"S1 The minutes of the regular meeting of the Common Council held in the ~ '" Coun?il Chambers on De~ember 9, 1940, at 7:3CJo'clock p.m. Mayor Elisha Large preslded over the meetlng. Councilmen present were: A. A. Reid Sam C. Bond 1- A. C. Farrington, Louis Koppe, E. A. Barette, and Orren Brownson; absent: Fred C. Carlson and Ira O. Stewart. I The minutes of the previous meeting were presented and ordered placed on 2-.-.. file. The meeting was herewith called to order. Mr. W. H. Quinn representing the Beta Theta Pi Fraternity addressed the council concerning a large tree that was planted in the parking strip in such a manner that part of the tree was extending into the sidewalk and causing the side- malk to raise and break. Mr. Quinn reported that Councilman Barette had stated the tree must be removed and he was appealing to the council to allow the fraternity house from one to two years time in which to plant another tree upon their own property so that it will have time to get a food start. Councilman Barette stated that the tree was decaying and interferred with the sidewalk and it should come out and asked Engineer Clubb to malee a statement. City Engineer Clubb stated the roots of the tree were damaging the sidewalk and should be taken out and under he instructions of Mr. Barette had ordered it removed. After considerable discussio eouncilman Barette stated that the cOlnmittee would recommend a year's extension of ~ime for the removal of the tree. Upon motion made and seconded the recommendation 3 - as unanimously approved. ' . A representative of the Eugene Safety Council addressed the council and prese un petitions signed by faculty members and students of the Eugene High School and taxpay rs and residents of the Eugene High School District asking that the council establish ~-way stop signs on 17th and Lincoln ~Streets and 17th and Charnelton Streets. Also, paint necessary cross walks near and around the Eugene High School building and ~nstall 30-minute parking signs in front of the high school from Lincoln to Charnelto I. ptreet. Councilman Bond stated that the Police Committee had approved the installa- ~ion of 30-minute parking signs in front of the school building and had approved the ainting of cross walks but still had under consideration the request for placing 4_ !!:i-way stop signs at 17th and Lincoln Streets and 17th and Charnelton Streets. Councilman Farrington, Chairman of the Finance Committee presented the roperty offers beginning vlith the offer of L. R. I Councilman Farrington presented the bills for the month of November 1940, rith the recolllinendation that they be allowed and warrants drawn for payment of the same. The ayes and nays were called, councilmen voting aye: Reid, Bond, Farrington, I , Koppe, Barette, and Brownson; absent: Carlson and Stewart; nay: none. Findtner for a permit to construct a service station on the northeast corner of 13th and Willamette, the City Recorder resented a cooonunication from Councilman Carlson, Chairman of the Street Committee, the committee to which the matter had been referred. Councilman Carlson stated in Ihis communication that an ordinance is in effect prohibiting additional service stati ns Ion Willamette Street between the Southern Pacific right-of-way and 19th Street and it rould seem that the council would have to pepeal this ordinance first and then it vould be up to the council. As chairman he would make no recommendation and felt .. ~he Planning Commission might have somethin[jto say about this too. The Recorder ~ hen presented a petition signed by residents in the neighborhood enterinG their ~rotest against the erection of a service station on this corner. Councilman Bond ~aid he could see no objections to the installation of a service station at this ocation and the ordinance in question was passed to prohibit the installation of I service station at 8th and Vhllamette Streets. Councilman Reid maJ e Q motion, econded by Councilman Barette, to deny the request. Mr. Findter being present ddressed the council making a plea for a permit. On behalf of the Street COTMnittee, Councilman Reid made a motion, seconded by 'ouncilman Barette, instructinG the City Recorcler to call for bids for a street sweep I' nd call for bids for a tractor with mower attachments, said bids to be opened at l't"" he council meeting of December 23. The motion was unanimously approved. The Fire and Water COIT~ittee represented by Councilman Koppe in the I bsence of Councilman Stewart requested additional tliue for consideration regarding 18,,- he installation of a street light in the alley adjacent to the Del Ray Cafe. Councilman Brownson, Chairman of the Health Committee, reported that is comnlittee had contacted the management of the Midgley Planing Mill concerning the I' 'moke nuisance and the mill officials were willing to cooperate in every way possible tor the removal of the nuisance providing it was within reason to do so and it didn't 19 'Jhecessitate too many changes. Councilman Bond reported that an investigation had been made at 1283 West 4th Street and found a residence was being used for carrying on a wholesale vegetabl pr9duce business. He'recomIllended that the bu~iness be stopped. Motion was made'and seponded approvinG the recomrnendation and the~ Chief of Police instructed to not1fy th~ residents thereof that the practice would. have to be discontinued, and it was 26 so ordered. It was reported that theVVPA'wished pennission to construct a room within 1 the auditoriUm on the third floor of the city' hall for the purpo~e of conducting , classes. Mayor Elisha Large wished to appoint Mr. G. G. Busillaan to complete the unexpired term of E. O. Potter, deceased, as a member of the Planning Commission. 