Stewart addressed the council asking that consideration be extende on the proposed vacation of Indiana Street, (26th Avenue East). It was pointed out by members of the council that the proposed vac~tion as advertised for hearing en July 8, would absolutely shut off entrance to 8~ residence on said street and ~robably effect other adjoining property. The City Engineer explained it would hardly be worthwhileoto continue the vacation proceedings of the street adjacent ~o the property of the original petitioners., Upon motion made ,and seconded the 3/~roposed vacation of Indiana Street was tabled indefinitely. , I : In the absence of Councilman Farringion, Councilman Carlson presented the 0 ~~operty offers begi.n~ing with the offer of ~arl L. The acceptance of the offer of Ramey Hugh for client, Paul B. Hoven, $475.00, '95.00 cash and the balance on or before 120'days ($380.00) for the East 50 feet pf Lots 7 and 8, Block 2, College Hill Park Addition (100 feet East of the Southeast ~orner of 19th Avenue and Lincoln Street) subject to FHA loan--intends to build a home; was recommended by the Finance Committee which recommendation was approved by 10 v1the council. .' Cecile ~tewart, $300.00, $50.00 cash and the balance at $10.00 or more per month plus interest at 6%, for Lots 18, 19, and 20, Block 25, City Ovtlook Addition (109.4 feet _/~outh of the Southeast corner of 25th and Potter Streets). The recommendation was II hnanimously approved. II The Finance Committee recommended a counter offer of $200.00 cash plus monthly payments of $17.00 at 6% int~rest on the offer of Mrs. William Kissinger, ~lOOO.OO, $200.00 cash and the balan?e monthly at 6% interest for'Lot'4, Block 5, ~lair Street Addition (known as 1683 and l683t West 2nd Avenue. Offers made on condition that he be granted both offers, was presented with the recommendation that a counter offer of $15l0.00 be extended for his consideration. The recommendation was ,unanimously approved. At this,time Councilman Farrington arrived. I The regular bills for the month of May, 1940 were presented with the recommendation that they be allow~d and warrants be drawn to pay for the same. The ayes and nays were called, councilmen voting aye: Reid, Bond, Carlson, Farring- ton, Hanns, Koppe, Barette and Cox; nay: none. The recommendation was declared approved. A. Hqrton, AudQtor, had submitted the annual auditor's report for the year 1939 and it was their recommendation that t e 1~1 ame be accepted and placed on file. The recommendation was unanimously approved. The Finance Committee reported that under date of February 6, 1934, Paul D. ~nd Tillie Green gave the City of Eugene a deed to Lots I, 2, 3, 6, 10, 11, and 12, and the West 100 feet of Lots 7 and 8, all in Block 25, College Hill Park; the city aid not foreclose on these lots and now Lane County Abstract Company will not issue ::insured title until Mr. Green gives each purchaser a quit claim deed. Lot #6 should hot have been deeded to the City had no liens against this lot. The City has sold Lot #12 to Hazel C. Fishwood for $450.00 but under the circumstances cannot give clea ~I itle. Besi.des this Lot #l~, there is still unsold Lots I, 2, 3, 6, and 10 and the est 100 feet of Lots 7 and 8. It was now the committee's recommendation that upon payment of $100.00 to the city from Mr. Green, the city would deed to Paul D. and 'I~illie Green Lot 1, Block 25, in College Hill Park and Paul D. and Tillie Green to give to the city a quit claim for the property that he had deeded to the city in tebruary of 1934. Under this arrangement the city would keep Lot No.6. Upon motion 17~kade and seconded the recommendation was unanimOUSly approved. I . Councilman Hanns, Chairman of the Fire and Water Committee, reported that a ~urvey and study was being made with regard to replacing the old boiler system in the Fire Department with a new single boiler and installing new pipes. Then by re- ~rranging the equipment it would be possible to place the ladder truck in the same foom. The matter was left in the hands of the committee to report back the costs 18tnvolved in the propos~d changes. II Councilman Reid requested an extension of time regarding transfer of sewer ~ssessments as asked for by Mrs. Lottie N. Rugh. The request was unanimOUSly 19v1granted. .' II . An application from Dave E. Asmervig of Dave's Pie Shop requesting a transfer pf.his Package Store Class "B" Liquor license from 128 East 11th to 133l Willamette ~treet was presented by the Police Committee. Councilman Barette brought in a minori y ~eport objecting to the proposed transfer on the grounds that other businesses in tha ~mmediate area were very much interested in liquor licenses and applications had been henied; further this particular area was traversed by children and he didn't feel ~hat it was a proper location for such a business. It was pointed out by members of ~he Council that this was merely a transfer as had been done in other cases and upon ~otion made and duly seconded, the application received an assenting vote from all councilmen except Barette who failed to submit a vote. The application was declared II 20'Vapproved. II Councilman Carlson asked the council's consideration in the installation of a ~treet light at the intersection of the two allies immediately back of the city barn ~t 5th and Olive Streets. The matter was referred to the Fire and Water Cornnittee 21 ~o report back at the next meeting. Oouncilman Reid reported that many complaints had been received from property ..4 "... 