'-' Council Chambers on December 23, 1940 at 7:30 o'clock p.m. Mayor Elisha Large
~ presided over the meeting. Councilmen present were A. A. Reid, Sam C. Bond,
! A. C. Farrington, Louis Koppe, E. A. Barette, and Ira O. Stewart and Orren Brownson;
absent: Fred C. Carlson.

Mayor Large announced that official notification had been received from the
CAA aiPrOVing the proposed airport site for the City of Eugene and allocating the
city '250',000. He requested the council to take action upon excercising the options
secured on Section 6. After a brief discussion a resolution was presented directing
the officers of the City of Eugene to proceed to exercise the options for all proper y
lying within Section 6 as proposed for the new airport for the city of Eugene. Mr.
W. M. Tugman addressed the council pointing out the necessity for immediate action
and the desirability of further attempting to l?ecure a reductIon in the purchase
price of the .l!osbeck and titickels properties. Upon motion made and seconded the
resolution was unanimously approved. ~he Mayor then requested action on the options
for the proposed cantonment and right-of-\~y property. Discussion was had particip-
ated in by Councilman Bond, Hobert Prescott, Ed Behnke, Mahilon Sweet, W. M. Tugman~
and Earl McNutt all pointing out the advisability of securing the property at this
time. Councilman Bond explained that in reducing the price of his property (in
keeping with the others) he had done so for the benefit of the city. A resolution
was presented authorizing officials of the City of Eugene to exercise options for
the cantonment and right of way prop~rtie$. Motion was made~ seconded, and approved

resolution accepting an offer of aid in th~ development of the Eugene Airport throug
the CAA was presented and upon motion made and seconded the resolution was unanimous y I
adopted. ~t was requested that the memQer~ of the airport committee consisting of
W. M. Tugman, Robert Behnke, Earl McNutt, Ray McInnis, A. C. Farrington, Louis Koppe I
and the Mayor meet in the office of the City Attorney December .24 at ten o'clock
a.m. for the purpose of completing this work. (Note: all options are now in the
3 hands of the ~ity Attorney)

WHEREAS, heretofore options have been obtained upon
Section 6, Township 17 South of Range 4 West of the Willamette
Meridian, Lane County, Oregon, for an airport site,
Therefore,
BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF EUGENE
that the City of Eugene does hereby exercise options for all of
the property lying within Section 6 as proposed for a new airport
for the City of ~ugene and the Mayor and the city Recorder be
and they are hereby authorized and directed to sign all papers,
make all arrangements and make all payments necessary to the
completion of the purchase of the airport site.

Section 6, 'l'ownship 17, South of Hange 4 West of the Willamette
Meridian, Lane County, Oregon, options have been procured by
the City of Eugene for an area lying to the East of the airport
to be used for cantonment and right of way property,

that the City of Eugene does hereby exercise options for all of
the property lying within Section 5, ~ownship 17 South of Range 4
West immediately East of Section 6 as proposed for a new airport,
for the ~ity of ~ugene and the Mayor and the City Recorder be and
they are hereby authorized and directed to sign all papers, make
all arrangements and make all payments necessary to the completion
of the purchase of the cantonment site immediately agjacent to the
airport site.

