The minutes of the adjourned meeting of the Common Council held on Jult22, ,;~....f <..~.:,;, 1940, at 7:30 o'clock p.m. Mayor Elisha Large presided over the meeting. Council- :.;~, men'present were: A. A. Reid, Sam C. Bond, Fred C. Carlson, A. C. Farriilgton, P. J. Hanns, Louis Koppe and A. E. Barette; absent: none. A vacancy existed from 1........ the second ward' because of the recent resignation of Councilman H. J. Cox. 0 The minutes of the previous meeting, July 8, were presented and ordered 2- placed on file. I Reverend J. H. Taylor addressed the council making a request for permis,sion to erect a gospel tent 32x62 feet on the southwest corner of 13th and Lawrence fora period of time not exceeding two months. After considerable discussion Councilman Bond requested that this be referred to a committee with power to act providing Reverend Taylor would prepare a petition securing the names and add~esses of surrounding neighbors showing their approval or disapproval of the temporary tent location in that place. Upon motion made and seconded the matter was referred 3'- to -the Police Committee with power to act. Judiciary Committee Chairman, Councilman Koppe, recommended the approval of the request from the Lane County Health Service for the City of Eugene to sponsor an NYA Project to remove the trees from the jungles located at the north western ~art of Eugene. Motion was made and seconded approving the recommendation of the 4v committee. The Judiciary Committee reported there was no reason for the city to take put insurance on the Eugene airport because the property was leased to another person. fhe committee therefore recommended that the city should not take out insurance protection as offered through the J. K. Pratt Company. City Attorney Calkins gave ~dditional explanations supporting the recommendation and the council approved 5- [he committee's recommendation. Councilman Farrington, Chairman of the Finance Committee, presented the I I roperty offers beginnin~ with the offer of Mr. and Mrs. Otto Rahn, $1900; $950 pash and the balance at ~15.00 per month plus interest at 6% for Lot 6 and the West l/2 of Lot 7, Block 2, Harris Addition (known as 691 West 6yh Avenue) with the ~ecommendation that the offer'be accepted. Motion was made and seconded unanimously 6~ approving the recommendation of the committee. . I Upon the recommendation of the Finance Committee, the offer of J. W. McCracke 1'500 cash for Lot 10, Block 20, COllege Hill Park Addition or $350 cash for the East 1/2 of the lot (180 feet South of the Southeast corner of 22nd and Lincoln ~treet) was extended to a counter offer of $650.00 and the recommendation unanimously 7 1/ ~pproved by the council. II The Finance Committee recommended the acceptance of the offer of Reverend !Roy K. Reed and Roy L. Scott, $500; $100 cash and the balance at $10.-00 wer month ~ flus interest at 6% for Lot 2, Block 6, Huddleston Amended Addition (66.8 feet West pf the Southwest corner of 12th'Avenue and Madison Street); to be used for a church &;:, '~i t~. Peterson, $300; $200 down and the balance at $25 per month plus interest at 6% for Lot 12, Block 2, Campbell's First Addition and also ~ 4 foot strip lying east of said lot (northwest corner of 7th and Tyler Streets); ~ntends to build two houses, was presented with the recommendation that a $350 counte pffer be extended, and when houses are started refund $50.00 to client. The 9' ~ecommendation was unanimously approved. I II ' The offer of Benjamin S. DeVries, $450.00; $90.00 cash and the balance on or before 90 days for Lot 4, Block 25, Huddleston's Extended Addition (66.8 feet east pf the southeast corner of 12th Avenue and Van Buren Street); conditioned on FHA Loan, upon the recommendation of the Finance Committee was held for further con- 10, ~ideration. II The offer of Rugh Realty Company for client, Roland P. Jackson, $180, $36.00 cash and the balance at $5.00 per month plus interest at 6% for a lot at the south-we t ~orner of 3rd and Filmore just inside the city limits was presented with the recommen a- I tion that this piece of property be held for re-appraisal. The recommendation was tnanimously approved. The Finance Committee reported that this piece of property ~as a piece of a large tract of land and questioned the breaking of these large " . 11' tracts by the sale of small p1eces. II The offer of B. R. Andrus, $350; $70 cash and the balance at $8.00 per month plus interest at 6% for Lot 1, Blcok 2, Zimmer~s Addition (SW corner of 2nd Avenue and Polk Street) was presented. The Finance Co~ittee recommended substituting the lot across the street, Lot 1, Block 1, Zimmer's Addition, at the same cost, which was ~greeable with B. R. Andrus, and accept the offer. Motion was made and seconded !pproving the recommendation of the committee. The Finance Committee also reported II rhat this piece of property was a piece of a large tract of land and questioned the 12- freaking of these large tracts by the sale of small pieces. .... r"" 346 -:: -- ~ --- .