Farr1ngton~ Fred Carlson and Louis Koppe; absent:' A. A.Reid. (Reid arrived 1 lat.er'); The minutes of the previo'Us meeting, December ll~ 1939 were p'resent'ed and I 2 ordered placed on file. Ford Hand, Chairman of the Merchants Division of the Chamber of Commerce, laddressed the council concerning the starting time of the operations of the parking meters. Mr. Hand reported that the commi ttee had been unaole toe,a1l a regular I . ' meeting but stated that it was the opinion of the memoers indi viduallythat. the start- ling time should be made at 10 A.M. because it was their belief and und~r.standing that the parking meters were installed as a means of regulating trafflccongestion, ,and that inasmuch as there was no congestion oefore 10 A.M. the meters shouldn I t be Iput into operation until that time. Councilman Bond, Uhairman of the Police Committee, stated that the Police Committee was not ready to submit a report but would recommend that the starting time at 10 A.M. be left in effect until the council meeting of ,January 8, at which time the merchant's Division of the Chamber of Commerce could make a formal report. All the councilmen expressed the same opinion and the matter I ~as held until the meeting of January S, with instructions that the operations should 3-continue as previously arranged. At this time Councilman Reid arrived. Counc ilman Farrington, Chairman of the l<'inance Committee, presented the 'request of Carl W. Robberson, asking a refund of a deposi t on the offer made 'ISeptember 16th on the north 60 feet of Lots 6 and '(, .I:Hock 6, Huddleston's !mended - ~ddition. He would like a refund of i80.00 since ne will not 'be able to complete Ithe deal. As the offer was made subject to ability to get a 10an~ the committee - recommends that this refund be allowed and upon motion made and seconded the I 4v~ecommendation was unanimously approved. I The ~lnance Committee recommended the acceptance of the offer of R. R. Fenn, ,$490..00, $160...00 cash and the balance at $10.00 per month plus interest' at' 0% for fhenorth' 60 feet of Lot 6, Block l~, Fackards Addition lnorth of the northeast corne pf 1th and Monroe). He intends to move a house on this lot and rebuild it. The FInance Uommittee recommends that this offer be accepted and upon motion made and ~-~econded the Irecommendation was unanimously approved. I The offer of Edith F. Gardiner for client, wm. H. Hodes, $75.,00 cash for t;hat part or Lot 3, Block 3, whitney Addition which lies east of the newly estaolished ~lley was presented by the ~inance uommittee with a recommendation that the offer Blbe accepted. Motion was made and seconded unanImously approving the re'commenaation. The r:inance Uommittee recommended the acceptance of the offer of Mr-. and Mrs. 9. F. Hoare, ~150.00 cash for lots 11 and 12, Block ;5, Agate .t'lat, (450 feet t>outh pf the southwest corner of ~5th and ~merald). They intend to move a house on this Qot and motion was made and seconded unanimously approving the recommendation of I 7~the Finance Committee. The Finance uommittee recommended the acceptance of the offer of War-dJohnsto tor piece of property at the southwest corner of 10th Avenue and Polk ::;treet~ 00.93 reet oy 160 feet; price 1P,600.00, :jp120.00 down and :jjl120.00 per year interest at 6 per cent. Motion was made and seconded unanimously approving tne committee's I W~ecommendation. I Councilman ,tf'arrington presented the request; of Guy Jjailey for a zonlng Change ana inasmuch as.,the offer details the approval of the Board of Appeals~ it was refer~ 9/!to the Beard of Appeals to repor t at the next council meeting. ,I Councilman !1aprington recommended the aen:lal of the previous request of the ~lnisterlal Association and the Salvation Army asking the city to set aside $1500.00 put of thisyearts emergency fund for taking care of tr-ansients and for relief" 1- purposes. Councilman Hanns expressed the opinion that the city owed some relief" ~ssistance of this kind and that he would hate to see the council take adverse action without giving this more serious consideration. Motion was made and seconded that . I ~he report of the committee be approved and upon taking a general vote all councilmen ) present voted yes except Councilmen Ltamb and Hanns, and they voted no. The motion 10 was declared carried. ' I 60unci1man Farrington reported that the Finance Committee had received a r-e- puest from the City Recorde~'s office for additional office help in taking car-e of th extra work c.:.aused through the rigid enforcement of the traffic ordinances. Upon motion made~ seconded and t" I approved, the matter was held unti1 the meeting of JantB._ry a" Councilman ,'~ Far'r1ngton then -stated that there was the possibility of the Police Department .....,j'd taking care of some of issued traffic tickets and that this was being very seriously ~-, II../' considered. . , ;~,..~ Ilayor Elisha Large brought up the question of transferring the issuing of ."'1;;:, " .,~ dog licenses from the RecQrder's Office to the T~easurer-fs office. Councilman .