M'arch 25, 1940 l'~ . ., ..../~ ~.~ 1/ The minutes of the adjourned meeting of the Common Council held on Ma~ch 25, 1940 at 7:30 o'clock p.m. Mayor Elisha Large presided over the meeting. Councilmen present were: Messrs. A. A.Reid, P. J. Hanns, Sam C~ Bond, A. C. Farrington, Fred Carlson, E. A. Barette, and H. J. Cox; absent: Louis Koppe. The minutes of the previous meeting, Warch 11, 1940 were presented and ~ ordered placed on file. Mr. Irish of Irish & Swartz, Inc. explained that he wanted to change the location of a curb cut on Sixth Street between Mridison and Monroe Streets asked for at the last council meeting. After some discussion by the council members, otion was made, seconded and carried that Mr. Irish,be allowed the cuts as per the recomrnendation of the City Engineer which is one thirty seven foot cut and two 3L forty foot cuts on Sixth Street. Communication was presented from H. E. Henzler accepting the $715.00 count I' offer for Lots 6 and 7, Blocl~ 1, Gilmore's Addit ion (southwest corner of 8th Street and Polk Street). Attached to the communication was a ~~143.00 check as a down payment to cover 20% of.the offer. (note that this offer was originally made [pending decision of the Board of Appeals) Residents in the neighborhood where Mr. ~enzler desires to build a store presented a petition asking that this property < ~e reclassified making it residence property only. Mr. Henzler's offer was held fP and the matter was referred to the Planning Commission to be reported upon at ffihe next council meeting. 4v 5--- Several residents living north of 4th and High Streets appeared at the council meeting protesting the conditions at and around the Walters-Bushong Mill. ~heir objection is to the condition of the sidewalks on High Street, the South side of 4th Street and both sides of Pearl Street. Albert Kaufman spoke in ponsiderable length and said that six years ago a petition had been presented to the pouncil protesting the condi-tions at ,the mill. Mr. H. T. Davenport said he had lived d.n the neighborhood for twenty years and that conditions around the mill were overy ~ad; that the 4th Street Sidewalk is buried a foot or two under rubbish from the mill and that the mill occupies all the parking and sidewalks. At times the lumber rxtends over into 4th Street. These people explained that traffic from north of ~here wish to corne dovm High Street and go over on 4th Street to Pearl and down ~own passed the depot rather than to go dovvn -High Street ,to ,5th across in that direc- tion. They complained that at times, especially on Saturday, the sidewalk on the rorth side of 4th Street is blocked on account of the nmny people at the auction house and that the people have to take to the middle of 4th Street in order to get ~hrough. There was some discussion from the council about this matter and Mayor ~arge suggested that it should be referred to the Street Committee. Councilman Reid said he could not see any necessity of referring it to the Street COIT@ittee as ~he matter had been presented two or three times before but the Street Committee did ~ot appear to be able to solve the problem. Councilman Carlson said he was aware of ~he trouble but did not believe it wise to take any action without attempting again ~o make some kind of settlement. After som.e discussion a motion was made and reconded that the matter be referred to the Street Committee t~ make an investigation ~nd report back at the next council meeting .and it was so ordered. _ II Mr. A. L. Hawn said that he had previously made a $400.00 couilter offer to ~he city for the east half of Lot 6, and the west half of Lot 7, Block 6, Fairmount lddition and the offer had been refused but no counter offer had been made and he ~rondered what the situation was. He wanted this property in order to make a driveway ~o the back of his present property for convenience in getting in and out of his residence. He said if it would suit the council any better he would make his offer for the east half of Lot 13 and the east half of Lot 6. Councilman Farrington explai ed FO him that at. the time his offer was made the lots had not been appraised. Since ~hen there has been an appraisal on the~ but the committee has not,had an opp~rtunity fo get together and work them over. ThlS matter was left to the Flnance Cormnlttee ,or further report. I