'--' Councilmen present were; A. A. Reid, Sam C. Bond, Fred C. Carlson, A. C. ,Farring- 1l.ton, Louis Koppe, E. A. Barette and Ira 6. Stewar~; absent: P. J. Hanns. The minutes of the previous meeting were presented and ordered placed on 2M'ile. The meeting was herewith called to order. The Recorder was requested to read the resolution directing the Mayor I and City Recorder to execute on behalf of the City of Eugene a contract wi th the Bethel Rural Fire Protection District. Motion was made, seconded and duly carried that the adoption of .the resolution be placed upon roll call. The ayes and nays were called; councilmen voting aye: Reid, Bond, Carlson, Farrington, Hanns, Koppe, Barette and Stewart; nay: none; absent: P. J. Hanns. The motion was, declared unanimously approved and theresolution duly adopted. Attorney S. M. Calkins further explained that in case of injury to firemen on call to such fire districts that they were protected under the State Industrial Accident Commission and further, that in the event of any property damage being inflicted by reason of such fire service that the city would not be liable. Mr. Day T. Bayly, Attorney representing the Bethel Fire District, explained that the assessed valuation at 3 the present time was approximately $178,000.00. (Resolution typed at end of minutes) Mr. Henry Ryan addressed the council. asking for a permit to build another house on his lot located on West 11th Street. ~he Board of Appeals recommended that the request be denied. The City Attorney stated that he could give no opinion on this subject but he would have to have'time to study the same. Councilman Bond made a motion that the request be approved but the motion was lost because it was not seconded. Motion was made and seconded to adopt the report of the Board of Appeals in this matter. As a result of the discussion, the question was placed upon roll call, councilmen voting aye: Carlson and Barette; nay: Reid, Bond, Farrington, Koppe and Stewart; absent: Hanns. The motion was declared lost. Finally, a motion was made by Councilman Farrington and seconded by Councilman "~.\ Stewart that the matter be referred to the City Attorney and Judiciary Committee I to report back at the next meeting~ The ayes and nays were called, Councilmen voting aye: Reid, Bond, Carlson, farrington, Koppe, Barette and Stewart; nay: none; I absent: Hanns. The motion was decfared carried and a report expected at the next 4 meeting. Councilman Farrington, Chair.manof the Finance C~mmittee, presented the property offers beginning with the offer of E. N. Hopper, $25.00 cash, for a strip of land 21 feet on the South side of Second Avenue West and 140 feet on West vSide of Taylor. The Finance Committee recommended a $75 counter offer and motion 5 was made and seconded unanimously approving the recommendation of the Board. The Finance Committee recommended the rejection of the offer of M. A. Schweppe $350.00 cash, for the North 50 feet of Lots 7 and 8, Block 1, Lills Addition t89.04)feet North of the Northeast corner of Broadway and Polk Streets); ,J intends to start construction of house within ninety days. The recommendation 6 of the Finance Committee was unanimously approved. The offer of A. S. Hilton, $1000.00 cash, for Lot 6 and the West 24.~ feet of Lot 7, Block 3, Wallis-Dorriss Addition (Northeast corner of 11th and ~olk ~Streets) was presented. A counter offer of $1225 was recommended by the Finance 7 Committee and unanimously approved by the Council. The offer of K. D. Gilbert $400 cash, for the West 100 feet of Lot 8, Block 2, College Hill Park Addition t60 feet South of the Southeast corner of 19th and LincolnnStreets) was presented. He intends to build within 90 days on I condition of an F.R.A. Loan. The Finance Committee recommended that the offer be ~accepted if construction is started within ninety days. The council'approved the 8 recommendation of the Finance Committee. ~ The offer of Richard R. Rouw, $325.00 cash, for Lot 10, Block 8, College Hill Park Addition (120 feet North of the Northeast corner of 21st and Lincoln Streets) was presented. The Finance Committee recommended the acceptance of the 910ffer and the recommendation was unanimously approved by the council. "1'"" The offer of Mrs. O. J. Pedersen, $400 cash, for the South 60 feet . of the North 110 feet of Lots 8 and 9, bloc~ 4, Driverton Addition {50 feet North ' - of the Northeast corner of 18th and Mill Streets}; intends to build h~use at once, was presented. The Finance Committee recommended a counter offer of $450 and the 10~recommendation was unanimously approved. The Finance Committee recommended a counter offer of $450 on the offer of Cecil B. Reporting on the purchase of city directories for the city offices as per th offer I!l% <Df the Valley Printing Company at $12.50 for each directory and the offer of Polk and Cothpany at $10.00. for each directory, the Finance Committee recommended that the City 1 Recorder purchase six directoreis from Polk and Company at the cost of $10.00 each. Motion was made and seconded to accept the recommendation of the Finance Committee a d I all councilmen voted aye with the exception of councilman Stewart who voted no. Councilman Farrington reported that Mr: Joseph Harrell, Manager of the Airpo t, had talked of constructing a shop and hangar at' the airport at his own expense but wished an option on the lot on which the building stands or be reimbursed in some ma in case the airport should be discontinued. The Recorder read a communication from Joseph Harrell in support of the request. After a short discussion motion was