~"ll>;o Farrington stated that he had considered the same change and had consulted the City Treasurer but felt that the Treasurer's office could not handle this extra I work without additional help. ~-e stated his committee had considered hiring a man 0 part time basis to assist with the care of the parking meters and in that way Treasurer Hulegaard would remain in t he office all day so he could take care of the dog licenses and other business. However, this matter is being given conside~ation 12- and ~ll be discussed further at the council meeting of January 8, 1940. Councilman Farr:ington asked the counci 11 s approval for the purchasing' of office equipment, in the amount of ~93.30 from Koke-Chapman Company, to handle the parking meter work and also the approval of the purchase of a filing cabi at . at the rate of $3.00 per month as rental to be applied on the purchase price if the meters are kept permanently. Upon mbtion made and seconded the r'equest was 13-- unanimously approved. Councilman Farrington also reported that he had received a number of complaints from people protesting against the alley parking of the Dollar Stage Line- busses parking 1n the alley running north and south between P.ark and Broadway and Willamette and Oak Streets. tie stated that the busses often park there for long periods of. time and he felt it wasn1t quite fair to grant the bUS line this priv11eg and deny the same priVilege to others. ,It was his recommendation that the Recorder write Mr. W. H. Eggers of the Facific Greyhound Lines to see if arrangements could b 14/made for taking care of these stages at some other location and it was so ordered. Councilman Hanns.~ Chairman of the Fire and Water Committee recommended the installation of a street light on west 4th street halfway between Blair and Polk Streets. . The recommendation was unanimously approved and the City Recorder instruct I 15- to notify the ~ugene Water Board of such installation. Councilman Page reported that the P'arks Ccrmmittee had given due cons'lderatio to the request of the Eugene Active Club for a B'oy Scout Cabin location in Spencer's Butte Farka and recommended that the request be granted. Mr. Wendell IGray, representing the Bugene Active Club stated that it would be a log cabin', well Ibu1,1 t and located on the spring on the south side of the l:3utte. He stated that the !Active Club was not asking the city for title to the property and at any' time the '2i ty f'el t the cabin should be removed they would gladly remove it. He recommended Ithat the cabin be kept closed and not thrown open to general puolic use because it ~as for the benefit of their particular troupe He added, however, that they were Iwilling to extend the use of the cabin to responsible parties wishing to use the cabi ~hen it was not in use by the Scout, Troup. Councilman Page recommended that this ~e allowed with the provision that the exact location and nature of the construction pf the building meet with the approval of the Gity Engineer. Councilman Reid objecte Ito allowing this group or any other group to construct buildings on city property stating that the precedent would throw the parks open for many such requests. Upon I 16--motion made and seconded the recommendation of Parks Committee was approved. l C:ommunication was presented from C. A. Swarts, Sheriff & Tex Collector otifying the city to file a list of all properties upon-which the city has municipal Qiens, which property is included in the deed issued to Lane County by the Shertfr l:1nd f'iled for record'December 15, 1939, and upon which the County Court has, given ~n order to the Sheriff to offer the same for sale to the highest bidder for cash, ~ut ~or not less than the assessed value thereof as the same appears on the .1935 tax I ,k-oll, said sale to be held at the County Court Eouse, in Eugene ~ Lane County, Oregon, Ibn the 19th day of January, 1940', between the hours of 10 :00 0' clock in the forenoon k:nd 4:00 oiclock in the afternoon of said date. The matter was referred to the c;ity 17--lAttorney and the Judiciary Committee. II The monthly report of the Eugene Public Library was presented for the la-month of November and ordered placed on file. I J- . Signed petitions were presented to the council petitioning the council to -'rule that all loading zones hereafter will be held open to trucks servicing customers , . pnly, without charge, all day, and if loading zone be filled and other- parking space be vacant, that service trucks be permitted to park in aaid other space~ fo~" ~ervicing customers, by paying meter fee the same as any other vehicle, and further fhat service trucks be permitted to park in any legal parking space without cha,ge, ~o service c~stomers only~ until 10:00 A.M. The petitions were ordered placed on tile because all the requests presented within the petitions had previously been 19 - tranted. I At this time the hearing was called on all objections and remonstrances to. ~he proposed zoning change redistricting and reclassifying Lots