The minutes of the adjourned meeting of the Common Council held at the hour I ;.~; of 7:30 oJclock P.M. November 27, 1939. Mayor Large presided over the meeting. . Councilmen present were: Messrs. A. A. Reid, P. J. Hanns, C. C. Page, Sam C. Bond, lv-!\.. C. Farrington, Fred Carlson, and Louis Koppe; absent: Fred E.. Lamb. t~ The minutes of the previous meeting, November 13, 1939 were presented ~~and ordered placed on file. ,.- .>~ ~. Bryant DeBar, local insurance agent, addressed the council asking permission I to write the Treasurer's Surety Bond for the year 1940. Mr. DeBar explained that e should have received the business for 1939 but through some misunderstanding it was given to another person and that the council then intended to give the business 3.... to him, Mr'. DeBar, for the year 1940. The request was referred to the Finance Commit ee. Mr. Abe Bangs addressed the council concerning the rejection of his request lfor a hotel zone. Mr. Bangs stated that his hotel contains as many rooms as the Smee Hotel or the Hoffman Hotel and even though his customers were fifty percent ~ransient tnd fifty percent permanent customers he felt he should be given some considerat. ion. Councilman Farrington said that the customers have to have some place to stop and start and Mayor Large was of the opinion that all hotels should be granted the ~ame ~riVileges. Councilman Reid said that the butchershops want a space in f'ront of thei I lace of business and Councilman Bond said that if spaces are granted for all request here will be too many reserved spaces. Additional discussion was had after which ~he Bangs request was referred to the Police Committee to consider granting a hotel 4-zone on Olive Street instead of 8th Street was was previously requested. I Complaint was made concerning the increasing amount of Double Parking taking blace on the streets of the city. Councilman Hond reDorted that the Folice Committee ~as waiting the installation of the parking meters an~ the arrival of steel posts I or the new traffic signs before conducting a vigorous campaign on traffic regula- 0' t ions down town. .. The Judiciary Committee represented by City Attorney Calkins, reported on th IU damage claim of Estella V. Norris in which she was injured when raIling on the side- walk in front of the Buster Brown Shoe Store and Lerner's Dress Shop. The Committee recommended that a settlement of $150.00 be allowed, the warrant being made payable / to Estella V. Norris and William bast, Attorney. Upon motion made and seconded the 6 recommendation was unanimously approved. Counci~man Farrington, Chairman of the Finance Committee, presented the property offers beginning with the offer of G. E. Hastings, for client Church of Christ by H. Orlille Powell, $750.00, $250.00 cash and the balance at $25.00 per month including interest at 6%~for the West 100 feet of Lot 10, Block 4, Kelsy's Second Addition. The r'inance Committee recommended the acceptance of this offer and A '. 7 upon motion made and seconded the recommendation was unanimously approved. The Finance Committee presented the offer of Carl L. Dolynook, $125.00, $10.00 cash and the balance at $10.00 per month plus interest at 6% for the West ~O feet of Lot 1 and the West 50 feet of the North 30 of Lot 4, Block 5, Cheshires Addi tion, wi th the recommendation that the offer be accepted on the condition that '- the cash payment be $25.00 instead of ~10.00. Upon motion made and seconded the 8 recommendation was unanimously approved. The Finance Committee recommended the acceptance of the offer of H. E. Cully for clients, Mr'. and Mrs. Thurman S. Paterson, ~p900.00 cash for the South one- half of Lot 5 and all of Lot 6, ~lock ~2, Gross Addition.. He intends to build not less than a $4000.00 home and requests a refund of ~100.00 if home is built and occupied within six months Tram issuance of the deed. Upon motion made and seconded I 9 the recommendation was unanimously approved. The Finance Committee recommended a counter offer of $750.00 on the offer of Louise Wetterstrom, $500.0a, $100.00 cash and the balance at $25.00 per month plus interest at b% for part of Lot 2, Block 6, Scottrs Addition and also the Nocth 67 feet of Lot 2, Block 6, Ellsworth Addition; he intends to build a duplex. Upon lclmotion made and seconded the recommendation was unanimously approved. The $250.00 cash offer of Giustina Bros. for Lot 4, Block 4, Blair Street 1- Addition was recommended for acceptance by the Finance, Committee and upon motion 11" made and seconded the recommendation was unanimously approved. __ The $128.