28.... Communication ViaS presented by the City Recorder from the Booth Kelly Lum- ber Company, the Springfield Pl~vood Corporation and the Cone Lumber Company concern ing fire protection after December 31, 1940. The matter referred to the Fire and Water Coramittee to report back at the next meeting of the,council with suggestions as to working out a schedule for an annual charge payable in advance for such servic s. Question was brought up as to the possibility of such industrial plants furnishing the City a statement of their assessed valuation each year and they to pay the city, J in advance, the same millage on their assessed valuation as the people of the city 29 pay on their property. Communication was presented from the Board of Appeals presenting the request of E. M. ~anta, Real Estate Broker,.asking for a re-zoning of the Harry H. Gordon Addition into a Business Zone. This is a tract of land lying on each side of Sevent Avenue from the City limits on the West to a point sixty-six feet east of the east line of Taylor Street. The Board rec9mmend~hat this request be referred to the 30' Planning Commission and the recommendation was unanimously approved: .11 Req~est was recelved from the Snellstrom Lumber Company asklng for a permit to erect an addition to their present buildin~t the northeast corner of the intersection of Sixth Avenue and Charnelton Street, of the same construction of the present bui~ding--frame covered with corrugated iron. Said building addition to be not closer than twelve feet to the east property line. The Board recommends that this request be granted and motion was made and seconded unanimously 31 approving the recommendation of the Board. - A resolution was presented directing the Planning Commission to hold a , II hearing on the proposal to change the classification of a tract of land on Seventh Avenue from the city limits to Taylor Street from a single family residence district to a business district and to adopt a tentative report and thereafter make a final report and transmit the same to the council with their recommendation and it was ~~~ unanimously approved. A statement of sewerage Charges billed and collected for the month of November was presented from the Eugene Water Board shovv-ing a collection for the 34- month of November at Gl,569.41. The report was ordered placed on file. I VmEP~AS, the state law fixes a basic rule which makes it almost impossible to establish any speed regulation, Now, Therefore, The COMilon Council does hereby resolve that it is necessary for the protection of the citizens of the City of Eugene and of other cities of the state that they be permitted to dix definite speed limitations within the city in order to protect their street intersect on and the City Recorder be and he is hereby directed to transmit to each representative of Lane . County in the Oregon Legislature a copy of this resolution, together '!f/ith a letter asking for their cooperation, and assistance in getting through such legislation. A resolution was presented authorizing the City Recorder and the Mayor to j execute a contract between the City of Eugene and Shaefers.Brothers with respect 38 to the setback line on Eleventh Street East. Refund is claimed because this ordinance fl was declared unconstitutional. The matter was taken to the supreme court and the 391 circuit court decision upheld. Motion was made and seconded to allow the refund and the expense to be taken from the Emergency Fund. It was unanimously approved. Curb cut applications were/presented from the following applicants: Alfred Skade~, No. 816; J. C. Watts, No. 817; and Eanes & Dragoo, No. 818. City 40 Engineer Clubb recownended tlEt the cuts be granted and motion was made and seconded unanimously: approving the recomrnendation of the Engineer. An ordinance providing for a means of entrance and exit from residential properties in the City of Eugene was presented and had its firsx reading. A large number of suggestions for changes in the ordinance were presented. Councilmen Reid and Barette were opposed to passing the ordinance without considerable study while other members of the council were in favor of passing it. Mayor Large referred the matter to the Police Committee for study and instructed them to bring before the next meeting of the c'ouncil a complete ordinance covering suggestions I 41 - in this matter.