Communication from the Board of Appeals was presented revealing the request from W. H. Smyth for a permit to construct a small wood frame woodshed, covered with ~orrugated iron on two sides and roof, at the rear of the Cosmo Cigar Store. As Fhis shed will be located in a rear court, invisible from the Streets, as a protectio from the v/eather and petty thieves, the Board recommends that the permit be granted. Motion was made and seconded unanimously approving the recolnmendation of the Board. II ' The comrnunication also presented the request from Jack Thomason for a ~ermit to construct a duplex residence on the north 33-3/10 feet of Lot 13 and the ~outh!~6-7/l0 feet of Lot 14, Block 4, Fairmount Addition, located on the East/side bf Agate Street between 14th and 15th. The Board recommends that this request be ~enied. Motion was made and seconded unanimously approving the recommendation of ~he Bo ard. 6 0' 7 v 8- A request was received from Hugh B. Wood--who has made an offer on the lot ~ ,... 294, at the northwest corner of the intersection of Onyx Street and ~Nenty-second Avenue --asking for a waiver of the "set-back" on Onyx Street. The Board would recommend that he be granted a twenty-two foot "set-back" on Onyx Street and a twenty foot "set-back" on Twenty-second Avenue. The recommendation of. the Board of Appeals was ~; unanimously approved. "'l.:.....).. I 'l\) A request was received from Roy Pierce asking for a permit to erect an out- C..": side stairway to the barn on the rear of the propr;:rty at 157 Eleventh Avenue West. ~ As this _ barn is being used for Light. Industri~l purposes, the Board recommends that the requ~st be denied. Motion was ma~e and seconded unanimously approving the 10 recommendation of the Board of Appeals. The Board of Appeals presented a request from Eyler Brown, for his client, Mr. Riddlesbarger, appearing before the Board with a contour map and plot plan of a proposed residence on Twenty-Sixth Avenve between Central and Woodlawn Streets, asking for a five foot "set-back" on Twenty-sixth Avenue. Owing to the nature of the location and numerous questions involved, the BOard wishes to refer this request directly to the Council. At this time Mr. Brown presented a map showing the location of the building on the lot as planned. After the council had studied the map and noted the location of the building and the territory in which it is located a motion was made and seconded that this party be allowed to place his garag 11 within five feet of 26th Street as requested. The motion was carried. I Councilman Farrington, Chairman of the Finance Cornmittee, presented the property offers beginning with the offer of Guy Bailey, $100.00, $20.00 cash and the balance within one year at 6% interest for Lot 6, Block 3, Elair Street Addition (68.4 feet north of 2nd Avenue on E Street). The Finance Cormnittee recow~ended that the offer be accepted and motion was made and seconded approving the recon~endation 12/ of the COnIDlittee. The Finance Cooonittee recommended the rejection of the offer of Edith Gardiner for client, Harris Holtan, $300.00 cash for the North 100 feet of Lot 1, Block 5, Croner's Addition (Southwest corner of 4th and Almaden). Motion was made 13 and seconded unanimously approving the reconMendation of the Con~ittee. Upon the recoInITlendation of the Finance Conrrnittee, motion was made and second d that the following offer of Plenn B. Pike, $500.00, $100.00 down and the balance at $20.00 or more per month plus interest at 6% for Lot 2, Block 1, Gilmore's Addition (100 feet East of the northeast corner of Broadway and Taylor Streets) l~ be rejected, and it waa so ordered. I Upon the recomrnendation of the Finance Committee motion was made and seconde rejecting the offer of R. S. Hall, $400.00, $100.00 down and the balance at $lO.GG per month with 6% interest for Lot 1, Block 3, Chamber's Addition (116 feet Eas~ l~ of the Soilltheast corner of 11th and Polk.) , The offer of H. E. Cully for clients, H. Grady Johnson and Hazel Johnson, $500.00 cash for the East 50 feet of Lots 7 and 8, Block 2 COllege Hill Park (100 feet east of the southeast corner of 19th and Lincoln~, was presented. The Finance Committee reco~mended that the offer be accepted and motion was made and seconded unanimously approving the recooonendation of the Committee. 