cash ror Lot 5, Block 26, College Hill Park was not recommended for acceptance by the F~nance Committee but the Financ Committee, however, did recommend a counter offer of $600.00 which, upon motion made rHand seconded was unanimously approved. Upon the recommendation of the Finance Committee, the offer of Sam Goddard $160.00, $30.00 cash and the balance at $10.00 per month including interest at 6% for the south 45 feet of Lot 1 and the South 45 feet of the East 44-1/3 feet of Lot 2, Block 4, Grand Prairie Addition, motion was made and seconded unanimously app 8)(roving the recommendation of the Commi ttee to accept this offer. . The offer of Fay M~. Bennett for cl ient, Marshall Fields" $475.00, $80.00 cash and $50.00 per year for the East 70 feet of the North 65 feet of Lot 4, Block 2 , Fairmount Addition, plus interest, was recommended by the Finance Committee and upon 9Ymotion made and seconded the recommendation was unanimously approved. The Finance Committee recommended a counter offer of $400.00 on the offer of Glen Hastings for client, Raymond A. Williams, 1350.00, $100.00 cash and the bal- ance on or befora 60 days for Lot 2 on the south side of West Broadway between Van ~ren and Tyler 66.84 by 101.35. Upon motion made and seconded the recommendation 0 10 the Finance Committee was unanimously approved. I The offer of School District ff4, $745.00, $50.00 down and the balance with 6% interest from the date of acceptance of offer till payment to be made July 1, 1940 for Lots 1, 2, and 3, and the north 10 feet of Lot 4, Block 2~ Kiserfs Addition, was recommended by the Finance Committee for acceptance and unanirrously ll/.approved by the Council. The offer of George D. Gilmore, $100.00 cash for the property at 2411 Potter Street was presented. The Finance Committee recommended the acceptance I of the south 34.3 feet upon the condition that Mr. Gi Imore pay the cash before !VNovember 1, 1939. Upon motion made and seconded the recommendation of the Finance 12 Committee was unanimously approved. The Finance Committee recommended the acceptance of the offer of W. Hargre ves & Sons, $150.00 for lots 7 and 8, Block 2, Blair Street Addition and the Council 1311" unanimously approved the Commi ttee "s Action. Upon the recommendation of the Finance Commi ttee, moti on was made and s eco ded ' approving the offer of W. Hargreaves & Sons for'client, Nellie Hunsaker, $450.00 cas. . 14 for fractional lot on the North side of West 11th between Van Buren and Tyler Street . ~ ~ ~ 245 I ---.- - --- .. - , ~-_.... . .- - -- - ~ '- - Upon recommendation of the Finance Committee, motion- was made, seconded and approved that the Realty Board be notified of the expiration of the contract I between the City of Eugene and the Realty Board and further, to inform the Boa rd \,') HS"'" that the City would not be interested in renewing the contract. - ~.;:;;, The Finance Committee requested the members of the council to prepare -:;1 ,",-d" for a discussion on a method of compensating individual members of the Realty Board ..~.-t handling city lot sales. It was also recommended that until the next council meetin , at which time the matter should be settled, individual memoers of the Realty Board 16- sell.ing city lots were to receive regular commissions. I Councilman Hanns reported that his committee had considered the recommenda- tion of the State Fire Marshall to set up within Eugene a Municipal Fire M?rshall department but recommended a continuation of the present -system of inspection sur- sur vey. Upon motion made and seconded the recomrnenaatioh was unanimously app- 17 roved. With reference to the installation of portable boilers, Councilman Hanns, Chairman of the Fire & Water Committee, requested the Recorder to read communica- tions from W. E. Nus baum, Eugene Fir e Chief B.nd communica"tion rrotn Fred W. Roberts, Portland Fire Marshall. Upon reading the communications, it was learned that the City of Portland allowed the installation of the boilers upon meeting designated . requirements. It was also revealed that within the City of Eugene there was a sligh increase in insurance rates on the business involved where the boiler is in the inside of the bui Id ing, but the insurance rates do not extend to the ad jo ining pr,-op- erty. It was the recommendation of the committee that the Council allow the install - lEY tion of portable hoilers