THROUGH THE ADMINISTRATOR OF CIVIL AERO-
,NAUTICS OF THE DEPAR~~NT OF COMMERCE AND
PROVIDING CERTAIN ASSURANCES AND COVENANTS
I IN CONSIDERATION THEREOF.
WHEREAS, the Administrator of Civil Aeronautics of the
United States Department of Commerce, through the Hegional Manager
of Civil Aeronautics, Seattle, Washington, advises that the devel-
opment of the ~ugene Airport in the approximate amount of $250,000.00
has been approved by the ~oard composed of the Secretaries of War,
Navy and Commerce as necessary to national defense for inclusion
in the construction program authorized by Public No. 812, 76th
Congress, approved October 9, 1940.
WHEREAS, the undertaking of this development is contingent
on the fulfillment of certain conditions, to-wit:
1. ~hat the City of ~ugene through its properly con-
stituted officials provide evidence that it has title or will
obtain title prior to construction being placed underway to the
requisite land for the project.
2. That the Oity of Eugene agree to accept full res-
ponsibility for the maintenance of the improved airport.
3. That the Gity of Eugene agree to accept full res-
ponsibility for the operation of the improved airport as a public
I airport in the public interest.
4. ~hat the Gity of Eugene agree to protect the aerial
approaches to the airport to the full extent of its ,legal ability.
5. ~hat the city of Eugene agree to co-operate with the
Civil Aeronautics Administration in the orderly prosecution of
the proposed work.
6. ~hat the Gity of ~ugene agree to hold the united
States harmless from all claims and damages which may arise from
the construction operations but are not a definite part thereof.
WHEREAS, the proposed development would be to the advantage and
benef~t of the Gity of Eugene,
NOW THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF EUG'ENE,
SECTION 1. 'l'ha t the Gi ty of Eugene hereby agrees, sub ject to
the united States undertaking the development of the ~ugene
Airport at an approximate cost of $250,000.00, as follows:
REPRESENTATIONS k~D WARRANTIES
I (a) 'l'hat the City of Eugene owns and possesses title in fee
simple to the lands comprising the landing area of the Eugene
Airport, together with all other lands to be improved
under the project or will acquire title in fee simple to these
lands without delay, which lands are more particularly described
herewi th by metes or bounds .( which lands are shown herewith on
Exhibi t nAn): (omitted here)
(b) That the City of Eugene has the power and authority under
I the laws of the State of Oregon to perform all of its obligations
hereunder.
SECTION II. That the City of Eugene agrees to permit the
agents of theuovernment and all contractors or sub-con-
tractors engaged directly or indirectly in carrying out the
project, including their agents and employees to enter upon, use
and occupy the airport as may be deemed by the Uovernment to be
necessary or desirable in the conduct of the project.

SECTION III. OWNERSHIP OF IMPROVEMENTS

SECTION IV. MAINTENANCE OF AIRPORT FACILITIES
That the City of Eugene agrees to accept full responsibility
for the maintenance,of the Eugene Airport, to include all work I
undertaken under this project by the united States o'f America.
SECTION V. THE OPERATION OF THE AIRPORT
That the City of Eugene agrees to accept full responsibility
for the operation of the ~ugene Airport for the use and benefit
of the public on reasonable terms and without unjust
discrimination and to grant no exclusive right therein contrary
to the provisions of Section 303 of the Civil Aeronautics Act of 1938.
SECTION VI. PREV.l!;NTION OF HAZARDS
That the City of Eugene agrees, insofar as is reasonably
possible and within its legal ability, to protect the aerial
approaches to the airport from the erection of structures or
from growth tending to render the use of the airport dangerous
to aircraft and that it will not erect on the airport or permit
to be erected, any structure or building which will limit the
usefulness of the airport or constitute a hazard to aircraft
using the airport.
SECTION VII. CO,..OPERATION
That the City of Eugene agrees to, co-operate with the
Civil Aeronautics Administration in the orderly prosecution of
the project. I
SECTION VIII. RELEASE FROM CLAIMS
That the vity of Eugene agrees to hold the United States
harmless from any and all claims or damages which may arise
from the construction activities of the United States but are
not a definite part thereof.
SECTION LX. CERTIFICATION ,
That the City Recorder is hereby authorized and directed
to send to the Administrator through the Hegional Manager of
Civil Aeronautics, Seattle, Washington, two certified copies
of this resolution with two certified copies of an extract of
the minutes of the meeting of the vommon Council showing all
proceedings in connection with the adoption of this resolution.

