The minutes of the regular me,eting of ,the Common Counci-1 held on April 8,
1940 at 7:30 o'clock p.m. Mayor Elisha Large presided over the meeting. Council-
men present were M.essrs ~ A. A. Reid, P. J. Hanns, Sam, C. Bond, A. C. Fa rrington,
Fred Carlson, E. A. Barette and H. J. Cox, absent: Louis Koppe.

~he Judiciary Conmlittee represented by Councilman Hanns reported on the
request of John Dayton, Jr. for damages done to his car by a falling limb and it
was :the conmlittee's recorrnnendation ,that the ,request be denied. Upon motion made
and seconded the recommendation was unanimously approved.

Councilman Farrington" Chairman of the Finance Committee, presented ~he
property offers beginning wi th the offer of Henry Whi ttall, ~~150. 00 cash, for Lot s
1 and 2, Bloc~ 4, Blair Street Addition (136.8 feet north of Second Avenue on the
vvest side of E Street). The Finance Committee recommended the rejection of this
offer and motion was made and seconded unanimously approving the recorrnnenda tion
of the committee.

and Potter); intends to build a home. The Finance Committee recommended the re-
jection of the offer and motion was made and seconded unanimously approving the

The Finance Comrnittee recommended a counter offer of $650.00' $100.00 credit
when construction starts within 90 days, on the offer of Ed Walder, $550.00 cash,
for Lot 2, Block 1, Chula Vista Park 1st Addition (64.5 feet east of the southeast
corner of 26th and Agate). Intends to build a horne. Motion was made and seconded

Withdrawal of the off-er of Guy Bailey which was accepted March 25, 1940,
requests refund of ~~20.00 deposit since the city would be unable to obtain a clear
title for some time, Lot 6, Block 3, Blair Street Additioll;(68.4 feet north of
2nd on E Street. The Finance Cormnittee recommends that the refund be granted and
a cancellation of sale of the above lot. Motion was made and seconded unanimously

The offer of H. E. Cully for clients, Joseph A. Morgan an~ Carroll Kennedy,
$437.49 cash for a strip of land 5.17 by 231 at the northeast corner of 11th Avenue
and Chambers Street vms presented. It was the recommendation of the Finance Con.uni tt ee
tha t ,a counter offer be extended as follows: Purchase ~ri ce: ~~400. 00; Taxes ~t12. 49 ;
and $25.00 for th~ city to quiet the title; ,a total of ~437.49; a subsequent contrac
between the parties whereby the purchaser agrees to deed back to the city free of
charge whatever part of this piece of property that might be needed in the event of
a future widening of 11th Avenue. Further that the Mayor and Rec~rder are hereby
instructed to execute necessary papers in the event of acceptance of this counter
offer. The recommendation of the Committee was unallimously approved.

a recommendation that warrants be drawn to pay for the same. The ayes and nflYS were

Street Committee Chairman Carlson reported that his committee had investigat d
the sidewalk conditions surrounding Walters-Bushong Lumber Mill and recommended the

Regarding the Walters-Bushong Lumber Company Street Problem:
I
On High street:
Install a new screen on dust collector.
Close the chute in the shaving bin to prevent air from circulating
and blowing loose shavings and dust.
Concrete the runway from High Street to the bin.
Put heavy plank flooring inside the bin runway.,
Shavings and dust must be cleaned out at least once each ,month.
Sawdust bin:
Plank the flooring same as in the shaving bin.
Clean out sawdust bin at least once each month.

4th Street to be properly graveled to the cur~ line; sj,ze and
amount of gravel to be determined by the Supt. of Streets.
As soon as the weather permits, the city is to oil the street
to at least two feet inside the curb line, this to be paid for
by the Walters-Bushong Lumber Company.
No lumber is to be stacked outside of the curb line.
The Superintendent of Streets shall inspect the above premises and
report his finding to the chairman of the Street Committee at
least once each month.

