Ii~ The minutes of the regular meeting of the Common Council held on August 12,11
" 1940 at 7:30 o'clock p.m. Mayor Elisha Large presided over the meeting. Councilmen
present were:, A. A. Reid, Sam C. Bond, Fred C. Carlson, A. C. Farrington, P. J.
~anns, Louis Koppe and A. E. Barette; absent: none. A vacancy existed from the seco d
, ,1]iWard because of the recent resignation of Councilman H. J. Cox.
;., The minutes of the previous meeting, July 22, were presented and ordered I
2 laced on file. C The meeting was herewith called to order.
IV'myor Large turned the meeting over to Commander H. Taylor of the American
Legion who introduced Harold J. Wells. Mr. Wells made a very excellent address in
presenting the American Flag which had been purchased by the City throug~he
facilities of the American Legion for the use of the Common Council in the Council
Chambers. Mayor Large, on behalf of the Common Council, accepted the flag express-
3~ing appreciation and sincere thanks for the legion's cooperation in the matter.
Councilman Farrington, Chairman of the Finance Committee, presented the
roperty offers beginning with the offer of Ford Hand, $700 cash, for Lot 12, Block
11, Hendricks Amended Addition (Southwest corner of 16th and Charnelton). The offer
is made on condition that he be allowed to build a duplex and also that the city
construct a new cement sidewalk on the Charnelton Street side of the property. It
~fas the recommendation of the Finance Committee that the offer be accepted and the
4~ eco~~endation was unanimously approved by the council.

The Finance Cormnittee recornmended a counter offer of $550 on the offer of
jw. E. Reischman, $450 cash, for the North 60 feet of Lot 11, Block 10, Driverton
~ddition (100 feet North of the Northeast corner of 19th and Hilyard). Offer con-
5,~itional on FHA Loan. The recomraendation was unanimously approved.

~450 cash, for Lot 3, Block 3, Hollenbeck Addition (52 feet south of the Southvvest -
Icorner of 14th and Washington). Offer conditional on FHA Loan. The recommendation

I The Fin~nce Committee recommended a $550 counter offer on the offer of
v. E. Reischman, ~500 cash, for Lot 1, Block 5, Hollenbeck Addition (Southeast
~orner of 15th and Washington); offer conditional on FHA Loan. The recommendation

The offer of Rugh Realty Company for client, Ernest G. Ray, $375;, $75
pash and the balance at $10.00 per month including interest at 6% for Lot 9,. Block 6,
Chambers Addition (59.7 feet east of the Southeast corner of 11th and Chambers)
ras presented with the recommendation that the offer be accepted and the recommenda-

A counter offer of $475; $75 rebate if house is started in sixty days
~as recomraended by the Finance Comnittee on the offer of W. H. Dandy, $400 cash,
~or Lot 1, Block 4, Walnut Park Addition (Southeast corner of 14th and Jefferson).

It was the recomrnendation of the Finance Comnlittee to accept the offer
of C. S. McHenry, $75 cash, for a strip of land 10 x 110 (70 feet North of the _
Northeast corner of 23rd and Agate); offer conditional on FHA Loan. The recomTIlenda- I
11 ~ion was unanimously approved.
The offer of J. W. McCracken, $650 cash, for Lot 10, Block 20, Colle~e
Hill Park Addition (120 feet North of the Northeast corner of 23rd and Lincoln);
requests refund of $50.00 at time construction of house is started was presented with
, ~he recommendation that the offer be accepted and the recommendation was unanimously

I A counter offer of $200; $40 down and $10 per month was recommended on the I
offer of Pietro LaCa1si, $150.00, $30.00 cash and the balance at $5.00 per month
blus interest at 6% for Lot 8, Block 4, Shelton's First Addition (133.6 feet North ~-
bf the Northeast corner of 2nd and Lawrence). The recomrnendation was unanimously

A $450 counter offer was extended on the offer of Elmer H. Hunt, $400;
~50 cash and the balance at $10 per month plus interest at 6%(beginning Oct. 5, 1940}
for the North 100 feet of Lot 1, Block 4, Campbell's First Addition, (Southwest
Ieorner of 7th and Polk Streets. The recommendation of the Committee was unanimously

Benjronin S. DeVries, $450; $90 cash and the balance on or before 90 days for Lot 4,
Block 25, Huddleston's Extended Addition (66.8 feet East of the South east corner
of 12th and Van Buren); conditional on FHA Loan. The recomrrlendation was unanimously tN

