Mayor Large presided over the meeting. Councilmen present were: Messrs. Fred E. Lamb, A. A. Reid, P. J. Hen ns, C. C. Page, ];..- Sam C. Bond, A. C. Farrington and Louis Koppe; absent: Fred Carlson. I The minutes of the previous meeting, October 23, 1939, were presented and 2 ordered placed on file. . Dr. R. T. Burnett addressed the council in behalf of the Citizens Committe of the Salvation Army raising funds for the relief and care of transients. Dr. Burnett pointed out that the funds secured are used only for relief purposes and not used in any way toWard the SUpport of the Salvation Army. Fur'ther, it was his opini n that the goUerning body of the city owed a duty to this transient group and that the should be given some consideration. He realized that 'funds had not been appropriate for relief but requested that the amount that might be granted be expended from the Emergency Fund. Councilman Farrington, Chairman of the Finance Comrdttee, stated th he had the greatest respect in the world for the Salvation Army and the difficult ta facing the Citizens Committee i~ soliciting funds. Word had reached him that the Citizens Committee had pledged $25,00.00 of the estimated goal of $5000.00 but he felt that if the members of the committee were unable to secure voluntary subscripti then the Common Council was under no moral obligation to force people to make contri butions through taxation. C. C. Page, emember of the Finance Committee, stated that there were no provisions in the budget for this type ~f charity and didn't see where the money VlO uld come from. Mayor Large and other members expressed opinions on this subject and Councilman Farrington made a motion, which was seconded by Councilman Bond, that this request be tabled indefinitely and the motion was ~ssed without a 3- dissenting vote. . The Finance Committee presented the property offers beginning with the. offer of basil Dilliams, $400.00 cash, for Lot 4, Block 5, Amended Plat of Fairmount, I provided Lots 3 and 4 a~e included in limited commercial district. As the Finance Committee recommended the transaction of this offer, motnon was made and seconded ~ un~nimously approving the recommendation of the Finance Committee. A $650.00 oounter offer was recommended by the Finance Committee on the offer of C. B. Johnson, $500.00, cash, for Lot 10, Block 6r Shelton's First Additio 5- and upon motion made and seconded the recommendation was unanimously approved. The Finance Committee recommended that the offer of Rugh Realty Company for client, H. M. Young, $150.00; $30.00 cash and the balance at $10.00 per month fo the South 62 feet of Lot 1, Fosters Addition be rejected and upon motion made and 6~seconded the recommendation was unanimously approved. Upon the recommendation of the Finance Committee, motion was made, seconded and unanimously approved accepting the offer of Gordon Perlich, $~OO.OO cash, for Lo 7- 3, Block 26, College Hill Park~ A $1500.00 counter offer was recommended by the Finance Committee on the offer- of B. F. Mulkey, $800.00 cash, for Lot 1 and the Eas t 6..8 feet of Lot 2, Bloe-k 11, Huddleston's Amended Addition and upon motion made and seconded the recommenda- 8~ tian was unanimously approved. A $750.00 counter offer- was recommended by the Finance Comilli ttee on the offer of Melvin Short, 8650.00, cash within 30 days, for Lot 7, Block 6, Lizzie Lucke 9 - !A.ddition and upon illotion made and seconded the recommendation was unanimously approve'. I The offer of G. E. Hastings for client, Church of Christ by Orlille Powell, 750.00; $250.00 cash and the balance at $25.00 per month including interest for the Nest 100 feet of Lot 10, Block 4, Kelsys Second Addition was presented. The Finance 10-- ommittee withdrew this offer for further consideration. The offer of Clyde McDougall $600.00, $120.00 down and $60.00 plus interes t 6% every six months for two lots on the East side of Polk Street beginning 110 eet north of 8th Avenue West was presented and upon recommendation of the Finance I ll-rommittee, motion was made and seconded unanimously accepting this offer. Councilman Farrington presented the bills for the month of October, 1939, i\h the recommendation that warrants be arawn to pay for the same. This change would allow h~m to enlarge and remodel his present .:t\..") bakery. His plan is to set the building back twenty five feet from the property ;;,c.'1 line and to put the loading platform in the extreme rear of the building, which :'Y would remove the traffic hazard from 13th Street. The matter was referred to the 13-- P~nning Commission for report at the meeting of November 27. The Fire and Water Commi ttee {'eported that they had received a.'request fOD a street light at the intersection of 24th and Kincaid Streets but that it was the committee's recommendat-ion that the Street light at the corner of 25th and Kincaid I Streets be increased to the largest size to satisfy the condition at 24th and Kincaid Streets. Upon motion made and seconded the recommendation was unanimously approved and the City Recorder instructed to inform the Eugene Water Board of this 14- change. It was reported by Mayor Large that the Frazier property, commonly known as Joe's place, had not been removed and the City Engineer was instructed to pre~re speeifications and call for bids for the removal of the bUilding and it was so 15J ordered. Councilman Page, Chairman of the Park Committee, stated that no action had been taken to connect the graded road in Hendrick's Park with the Rostein road as ha ".. been previously approved, but stated that the same is being carefully watched by the ;L'6 city. (p 17, acciden~ally omitted but added at end of minutes) are At the req1.B st of the Sewer Commi ttee, the City Recorder presented a $4.25 sewerage claim in behalf of Mrs. Jack Allison. Communication from Mrs. Allison stated that after calling a plumber to make the repairs it was discovered that the City sewer was causing the ~rouble and respectfully reo1.B sted the city to pay the bill. As the Sewer Committee recommended the aenial of this bill, motion was made a d seconded denying the bill and it was so ordered. It was also recommended by the 18/ Sewer Committee that the $7.,00 sewerage claim of Bertha M. Furrow be aenied and upon motion made and seconded the recommendation was unanimously approved. Councilman Bond, Chairman of the Police Committee, re~rted the request of I Mr. Asa L. Findlay for a transfer of his bottled beer license from his original plac of business, the Tip Top on East 10th ~treet to his present location at 855 Olive Street because his original place of business had burned down. Upon motion made and 19....