I cr"" The minutes of the adjourned meeting of the Common Council held in the Council Chamb.ers on October 28, 1940 at 7:30 o'clock p,m. Mayor Elisha Large presided over the meeting. Councilmen present were: A. A. Reid, Sam C. Bond, 1 Fred C. Carlson, A. C. Farrington, Louis Koppe, E. A. Barette and Ira O. Stewart. A vacancy existed from the First Ward because of the recent resignation of Council- man Hanns. 2 (. . The minutes of the previ9us meeting were presented and ordered placed I on fl1e. The meeting was,h~rewith called to order. Mayor Large presented Patrolman Leonard Kearney who gave a report on his recent twelve week's of training under the supervision of the Federal Bureau of Investigation in Washington, D. C. Officer Kearney stated that the city's 3~investment would return dividends. . > Commu~ication was presented from Mr. Day T. Bayly, spokesman for the PTA Comml~tee maklng the following suggestions for improvements in the traffic safety campalgn: . 1st That all car parking be prohibited, during school hours for one- half block or more in front of each city school so that if any child' should venture ~nto the str~et, i~ would ~ot be from between parked cars, and so that parents bring lng and gettlng chl1dren wl11 not have to double park, while loading or unloading. 2nd That the city put on its program for installation within a year or so regular stop lights for the intersection of 13th and Willamette because that inter~ i section has become very busy and many schQol children cross there. 3rd Suggest th~ installation of the following stop signs: Stop signs on Olive and Charnel ton at 13th; stop signs on Railroad Avenue at Grand and a 5-way stop at 8th, Blair and Monroe Streets. 4th Enforcement of pedestrian right-of-way at intersections. I Mayor Large stated that arrangements for the installation of traffic signals at 13th and Willamette had already been taken care of. Mr. Raymond Walsh, representin the traffic safety committee at the Eugene High School addressed the council aSking that the parking area in front of and on each side of the high school be restricted; also the installation of four-way stop signs at the intersections of 17th and Lincol and 17th and Charnel ton Streets. Mayor Large pledged the support of the 00 uncil in ; the regulation and control of traffic and asked in return the cooperation of the -.I PTA and other civic organizations. Mayor Large also asked the correction of the 4 traffic law in the next session of the Oregon State legislature. Mr. Arthur Hendershott addressed the council making a request for the use of space on the second floor of the city maintenance building at 5th and Olive Streets for the purpose of rifle and pistol practice in conjunction with the Eugene Police Department. Councilman Carlson, Chairman of the Street Committee, stated he Ihad investigated the request and found that space could be made available and would recommend granting the request. Motion was made and seconded unanimously approving 5 the recommendation to grant the request. Herman Hendershott, local attorney, addressed the council requesting the council to grant a transfer of ownership of Package Store Class A License from Thomas L. Lawhorneoc and Charles I. Wilson at the Lawrence Street Grocery, 395 West 11th Street to Mrs. Elsie M. Erlandson. The Police Committee had no recommendation or comment to make and the matter was held in abeyance. At the request of Herman }Hendershott the letter from Mrs. Erlandson addressed to the City Council was not I 6 read but placed on file. Concerning the request of Henry Ryan for a permit to build another house on his lot on West 11th, which was referred to the Judiciary Committee and City Atto - ney, Councilman Koppe, Chairman of the Judiciary Committee reported that the Ryans prior to any building beind done, had acquired one lot and 22 feet off from another. They had, heretofore and prior to the passage of the ordinance fixing the proportion ate areas of buildings to lots, made an application to the City Council, which was granted, permitting them to build a ser~es of sma~l buildings consisting of what. is I ordinarily called a court. These buildlngs constltuted a departure from the zonlng ordinance in that this was a single family residence zone. Subsequent to that the proportionate building area ordinance was passed and the court, together with the ho se already on the property, constitutes all of the structures that can be placed on that amount of area of land, and the area of the proposed extra building will be a violation of the proportionate area ordinance. It seemed to the committee and the uted City Attorney that in view of the permission heretofore g~ven, wh~ch ~ctually consti the violation, that