Mayor Elisha Large presided over the meeting. Councilmen present were: Messrs: A. A. Reid, P. J. Hanns, Sam C. Bond, l~ A. C. Farrington, Fred Carlson, Louis Koppe, E. A. Barette and Herbert J. I Councilman Farrington, Chairman of the Finance'Committee, recommended the acceptance of the property offer of Ramey' W. Rugh for client, Marvin L. Dow, $400.00; $80.00 cash and the balance of $320.00 to be paid on or before 90 days for Lot 11, Block 1, Gilmores Addition (48.7 feet north from the northwest corner of Broadway and Polk) Upon motion made and seconded the recorunendation of the 3' committee was unanimously approved. The Finance Committee recommended that the offer of Mike Dewey be rejected: $243.00 cash for the West-55-feet of Lot 7, Block 6, Lizzie Luckey Addition; or if the city does not want to cut off the 55 feet, will ~ive $221.00 for the West 50 feet of same lot (northwest corner of 16th and Olive); intends to build a house. Upon motion made and seconded the recommendation of the Finance Committee was 4- unanimously approved. I , The offer of H. E. Cully for Lot 7, Block 6, Lizzie Luckey Addition, at a price of $750.00 cash and a refund of 10% if house is constructed within ninety days was presented to the cou~cil with a recommendation of the following counter offer: $750.00 cash with a $50.00 Defund when the house is completed. Upon motion made and seconded the recommendation of the Finance Committee was unanimously 5 approved. C.0.i/~(f-', Cf....-?-oO./H.;! 1,), ~~ The following offer of Blayne M. Brewer was presented: $400.00, $20.00 cash; $80.00 on February 5th and the balance at $50.00 a month plus interest at 6% for Lot 9, Block 1, Hendricks Addition (150 feet from the northwest corner of 15th and Lawrence) Request $50.00 refund upon completion of house. The Finance Committee reeommended that this offer be accepted and upon motion made and 6, seconded the recommendation was unanimously approved. The Finance Committee recommended the acceptance of the offer of H. E. Cully, for client, $400.00 for a 5.17 foot strip on the north side of 11th Avenue between Almaden and Chambers Streets and upon motion made and seconded the 7" recommendation was unanimously approved. ~: cq~~ -1~ --dJ-a.-117~"'(../ The Finance Corunittee recommended the offer of Ramey W. Rugh for client, Floyd A. Painter, $425.00; $85.00 cash and the balance of $340.00 to be paid on or before 90 days for Lot 10, Block 2, Gilmore's 4ddition. Intends to build. 8" Upon motio'n made and seconded the recommendation was unanimously approved. The Finance Committee' also recorunended the offer of Lynn S. McCready to deed the city part of Lot 10, Sunset Terrace and a Metes and Bounds description; the city to cancel an assessment of $23.17 against the north six feet of Lot 10, 9\ and upon motion made and seconded the recommendation was unanimously accepted. A $1000.00 counter offer was recommended on the offer'of Hugh B. Wood, $800.00 for the ,East 105 feet of Lots 5 and 61 Block 24, Gross Addition (northwest corner of 22nd and Onyx); intends to build a ;ui7500.00 home. ' Upon motion made and 10- seconded the recommendation was unanimously approved. I A $600 counter offer was recommended on the offer of Clyde McDougall, $500.00, $100 cash and the balance at $80.00 each six months plus interest at 6% for-the two lots on the West side of Polk between 7th and 8th Avenues; one 66'xlO ' and the other 60'xl05'. Wishes separate contracts on these lots. Motion was made 11-' and seconded unanimously approving the recommendations of the Finance Committee. The offer of W. L. Seward for Lot 1, Block 10, Hollenbecks addition,$600.00, $120.00 down and $10 per month at 6% interest; southwest corner of 17th and mashington Streets, was presented with the recommendation of the Finance Committee l2~ and upon motion made and seconded the recommendation was unanimously approved. I l~ Councilman Farrington reported that at a meeting of the budget committee several years ago it was agreed between the City of Eugene and the school board of School District #4, that beginning July 1, 1939, the school board would pay ~50.00 per month rent for office space in the city hall building. It was the ~ecommendation of the Finance Committee that beginning July 1, 1939 the school ~oard be billed at $50.00 per month and upon motion made and seconded the recornmenda- ~ion of the committee was unanimously approved. Councilman Bond, Chairman of the Police Committee, stated it was the. committee's recommendation that the starting time of the operations of the parking eters be set at 9:00 o'clock a.m. and the recommendation was, upon motion made ~nd seconded, unanimously approved. I ~ l~ ~276 Communication from the Board of Appeals revealed the request of Tom Shumway asking for a s~ecial permit to enlarge a small building on a fractional lot which L) he owns at 5412' Lawrence Street for 'his own private use as a residence, said build in ~;.J to exceed the zoning limitation as to area but to comply with the Building code. ~' The Board would recommend that this request be granted, and upon motion made and 15liSeconded the recommendation was unanimousfY approved. The communication" from the' Board of Appeals also presented the request +ro~ C. A. Carlson for a permit to erect an apartment house on his lot at 1458 Pearl Street. This lot is just across the alley from, the R-2 zone but the building would otherwise conform to the zoning ordinance and the Building Code. The Board recommends that this permit be granted and upon motion made and seconded the recomme da- 16~tion was unanimously approved. The communication from the Boar~' of Appeals also revealed the r~quest of Julio W. Silva to erect a twenty foot can9PY on the east side of. the oi~ Knights of Pythias property at the southeast corner of the intersection of Olive Street and