I It was the recommendation of theoFinance Committee that the following -
offer of Claude G. Erwin be accepted: $100 cash, for Lot 2, Block 1, Croner's
17/ Addition (55-2/3 feet West of the Southwest corner of 3rd and Tyler). The recommend -
tion was unanimously approved.
The Finance Committee presented the bills for the month of July, 1940
~ith a recommendation that they be allowed and warrants drawn to pay for the same.
The roll was called, councilmen voting aye: Reid, Bond, Carlson, Farrington, Hanns,
oppe and Barette. The- recommendation was declared approved and. the City Recorder

Counciillman Carlson presented bids for the. purchase of a truck to be used I
b~ the Sidewalk ~PA pro~ect and the E,treet Depar~ment, bids being received from Lane
~plement & Truck Co. (,~1116. 80); Sil va Chevrole~ Company, ($1181.00); and Sigloh-
Sawyer Company ($1095.00). Upon motion made and ,seconded the bids were referred to r)
19 the Street Committee with Power to act. (Note: .the bid was awarded to Sigloh-Sawye
Councilman Hanns, Chairman of the Fire and Water Committee told the council
of the need for a passenger car, preferabl~ a coupe, to be used on duty in the Fire
Department for the purpo~e of answering emergenci first aid calls and for cond~cting I
fire investigations. . Councilman Hanns pointed out that in the past it had been
customary for the Fire Chief and firemen on duty:to make these c~lls with their own
cars. Councilman Bond questioned the advisibility of purchasing a' new car and
after considerable discussion -and expression of opinion by various members of the
department, motion was made "by Councilman Reid, seconded by Councilman Hanns, IT
authorizing the Fire and Water Committee to purchase the necessary car when the mone
20"'- is available within the 1940 budget. The question being put, was unaninlously approv ed.

Councilman Hanns reported he had been called a number of times by people
inquiring why the city had not been watering the center strips of Agate and Villard
Streets. Mr. Hanns st,ated that the city had not been watering the center strips
~ 'because of equipment- breakdown, but now the equipment was repaired and the city woul

.. Councilman Bond, Chairman of the Police Committee,
I presented an ~pp11cat10n from J. A. Morgan & Carroll Kennedy, and an application
f~om Mr~. Els1e Erlandson for a Package Store Class A liquor license. A general m
d1SCUSS~0~ was had by members of th~ council participated in by Mr. Charles I. Wilso ~!~
former J01nt-owner of the Lawrence Street Grocery and Mrs. Elsie Erlandson, ,purchase ~,
of the Lawrence Street Grocery. It appeared that Mr. Wilson was requesting $500 , ~~
as the purchase price of his liquor license and inasmuch as Mrs. Erlandson was not
willing to pay it, Mr. Wilson had sold the license to Messrs. Morgan and Kennedy and
now they were asking the council for a permit to transfer the license to Messrs. "',
Morgan and Kennedy. It was the Police Committee's recommendation that both applica- ;'~~
tions be denied and the recommendation was unanimously approved. The applicants "",

Councilman Bond reported that complaints had been received from property
owners because the telephone company was installing guy wires from the poles to
23r directly in front of their residences making it a nuisance and very unsightly.
Councilman Reid recommended to the Common Council the appointment of Mr. 1. .
Stewart, to succeed Mr. H. J. Cox who had resigned from the Second Ward because of
his change in residence. Motion was made and seconded unanimously approving the
appointment and Mayor Large designated Mr. Stewart to succeed Mr. Cox on all Council

Communication was presented from Norman T. Schneider regarding the property
at 1420 West 6th Street about to be foreclosed upon for taxes. He was requesting
the city to pay the taxes and charge the same against the purchase price and he
Fould continue his payments of $10.00 per month until all obligations to the city
- 25~~ere paid in full. The request was referred to the Finance Committee.
The City Recorder reported that communication had been received from R. H.
Jotmston, Fireman, npw on active duty with the U. S. Army at Fort Lewis, in which
he stated that he had been ordered to duty with the regular army for an indefinite
26\ period of time. The communication-was ordered placed on file.
~ Communication was presented from O. T. Gilstrap in behalf of R. L. Polk and
I Company offering to supply the offices at the city hall with 1941 directories at
the price of $10.00 each. Communication was also presented. from the Valley Printing
Company offering city ,directories to the city hall offices at the price of $12.50
2~ each. Both communications were referred to the Finance Committee to report back.
Communication was presented from Mr. C. E. Gray, recommending the removal
of the three trees in the parking strip north of the library when the matter comes
fP for re-laying the sidewalk. The communication was referred to the Park Committee
228\ and the City Engineer to investig,ate and report back.
I Communication was presented from the Board of Appeals presenting the
request from A. A. Furber asking for a permit to make certain small alterations and
Irepairs to his box factory at 1385 Viillamette Street. The Board recommends that this
29- ~equest be granted and the recommendation was unanimously approved.
I 'Request was received from Marie Tinker asking for a permit to convert her
~esidence at 334 East Fifteenth Avenue into a two-family house. As there are to be