16v The Finance Committee recommended the acceptance of the offer of John Thomason $500.00, $100.00 dovm and the balance within one year at 6% interest for the North 33.3 feet, of ~ot 13 and the South 16.7 feet of Lot 14, Block 4, Fairmount Addition (100.0 feet north of the northeast corner of 15th and Agate) providing the Board allows him to build a duplex. Motion was made and seconded unanimously approving the recommendation of the Committee. The Finance Committee reconIDlended a counter o~fer of $500.00 on the offer of W. W. McDonald, $300.00 cash, for that portion of Lot 20, Block 3, Victoria Heights owned by the City and that portion of Lot 21, described within a line from the southeast corner to 17 feet from the northeast corner of Lot 21. Motion was made 18~ and seoonded unanimously approving the recommendation of the Committee. 17v 1 The Finance Cownittee recommended the acceptance of the offer of H. E. Cully for client, A. D. Cmupbell, $950.00, $250.00 cash and the balance on or before November 1, 1940 for Lot 6, Block 20, J~les Huddleston's Addition (northeast corner of Broadway and Jackson), intends to build about a $3500.00 home. Motion was made 19J and seconded unanimously approving the recornmendation of the COllIDlittee. Cownunication from Hugh B. Wood accepting the $1000 counter offe~ for the East 105 feet of Lots 5 and 6 in Block 24 of the Gross Addition, northwest corner 2~ of-22nd and Onyx Streets, was presented and approved. At this time Councilman Carlson asked to be excused from the meeting. I Mayor Large reported that he had received complaints about fiarbage wagons not using their covers as designated in the ordinance. Councilman anns stated that he had driven down Hilyard Street recently to investigate this and found that jJhe wagons were not using their covers and there was much loose material and paper scatt red 2~ along the streets. Chief of Police Bergman was instructed to check into the matwer. ~ ,-:,l ~ 295 ~-'I-.---- I I I I I Councilman Barette reported that he had not been able to'make an 22/ exchange of park animals but was still working on it. An application for a transfer of Retail Beer Class "B" License from Ted E. Stewart to Walter A. Eallium at the Fir Tree Inn at 2183 Franklin Blvd. was 23 presented and approved by the Council. Chief of Police Bergman reported that he had been checking the cars parked in the city hall lot and he had pretty well weeded out all cars parked 24/ there without authority. t...j -"'" ,-",~ ~::""1 ".,/<. r .....:.: Councilman Farrington reported that Councilman Koppe had been operated on last Thursday and was getting along fine; he is at the Sacred Heart Hospital 25~ and is now able to see visitors. Corrununication from Harlow E. Hudson permitting public utilities to use a 2EY ive foot strip of his property was referred to the City Attorney to report back. Communication from I. G. Kjosness attached to a petition asking for a 27v street light at 25th and Harris Street was referred to the Fire and Water Committee. The Eugene Public Library presented their report for the month of Feb- 280/' ,ruary. The, report was ordered placed on file. I A petition from Wayne W. Holmes for a license to operate a motion iPicture theater at 70 West 10th Street was read to the council. Gordon Ramstead 'spoke in behalf of Mr. Holmes and said Mr. Holmes intended to make this a permanent ~ttraction. He pointed out that the seats in this room would not be stationary as [n a regular theater but the seating capacity would be approximately 300 seats ~nd this would be the basis for which he was willing to pay a city license. ~Jecessary provisions of the State Fire Marshall's Office and the city fire and health ordinances were to be complied with. He wanted some assurance that if he went to this expense he would be able to secure a license from the city. After ~ome discussion by the council a motion was made and seconded that if the re- ~uirements of the fire marshall's office and the regulating city ordinances were 2~ complied with that a license would be granted to Mr. -Holmes and it was so ordered. I A written request from ~~~s. C. V. Sinniger asking for a refund of $50.00 jYVhich she made as a dovm payment on the South 60 feet of Lots 1 and 2, Block 4, Fampbell's First Addition was presented. She explained in her letter that due ~o unexpected sickness and hospital bills she would