Eleventh Avenue. The Board recommends that this request be denied and upon motion 17~made and seconded the recommendation of the Boardowas unanimously approved. The Board of Appeals presented the request of L. L. Dunham asking for a.perm't to erect a duplex residence on the west 50 feet of Lots 7 and 8, Block 11, Hendrick' Amended Addition. This lot, is across the street north of the High School and is one block west of the R-2 zone. Mr. Dunham bought the property with the understanding that it was in the Apartment Zone, had plans drawn and obtainedoapproval for a loan, but was refused a permit by the Building Department. A majority of the members of t Board recornnended that the request be denied. A brief discussion was had on the matter after which Mr. Dunham addressed the council in person'asking f9r a special permit to proceed with the building of the duplex. Motion was then made and seconde 1 and approved that a special permit be granted and it was so ordered. o 0 I I Communication was presented from the Eugene Hardware Company protesting against traffic violation tickets being placed on their delivery trucks behind their store. It was pointed out that some few months ago, permission had been granted to allow tnem to park their delivery, truck at this spot and they requested so~e stateme t that would assure them that there is no musunderstanding. Expression from members of the council was. fairly well divided on the request.and the matter was ordered 19--tteferred to the Police Committee for report at the next council meeting., Communication was presented from J. D. Barnett thanking the Council for his reappointment. to the City Civil Service Commission, which he very gladly accepted. 20~IThe communication was ordered placed on file. I The annual report of the City Engine~rts ~ffice for ~939 was presented:and 2~ ordered placed on file. I An application for a Second-Hand Dealers lice~se was presented on be~alf L. C. Hollaway at the'Tire Mart, 966 Oak Street. As the app+ication had been approved. by the Chief of Police, motion was made and seconded that the license be 22~granted and it was so ordered. The following curb cut applications were presented and the recommendations of the City Engineer unanimouslyaapproved: N9. 713, Thelma Peckham,v980 Charnelton Street for a parking lot at Stanleys Store, (approved) ; No. 714, W. B. Frink~65 West Sixth Avenue, the Engineer recommends that this cut be granted with two provisions, that the cut east of this one be closed four feet, that provision be made so that the backing of ~ars onto Sixth Avenue be prohibited, recommendatio~ 23 approved; and No. 715, J. _0. Eane~, 1253 West 12th Avenue, (approved). The City Recorder reported that through an error in the listing of the 1940 license plates on traffic tickets, Mr. N. H. Comish had paid for a traffic violation which in reality was the violatiqn of another person. It was discQve~ed that the license number in question was a 1939 license and not a 1940 license. The Recorder requested that the $1.00 be refunded to Mr. Comi~h and "upon motion made and seconded the refund was unanimously approved and the Recorder instructed 24~to include the bill with the January bills. A resolution was presented stating that the City of Eugene does not wis4 to continue the present haphazard method of guaranty and will, after.January 1, 1941 and shall discontinue the present policy of rural fire protection; it shall recogniz only contracts with regularly organized fire districts for outside fire protection 25~and upon motion made and seconded the resolution was unanimously approved. I RES 0 L UTI 0 N VrnEREAS, the City of Eugene as a temporary expedient has been accepting bonds and insurance policies as a ~eans of guaranty for the costs incurred by the city in going to fires outside of the city limits with the city's fire equip- ment, and WHEREAS, the Legislature of the State of Oregon has made ( ~ ~ 277 __ ..0 _. ___ ~.. I provision for the formation of fire districts, g1v1ng them power to organize and to contract with municipalities for fire protection, and WHEREAS, the city of Eugene does not wish to continue the present l1aphazard method of guaDanty and will, afte,r. Januaryl, 1941, refuse to rurther recognize any other than contracts ~ith .regularly organized fire districts for outside protection, t\:D '!'O -J Now, Therefore I BE IT RESOLVED By the Common Council of the City of Eugene that ~he City Recorder of the City of Eugene be and he is hereby directed to forward a copy of this Resolution to all persons having filed either bonds or fire insurance policies as a means of securing fire protection outside of the city, and ~e is furtheroinstructed to cause the substance of ,this resolution to be published. Councilman Koppe asked the condition of the sidewalk repair-project and Mayor Large reported that the City Engineer's Office and the local \VPA agency II were about ready to begin work. Councilman Farrington stated that a very bad sidewalk spot existed on north 14th Street between Mill and Ferry and it .needed 26~repairs very badly now. ' It was reported by Councilman Cox that trash was being dumped at the end of 13th Street and the .Chief of .Police was instructed to see that this matter 27 was cleaned up and the practice stopped. I Councilman Barette reported that :Mrs. Ella M. Berger ,had requested the city's permission to trim two maple trees and remove two maple trees on Lincoln Street at the corner of Fifth. As the Park Cownittee has not had an opportunity to investigate this request, it r-espectfu~ly requested an extension of time to 28 consider the matter. The request was unanimously granted. The City Recorder was instructed to publish a "Call for Bids" for the purchase of two motor vehicles for the City Engineer's Department--one pick-up model and one panel body model.