it would be inequitable for the Councll at thlS tlme to refuse the permit for the building extending the court, and therefore recoF~ended to the council that it instruct the Building Inspector to issue a permit. Counciiliman Farrington reported that at this time the committee had no 8/ recomrrlendation to make on this offer. Offer of Ralph Arensmeier, $300 cash, for the south 60 feet of Lots 1 and 2, Block 6, Croners Addition (100 feet south of the Southwest corner of 4th Avenue and Taylor Street); conditional on FHA Loan was presented. The ]'inance Pornmittee recommended that the offer be accepted and motion was made and seconded unanimously I 9/ approving the recommendation of the Finance Committee. Offer of George Foster, ~~200, $10.00 down and $30.00 within 30 days and the balance at $10.00 per month plus interest at 6% for Lot 8, Block 4, Shelton's First Addition (133.6 feet north of the northeast corner of 2nd Avenue and Lawrence Street) was presented. The Finance Committee recommended that the offer be accepted and motion was made and seconded unanimously approving the recommendation of the 10 c ommi t tee. 'rhe Finance CSlDlillittee reconuJJ.ended the acceptance of the offer of E. H. Peterson for client, $110.00 cash, for Lot 2, Block 7, Riverwood Addition (61.04) feet North of the Northeast corner of Clark Avenue and Ash Street). Motion was 11/ made and seconded unanimously approving the recommendation of the committe~; i, 'rhe Finance Co~nittee recommended the denial of the offer of Edward L. Ryan, $400 cash, for Lot 9 and the South 30 feet of Lot 8, Block 3, Rugh's Addition / (Northwest corner of 24th Avenue and rocMillan Street). Motion was made and seconded 12 unanimously approving the recomrrlendation of the committee. Offer of Mrs. Leonard Anderson, $110.00, $25.00 down and the balance at $10. 0 per month including interest at 6% for Lot 2, Block 7, Rivenvood Addition (61.04 feet North of the northeast corner of Clark Avenue and Ash Street) was presented. As this offer came in after the offer submitted by E. H. Peterson, the Finance Committee recomraended that the offer be rejected and motion was made and seconded 13/' unanimously approving the recomrrlendation. I Councilman Farrington requested until the next council meeting to report on the request of Joe Harrell regarding construction of an additional hangar at the l~ airport. The request was granted. Councilman Carlson, chairman of the Street Committee, reported that he had witnessed a demonstration of one street sweeper and wished to investigate other .. offers before making a recommendation. Anyway,. funds would not be availa~e unt~l 15" 1941 for the purchase of the same.(~ c,(..4-~..............I"'-//~~ ~.) Councilman Barette, Chairman of the Parks Committee, stated that trees were still being trimrrred and he wished to inform the members of the council that 16- residents were being consulted before any trimming was done. Mayor Elisha Large stated that Clarence Simon, representing the veterans organization, requested a permit from the Common Council to hold the usual 17~ Armistice day parade. Motion was made and seconded unanimously approving the reques . [1. Communication was presented from the Board of Appeals presenting a request from E. F. McBe~ asking for a permit to extend his house at 603 19th Avenue West /23 feet east to the property line in order to make additional room for the grocery jstore already operating on the property. As this is in the single family zone ,the Board considers that this addition would make a traffic hazard on a much travele street and therefor recommends that the request be denied. Motion was made and 18v 'seconded unanimously approving the recommendation of the Board. I Request was received from W. F. Guske asking for a permit to remodel part of a house at 414 East 15th Avenue into a small cpartment for the use of his parents, eventually to be used for rental purposes. The Board recommends th~t the request be granted on condition that the plans meet the approval of the Building Departlnent. 