Stewart. 1 The minutes of the previous meeting, August 26, 1940, were presented 2- rnd ordered placed on file. The meeting was herewith called to order. . The City Recorder presented a communication from the NYA in which they ~equested permission to construct additional units behi~d Skinner Butte Park for the ~urpose of meeting a demand for your~ men desiring to take training at the Eugene ~ocational School and the various work activities offered by the NYA, with the ~rovision that they retain the right to r~move property of salvage or use value. at was the recommendation of the Park Committee ,that the council give their approval 3" ~o this project and upon motion made and seconded the recommendation was unanimously approved. Out of order of business Mayor Large called for the curb cut applications. The following applications were presented and recommendations of the City Engineer ~pproved: No. 789 for Clyde MCDougalV(ap1roved}; No. 787 for W. C. VOlz~(afproved); iNo. 788 for Charles Snellstrom; (approved ; and no. 791 for Hazel FishwooCt"' approved). ~ application for a curb cut from Simmons-K~ndall Company for a pUblic garage at Q3th and Olive Streets was presented. The City Engineer reported that the cut was necessary as the new building is at present designed and is now under construction. ~ motion to approve the request was made by Councilman Carlson and seconded by pouncilman Barette. Councilman Carlson explained that as to. the cut on 13th Street he believed the same could be adjusted but that the request for a 70 foot cut was necessary from a safety-first point of view. The City Engineer's Department had approved the building plans and specifications and had issued a building permit which ~alled for this amount of cut. It was'further pointed out by members of the council ~hat this policy of issuing building permits which showed that the curb cut applica- -- I ~ions would have to be approved by the council should be changed and such applications held in abeyance until after the council's action upon the request ~f the durb cut. Councilman Barette withdrew his second to the motion. Councilman iHanns made a motion seconded by Councilman Bond to refer the matter to the Street !Pommittee with power to act. The ayes and nays were called, councilmen voting aye: Bond, Carlson, Farrington, and Hanns; nay: Reid, Koppe, Barette and Stewart. The 4~ ~esult being a tie, Mayor Large voted aye and the motion was declared carried. I Counuilman Farrington, Chairman,of the Finance Committee, presented the property offers befinning with the offer of Gertrude Kay, $400 cash, for Lot 1, Block 3, phambers Addition 116 feet East of the Southeast corner of 11th Avenue and Polk Street). Intends to build. The Finance Committee recommended a counter offer of I ' ~500 with $50 returnable if construction of a house starts within sixty days. The ~ recommendation was unanimously approved. I Offer' of R. L. Dixson, $450 cash, for Lot 6, Block 5"Driverton Addition (Nor h- rest corner of 18th Avenue and Mill Street) was presented. He intends to build about ~ $3500 residence. It was the recommendation of the Finance Committee that the offer 6/ be accepted and it was unanimously approved. - I Offer of S. A. Mogan, $600 cash, for Lots 1 to 6 inClusive" Block 3, proner's Addition (3rd Avenue between Taylor and Almaden Streets) was presented. Wil start construction within five days. The Finance Committee recommended a counter ';' 7 - bffer of $900 and the recommendation was unanimously approved. I I It was the recommendation of the Finance Committee to accept the offer of ~. E. The recommendation was unanimously approved. I ,Offer of H. E. Cully for clients, Roy L. and Lillian Ray was presented; $1800; $500 down and the balance at $25.00 per month plus interest at 6% for the West 26.4 feet of Lot 3 and all of 4 and 5, Block 3, Whitney's Addition (Southeast corner 1 bf 16th Avenue and Olive Street). ,Plans to build 12 family unit on each half of property. The recommendation was unanimously approved. Offer of C. F. Hyde for clients, W. K. and Florence L. Hamilton; $500, $100 down and the balance on or before 90 days for Lot 7, Block 7, Huddlestons Amended ~ Addition (66.8,feet east of the Northeast corner of 12th Avenue and Monroe Street) I was presented. Intends to start construction within 90 days. This offer was , rejected because of a previous offer for the same property from H. E. Cully for 14~ clients Mrs. Rhea M. Larwood. The. 16 recommendation was unanimously 'approved. . Offer of EveardFish,- $425 cash' for the East 60 feet of Lot 1, Block 3, Kelseys .Addition, corner of 15th and Ferry, was presented. He requests the city to rebuild the sidewalks and grant permission to build wi thin 15 feet of Ferry Street. .. , It was the recommendation of the Finance Committee that this offer be accepted leaving the sidewalks as they are and the set back to be made by the Building 17- Inspector and the recommend at ion was approved. Offer of Dale Fischer, $500 each for Lots 26 and 27, Fairmount Heights on , Longview Drive was presented. Will pay $250 down and the balance in four or five .:~~ ,: I years to suit the city's judgment. Will pay usual interest charges and take care , of current tax~s. City to furnish title insurance. Plans to build on these lots in keeping with the surrounding property within a year or shortly after. It was the recommendation of the Finance Comrnittee that the offer be accepted with the stip la- ) tion that the balance be made in 18 months with the usual rate of interest and the 18 recommendation was unanimously approved. Offer was presented from Guistina Bros. $75 cash for Lot 8, Block 3, Blair __ Street Addition. The Council approved the Finance Committee's recommendation to acc pt .i. 19 the offer. Offer was presented from C. J. Gottschim for client, J. C. Watts, $650 cash for the North 100 feet of Lots 1 and 2, Block 2, Lills Addition, if clear title can be delivered in ten days. A right-of-way be granted the remainder of these lots for sewer. The Finance Committee recommended a counter offer of $750 for the proper y ~ and the sewer ~estion to be held in abeyance. Councilman Farrington presented the bills for the month of August, 1940 I with a recommendation that they be allowed and warrants be drawn in payment of the' same. Mayor Large stated he had contacted the City Engineer, W. C. Clubb, and it was their opinion that