made and seconded to refer the matter to the Finance' and Judiciary' Committees and it was I 15 ordered. Councilman Carlson, Chairman of the Street Committee, reported that there wa needed by the Street and Sewer Departments a heavy duty flat bottom trailer to trans their gas shovel and steam roller, and pointed out that it was now possible to purchase a used trailer for $750 f.o.b. Portland. Councilman Reid stated that fund~ were available within the Street Department for the purchase of the same. It was h1 opinion that the trailer shpuld be purchased an~ he made a motion, seconded by Coun~ man, Carlson authorizing the purchase of the equipment. It was declared unanimously approved. I Councilman Carlson stated it was his understanding there were provisions to prevent the burning of leaves, etc. upon the approved streets of the City of ,1:,,:) Eugene and if that were correct he felt that notice should be given to the people ~.J of the city that the ordinance would be enforced. He further requested the .l; -;, ',w 17 newspapers to give this matter publicity. '" The Board of Appeals reported receiving a request from Mildred Ryan aSking for a permit to erect a residence on the rear of her lot at 950 11th Avenue West. This house would still be within the 30% coverage limit of the lot as originally purchased. However, the Board recommends that the request be denied. This I I request was presented at the beginning of the meeting, Par. 4, and referred to the 18 City Attorney and Judiciary' Committee. Request was received from A. H. Wishart aSking permission to place a lunch car on the vacant spot at the end of the Oregon Feed and Seed Store at Fifth and High Streets, the sink to be connected to water and sewer. The Board recommends that the request be granted' on condition that the car be left on the wheels and that he take out a building permit. Motion was made and seconded 19v- unanimously approving the recommendation of the Board of Appeals. Request was received from Charles L. Paine asking for the re-zoning of the lot at the south-east corner of the intersection of Olive Street and 13th Avenue, the house to be moved off and the lot used as a used-car market. The Board recommen s that this request be denied. Councilman Bond spoke in behalf of allowing the used car lot to go in on this corner. Councilmen Carlson and Barette spoke in favor of the Board of Appeals recommendation. Councilman Farrington made a motion seconded by Councilman Stewart to accept the recommendation of the Board of Appeals 20- and the motion was duly carried. Hence the request was denied. A request was received from Jmues A. Rodman asking for a waiver of required "set-back" on 21st Avenue on the west side of University Street to' permit the erection of a new home. This request is accompanied by a recommendation from E. R. Bryson and Robert W. Prescot, owners of adjoining property. The Bbard recommends 21/ that this request be granted and motion was made and seconded unanimoUSly approving I the recommendation of the Board. In regard to the piece of property at the southwest corner of the inter- section of Fifteenth Avenue and Ferry Street, sold by the City to Mr. Eveard Fish, the Board is recommending that he be allowed a waiver of the set-back on Ferry Stree to Fifteen feet. Motion was made and seconded unanimously approving the recomrnenda- 22"- tion of the Board. Request was received from Goldie A. Burkhart asking for permission to conduct her beauty parlor business in the residence at the southwest corner of the intersection of 11th Avenue and Jefferson Street. ' As this is in the multiple family zone, the Board recommends that this request be refused. Motion was made and second d 23 unanimously approving the recommendation of the Board. Par 24 is below 25 Request was received from Lyle Burdick asking for a permit to remodel his residence at 1262 West Fifth Avenue into two apartments, the only exterior change being to enclose a part of the front porch. The Board recommends that this request be denied. Councilman Farrington spoke in behalf of granting the request. City Engineer Clubb reported that the Board of Appeals had denied the request because of the good quality of adjacent residences within the district. Councilman Farring- ton replied that at least six property owners immediately adjacent to the Burd~ck property approved granting the request. Councilman Stewart spoke favorably of the request and stated that'several neighbors had stated they had no objections to the construction. Councilman Farrington made a motion seconded by Stewart that the request should be granted and upon a call for the question, all councilmen present I voted aye with the exception of Councilman Carlson who voted no. The request was 25 declared granted. Request was received from Roy V. Baldwin for the World War Veterans State Aid Commission asking for a permit to convert the house at 1404 Twenty-First Avenue East into a four apartment house. The Board recommends that this request be 24... denied. Motion was made and seconded approving the recommendation of the Board. Communication was presented signed by E. R. Frank and J. L. Reynolds I requesting the council's consideration in the rezoning of East Broadway West from the Mill Race to High Street to allow business structures in-this area. A resolutio transmitting to the Planning Commission a proposal to change the classification of this area and directing the Planning Commission to adopt a tentative report and to hold hearing thereon, was presented and upon motion made and seconded it was 2tf unanimously adopted. Councilman