A. Reid, Sam C. Bond, A. C. Farrington, Louis Koppe, E. A. oarette, Ira O. Stewart, and Orren Brownson; absent: Fred C. ~Carlson . The minutes of the previous meeting were presented and ordered placed 2~on file. Gillette At this time Mayor Large stated that with the-approval of the council, all committee appointments would be postponed until a later meeting and the Council 3~ommittees would act as at present. The council approved the postponement. monthly Mayor Large named the following appointees and/salaries of all employees or officers elected or appointed for the ensuing year: Councilman brownson made a motion that the appointment of Dr. L. G. Helterline as Milk and Meat ~nspector be made on a temporary basis because the tlealth Committee was conducting a survey of his work and expected to have a complete report ready for the next council meemng which might alter the situation. 'fhe motion was seconded by ~ouncilman Reid and upon calling for the question was favorably passed. Dr. Helterline was thereby appointed to serve on a temporary-basis. uouncilman oarette then made a motion that all appointments named by Mayor Large be confirmed by the council with the exception of Charles Sullivan, Supt. of Parks. Th~ motion was seconded by ~ouncilman Stewart, and approved by the council. Mr. oarett'e, Chairman of the Printing and Parks ~ommi- ttee, stated that the corumi ttee had given full- consideration to the management of th Parks and they felt that a change of superintendents was essential. They would therefore recornmend to the Mayor and Council, and he made a motion to that effect, that Fred E. Lamb be appointed as Superintendent of Parks. The motion was seconded by Councilman Farrington and approved by ~he council. Matzger, Manager of the Oregon Fruit Company addressed the council asking for a special permit to complete the construction of an office on the platform of the old Kremmel Bakery on the Seventh Street side. It was pointed out that the platform exceeds the private property territory extending over the street area, into that portion of which is generally used for sidewalk pruposes enabling them to back up to the platform. After a brief discussion the City Attor- ney pointed' out that the city had no right to grant a permit for such purposes and the matter was dropped. Communication was presented from Sol Rosenberg calling the council's attenti n to the. condition of the street at 14th and Charnelton and asked the ~ouncil to do what is necessary to correct this condition. He pointed out that automobiles- driving South on Charnelton Street must make a turn at 14th Avenue West or they will run over the curb on the lawn of his house or directly into the house itself. He also reported that there have been ar1number of accidents at this corner, a numbe of cars having run over his lawn with several narrow escapes on the part of the pedestrians. He felt that perhaps a guard rail with red reflectors would solve the problem. The matter was referred to the Police Committee to make a recommendation at the next council meeting. I ~f~' (;0' ......'t. '--' 1 6 Councilman Farrington, Chairman of the ,!!'inance Committee, presented the prop erty offers beginning with the offer of E. H. and Mary E. Christensen, $1050.00 cash, for Lots 7 and 8, block 1, George W. Lills Addition (NE .comer of Broadway and Polk Street). Intends to commence construction of residence within thirty days. The Finance Committee recommended the acceptance of the offer and the 7lJY council unanimously approved the reccomendation. The offer of John T. Foreman, $750 cash, for Lot 2, Block 6, Elias Stewart's Addition (known as 528 West 10th Avenue) was presented. The ~'inance Committee recommended a counter offer of $1050 and upon motion made and seconded 8~ the recommendation was unanimously approved. I lO'l Councilman Farrington presented the bills for the month of December, 1940 with a reco~~endation that they be allowed and warrants be drawn for payment of the same; delivery of the warrants to be made upon completion of the work or delivery of the 'merchandise. The communication was ~EXXE~ 1- referred to the Finance Committee and the City' Attorney to report back at the next 121lcouncil meeting. - , - Councilman Stewart presented the following report on behalf of the Fire and Water Committee: quote "The Fire and Water Committee has been asked to investigate and make a report on the problem of Rural Fire Protection as applied to industries outside the city. To comply with this request and meet the requests from these industries, this committee ha's neld several meetings and has reviewed the reports of several other cities thru the research work of Herman Kehrli at the University of Oregon. We find this almost a Universal problem as many other cities are groping around for the answer to this problem. Since this council last January resolved to discontinue on January 1st 1941 the former practice of extending this service on the per run charge basis and since several business firms have requested this service by our fire department, your committee has decided to recomnlend a plan which seems to be producfng the best results as shown by the limited experiences of those we have studied and as applied to OUT situation. I Tt seems only fair that all parties priviledged to the use of the City Fire Department should contribute" to the cost and maintenance of the same, whether actual fires are experienced by them or not. That is the basis on which city reside?ts are paying. ' That is the basis on which we propose for those outside to pay. In the past 2-1/2 mills has been 'the estimated cost of our fire department. We wish to state that this is only a part of the city's expense and does not cover certain items of investment and other' expense which the city tax payer is paying. However, there are certain items ,which those out side the city should not be asked to c'ontri bute to, and while 2-1/2 mills does not represent the entire cost yet in all fairness to those concerned we deem i~ a reasonable charge. Therefore~_ we propose; All industries outside the City df Eugene who wish the services o~ the City Fire Department and whose assessed valuation (all properties) is $50,000 or more shall pay to the City of Eugene annually an amount ~ I ~ 423 1 1 I I 1 -----. -_........--~--- ---- -~-- -- --- ----" ------~~-===-- ~ ---_._-~-------'--~-~~-=:..:;.:~~~-~. ------------.