I Motion was made by Councilman ll'arrington, seconded by Councilman Hond, and approved
by the Council, accepting the bid of Associated Oil Company for Flying "A" Gasoline
at 12.73i per gallon and it was so ordered. The Mayor and City Recorder
were instructed to sign the contract with the company in behalf of the Uity of

The Howard-Cooper Corporation on two models of Elgin sweepers,

Eugene Hardware Company for the Austin-Western Patrol Sweeper at $4685.00j
@ouncilman Reid made a motion to accept the offer of A. C. Haag and Company on the
fuasis of a 30-day trial period. Councilman Hro~~son questioned ~he advisibility of
this,saying he had made a thorough study of the Austin-Western and Elgin Sweepers
~nd would recommend the purchase of the Elgin Jr. On behalf of Councilman Carlson,
€hairman of the Street Cooonittee, he also wished to report that Councilman Carlson
~ecommended the purchase of the Elgin Jr. Councilman Reid again spoke in behalf or
jhe purchase of the Haag & Company machine. Councilman Stewart stated he had seen on\Y~

one machine, the Austin-Western. Councilman Brownson stated that members of the
Street Committee had studied both the Elgin and Austin-Western machines. Council-
man Barette reported that he felt the recommendation of the Street Committee should
~~~ be accepted, because after all they were the ones who had made the investigation. I

ing the merits of three respective machines. Councilman Bond seconded Councilman
Reid's motion, but before the question was put, Councilman Koppe said he would have
to stand behind the recommendation of the Street Committee. '1'he ayes and nays were
called, councilmen voting aye: Reid, nond and Farrington; nay: Koppe, ~arette,
Stewart and ~rownson. 'l'he motion was declared lost. vouncilman bond made a I
motion to accept the recommendation of the 0treet vommittee and accept the bid on
the Elgin, Jr. The motion was seconded by Councilman narette, and placed ~pon
roll call. Councilmen voting aye: bond, Koppe, narette, and Brovmson; nay: Reid,
71 Farrington, and Stewart. ~he motion was declared carried.

Mayor Large declared a recess to give members of the council opportunity to study
various bids. The council was called to order by Mayor Large. Councilman Reid made
a motion seconded by Councilman Bond, that the offer of A. C. Haag & Company be
accepted. The motion was placed upon roll call, councilmen voting aye: Reid,
Hond, Farrington, Koppe, barette, Stewart, and Brownson; nay: none; absent: Carlson.

Mrs. Elsie Erlandson was present at the council m~eting and made a continue
plea for the council to grant the package store liquor license at the Lawrence
Street Grocery. Counciln~n Bond, Chairman of the Police Committee, stated that I
if this license was issued it would be granting a new license and the council V\'aS
opposed to that practice. vouncilman .it'arrington upheld Councilman ~ond' s statement.
, Councilman ~ond stated that if Mrs. Erlandson would get a written statement from Mr.
Wilson to the effect that he was no longer interested in the permit and the transfe
of the license to Mrs. Erlandson v~s satisfactory, he would recommend transfer
of the same. Councilman Koppe felt that this license should be granted to Mrs.
Erlandson. Mrs. Erlandson was then told to see if she could secure the written
9 statement from Mr. Wilson.
Councilman Farrington, Chairman of the .it'inance Committee, presented the
property offers beginning with the offer of Roy B. Wilcox, $900; $100 down and
the balance at $15.00 per month plus interest at 6% for Lots 1, 2, and 3,
block 12, Hollenbeck Additrnon (Southeast corner of 18th Avenue and Washington
Street). The Finance Committee recommended a counter offer of $1190 and the
ICY council unanimously approved the recooonendation.
The offer of Cordelia Evans for John Tiffany, client, $500 cash, for Lot 14,
Block 30, Driverton Addition (110 feet East of the Southeast corner of 22nd Avenue
and Hilyard Street) was presented, with a recommendation that a counter offer of
$575 be extended. Motion was made and seconded unanimously approving the recommend -

Councilman Stewart, Chairman of the .it'ire and Water Commi ttee, made a
request for authori ty to purchase six more Correy hydrants and valves for the .it'ire
Department; the same to be paid for from the regular budget as far as it goes, I
and the balance to be paid from the Emergency l"und. Upon motion made and seconded
l2J this was unanimously approved.
As to charges for industrial plants outside the vity of Eugene, the
committee requested an additional two weeks time for consideration. ~he request
13 was granted.
It was reported that the College Crest District would vote on their proposed
fire district on January 3. They have a copy of the contract between the City of I
14J.r"Eugene and the Bethel District to use as a pattern.