- -- ...-. Councilman Carlson, Chairman of the Street Committee, presented a communica ~ tion from the Southern Pacific Company in which they reported that repairs had been I C'~ completed to all of the various crossings within the city as desired with the excep .....1',1. ,f:~ ~~!# tion of the one at Lincoln Street which requires special authority and it will be .,-- taken care of. It was now the recommendation of the Street Committee that the City '-, . Attorney be instructed to prepare the franchise covering the spur track across Pearl Street and present the same at the next meeting of the council. The recommen 13~ tion was unanimously approved. On behalf of the Health Committee, Councilman Carlson reported that a communication had been received from the Northwest Cities Gas Company' stating that I they have been operating their plant in the best manner possible and doing every- thing they felt necessary to keep down any disturbances such as odors and smoke which might cause complaints and invited a committee from the city council to inspe t .the plant any time during the day between the hours of 8:00 o'clock a.m. and 3 o'clock p.m. which is the period when gas is being manufactured. Councilman Carlson 140- reported that the committee would visit the plant before the next meeting. Councilman Carlson reported to the council that the Street roller had broke down and while having the roller checked for possible repairs the State,Inspector had called for an inspection and condemned the roller, prohibiting it from future use. Councilman Carlson stated that a new roller would cost in the neighborhood of $3500 to t3700 and the Street Department did not have sufficient funds to complete the purchase. 'The roller is an absolute necessity in the matter of continuing stree repairs and work and Councilman Carlson suggested that if the council'could arrange for $2500 of the purchase price, the balance could be taken from a Street Department fund. Motion was made by Councilman Farrington, seconded by Councilman Barette, and unanimously approved by members of the council, authorizing the expenditure of $2500 from the emergency fund for a street roller. The question was then placed upon roll call approving the expenditure of $3500 to $3700, councilmen voting aye: Reid, Bond, Carlson, Farrington, Hanns, Koppe'and Barette. It was declared carried 15, and the City Recorder instructed to call for bids for.a Street Roller.. Oouncilman Reid, Chairman of the Sewer Committee, reported that he had received complaints about the Walters Bushong Lumber Company when washing their logs allowed the water and dirt to go on the Southern Pacific grounds and right of way, I 16- which kept the Southern Pacific property wet at all times producing an obnoxious odor. The matter was referred to the Health Committee. Councilman Bond, Chairman of the Police Committee, requested another two weeks time to consider the request of placing a stop sign at the intersection of 17- 8th and Jefferson Streets. 'The request was granted. On behalf of the Police Committee, the City Recorder presented a communica- tion from the State Industrial Accident Commission concerning a number of traffic tags received by their representatives in which they asked for leniencey. Upon motion made and second'ed the City Recorder was instructed to notify the State Industrial Accident Commission that it was the policy of the Common Council to re- quire all car drivers, regardless of their capacity, to comply'with parking restrict ons 18 '" of the City of Eugene and the tickets in question would have to be accounted for. The City Attorney reported that he had contacted the owner of the barn at 1010 West Sixth Avenue, and the owner of the barn located in Elk Drive, and both owners agreed to remove the buildings without further delay, and it would not be 19v- necessary for the city to initiate condemnation proceedings.