[9 cash offer of Paul Hadley, for Lots 8 and 9, Block 3, Driverton Addition was recommended for acceptance by the Finance Committee and upon motion made and seconded the recommendation was unanimously approved. It w~s pointed out that M~~ HadLey was the original owner of this lot and the city allowed him to 10 redeem it. The offer of Ramey Hugh for client, Earl Byrom, $475.00, $47.50 cash and the balance to be paid on or before two years in two equal paymen~s, annual of $213.75 plus interest at 6% for Lot 6, Block 8, Hollenbeck;(He intends to build a house withi ~ "'llllIll 257 - - ....- - ~ -" -_. ~ - - -- - '- -- - - - - - --- ~- -- -.... -- - -- - _._-- -- - ----.--.-- -. -- --~'- -- - -- - ~.- - ~ ..---- two years for about $3500.00) was presented with the recommendation of the Finance Committee. Upon motion made and seconded the recommendation was unanimously I 13"- approved. Cox t.;) The Finance Committee recommended the rejection of the offer of Lex B. ~.H $500.00 for lot located on the northea~t corner of c3rd and Charnel ton, part of '"'-J Lot 12, Block 19, College Hill Park Addition, this lot being 60' x 100'. Upon 14- motion made and seconded the recommendation was unanimously approved. Earl W. and Goldie Bolton offered to deed the follovdng described property to (.~J the City of Eugene for the purposed of extending Monroe Street out to Cheshire Stree ~.,:,: , " I . " ~ Beginning at a point on the East line of Monroe Street if produced north, 54 reet north of the North line of Clark Avenue; running thence North 254 feet, to the South line of Cheshire Avenue, if produced West, thence West 66 feet, thence South 254 feet, thence E~st 66 feet to the place of beginning. All in Eugene, Lane County, Oregon pro.viding the City muld deed their following described territory for the same purpose: Beginning at the intersection of the Narth line of Clark Avenue and the East line of Monroe Street, if produced north, running thence north 54 feet, thence West 66 feet, thence South 54 feet, thence East along the north line of Clark Avenue 66 feet to the place of beginning. All in Eugene, Lane County, Oregon. Upon motion made and seconded the resolution was unanimously approved and the Mayor and Recorder instructed to complete the necessary documents. RESOLUTION BE IT RESOLVED, by the Common Council of the City of Eugene that the Mayor and the City Recorder be and they are I hereby authorized and directed to make, execute and deliver and record a deed to the public for~reet purposes, of the following described property, to-wit~ Beginning at the intersection of the north line of Clark Avenue and the East line of Monroe Street, if produced North, running thence North 54 feet, thence West 66 feet, thence South 54 feet, thence East along the north line of Clark Avenue 66 feet to the place of beginning. 15- All in Eugene, Lane County, Oregon ~ouncilman Bond, Chairman of the Police Committee, recommended that the City Recorder be authorized to approve all 1940 renewal liquor applications(This authority ending on January 1, 1940), providing the renewals are for exactly the sam type of license as issued in 1939. Upon motion made and seconded the recommendation 16- was unanimously approved. At this time a discussion was had concerning the problem of additional help for the enforcement of the parking meter 20 ne and the handl ing of the accounts for the meters. Upon motion made and seconded the Finance Committee was granted complete authority to set up complete accounts and provide necessary personnel to properly handle the meter problem. It is further understood that if the meters be- come operative prior to the next meeting of the council, temporary appointments can be made from the present Civil Service list for patrolmen to check the meters and it 17- was so ordered. I Councilman Farrinston asked for an extension of time to make the repopt on 18- the storeroom space at the Eugene Airport and the request was unanimously granted. Communication was presented from Horace W. Munro requesting the use of the city lot at 1st and Monroe Streets for a garden spot. The.communication was referre to the Lien Department, under the supervision of the City Enginner's Officr, 19..... granting the authority to allow the request. I Communication was presented from the Board of Appeals presenting the r'equest of Louise Wetterstrom for permission to erect a duplex residence on the property offer presented earlier in the evening. As this property is just out of the R-2 zone the Board would recommend that Miss Wetterstrom be granted a permit to erect a two- family residence, the ground area of said structure not to exceed 30% of the total area of property purchased. Upon motion made and seconded the recommendation was 20 "- unanimously approved. Further communication was presented f'rom the Board of Appeals revealing the request of Mrs. McBee who had purchased the two-story house at 1307 11th Avenue West from the City, asking to be allowed to convert this house into a two-family 21t residence. An Ordinance initiating the vacation of Baker Boulevard was