not be able to go through ~ith the contract to purchase the property. Upon recommendation of the Finance tommittee it was moved and seconded that this money be refunded. The roll was palled, councilmen voting aye: Reid, Hanns, Bond, Farrington, Barette and Cox; hay: nonei absent: Carlson and Koppe. It was unanimously approved that the refund be 30 v ~ranted. II Communica tio~ was presented from IN. J. Scharen regarding a notice that he had received from the city to repair his sidewalk in front of 2005 Franklin II Woulevard. It was stated tl~t City Engineer Clubb had said that owing to the probability of re-locating the highway along Franklin Boulevard that this work out r"here should be held up and nothing done until the direct highway route was knovvn. 3lv l11e letter was referred to the City Engineer. I Corununication was presented from C. M. Bryan, qity Recorder stating that 0n March 16, 1940 a copy of the resolution passed by the Common Council on January ~2, 1940 regarding fire calls outside of the city limits of the City of Eugene had been mailed to all the subscribers and insurance companies on record in the Recorder' 32..1 r'! ffi ce. I Communication was presented from the Union Central Life Insurance Company an which they returned to the city warrant #52028 in the amount of $64.01 dated ".. .. February 29, 1940 WhlCh had been sent them as over payment on WaSI11ngton Street :Waving and sewer assessmerts.. rrhe company asked for an additional sum of interest thich they had paid on this $64.01 at the time the payment was made. The matter was 33 v'teferred to the City Attorney. ~ Curb cut applications #726, T. S. Peterson~ #727, Ludwig Kaufman;'and W728, 1~s. Oza Whittenberg, were presented and as the City Engineer recommended ~hat the cuts be granted motion was rnade and seconded unanimously approving the ~ecorrnlendation. Curb cut application #725, C. P. Tillman, denied at the council weeting of March 11, was presente~ for reconsideration at the request of Mr. Tillman. ~. Tillman stated that cars would not be parked across the sidewalk. There was ~ome discussion from various members of the council after which motion was made ~y Councilman Hanns, Seconded by Councilman Reid to allow the 18 foot curb cut as 34 vwreviously asked for. The motion was approved. ~ An ordinance initiating the vacation of that portion of 21st Avenue West lying between the East.line o~ Oli~e Street,and the West line of.Willamette was. ~resented to the Councll for ltS flrst readlng and under suspenslon of the rules wassed to its second and third readings and placed for final passage. I Co~nunication addressed to the Mayor and Common Coun9il from Robert A. Johnston, ~ecretary of the Oregon Department of the Reserve Officers Association of the United States asking that in the event of mobilization if the city employees holding cownissions in the officers reserve corp could be allowed to report for duty within 24 hours from the tirne of their call. Motion was made by CQuncilman Hanns, seconded by Councilman Cox that any city employees belonging to any government orga~ization if called for duty would be allowed to report at once and that their respective jobs would be held open for them to be resumed at the expiration of the time of their call. The motion was 37vunanimous+y carried. In accordance with a publicatio~ of a call for bids the Finance Committee reported bids for the purchase of a one-half ton panel body truck one seated, for the City Engineer's Departm.ent had been received from Lane Implement & Truck Company ($799.75); Sinwons-Rendall Cornpany ($710.66); Silva Chevrolet Company ($716. 0) an4 Sigloh-Sawyer Company ($719.70). It was the COIMlittee's recoITtinendation that the award be made to Sigloh-Sawyer Company and Inotion was made and seconded unanimously I 38 pprQving the recommendation of the cownittee. ,,- Mayor Large reported that there wa~ a vacancy on the Police force and wish d to appoint Paul E. Snell for this position. Upon motion the appointment was confirm d yby the council and lvIr. Snell placed on th~ payroll at $100.00 per month effective 3911 April 1, 1940. , Nffiyor Large reported that he had received an invitation from Mrs. Hathaway of the McKenzie Flying Club inviting the members of the council to attend a ~ree 40 banquet to be held at the Eugene Hotel on April 5th at 6:30 p.m. . .