Upon ac ceptance of this recoommendat ion by the council it is
further desired that the City Recorder be instructed to transmit two copies
of this statement to the Walters Bushong Lumber Company with provision there n
for a signed acceptance of the above conditions; the 6riginal of said signed
statements be return~d to the office of the City Recorder.
It is further agreed and understood that this work is to be
completed within thirty days from the date of signing.

Councilman Hanns, Chairman of the J!'ire and Water Committee recommended that
a street light be placed at the intersection of 25th and Harris Streets and a street
light be placed at tIle intersection of Fairmount Boulevard and Sunset Drive. The

NJayor Large offered a correction to paragraph 34,of the minutes of the meeti g
of March 11, 1940. The minutes now read that the property. at, 12th, 13th, Tyler and
Chambers Street had been withdrawn for park purpo.ses and he recommended it shou.J..d
be changed to read that the property should be removed from the list of saleable
properties.' Upon. motion made and second'ed the recommendation was unanimously approv d
and the City Recorder instructed to change it to read as so stated.
Chairman Cox of the Health COIMlittee requested the Council to grant Police
Authority to R. R. Hughes, Caretaker of the city dumpgrounds, in order that he might
properly supervise the work at the dwnpgrounds. Upon motion made and seconded this
request was una<Ilimously approved. Councilman Cox reported that the Contract hetween
the City of Eugene and R. R. Hughes expires on the 30th day of April and would like
expression from the council as to what the committee should do. Mr. Cox expressed
the opinion that it was the city's responsibility to see that Mr. Hughes received al
the garbage' of the City of Eugene plus his ~~30. 00 per month or he should receive a
greater monthly remuneration. The Chief of Police was instructed to rigidly endorce
the garbage ordinance as to the picking up and haulil~ garbage only by licensed garb ge

Coullcilman Barette, Chairman of the ParkCommi.ttee, reported that R. W. Schi ka
requested the construction of a party fence between his property and Hendrick's
Park; 11r. Schiska would furnish the wire for the fence if the city would furnish
posts and labor and install the fence. After considerable discussion the matter was
left in the hands of the Park Committee to report back to the council as to the city s
36.... share in the cost of this improvement.
Councilman Bond, Chairman of the Police Committee, recomnended the approval
of the application from Lee's Coffee Shop for the transfer of his Retail Beer Class
"B" License from 966 Charnel ton to 757 West 6th Street. Ivlotion was made and seconde
3~ unanimously approving the recommendation.
Mayor Large introduced H. W. Libby, representing the Oregon State Highway
Commission, who gave an outl-ine of the proposed re-routing of traffic through the
City of Eugene. Upon motion made and seconded the following resolution was
unanimously approved." Mayor Large requested the City Recorder to try to make arrang -
ments for the use of the Circuit Court Room for the public hearing on May 1, at 2
o'clock p.m. and to report back at the next council meeting.

vVHEREAS, the State Highway COlmnission through one of its
engineers, Mr. H. W. Libby, has presented to the Council a proposed
. route and plan for the routing of the Pacific Highway through the
City of Eugene as follows, to-wit:
North bound t.raffic shall come into the city on Franklin
Boulevard, thence down 9th Street to High, thence
North to 6th Street and thence West on 6th Street and
on to the Pacific highway. South bound traffic shall
enter the City on 7th Street~nd thence East to Pearl
Street, thence north to Broadway and thence East over
Franklin to the City Limits.
T~iliREFORE, BE IT RESOLVED, That the C01TIillOn Council hereby accepts
and approves such designation and will lend its approval and
support and co-operation in every way possible.
In addition to the foregoing, the Common,Council extends to
the State Highway Commission and to its officers its acknowledgement
and appreciation of their labors in solving the problem of routing
the higlThvay through the City of Eugene.

Communication was presented from Janet B. Smith asking that the city deed
to the public for street purposes the necessary mnount of land to open 24th Avenue
from Alder Street to the West line of the Maltman Addition. 'rhe communication was
referred to the Street COlmnittee.