19'-' Motion was made and seconded unanimously approving the recommendation of the Board. Request was received from Mr. and Mrs. S~ C. Sunderland asking for permissio to place the lunch trailer, that was spotted in Skinner Butte Park last summer, on I the parking lot just south of the Public Market, to be located on the east side of Charnelton'Street just south of the alley. The Board recorunends that the request be granted on condition that the trailer be left on its wheels and to be connected to the sewer. Q,ueBtion was raised concerning the granting of this request by Councilmen Bond and Reid. Upon motion made and seconded the recoIT.J.mendation of the , 20/ Board was not upheld and the request was denied. Communication waS presented from Mrs. Emrr~ Moxley who lives at the corner of 13th and Olive, complaining that her property is now being used at all times as a garage for cars and she has no ingress or egress to and from her prope:ty. She wo Id be very glad to hear from the council as to whether or not she has the r~ght of ingress and egress to her ovm property, and if so, how she can enf orce it. Cramer, Supt. of Eugene Public I ij~j Schools, requesting the city to give school district No. 4 first chance to make an "J;; offer on Lot 14, Block 2, Sladden's Addition, on lv~onroe Street. The request was ~ referred to the Finance Committee. Communication was presented from the Civil Service Commission stating that probationers Carl CuddebackJand Burton Davis; Firemen and probationers J.T.H. Cullender"'and C. P. Lindsay~ Patrolmen, had successfully passed their probationary and physical fitness requirements and recommended that they receive permanent appointment in their respective departments. Motion was made and seconded unanimous y I approving the recornnendation of the commission. (note: Carl Cuddeback is employed 2:1 during the leave of absence of Robert H. J?hnston, Fireman. Mr. Johnston is now with the U. S. Army at Fort Lewis, Wn.) . A report for the month of August was presented from the Eugene P blic Librar 24'- and ordered placed on ,file. ' " Upon motion made and seconded the council dismissed the proposed opening 25'- of Van Buren Street extending 160 feet south of the south line of West 13th Avenue, and it was so ordered. Communication was read from the City Planning Commission adopting as its permanent r~port the tentative report changing the classification of Lots 71, 72, 73 and. 74, Foster's Addition from a single family residence district to a light industrial district. Upon motion made and seconded it was unanimously approved. An ordinance amending Ordinance 8413 incorporating this classification change in Foster's Addition was pres~nted and had its first reading and held over. A resolu- tion directing the City Recorder to publish in the Register Guard not less than three times a notice of a hearipg on th~ proposed change to be ~eld at the regular '. council meeting on November 12, was presented and upon mbtion made and seconded - 26" unanimously adopted. .... At this time there came up for public hearing and consideration I by the City Planning Commission a proposal to change the classification of Lots 71, 72, 73 and 74, Foster's Addition to Eugene, Lane County, Oregon, from a single family residence district to a light industrial district, and there being no objections to the proposed change and the City Planning Commission having under consideration its tentative report thereon, the said tentative report is hereby adopted and made the permanent report of the Planning Commission, and the Secretary is directed ,to transmit the same to the Common Council of the City of Eugene to hold further hearings thereon. .~' f PERMANENT REPORT UPON THE REDISTRICTING OF LOTS . 71, 72, 73, and 74, FOSTER'S ADDITION TO EUGENE, LANE COUNTY, OREGON. -.J' , I 0 As a permanent report pursuant to Resolution of the Common Council of the City of Eugene directing the City Planning Commission to prepare a report upon the redistricting of a certain area in the cityt the City Planning Commission hereby adopts as its permanent report to be submitted at a public hearing to be held in the Council Chambers in the City Hall r of the City of Eugen~, at 7:30 o'clock p.m. of October 22, 1940, the following proposed change: - A proposal to change the classification of Lots 71, 72, I 73 and 74, Foster's Addition to Eugene, Lane County, Oregon, from a single family residence district to a light industrial district. Whereas, . to the Planning Commission certain changes in the classification of Lots 71, 72, 73, and 74, Foster's Addition to Eugene, ~ne I 'G'ounty, Oregon, and the Planning Commission was held a hearing, adopted a tentative report, and converted the same into a permanent and final report and resubmitted it to the Common Council with the recommendation that the same be enacted into an ordinance, and the Council has prepared and given its first reading of an ordinance enacting said permanent report. The matter was then dropped. Upon the recomrnendation of City Engineer Clubb the council voted to grant I a refund of $2.00 to J. R. Lawson for a building permit which was a duplicate and a refund of $4.50 to C. C. Mongold for electrical and plumbing permits which were duplicates. The Recorder was instructed to include payment of the refunds with 2fr the October bills and it was so ordered. Request was received from