no exterior changes to the house, the Board recommends that the request be grante~,
30, ~nd the recommendation was unanimously approved.
I . Request was received from Richard Osborn asking for permission to move
fhe used car office from its present location just east of the Eugene Public Library
lito the car lot at 135 Tenth Avenue East, just east of the "Cooper" building. The
Board recommends that this request be granted for a period of one year and the
I, 31~ ~ecownendation was unanimously approyed.
, I Request was received from Ford A. Hand aSking for a permit to erect a
fiuplex residence on Lot 12, Block 11, Hendrick's Amended Addition. This lot is
[ocated on the southwest corner of the intersection of Sixteenth Avenue and Charnelto
'treet. fhe Board recommends that this request be granted, and the recommendation

I Communication was presented from Mrs. V.D. Scobert'requesting permission to
I construct houses on the west end of her lots instead of the east end as previously
33' granted and the request was referred to the Board of Appeals.

bf July showing a collection of $1,721.63 for sewage disposal charges was also presen ed

r A petition was presented from Spencer Creek Grange ~o. 85?, asking ~he city
council to remove all limit parking signs from the streets 1n res1dent sect10ns, and
~lso that two hour parking signs be placed around both parks, jail and court house

Southern Pacific Company the right tb construct a spur track over a certain portion
of Pearl Street were presented. The1resolution was unanimously adopted and the I
ordinance, upon having its first reacting, was held over until September' 9,1940 for

~ WHEREAS, There has bE~en presented to the Common Counc il
c.;1 for passage an ordinance granting the Southern Pacific Company~
~ its lessees, successors and Elssigns, as the successors in interest of
Oregon and California Railroad Company, the right to maintain a spur I
track over the following portion of Pearl Street, to-wit:
Beginning at a point on the West line of Pearl Street
in the City of Eugene, 182 feet, more or less, North of
the North line of Fi:~th Street, and running in a South-
easterly direction aoross Pearl Street, and intersecting
the east line thereof at a point 147 feet, more or less,
North of North line of said Fifth Street. All in the
City of Eugene, Lane County, Oregon.
IT IS THEREFORE RESOLVED,That the ordinance shall be
gi ven its first reading and ijheRecorder be and he is hereby ,
notified to publish the hereijo annexed notice on August 14, 21,
28th and September 4th, 1940 in the Eugene Daily News.
That the ordinance shall come up for its final hearing
on September 9, 1940, at whioh time the o'rdinance will either be
adopted or rejected.
An ordinance vacating 3rd Avenue West from Jefferson to Madison Streets
was presented for its first reading and a hearing was called. There being no
objections the ordinance passed to its second and third readings by title under
suspension of the rules by unanimous consent of the council and placed for final
passage. The ayes and nays were called, councilmen voting aye: Reid, Bond, Carlso ,
Farrington, Hanns, Koppe, and BarettElj^ nay: none. The ordinance was declared I
37' passed and numbered 8653.
An ordinance initiating the vacation of "Community Drive" was presented to
the' council for its first reading and. passed to its second and third readings by
title under suspension of the rules by unanimous consent of the council,~and placed
for final passage. The ayes and nay::: were called, councilmen voting aye,: Reid,
Bond, Carlson, Farrington, Hanns , Koppe and Barettej nay: none. The ordinance was
38 declared passed and numbered 8654.
Applications for a Second-Hand Dealers License were presented from R. A.
Narks of the OK Tire Welding Shop; Vern Smith of VernIs Tire Shopf R. R. Fenn of
Fenn's Tire Shop;- and Mothe 1" s Boys' Home. An application was presented from
Mrs. Walter Coakes for a Rooming and Boarding House. As all applications had been
approved by the Chief of Police, motion was made and seconded approving the applica-
39 tions and the City Recorder was instructed to issue licenses to all applicants.
The following curb cut applications were presented with the Engineer's
recommendation that they be approved: No. 775 for James PeeblesfHo. 776 for
Charles BullivantjVNo. 777 for Ward Johnstonr No. 778 for Paul Hoven~ and No.
779 for Clyde McDougall~ An application f;or a curb cut was presented from J. A.
Morgan. The City Engineer recormnended one cut on 11th Avenue as sho~m on sketch,
a cut of 30 feet. The recommendations of the City Engineer were unanimously

",The City Engineer presented a blue print map showing the recommendations I
of the curb cuts for the Firestone Station at 11th and Pearl Streets. It was
referred to the Street Committee.
The City Recorder presented a bid from Chase Company for the installation
of a new heating system in the Fire Department as per specifications for the price
of $595.00. Councilman Hanns, recommended that the bid be accepted and Councilman
42' Bond seconded the motion. It was unanimously approved.