in the City of Eugene and upon motion made and seconded the recommendation w'as unanimous ly approved. Councilman Page,. Chairman of the Farks Committee stated that his committee had investigated the req~st of Edward Rostein of Rostein Realty Company for connecting the open road in Hendrick's Park with the road being built by Mr. Rostein, stating that the committee's opinion was divided as to whether or. not the reque st should be granted. Counci Iman Fage s ta ted tha t he 110 uld recomme nd grant ng the request but Councilman Reid opposed granting the r eque st upon the grounds tha t it provided too many entrances and exists to the park, and it would increase traffic I He also stated that there was no provision for the upkeep of said road. After considerable discussion by warious members of the council, motion was made by C.ounci Iman Page and seconded by Counci Iman Carl son, that the reque st be granted upon condition that a twenty-four foot wide connecting road be built by Rostein and the building of the road be under complete supervision and direction of the City 19- Engineer, and it was so ordered. Councilman Relid. stated that theSewer Commi ttee was not in position to report on the Sewerage claim of Bertha M. Furrow and requested two more weeks in which to 20""- consider the case. The reqm st was unanimously granted. The Sewer Committee further stated that it was their recommendation to deny the request for a storm sewer on Onyx Street between 24th and 25th because of insurf - cient funds. Upon motion made and seconded the recommendation was unani~ously 21.-: approved. The Sewer Committee requested the Common Council's approval in the committee s action in purchasing the following described property from the Sewage Disposal fund for Sewage Disposal plant purposes: Hec:kathorn Tract Beginning at the northeast corner of Mathews Park Addition in Lane County, Oregon, and run thence north 99 feet, thence west 328.95 feet to the East line of Polk street is projected north, thence I south along the east line of said Polk street if extended, a dis- tance of 99.10 feet to the north line of Mathews Park Addition a a distance of 329.88 feet, to the place of beginning, containing 0.75 acres. Also beginning at a point 99 feet north of the north east corner of Mathews Park, in Lane County, Oregon, as platted and rBcorded in Plat Book No. 4. at page 59 of Plat r.ecords of Lane County, Oregon, and run thence west along the north line of lot one so-called, heretofore deeded to Ray S. Thomason, a distance of 328.95 feet to the east line of Polk Street if extended north, and thence north I along said east line of Polk street so extended a distance of 99.10 feet, thence east 328.03 feet, thence south 99 feet to the place of ../ beginning, containing ..75 acres, all in Lane County, and State of Oregon. I.", - The purchase price of the Moriarity Tract is $1000._00 and the purchase price of the Heckathorn Tract is $2100.00 and the City of Eugene paid to the Eugene Abstract Company, $21.00 for a complete abstracts on both tracts. The City is also to pay taxes in the amount of $56.70 on the Mor'iari ty Tract. The ayes and nays were called, councilmen voting aye: Reid, Bond, Carlson, Hanns, I 22 ?age and Koppe; nay: none; absent: Lamb and Farrington. The purchasing of the property was declared approved. I At, this time Mayor Large reported that various local service clubs and the State Highway Department requested permission to install the club signs within the ~ city limits of Eugene at both highway entrances to the city. Upon motion made. and 2 ' seconded the request was unanimously approved. Communication from the Board of Appeals presented an appeal f"rom R. E. Barrett, Architect for the Safeway Stores, Inc. and R. B. McMath, Real Estate Manage r for the Safeway Stores, as to the amount of reinforcing steel to be placed in the panel walls between the pilasters and in the rear wall. The Board recommended that the appeal ants be required to move the two one-half inch bars from the top of the wall and with two additional bars of the same size,place them in the wall just ~elow the line of the truss cords. Also that they be required to place three eighths bars eighteen inches on centers vertically in theI'ear wall. Upon motion 24 made and seconded the recommendation of the Beard of Appeals was unanimously appr'ove d. A request received by the