M. A. Hodgins for a $1.00 refund for payment of a traffic offenSe which was not committed by him but by the person who bought his caI'. Motion was made and seconded to grant the refund and it was unanimously 2<;Y- approved. Councilman Reid stated that some university students had contacted him making a request to use the old city hall fire bell as a noisemaker in the Universit of Oregon homecoming noise parade, November 8. After considerable discussion, motion was made by Councilman Bond and seconded by Councilman Farrington that the request be denied and it was so ordered. However, upon further discussion the council agreed to allow the university students to use the small city bell. Referri g again to the large city hall fire bell, motion was made and seconded to set the larg bell in a proper concrete base in the lawn of the city lot at 11th and Willamette; funds for the same to be taken from the Street and Bridge Revolving Fund, and it '1', 30- was so ordered. - ~ Upon motion made and seconded the City l1ecorder was instructed to call for sealed bids for fuel oil requirements for the city of Eugene on a one year contract basis, said bids to be opened at the council meeting of November 25, 1940. .. The recorder was also instructed to advertise a call for bids to cover the city's I gasoline requirements for the year 1941 and an auditor to audit the city's - g~X~xxNEXX~~Nix~NXXX~~XXX~X~E~xxtX*XX~NOCX~NX~NOCXX~XXX~XXMOCXXXKkEX~X~xxx 31..- books for the year 1941, said bids to be opened on December 30, 1940. The following curb cut applications were presented: No. 804 for Ralph patterson;/No. 805 for Wayne Ward~ No. 806 for Floyd Keeneyr and No. 807 for St. Mary's Catholic School~ As the City Engineer recommended that all cuts be granted, 32lr motion was made and seconded unanimously approving the recommendation of the Enginee . t, , Communication was read from H. W. Hand, Mayor of Corvallis, inviting all " interested city officials to attend a short course for ,water and sewage operators ',. to be held on the Oregon State COllege campus. The communication was ordered 33'- placed on file. . Verbal request was had from the Shell Oil Company Qoncerning the right to ,install a gasoline pump and pit at the aTIlort to service airplanes. After a dis- . cussion, the City Attorney hhecked our contract with Joseph Harrell, Manager of 34" the airport and it was felt advisable to hold the matter in abeyance until the next council meeting at which time a report would be made. It was reported to the council that a very unsightly construction was , being put up on the East side of Lawrence Street between 11th and 12th and the construction was exceeding the pennit granted by the building inspector. Upon - motion made and seconded the council ordered a stop-order placed on the premises 35 and instructed the City Engineer to enforce the same. It was unanimously approved. I Councilman Carlson stated there were several candidates for the position of counci~man in the city council left vacant by the resignation of Councilman P. J. Iianns and he would have no recoImnendation to make until after the election of November 5. Whichever individual is elected to the office he would recommend to fill out the balance of the year. Councilman Carlson stated he had not liked the article which appeared in the Morning News following the last council meeting. .. He stated that the only part of the statement which was correct was that he intended to resign after the first of the year. He wished it understood by the ,council ~at I he had never made any such stateruent as a one man government and he resented this appearing in the nevvspaper~ The reported had to;L.d him that this made a better story out of it. Mr. Carlson said he had talked with Mr. ArthurPriaulx, owner of the 'Jorning News, and Mr. Priaulx stated the story was solely the work of the reporter and the columns were open to make a correction. He therefore felt the management mas sincere. However, he. wished his statement made public and he therefore made it in the presence of both newspapers and the co~ncil so he wou~d not be misunder- 36'- stood. He did state again that he wished to reS1Gn after the flrst of the year. Upon motion made and seconded the council adjourned to meet on Tuesday~ November 12, instead of Monday November 11, due to the fact that Armistice Day 37 falls on November 11. C. M. All councilmen were present. Mayor Large,. herewi th called the meeting to order. Councilman Carlson recommended the appointment of Orren Brownson to fill the unexpired term of Councilman P. eT. Hanns, resigned; said term to expire on December 31, 1940. Motion was made and seconded unanimously approving the recommendation of Councilman Carlson.