- A classification of dairies supplying milk to Eugene was presented from 20 v' L. G. Helterline, Milk and 'Meat Inspector, a~tt ordered placed on 'file. Oommunication was presented from Lillian E. Tingle complaining that tenants I from neighboring apartment houses were parking their'cars directly in front of her residence at 470 East 14th Street which was a great inconvenience to her. The 21' communication was ordered placed on file. Communication was presented from Mrs. Lena Keen complaining of the noise from dances at the W.O.W. Hall near her apartment house at 755 Lincoln Street. The 22' communication was ordered placed :on file. Communication was presented r~om CarltonE. Spencer, Director of Civilian I Pilot Training at the Eugene Airport, assuring the council that students will not hereafter do any of their flying over the city and will not do any more flying in the early hours of the morning. The council welc~med the communication and expresse 23' pleasure in bringing this practice to a stop. Communication was presented from the Board of Appeals presenting the request from L. M. Watson, asking for a permit for a structure, covered with corrugated iron to be allowed to remain in the rear of the "Dutch Girl" at 1224 Willamette Street. This structure was erected without permit by the present tenants who were unfamiliar with our city regulations and the B'oard recommends that the reque'stbe denied. T. Crawford asking to be allowed to leave a structure which he recently erected, having first obtained a permit, but which does I not comply with the "Set-back" ordinance. As N'Jr. Crawford is willing -to enter into .~)) a contract with the city to remove the building, if and when the street is widened, ~:.. 25- the Board recommends that his request be granted. Motion was made and seconded ~~ unanimously approving the recommendation of the Board. ~ , _,r Request was received from J. A. Morgan aSking for a permit to erect a servic station at the northeast corner of the intersection of Eleventh Avenue and Chambers Street, the exterior of the building to be covered with water-proof plywood. The Board of Appeals recommends that the request be granted if the plans are approved I by the Building Department and upon motion made and seconded the recommendation was 2t} unanimously approved. T. N. Shumway obtained a permit to erect a house at 370 Fifth Avenue West. ~fter the house was under construction, it was discovered that it di~ot comply rith the Code and th~ work was stopped. Mr. Shumway is asking to be allowed to complete the house. The.Board of Appeals recommends that he be permitted to finish Ithe house on condition that he strip the walls with. one inch by two inch strips placed sixteen inches on center vertically, and the recomrnendation was unanimously 27'iB.pproved. I A request was received from Kitty Scobert asking to have her property on ~ourth Avenue west of Blair Boulevard rezoned into a multiple family zone as she is laesirous of building two duplex residences. The Board recommends that she be granted r special permit to erect the duplexes provided she builds them on the east end of 28--iher property and the counc il unanimously approved the recommendation.. I Request was received from Harry Collins for a permit to erect a garage at ~5 N. Jefferson Street, waiVing the "set-back" on Cheshire Avenue. His request is !for a four foot "set-back". The Board of Appeals recommends that the request be 29-~enied and upon motion made and seconded the recommendation was unanimously approved. I The Union Oil Company made a request for a permit for a new service station ~t the northeast corner of the intersection, of Eleventh Avenue and Willamette Street rvaiving the "set-back" requirements. The Board recommends that the permit be granted I fPon their filing the usual contract covering the "set-back" and motion was made 30 end duly seconded approving the recommendation of the Board of Appeals. II Request was received from Marie Tinker for a permit to convert her house at ~34 Fifteenth Avenue East into an apartment. The Board of Appeals is holding this ( 3l~~equest for further information. II . Request was received from Ivan Ware asking for a permit to erect a new ~ouse on Lot 11, Alpha Addition, with a "set-back" of ten feet. The Board recommends fhat the request be granted and upon motion the recommendation of the Board was 32' nanimously approved. I A statement of sewerage charges billed and oollected for the month of June, i940 was presented from the Eugene Water Board and ordered placed on file. Report 33'from the Eugene Library was presented for the month of June and ordered placed on fil . 