Co~munication was presented from E. R. Endicott requesting pennission to
remodel his home at 1639 Jefferson Street which is in the Single-Family oResidence
Zone. He would like to make three aIJartments in the upstairs which would be constru ted
according to the uniform building code. Mr. Endicott presented the plans for the
change. Motion was made and seconded approving the plans and the City Engineer was
40/ instructed to issue a permit to 1\111'. Endi cott to conform with the plans presented.

The Chief of Police repo:rted that all garbage hauJ.ers had been notified
to cover ga.rbage trucks vihen making trips to the dumpgrounds and instructed the
44v officers to arrest any garbage man failine; to comply vii th this regulation.
Regarding the comrrrunication from Harlow E. Hudson pennitting public
utilities to use a five foot strip of his property which was referred to the City
Attorney, Attorney Calkins reported that the city has no interest in the subject
requested and Mr. Hudson should procede with any action he desires. The comrnunica-
tion was ordered placed on file.

repairs at his place of business, 2005 Franklin, because of the possibility of

The City Engineer recommends that the cuts be granted and motion was made and

Application for a Second-Hand Dealers License was presented from Jacob
Bla tt operating Blatt's Clothine; &: Tailoring Shop at 740 Willernette Street. As the
application had been approved by the Chief of Police, motion was made and seconded
48~ granting the license.
Request from Arthur M. Gilbert requesting a refund for building permit
No. 14546 issued for the Eugene Home ApplianceeCompany for repairs. Inasmuch as
the work was not done lVIr. Gilbert would appreciate a refund of $2.00 for the permit.
The Gity Engineer recommended the refund and motion was made and seconded unanimousli

Tobacco applications from forty five applicants were presented and upon

Communication was presented from Lottie N. Rugh asking to change the

An ordinance initiating the vacation of certain parts of Ramey Street was
presented to the council for its ~irst reading and under suspension of the rules
passed to its second and third readings and placed for final passage. The ayes
and nays were called, councilmen voting aye: Reid, Hanns, Bond, Farrington,
Fred Carlson, Barette and Cox; nay: none; absent: Koppe. The ordinance was declared
520/ passed and numbered 8636.
A resolution was presented ordering the Treasurer to refund an additional
~~35. 21 to the Union Central Life Insurance Company to account for erroneous assess-
ments of paving and sewer on Washington Street. The resolution was unanimously

The City Recorder presented the 1939 Financial Statement for the City of
Eugene and the same was duly accepted and ordered placed on file.

Mayor Large reported that the deeds relating to the exchange of property
between School District #4 and the City of Eugene were prepared and ready for
signatures on the following terms: $16,729.97 appraisal price for the city property
and $16,179.00 appraisal price for the School district property, entailing a $550.97
difference which the school district will pay to the city. The school board stated
they would pay $300.00 cash with interest at 6% on unpaid balance until its date
of payment on July 1, 1940. In addition thereto that the City of Eugene agrees to
furnish the services of the City Attorney in the matter of a possible future quietin
of' title for the property deeded to the school district by the City. How-eEer, the
school board agrees to pay the costs involved in said quieting of title. Resolution
was presented and adopted instructing the ~hyor and City Recorder to execute the dee
upon the acceptance bf the School Board of these terms. (This supercedes all
previous actions and statements regarding the above action) Legal descriptions,

Councilman Farrington sugLested that the City Recorder be instructed to call
for bids to audit the books for 1940. Councilman Cox voiced serious objections to
call for bids for auditing, which oojectio'n was supported by Councilman Carlson.
Mo"tion vms made to call for bids, bids tobe opened at the next meeting of the
co'uncil. All councilmen present' voting ay'e except Carlson and Cox'. The motion
56V wa? declared passed and the City Recorder ~as instructed to call for bids.
Councilman Hanns reported that ou~lying districts were taking steps to
be.come regularly constituted fire district's and requested the City of Eugene to
advance the legal fund requirement to put 'the proposed dfstrict measures on the

Harvey Blythe, whose property offer was rej ected oomo t irao :lga.., addressed
the council asking that his offer be reconsidered inasmuch as there was a musunder~
standing on the part of the committee as to the property involved. The D~yor
58 re-ferred the matter to the Finance Committee to report back, at the next meeting.