Board of Appeals from Charles P. Poole asking for a waiver of the Building Code in regard to the amount of window space in two walls of his proposed reconstructed funeral home which are less than three reet from property lines. The Board recommends that this request be granted on condi- tion that he use steel sash and wire glass in the windows in the south and west walls on the first and second stories. Upon motion made and seconded the recommend - I 25~ tion of the Board was unanimously approved. A request was also received from Dale Carson asking for a permit to be allowed to use a special type chimney in his saw shop at 670 Olive Street. The Board recommended that this request be granted and upon motion made and seconde 36./ the recommendation was unanimously approved. Communication was presented from Lottie N. Rugh calling attention to the : traffic condition on Twenty-Second, twenty-third and twenty-fourth streets entering South Willamette Street, stating that these streets should be made stop streets due to the existing heavy traffic. After a short discussion, the Police Committee recommended that stop signs be placed at these intersections and upon motion made 21,.-<: and seconded the r:ecommendation was, unanimously approved. At this time Mayor Large called for objections to the proposed zoning changes reclassifying single and multiple family rBsidences as advertised and as are contained in the ordinance that is being presented for its final reading. As there were no objections, City Engineer' Clubb explained in oetail the proposed changes and the ordinance had its 2nd reading and was placed for its final reading under suspension of the rules. ~he ayes and nays were called, Councilmen voting aye: Reid, Bond, Carlson, Hanns, Page and Koppe; nay:' none; absent: Lamb and Farrington. The ordinance was declared passed and numbered 8622. (note: this 28~ ordinance ro~o~}c Ordinance NO. 8413) ~~~ Mr. William Hargreaves, local contractor, requested that zoning ordinance I No. 8622 be changed to allow the construction of duplex dwellings on single ramily ~ residence lots as well as on mul tiple family residence lots.. The reque st was referred to the Planning Commission for study and a request to report at the next 2.9f council meeting. .. An application for an apartment house at 45 ~ast ~roadway in behalf of Frank Haba, and an application for a roomIng and apartment house at 32~ West Eighth Street in behalf of Floy Johnson, were presented and upon being approved by the 301 Chief of Pol.ice, mot,ion was made and seconded that licenses be granted and it was I so ordered. , Curb cut applications were presented and in each case, the recommendation of the City Engineer was unanimously approved. TENTATIVE REPORT UPON THE PROPOSAL TO ESTABLISH A PROPORTIONATE ...J AREA OF BUILDINGS AND LOTS IN SINGLE FAMILY RESIDENCE ZONES. As a tentative report pursuant to a Resolution of the Common Gouncil of the City of Eugene directing the City Planning Commission I to prepare a report upon the establishment of a proportionate area of buildings and lots in single family residence zones, the City Planning Commission hereby adopts as its tentative report to be submitted at a public hearing to be held in the Council Chambers at 7:.30 o'clock P.M. of October 17, 1939 the following proposed changes: In all single family residence zones the building, including ~ccessory buildings, shall not occupy to exceed 30 per cent of the area of the owners' lot, for an interior lot, and shall not occupy to exceed 40 per cent for a corner lot. /s/ E. Calkins Secretary TENTATIVE REPORT UPON THE RE-ZONING OF CERTAIN AREAS IN THE CITY OF EUGENE:, As a tentative report pursuant to a Resolution of the Common Council I of the City of Eugene directing the City Planning Commission to prBpare a report upon the re-districting of certain areas in the City, the City Planning Commission hereby adopts as its tentative report to be submitted at a public hearing to be held in the Council Chamber~ at 7 :,30 0' clock P.M. of October 17, 1939, the following proposed change: A pr'oposal to change the west side of Oak Street from 11 th Avenue to 13th Avenue East from a multiple family residence district to a business district. /s/ E. 0). Calkins Secretary RES 0 L UTI 0 N WHEREAS, heretofore the Common Council has submitted to the Planning I Commission certain changes in the zoning