Three (3). and Four. {4 Block Five (5) Fairmount Addition to l!;ugene, Lane County, Oregon from a single family . The matter was referred to the Police Gommlttee. An application' for a curb cut was presented in behalf of Clyde McDougal, at 761 Polk Street, No. "lll~ and as the application was recommended by the City 1Snglneer, 22-motion was made and seconded approving the recommendation. I ' I Am' application for a dance hall license at the Wintergarden Dance Hall, 211 ~est eth ::street, was presented in behalf of M'rs. Pearl l:+'orncrook. As the applicatio ad been approved by the Chief of Police, motion was made and seconded that the lice se 23' Ibe granted and it was so ordered. , The City Hecorder was instructed to advertise for sealed bids for the purchase lor any or all of the gasoline needs of the uityof Eugene for the yea~ 1940, said bids 24"'to be opened at the council meeting of January 8, 1940. and it was so ordered. Councilman Hanns recomme'nded that 111100.00 be 'transferred t"rom the l!imergency ~ccoun~ to the Uity ~ngineer's o~fice, alc ~upplies & Expense, to compensate this 25-< jPart of his budget for money expended on Blue .t'rint p~per. Upo-n mot ion made and seconded the recommendation was unani~ously approved. ' Councilman Bond recommended granting the following renewal applications for Iliquor Id.cense's:; transfer of l,ocation of Package Store Class "B" license from the IGregon Hotel_ Cafe to the ~ugene Stage Terminal the 1 icense to be issued to J. J. IChiaramonte I s Cafe; the renewal of the Restaurant and Hotel license for the 0regon ~otel Cafe and the renewal of the Club license for the Fraternal Order of Eagles. ,jU:pon motion made and seconded the recommendations were unanimously approved. pouncilman Bond further recommended the denial of the application from the Fraternal ...-O'rder of Eagles for a Package Store Class "An License and upon motion made and second ed 26the recommendation was unanimously approved. I C'ouncllman -Koppe introduced a resolution to require any group outside the council to SUbmit a petition bearing the names of at least 15 per cent of the voters' ~efore a special election will be called. Any issue arising within the council need not be supported by the petitions. Upon motion made and seconded the resolution was lapproved in order to avoid unnecessary expense of an election unless a truly rep- I~esentati ve group of citizens desire a vote. However, Counc1.lman Hanns voted no on the passage of the resolution stating that he wished to keep a clear, open mind to de 1 27 with m~tters as he ~aw fit. RR.e01.YTION ( vw. ? O.6J WHEREAS, the statutes of the'st;ate of Oregon provide for' initiative measures and referendum upon measures by initiative p petitions to be signed by petitioners as fixed by statute or modified by the city charter thus providing a means for determining . in advance whether it is a general demand for the SUbmission of t'hemeasure, and WHEREA.S, the state law also makes provision for the SUb- mission of charter amendments by theCommon Council with or without initiative petition~ and WHEREAS, the Council believes it to be the true intent and purpose of the initiative statutes that measures pre posed oy I individuals or groups of citizens are to be 'tested in advance by an initiative petition before submission to the electorate and that the prOVision authorizing the Council to submit proposals on its own initiative contemplates only such measures as arise 1n the Council itself and are deemed necessary for the orderly conduct of the cityts business and that it is not the purpose and intention of the statute that the initiative petition shall be made inoperative by the Council's SUbstituting themselves for the proponent's measure. I THEREFORE. BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF EUGENE, that they will nereafter adher.e to what they deem the spirit and intent of the initiative law and will refuse to substitute themselves for proponents of measures sought to be submitted to the electorate under the initiative statute. ~ I ~ 267 -- - -- - - - ..--. ~- - - - Mayor Large called for election of councilmen to eomplete the unexpired term of the two councilmen just resigned, Fred E._ Lamb and C. C. Page, Councilman I Reid of Ward 'No.2 nominated nerbert J'. Cox to f1l1 the unexpired term of Fred E. Lamb'. ' Nominations were closed and a unanimous ballot cast, electing ~r. Barette, spoke briefly to the Council pledging to conscientiously serve the u1ty of Eugene. Mayor Large expressed the appreciation of the City of Eugene and the Common Council for the many years of wervice of' both 28"~ resigned councilmen, Page and Lamb. t'~~: ~"'~-"7 ~.'~l/fJ I Councilman Hanns brought up the question of the legal right'to transfer the unexpended balancet"rom the b:mergency Fund to the Special fund for a new 'fire truck which the Fire Committee hopes to purchase wi thin the next year or so'. ]:',~ was the opinion of ,the City Attorney and the Majority of the Common Council that this 29:'- should not be done. ..