the Fire Department could get by this year by paving enough to tak~ . care of the furnace and fuel storage. Councilman Hanns pointed out that to complete the job now would take only an additional $?5 material and Councilman Carlson stated that the Street Department would furnish equipment and labor to pave the whole 23.1. thing. Motion was made and seconded to draw upon the emergency fund for the purpose of buying sufficient material to pave" the entire room, and it was so ordered. Becuase of the recent absence of Councilman Stewart, Councilman Barette made thereport"on behalf of the Health Committee stating that a number' of 'calls had been. received concerning tne promiscuous parking of trailer houses for various lengt'h.s at a time. Mayor Large suggested that maybe this could be controlled by requiring a license. After short discussion the matter was left in the hands of the I 24 'ifHeal th Committee. Oommunication was presented from the Board of Appeals presenting a request from A. P. Miller to erect a service station on the southeast corner of 11th and 25' ~erry Streets. The Board recommends that this Tequest be denied and motion was kade and seconded unanimously approving the recommendation. I Request was received from Joe Akin to e'rect a duplex residence ~t 1432 Moss ptreet which is in the Single-Family zone. The building to be stmilar to the one ~uilt by Hargreaves at 534 East 15th Avenue. The Board of Appeals recommends that 26~ fhis request be denied and motion was made and 'seconded unanimously approving 'the Ire c ommend at ion of the Board. ' I Request was received from Ford-Nelson ~ill Company to erect their Ford's : Kozy Kabins within the City limits. The foundations, girders, joist, floorlining, ~afters, sheeting, shingles, etc. to be in accordance with the ordinance of said Icity and the walls and partitions to be of their patented type and all to be under Ithe "direction of the city Building Irispe'ctor. Brown petitioning the council forperm~ssion to use a public address system kounted on a car and also to erect a canvas tab~rnacle for the purpos~ of conducting :religious services for at least two weeks and not more than a month. I~yor Large _ ~eported that the request for a loud speaker mo~nted on a ~ar was denied. The ordinance was ~~ 3201 declared passed and numbered 8655. .;.~ An Ordinance directing the City Recorder to place two charter amendments upo the general election ballot (swimming pool and airport) was presented to the council for its first reading and passed to its second and third readings by title by unanimous consent of the council under suspension of the rules and placed for I final passage. Councilmen voting aye: Reid, Bond, Farrington, Hanns, Koppe, Barett , and Stewart; na~: none; absent: Carlson. The ordinance was declared passed and 33 numbered 8656. An application for a Second-Hand Dealers 'license was presented from J. E. Moore of Dinty's Trading Post, 120 West 8th Street. As the application had been approved by the Chief of Police, motion was made and seconded to grant a license 3r and it was so ordered. The City Recorder stated that the Veterans of Foreign Wars organization in the city was attempting to have all business firms renew their flag decorations for their curb line and would like to have the City of Eugene purchase a flag and staff to display at the City Hall on special occasions. Upon motion made 'and seconded the City Recorder was instructed to purchase a flag and staff, the purchase price 35..... to be $4.95, and it was so ordered. Councilman Reid asked for a discussion regarding the overflowing of septic tanks in the neighborhood of '25th and Chula Vista' which created a very definite heal menace and asked the council-' s permission to installl50 feet of six inch sewer to ~rovide city sewerage for the property in question. He further pointed out that this ~roperty had been assessed for sewerage and funds were available., After a short 36"'- ~iscussion motion was made and seconded approving the request to install a sewer. City Attorney Calkins raised a question concerning the Swafford property. It was learned that the city had sold Lot 9, Block 6, Chambers Addition. In I securing the title to the property for the tax sale it was found that Whitten Swaffo had been the former owner. Mr. Swafford demanded $50 for a quit claim deed. This Qot had been lost in the Lane County tax sale for the year 1935 and the City had bot foreclosed on their liens. JUdge Skipworth, has held there are some irregular1tie lin the 1935 tax sale and the City Attorney doubts if he could secure a title if, in a suit to quiet title, Swafford opposes it. The matter was referred to the Finance IComm1ttee to determine whether to pay $50 for a quit claim deed or if the city should take more time which would probably be a year to foreclose on our liens and 37 v 'acquire ti tIe that way. I S. M. Calkins, City Attorney, stated that D~~ ~rown, operating in the county !health unit, had served a notice on Mrs. Emily,J-. Lowry informin~ her she would have ~o make a sewer connection at her r~s.idence ~ocated at 19th and effer~on Streets. It was learned that Mrs. Lowry is a very elderly lady and has no visible...means of ~upport and cannot afford to install a sewer. Residents in the neighborhood entered a vigorous complaint on the practice now being followed. The matter was referred ~o the Sewer Committee to report back at the next meeting as to what method could be 38 .... iUsed to connect this property with the ci ty sewer. . City Attorney Calkins presented to the ~ayor and Common Council an order ~rom the Lane County Court granting to the City of Eugene, in behalf of the ~berdeen Plywood Corporation, an easement and franchise to,'lay down and maintain on 39~ ~he south side of Second Avenue West an eight inch sanitary sewer. North line of 11th Avenue West 231.39 feet more or less to the place of beginning, in Eugene, Lane County, Oregon. 1j with an agreement and understanding that the city should retain the r~ght without cost to widen the street to the extent of the set-back line, and I WHEREAS, On June 24, 1940 the city executed a deed to Joseph A. Morgan and Carroll Kennedy incorrectly delineating this reservation; Now, Therefore, the Mayor and Recorder be and they are hereby directed to re-execute and deliver a deed, a copy of which is hereto attached, showing the agreement as it actual~y existed.