of an area upon Oak Street and a proposal limiting the number of residences that can be erected on a city lot in the Single Family District and the Planning Commission has held a hearing, adopted the Tentative Reports and re- submitted them to the Common Council with the recommendation that the same be enacted into an ordinance, and the Council has prepared and given its first reading of an ordinance enacting said permanent reports, I Now, Therefore, the City Recorder be and he is hereby directed to prepare and cause to be published not less than three times in the Eugene Register Guard in Eugene, Oregon a notice of hearing to be held at the regular Council meeting on November 13th, 1939 at 7:30 o'clock P.M., said notices to be published within the week commencing November 6th. 1939. A~ application for a Second-Hand Dealers' license was presented in behalf of J. W. Mears. As the application had been approved by the Chief of Police, motion was made and seconded granting a license to Mr. Mears and it was so 0 de: 33r ordered. The general traffic ordinance pertaining to the installation of parking meters which had its first reading at the last council meeting was presented to I the council for its second reading and held over until the next council meeting for its final reading. A motion authorizing an amendment to Section 29~ of the proposed traffic ordinance was made, aeconded and unanimously approved. .&. resolution authorizing the Mayor and Recorder to enter into contracts with various ;':'35 parking meter companies was presented and unanimously approved. MOTION TO AMEND It was moved, seconded and carried that oection 29 of the proposed traffic regulation amendatory ordinance be amended to read as follows: "Section 29. PARKING METER TIME AND FEES: A parking meter fee of Five Cents ($0.051 shall be paid by all persons parking a motor v.ehicle using metered parking time for one hour and a parking meter fee of One Cent ($0.01) shall be paid by all persons parking a motor vehicle using metered parking time for twelve minutes, all as provided by the legend on the meter. Provided, however, that parking meter space may be used without charge on Sundays and legal holidays; and may be used on other days of the week between six o'clock P.M. and eight o'clock A.M., and delivery motor vehicles may use loading parking meter space without charge on any day up to twelve o'clock noon. Delivery motor vehicle is a truck used for delivery purposes only." RESOL1!TION I BE IT RESOLVED, By the Common Council of the City of Eugene, that the Mayor and the City Recorder be and they are hereby authorized and directed to execute on behalf of the city the permit contracts tendered by the three meter companies for execution and to deliver the executed contracts to the respective meter companies. Canvass of election returns for the special election held in the City of Eugene and Glenwood, (proposed territory to be annexed to the City of Eugene) on October 13, 1939, by the Mayor and Recorder constituting the Board of Canvassers was presented and the results were as follows: Roosevelt School, 28 yes, 32 no; Frances Willard School, 21 yes, 20 No; Geary School 19 yes, 25 no; Washington School 17 yes, 32 no; Glenwood 47 yes, 91 no; Total yes votes: 132, total no 36'*'Votes, 200; majority 68. Councilman Hanns recommended that a 400 candle power street light be placed at the two Jefferson Street intersections at 13th Street West. It was pointed out that on the north side of Jet"terson Street there is a street light which doesn't; give sufficient light and the Fire and Water Commi ttee recommends tha:t 37~this light be removed and smaller lights be placed at each intersection. The question was presented concerning the tvpe of insured titles that the city furnishes to the purchasers of the city property and City Attorney reported I that the city had agreed to furnish purchasers the best insured title that can be furnished within the city of Eugene. The request of Fred E. and Willie Mae Williams for a better insured title from the city in connection with their recent property purchase from the city was not in conformance with the regular transacting of ~roperty sales. Upon motion made and seconded the council voted to contlinue giving 38 the best insured titles that can be had and it was so ordered. Upon motion made and seconded the council was adjourned. G. M.
