To the Members of the Common Council ~.." ~ of the City of Eugene: ,.~"" a ",...'- NOTICE IS HEREBY GIVEN, That on this 31st day of December, 1940, the Mayor of the City of Eugene hereby calls a meeting to be held at 10:30 o'clock a.m. in the Council Chambers in the City Hall in I the City of Eugene for' the consideration of the following matter: For the purpose of gratifying actions tl.ke n by the City Attorney on Airport options. Eugene, Oregon December 31, 1940 /s/ Elisha Large, Mayor * * * * * * * * * * * * * * * Council Chambers Eugene, Oregon December 31, 1940 The council met in special meeting pursuant to the call of Mayor Large. Councilmen present were: A. A. Reid, Sam C. Hond, Fred C. Carlson, A. C. Farrington, Louis Koppe, E. A. Harette and Orren Brownson; absent: I. O. Stewart. Mayor Large herewith called the meeting to order. City Attorney S. M. Calkins stated that attorneys representing the First National Bank of Eugene and the Eugene branch of the United States National Hank I of Portland, had agreed upon the right of the city to issue warrants covering the two year tax levies for the purchase of the municipal airport site and the method of handling the business with the banks would be as follows: For the purchase of each tract of land the City of Eugene would draw two warrants, each covering fifty percent (50%) of the purchase price, and each bank would receive one warrant. Concerning the option from Clyde F. and Juanita Crawford, the City Attorney stated that after very 'careful consideration on the part of himself and Mayor Large, because the Crawfords were objecting to the option price of $6500 instead of $7000, due to the amount being paid for adjoining property, it was their recommendation that the price of the Crawford property be increased from $6500 , to $7000 and papers had been drawn to this effect. As to the reservations in the options for crops on the F. E. and Cora S. Hyland property and the John H. and Agnes V. Bernards property it was felt that no difficulties would be experienced by the city because other sections of the airport would be worked upon first. It was agreed that the option price of $8500 would be paid for the J.. C. Hurzeler property, which was the highest price paid for any of the pieces of land. Since the signing of the option, the Hurzelers asked an additional $1140 for crops, but, after considerable discussion with their attorney, Bernard Fedde, the Hurzelers were apparently giving up their crop claim and were going to take the I position that the option was not good. The Mayor and City Attorney requested the council's authority to file suit, if necessary, for completion of the contract as it now stands. A resolution was presented and unanimously approved, au tlLOI'izin the City Attorney to proceed with such action for the acquisition of any of the lan s embraced in the proposed airport for the City of Eugene. City Attorney Calkins stated it was his opinion that the city would be in a very favorable position shoul such action become necessary. R E~,s 0 L UTI 0 N ---------- I BE IT RESOLVED, by the Common Council of the City of Eugene that the City Attorney be and he is hereby authorized, empowered and directed to COWilence any suit or suits necessary or convenient for the acquisition of any of the lands embraced in the proposed airport for the City of Eugene, situat~d in Sections 5 and 6, in ~o~mship 17 South of Range 4 West of the Willamette Meridian in Lane County, Oregon, and to carry forward said litigation and to do any and all things necessary or convenient to its consummation and acquisition of the land for the city. ~ r"" 412 - - = As to the George W. and Gladys Boqua property, City Attorney Calkins reported ....F} that the original options had been for $7000 and that following the signing of the I f:+:;S original options, Mr. and Mrs. Hoqua were called upon and the price reduced to Au.;: $6400. However, the changes in the options had not been initialed and therefore the /--' .. ':; ('O city, in his opinion, was bound by the original option price of $7000. It was the determination of the Mayor and City Attorney that the city should stand on the orig- inal option price of $7000. Because of this condition Mr. Calkins wished authority, if necessary, to file suit on the property, which authority was granted by the resolution adopted in the previous paragraph. Mr. Cal~ins further reported that all other options had been taken up I and contracts entered into. Upon motion made by Councilman, Reid, seconded by Councilman ~ond, the Mayor and City Recorder were authorized to issue warrants covering the purchase price of the Hurzeler' and Boqua properties; said warrants to be made out to the name of Elisha Large, Mayor, ~n order to cash the warrants and have available money for the filing of suits in case it became necessary. It was unanimously approved. Motion was made and seconded authorizing the Mayor and City Hecorder to issue necessary warrants' for the purchase price of all other pieces of property as the occasion arose. City Attorney Calkins then stated that the contract forms had been presented to and approved by the representatives of both banks. Resolution was presented authorizing the Mayor and City Recorder to execute the contract and issue warrants, depositing the contract and warrants in the First National Bank of Eugene for the ~am C. ~ond and ~sther E. Bond property. A resoluti n was also presented pledging the full faith and credit of the City of Eugene to the orderly issuance of the warrants and payment thereof and expressly agrees 'with the banks aforesaid that they will, themselves, defend any litigation, should any arise, which in any way effects ~the validity of the warrants or impairs in any way the safety and security of the banks in taking up the warrants and paying for them. Motion was made and seconded unanimously approving both resolutions. RES 0 L UTI 0 N ---------- WHEREAS, the City of ~ugene, acting through its Common Council. under authorization of the electors at the election of November 5, 1940, has purchased certain properties constituting a site for an airport, and WHEREAS, in order that the city may complete the purchase, a series of contracts have been entered into with the sellers providing that upon their depositing a deed and an abstract showing marketable title, free of incumbrances, that the city will, as soon as it conveniently can, examine and approve the title, issue warrants for the purchase price, and WHEREAS, the First National ~ank of Eugene and the United I States National Hank of Portland tOregon) through its Eugene Branch, have agreed to take over the warrants so delivered to the sellers and to give the sellers cash therefor, BE IT RESOLVED that the Common Council of the City of Eugene does hereby pledge the full faith and credit of the City of Eugene to the orderly issuance of the warrants and the payment thereof and expressly agrees with the banks aforesaid that they will, themselves, defend any litigation, should any I arise, which in any way effects, the validity of the warrants or impairs in any way the safety and security of the banks in taking up the warrants and paying for them.