1 Speoial request for permission to store 4000 gallons of gasoline in the under . round storage tanks at their proposed new service station at 11th and Willamette Streets was presented from ~ 'Union Oil Company. This is 500 gallons over the Waximum allowed by the city~an~otion was made, seconded, and unanimously approved 34'that the request be granted. II The following curb cut applications were presented: No. _766' for Edward J. pillespie~ No. 768 for J. O. Eanes; No. 769 for Owen A. Thompson; No. 770 for H. A. I . v v ,......, I ~oore;~No. 772 for Roald Hanson; No. 773 for Ed Plant and No. 774 for T. H. Garrett. ~he City Engineer recommended that the foregoing applications be granted and motion ras made and seconded approving the recommendation. An application was presented from the Towne MarketVat 166 East 11th for a 12 foot curb cut (No. 765) and it was th ~ecommendation of the City Engineer that this cut be denied because it is a traffic hazard. Councilman Reid stated he felt the cut should be approved and referred to ~he Firestone station having a curb cut almost half a block in length. Engineer Clubb said that if the cut were granted it would very definitely cause a traffic hazard in entering and leaving across the sidewalk and the sharp turns necessary I ~o get between moving vehicles. It was the consensus opinion of the council that ~he curb cuts should be decreased instead of increased. Upon motion made and ~econded the recommendation of the City Engineer to deny the cut was unanimously ~ppr6ved. Curb cut applications were presented from the Union Oil Company No. 771, ~nd the Texas Company/No. 767, with the recommendation that the cuts be referred fO the Street Committee and the City Engineer with power to act. The recommendations ~ere unanimously approved. #The City Engineer was then instructed to prepare and ~ring to the next c'ouncil meeting a diagram showing proper markings to reduce the 351~ount of curb cut space now in use by the Firestone Station and it was so ~rdered." The ordinance was declared passed and numbered 8652. . I A resolution instructing the Mayor and City Recorder to execute a deed from the City of Eugene to Thomas R. Smothers for the following described property 37 was presented and unanimously adopted: fA RES 0 L UTI 0 N ~ WHEREAS, the Eugene Water Board has bought and sold cR1 property with a view to straightening out its lines on its properties on the McKenzie highway, and in the process of I this adjustment has found it necessary to convey to Thomas R. Smothers the following described property, to-wit: I All of a triangular shaped tract of land bounded on the East by the East line of the SW! of SE!, Sec. . 2, T. l~ S. R. lE., W.M.; on the Southwest by the old County Road; and on the Northwest by the McKenzie Highway" and more specifically described as follows: ~ Beginning at the intersection of the Southerly right of way line of McKenzie Highway with the East . Therefore, I BE IT RESOLVED BY THE COMMON COUNCIL of the City of Eug ene, that the Mayor and City ~ecordar be and they are hereby instructed and directed to execute a deed from the City of Eugene, a municipal corporation, to Thomas R. Smothers, for the above described property. Applications for a Second-Hand Dealers License, were presented fram the Oregon Book Exchange~at 31 West 7th; Eugene Exchange~ 695 Willamette; Brenner's Hardware and Furniture Store,~155 West 8th; Jerome's Trading post;-764 Willamette, Bob's Press Shop~ 875 Olive; Blatt's Second Hand Store~740 Willamette; and The Rummage Shop,' 661 Willamette. Application was presented from L. C. Peterson. for a bowling alley permit at 727 Willamette Street. As all applications had been approve 38'" by the Chief of Police, motion was made and seconded to grant licenses to all applicants and it was so ordered. The City Recorder reported there was a problem existing in the matter of providing chairs for members of the band at the regular band concerts. Motion was made and seconded that $75.00 be expended for purchasing,chairs with a possibility I of building a storage space for them at the base of the present stand. The question ~was placed upon roll. call, councilmen voting aye: Hanns; nay: Reid, Bond, Carlson, 39 Farrington, Koppe and Barette. The motion wa$ declared lost. . G " . _ On behalf of Mayor W. W. Chadwick of Salem, Mayor Elisha Large extended an I invitation to the City of Eugene to attend Salem's centennial celebration from July 40"'-J 31 to August 4, ,. inc. Mayor Large reported that department heads of the city had received ~m the proposed budget forms for the 1941 bUdget and the same should be completed and 41'- in the hands of the City Recorder by the 24th of this month. Councilman Hanns reported that the Water main. was being extended on West I Sixth Street to give 'service to the new plywood plant and said authority should be granted for the installation of water hydrants b~~ond Sixth Street. Upon motion made and seconded the authority was granted for the purpose of protecting the plant 42 as previously agreed upon. Upon motion the council adjourned. . C. M. Bryan City Recorder . ~