Counpilman Brownson, Chairman of the Health Committee, stated that an estima

for the installation of light standards in front of the vomfort Station was $170
but he had no recommendation to make in the matter because he was not familiar with
the situation. The co~~ittee was granted another two weeks time to further investi-
15~ gate the matter.

Councilman Bond, Chairman of the Police Committee, recommended approving
the renewal applications for liquor licenses at the Star Club, 66) Willamette,
and Percy's Place, 89 West 8th Street. Motion was made and seconded unanimously
16 approving the recommendation of the committee.

At the request of Councilman ~ond, Chairman of the Police Committee,
the City Hecorder read a communication from C. A. Swarts, Sheriff, notifying
I the city that effective January 15, 1941 the county will be unable to care for
city prisoners in the county jail, particularly transient drunks. the ~
communication also stated that owing to the increased costs of provisions it will -',

be necessary for the charge per day to be raised from 50~ to 75~, also effective ~,.....

on January 15, 1941. 'The matter was referred to the Police Committee to see ');
17' if an extension of time could be worked out with the c9unty.
At this time Councilman Hond was excused from the meeting.
I Communication was presented from the chief of Police stating he had
contacted Mr. and Mrs. Cecil McAllister at 1283 West 4th Street and informed them
they would have to discontinue their vegetable business at this location. They
promised to move from this location as soon as they are able to find another place
18 and they had also no.tified the head of their company in Portland that they would
have to move.
A report for the month of November was presented from the Eugene Public
19' Li brary an,d ordered placed on file.
Communication was presented from the ~lanning ~ornnission adopting as its
permanent report that the proposal to change the classification of Lot 4, nlock 9,
Elias Stewart's Addition to Eugene, from a multiple family residence district to
20' a business district be denied. (A. L. Williamson request) Motion was made and
seconded unanimously approving the recommendation of the Commission.
Petition was presented from property owners residing in the first
addition tot the City Outlook of Eugene asking the council's aid in remonstrating
against a property owner, namely, John Hawkinson, residing on Harris Street
between 26th and 27th for reasons as follows: 1st, unsanitary concH tions surround-
ing the home, 2nd Fire Hazard and 3rd, general accumulation of unsightly
paraphernailia around the home which detracts from value of adjoining properties
and curtails sale of property in entire tract. The matter was referred to the
21' Health Committee for investigation.
I 22' In the absence of Councilman Bond the ordinance providing for a means of
entrance and exit from residential properties was held over.
An ordinance initiating the vacation of the alley running North and South
through Block 9, Fairillount Addition was presented for its first reading and under
suspension of the rules by unanimous consent of the council was presented
for its second and third readings by title and placed for final passage. The
ayes and nays were called, councilmen voting aye: Reid, Farrington, Koppe,
21 Barette, Stewart, and ~rownson; nay: none; absent: Dond and Carlson. 'l'he ordinance
was declared passed and numbered 8669.
~uestion was brought up concerning the use of the Gouncil Chambers by
, various groups and organizations. Councilman Reid made a motion to restrict the
use of the City Council Chambers to thecity, county, and state officials.
The motion was lost for lack of a second. Councilman Farrington made a motion,
seconded by ~arette, tb:-:.:testri ct the use of the Gouncil Chambers to the Mayor
and the Common Council, this to be effective January 1, 1941. ~uestion was
called for and all councilmen voted aye with the exception of Stewart who voted

The fOllowing curb cut applications were presented: No. 819 for Laura
Stillman; No. 821' for E. H. Hall~ and No. 820 for A. V. Lewis:- The City Engineer
recorr~ended that the cuts be granted, with the cut for Mr. Lewis being two 23-foot
cuts, to be marked off by the Engineering Department. The reco~nendations were
I 251 unanimously approved.
The City Recorder reported that representatives of the ~ethel Fire District
wanted to know if it would be possible to align the streets of their district
26' with the streets of the City of Eugene for possible future service and it was
pointed out that there was no such service available.
The City Hecorder presented a statement recowmending the transfer of
funds at the close of 1940 from the Ueneral Fund Balances to Special fund
I balances for the following departments: (listed on next page.)
The recommendation was unanimously approvd.