Stewart stated that he wishe~ to be heard when the proper time came for hearing of this request. Commission of the City of Eugene a proposal to change, the I.. ~,: classification of an area from High Street to the millrace on East Broadway, including'160 feet deep on each side on East Broadway, in Eugene, Lane County, Oregon, from a multiple residence zone to a business district. And directing the Planning Commission to adopt a ten- tative report; and to hold a hearing thereon in the Council Chambers in the City Hall of the City of Eugene, on Tuesday, . the 22nd day of October, 1940, at 7:30 o'clock p.m. after giv~ng 1 due notice by publication once in the Eugene Register Guard, and they shall thereafter make a final report and transmit the same to the Council with their recommendation~ Communication was presented from C. L. Kelly, manager of the Miner Building, requesting that a revision be made in the electrical light signs in the City of Eugene. The matter was referred to the Fire and Water Committee to study and report 27 back. Communication was presented from' J. Edgar Hoover, Director of the Federal Bureau of Investigation, expressing his pleasure in presenting to Mr. Leonard Kearney of the Eugene Police Department a certificate as evidence of his satisfactor _ completion of the twelve weeks' course of training in Washington, D. C. in the 28 FBI National Police ~ademy. The communication was ordered placed on file. Communication was presented from Louis Waldorf calling the council's attention to the bad sidewalk condition on the south side of East 11th Avenue from the library corner to the alley one-half block east. The matter was referred to 29 the City Engineer. A written acceptance of Ordinance No. 8655 from the Southern Pacific 30 Company was presented and.ordered placed on file. Request was received from the Associated Students of the University of I Oregon asking the council's permission to use a street banner across Willamette Street, between Miller's Store and the Cafe Del Rey, for each of the five concert attractions as well aS,for the season ticket ,sale, Motion was made and seconded 31 unanimously approving the request. Mr. Norwald Nelson of 327 East 15th Street addres~ed the council making a claim of $50.00 for dalnages done to the walnut trees and $3.00 for the loss of nuts because of the tree trimming done by Charles Sullivan, Supt. of Parks under the direction of Councilman Barette, Chairman of the Park Committee. Mr. Nelson stated that Councilman Barette had made insulting remarks to his mother-in-law, Mrs. Stalsberg. Mr. Nelson pointed out that the trimming of trees in order to provide beautiful trees and thus beautiful streets had to be done properly and certainly it was not right to trim walnut trees at this time of the year. Councilman Barette stated that he had not made any insulting remarks to Mrs. Stalsberg and he felt the trimming which was done was a distinct improvement and it was his intention, as far as his authority permitted, to continue improving the streets by proper tree trimming. Councilmen Farringto~nd Bond both spoke in support of and in behalf of Councilman Barette. Councilman Farrington made a motion to refer this to the City Attorney and the Judiciary Committee. Upon the suggestion of the Mayor that this was not the proper place for this request the motion was withdrawn. Upon motio ,made and seconded damage claim of $50.00 for the tree and $3.00 for walnuts was 3Z denied and it was so ordered. Monthly repo~ts were presented from the following departments: Police, Police Matron~ City Engineer and Building Inspector; and a statement of cement I sidewalk repairs was presented. A report of sewage disposal collections from the Eugene Water Board revealed a tota~ of $1,53~.60 for the month of September, bringing the total collections to $31,690.09. All reports were ordered placed on 33 file. A petition asking the council to immediately remedy and fix up a deteriorate cement wall between 2nd and 3rd Avenues on Pearl Street which was erected for the purpose of maintaining the structures in Pearl Street was presented and referred I 34 to the Street Committee. Communication was presented from the Planning Commission requesting that the council submit to the Planning Commission a direction to hold hearings upon a proposed change of Lots 71, 72, 73, and 74, Foster's Addition to Eugene, Lane County, Oregon, from a single family re$idence district to a light industrial district, this being the DeCou property. I The following curb cut applications were presented: No. 799 for N. C. Koch; No. 800 for M. P. Fraleyf No. 802 for J. C. Watts; and No. 803 for R. A. Denney.-/ As the City Engineer recommended granting the reque sts, motion was made and seconded to grant licenses for curb cuts and it was so ordered. A curb cut application was presented from Safeway Stores for a cut of 17 feet. As the plans and specifications had not been received by the City Engineer in time to to make 36 a recornnendation, this application was held up until the next council meeting. Communication was presented from Councilman p. J. Hanns tendering his resign - tion from Ward #1 to take effect on October 14, 1940. Mayor Large expressed his regret of having to accept the same. Councilman Reid made a motion, seconded by Councilman Farrington to accept the resignation. All Councilmen present voting yes 37",. with the 'exception of Councilmen Carlson and Stewart. ~~~~ At this time Mayor Elisha Large~amed Mrs. P. W. Brown to fill the unexpired term created in the Planning Cemmissi0ft by' the death of E. O. Potter.