328 "1' ,- ~pwners and home owners adjacent to the Schulz Motor Company at 8th and Pearl Streets 7~~ecause the paint shop of the motor company has caused a very definite increase oc~n the neighboring insurance rates and they would appreciate anything that could be '.,::/ ~one for the same. The matter was referred to the Fire and Vvater Committee to report 80 back at the next meeting. ~ ......\...- I City Attorney Calkins reported that 1trs. Nettie Tucker of Springfield had pontacted him numerous times stating she wished-to secure the articles removed from ~he,GaYlord H0tel and stored in the Street Dept. shops at 5th and Olive Streets at ~he=time the city condemned and tore dovm said Building. Upon motion made, seconded land-duly approved, the City Attorney was directed to proceed with lien.foreclosure pn miscellaneous articles removed from the old Gaylord Hotel on South Willamette to JUake it possible to sell the articles; money received to Be given the former 23 bwner of the building, N. R. Gaylord, afld it was so ordered; I: The City Attorney reported that the City Recorder, C. M. Bryan a Reserve pfficer, had approached him concerning the proper procedure in taking care of the lyity Recorder's functions in the event that he was called to active training, and · palled attention to the fact that should this take place a necessary ordinance was pow=on file which would provide for Mr. John Fields, Assistant Rec0rder, to become pity Recorder pro-tem and the council would have authority to secure additional help as needed. City Attorney further reported-that he had contacted I~yor Large ~nd'in the event Mr. Bryan was called to active-service, would recommended that the fity make proper compensation for-whatever the difference might he between his presen kalary and base pay received as an officer in aetive service. However, no immediate I~ction was necessary on the part of the council: Councilman Bond stated that this 24,/~ec0mmendation was no more than fair and just. · ~ ~ Communication was received from O. A. Prince, trustee of the Eugene Box pompany petitioning the Finance Committee to release the interest, $122.62 from the principal, $189.58, for paving assessments on Pearl Street betweeno3rd and 4th Street ~trom which the Eugene Box Company burned down in 1931. The Finance Committee stated 25 Itha~ this coul~ not be d0ne which action was upheld by the Council. l 0 With regard to the proposed op~ning o~'15th Avenue between Kincaid and · I niversity Stteets, the City Engineer reported that a survey had been made and the ~oute does not seem feasible. However, he would make the following recomrnendations: ~l) Road along the North side of the University entering lIth and serving the Fairmount district be given consideration. (2} Sixteenth Avenue through the Cemeter from University to Alder Street might be used for local traffic. (3) Eighteenth Avenue from Willamette Street to University Street when improved be constructed ~ple width to accommodate four lanes of traffic and two lanes of parked cars. (4) Pedestrian crossing of Thirteenth Avenue be confined to Pedestrian lanes. The recommendations were approved and ordered placed on file in the event action is taken 26J~t a later date. ~ Request was r~ceived from the Congregational Church to construct a stage mhich does not meet the requirements of the building code. The Board of Appeals ~ecommends that they be required to construct the front.of the stage with studding ~nd use shiplap on both ~ides and finish with plyboard. Also, that they provide for 27v,6.n exit on the west side. The reoommendation was unanimously approved. . . I Request'was received from R. Clair Parsons for a waiver of the "set-back" pn East 22nd Avenue. He desires a "set-back" of 22 or 24 feet instead of the require .;30 feet. The Board recommends; that he be granted a 24 foot "set-back" which recommen a- 28 ' ion was unanimoUSly approved. I - Communication was read from the Roseburg Fire Department inviting the ~ugene Fire Chief and as many firemen as possible to attend the annual Fire School ,; Ilbf the Fire Chief's Association to be held in Roseburg on June 24, 25, and 26. The 29 ~nvitation was accepted and all firemen who can go will attend. II A statement of sewerage charges billed and collected for the mongh of May Fas submitted by the Eugene Water Board showing a collection of $1699.13 for the mont 30lpt N~y. Watson VIEWERS An ordinance amending Ordinance No. 8413 re-classifying a certain area at the four corners of West 8th and Polk Streets, which had its first reading on May 27, was presented for its second reading by title and passed to its 3rd reading by title by unanimous consent of the council. Objections were called for; no objections appearing, the ordinance was placed for final passage. The ayes and nays were called. Councilmen voting aye: Reid, Bond, Carlson, Farrington, Hanns, Koppe, Barette and Cox; nay: none; absent: none. The ordinance was declared passed 33~ and numbered 8646. I An ordinance vacating the east 13 feet and the west 13 feet of Emerald Street between 24th and 25th Avenues East in the City of Eugene was'presented to the council for its first reading and passed to its second and third readings by title by unanimous consent of the council.