- seconded the request was unanimously approved. An application for a rooming house ~rmit in behalf of Josephine Lindland wa presented, and as the application had been approved by the Chief of Police, motion 20- was made and seconded unanimously approving the granting of a license. An application for a Second-Hand Dealers License was presented on behalf of L. C. Holloway and as the application had been approved by-the Chief of Police, 21.... motion was made and seconded unanimously approving the granting of a license. The Recorder presented communications from R. L. Hazeltine, Radio Operator i charge of the Eugene Airport, and C. C. Lange, Superintendent of the Civil Aeronauti s Authority in Seattle, asking that their lease with the City of Eugene be rewritten to include the 11 x 12 foot room in the southwest corner of the Administration Building allowing them to use this space as a storeroom. A req~st was also presen ed in behalf of J0seph Harrell and Mrs. Mamie Zumwalt asking for additional storeroom s~ce in the main waiting room, referring to the same 11 x 12 foot room which is now being used without authority by the Civil Aeronautics Authority. City Engineer Club stated that in his opinion there is plenty of space in this one building for both parties and felt that this condition could be adequately settled. Mayor Large state that Joseph Harrell and Mrs. Zumwalt were in charge of the student training school, which enrolls about forty students, and were r ece i ving about $270.00 per year for ea h I student which makes a sizable income'. After considerable discussion the matter was 22 - referred to the Finance Committee to report back at the next council meeting. Councilman Bond presented the request of Dr. Harry Titus for permission to paint a yellow strip in front of his hOllie at 214 East 13th Street as a matter of con venience for people calling on him at his home. The Police Committee recommended that this request be denied and -upon motion made and seconded the recommendation was 23- unanimously approved. I A request was received from the Bangs Hotel for the installation of a hotel zone. The Police Committee recommended that this reqqest be denied and upon motion 24 - made and seconded the recommendation was unanimously approved. Communication and a rough draft of Onyx Plat, was presented from Calvin and Kat.tlryn E. Crumbaker respectfully reque sting that all of Baker Boulevard which lie s between Blocks five and six , Onyx Plat be vacated. After a short discussion this matter was referred to the Planning Commission to r epor t back at the next council 25 ( meeting. I. ...,,:" l' {;,~ At this time a public hearing was called for upon the proposed ~J zoning alteration to change the property on the west side of Oak Street between H ~.. 11th and 13th Streets from a multiple family residence district to a bU9iness property district. Ivlr. William Barker representing a number of property owners in that area addressed the council stating that they were very aefinitely opposed to a change of the classification of their property and they muld like to see it left as it is. Councilman Hanns pointed out that he was very definitely opposed to making this change and made a motion that the proposed change be denied. At I this tillie the City Attorney expressed the opinion that it might be best to hold this subject over for two more weeks in order to give everybody an opportunity to have their minds definitely made up. Councilman Hanns withdrew his motion and upon motion made and seconded the hearing upon the proposed zoning change was continued until 7:30 otclock P.M. November 27, and it was so ordered., At the request of City Attorney Calkins the council proceeded to act on Section 2 of this ordinance which provides for the proportionate areas for buildings, it being understood that Section 2 was now an ordinance by itself. This ordinance was presented for' its second reading and under- suspension of the rules was placed for its final reading. The ayes and nays were called, councilmen voting aye: Lamb, Reid, Bond, Farring- .... ton, Hanns, Page and Koppe; nay: none; absent: Carlson. The ordinance was declared 27. passed and numbered 8625. Upon motion made and seconded the hea~ing on the proposed vaca- tion of Ferry Street was continued until 7:3ID o'clock P.M. N~ember 27, and it was 28 so ordered. Git~ Attorney Calkins addressed the council stating that the City of Eugene has entered into an ag~eement and contract with various parking mete companies granting permit ordinances. with an attached emergency clause and it was his opinion that this general traffic meter ordinance should have an emergency clause. Councilman Lamb made a motion to amend the proposed ordinance by adding the emergency clause. This motion was seconded by Councilman Page. The ordinance was then placed for its final reading. MOTION TO AMEND It was moved, seconded and carr ie d that the re be added to the ordinance amending Ordinance No. 8611, another section to read as follows: 8Section 43; EMERGENCY: Whereas, the City'of Eugene has passed permit ordinances for the in- stallation of parking meters with three different companies and has authorized the signing of con- tracts with the companies, and the contracts have been signed, in which it is agreed by the city that the foregoing amendment shall be enacted, providing for the operation of the parking meters and the collection of the fees therefor, and failure to enact this ordinance might result in litigation and damage to the city: Now, therefore, an emergency is hereby declared to exist and that it is necessary for the preservation of the peace health and safety of the City of Eugene that this ordinance take effect immediately upon its passage by the Common Council and its approval by the Mayor, and it is so ordered." 1 The following curb cut applications were presented and in each~ase the recommendation of the City Engineer was unanimously approved: G. At this time the City Attorney stated that the council should b~ motion definitely set the set-back line on both sides of sixth and seventh streets extend- ing from High Street to the West city limits to sixteen t'eet in order to.prevent buildings I'rom being erected too close to the city line, as the State Highway 31 J Commission is working on a new super highway through the city.