presented to the I 1 Council for its first reading together with a petition signed by the abutting property owners that Baker Boulevard be vacated. The Ordinance passed to its second (; and third reading. The ayes and nays were called, council~en voting aye: A. A". ~'" Reid, P. J. Hanns, C. G. Page, Sam G. Bond, a. C. Farrington, Fred Carlson and Louis : '. ~ ,r" Koppe; nay: none; absent: Fred Lamb. The ord inance was dec 1 ared re. ssed and numbered ,'" ~ '2-3 8627. The proposed zoning ordinance to change the property on thew est side of Oak Street between 11th and 13th streets :Crom a mul tiple fan ily residence district I to a business property district was presented to the council for its third reading. Communic~tion t"rom Mr. Lamb stated tha t the Christian Church w as opposed to the proposed change. Mr. Arthur R. Wilcox, Mr. E. Smith and Mr. William Barker addresse the council in rigorous opposition to the proposed change. Councilman Hanns stated that in his opinion the ordinance should not be passed and in the future anyone ~' wishing to make a business corner out of 13th & Oak Streets should make their reques to the council and outline the type of business to be established and secure the approval of all these property owners. The proposed ordinance was placed for its final reading. Councilmen voting aye: None; nay: Reid, Hanns, Page, Bond, Farring- oW ~ absent: Lamb. The ordinance was declared not passed. 24 ton, Carlson.and Louis Koppe; An ordinance vacating Ferry Street from 8th Street north to the Southern Pacific Railroad right of way was presented for its third reading and placed for its final reading. Councilmen voting aye: A. A. Reid, Hanns, Page, Bond, Farring- ton, Carlson and Koppe; nay: none; absent:' !<INN Lamb. The ordinance was declared passed and numbered 8628. Upon motion made and seconded the Recorder was instructed to present to the Eugene Fruit Growers Association the bill covering the costs incurred in this vacation and 25- it was so ordered. Communication was presented from the Planning Commission requesting the council to submit to the Planning Commission a direction to hold hearings upon a proposed change of Lots 3 and 4, Block 5, Fairmount Addition from a single family residence district to a business district, as requested by Basil T. Williams, of I Williams Bakery . A resolution was presented directing the Commission to hold such hearings and make a final report and transmit the same to the Council with their recommendation. Upon motion made and seconded the resolution was unanimously adop- ted. RESOLUTION BE IT. RESOLVED by the Common Counci 1 of the Ci ty of Eugene ~ that there is hereby transmi tted to the Planning Commissi.on of the City of Eugene a proposal to change the classification of Lots Three (3) and Four (4), Block Five (5), Fairmount Addition to Eugene, Lane County, Oregon, from a single family residence district to a business district, this being an extension of the Williams Bakery property south on Moss Street. And directing the Planning Commission to adopt a tentative report; and to hold a hearing thereon in the Council Chambers in the City Hall of the City of Eugene on Monday, the 4th day of December, 1939 , at 7:30 ohclock P.M., after giving due notice by publication once int the Eugene Register Guard, and they shall thereafter make a final report and transmit the same to the Council with their 20- recommendation. Communication was presented from the Civil Service Commission recommending the permanent appointment of probationers Gladys L. Dohnert, Police Matron, Richard I Spies, Patrolman, and C. M. McCoy, Fireman, as a result of their having successfully passed the performance and physical fitness examinations required by the Civil Service Commission. Upon motion made and seconded the recommendation was unanimousl 27 approved. A miscellaneous request was presented to the council for their approval to have dances wi thin the Ci ty of Eugene on Sundaye vening, December 31, (New Year's 28/~ve) until 1:00 o'clock A. M. January 1; 1940. The request was tabled. . l Mr~. a. E. Barrette addressed the council concerning the progress of side- I walk repairs and the City Engineer reported that the survey was practically complete , rojects were now in and repairs are expected to commence within a reasonable length 29 -of time. ~ Mrs. Mamie Zumwalt addressed the council asking for a definite report as to their position under the Eugene Airport lease between themselves and the City of ugene. The Mayor replied that the matter had been referred to the Finance Committee ith a request that they report back at the next council mee;t-ing. It was under- ~tood that the Finance Committee would enter a discussion with Mrs. Zumwalt at the 30-bnd of the council meeting. Upon motion made and seconded the council meeting was adjourned. ~ C.