----~~~- 13\ equal to 2-1/2 mills per dollar of assessed valuation. ~ Industries having a smaller assessed valuation than $50,000 shall pay annually the sum of $100 plus a per run charge of $20.00 per hour for each piece of equipment" end quote In the event the fire equipment is used on a call of a minimum charge and the the fire equipment is used in excess of five hours then that account will be Dilled at the rate of $20.00 per hour or fraction of an hour above the original five hours. It was unanimously approved by the council. JS. (s;:; ",::6 14\ Councilman Stewart stated it was time for the committee to consider the purchase of a fire truck. Councilman Bond wished the City Recorder to investigate prices on the various types Of-fire fighting equipment so a study can be made and bids called for and it was so ordered. 15 Councilman Stewart stated that the representatives of the College Crest Fire District were to meet with the City Attorney for completion of their contract for rural fire protection." 16 Counci~man Barette reported that the Oregon State Grone Commission would like to give the city a group of pheasants for Skinners Butte Park. After a short discussion the committee was instructed to investigate the cost of building cages for the pheasants and report back to the council. 17-' Councilman Barette stated he felt the City should proceed without further delay ~~th the installation of traffic lights at 13th and Willamette Streets and the City Recorder was instructed to secure the price of installation from C & S Electric who had installed the other lights on Willamette Street. Councilman Reid, Chairman of the Sewer Committee, reported city sewer connections had been discovered beyond the city limits. Engineer was sending out bills and collecting for the same, and in users failed to pay the bill, the service would be discontinued. Councilman Reid reporting on th~equest for a Sewer at 24th and Willamette Streets, stated it was the committee's recommendation that the ditch be iniproved and necessary culverts be installed until the time comes when those people wish to permanently improve the streets. The recommendation was unanimously approved. Communication was presented from Donald M. Erb, President of the University of Oregon respectfully requesting the City of Eugene to vacate a certain area in Driverton's Addition as follows: Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, in Block No. 23; Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 16, 11, and 12 in Block No. 28; all of Blocks 16, 17, 18, 24, 25, 26, 27, 33, 34 and 35,' all in Driverton Adrntion to Eugene. (This block of land is bounded on the north by Twentieth Avenue, 0 the east by Patterson Street, and on the south by Twenty- fourth Avenue). The matter was referred to the City Engineer to make a study bf the street situation 21/ in that area and in the surrounding area and report back to the council. Councilman Bond reported that his committee had been working on the jail problem stating that the county had granted permission for the installation of a cage on the West side of the present county jail. The estimated cost for the erection of a jail is set at $443.00 and the Police Committee would recommend that this be done and paid for out of the Emergency Fund. Motion was made and 22' seconded unanimously approving the recommendation. Communication was presented from Marshall Fields requesting an extension of time to make t,he payments on his property contract. The matter was 2~ referred to the]inance Committee. The following department reports were presented: Annual r\?port of the Milk and Meat Inspector; annual report and report for the moni!J.h of December from the Police Department; annual report and report for the month of December from the Police Matron and a report for the month of December was presented from the City Engineer's Office. All reports were ordered placed on file. A statement of sewerag charges billed and collected was presented from the Eugene Water Board and ordered 24- placed on file. Communication was presented from the Board of Appeals recommending that the Council grant the request of Duane Crabtree, asking for a waiver of the "set-back" on Fifth Avenue at the corner of Oak Street, he being willing to enter in 0 the usual contract with the city covering the request. Nichols adking for permission to use the roo at 61 Tenth Avenue West as an office in connection with his laundry at 55 Tenth Aven e West. The Board of Appeals recommends that the request be granted for office pprposes only. Motion was made and seconded approving the recommendation of the Board. 1 Request has been received from Truman E. Phillips, an architect of Portland who is drawing plans for a six story reinforced concrete, fire proof hospital' building for the Sacred Heart Hospital, to be located on Twelfth Avenue just east of the present building, asking for a waiver of the provisions of Paragraph 2 of Section 904 of the Building Code which requires ramps. As the plans provide for an elevator and a stairway in a "smoke proof" tower and an additional stairway enclosed with fire proof walls and fire doors at the rear of the building, the Board recommends that the request be granted on condition that all corridors above the ~ second floor be divided by fire walls and doors as at the-first and second floors. 27 Motion was made and seconded unanimously approving the recommendation of the Board. Communication was presented from the Planning Commission recolr~ending the denial of the proposal to change the classification of a tract of land lying on each side of Seventh Avenue from the clty limits on the West to a point 66 feet East of t e East line of Taylor Street, in Eugene from a single family residence district to a business district. After a short discussion the matter was held for further cons ide a- 28' tion. I An ordinance providing for a means of entrance and exit from residential properties in the City of Eugene which had its first reading at the council meeting of December 9', was presented for its second reading and passed to its third reading by title under suspension of the rules by unanimous consent of the council and placed for final passage. The ayes and nays were called, councilman voting aye: \ Reid, Bond, Farrington, Koppe, Barette, Stewart, and Brownson; nay: none; absent: 29 Carlson. The ordinance was declared passed and numbered 8670. Applications for dance hall licenses were presented from the following: J. F. Olson for Townsend Club #l~Silver Spray Hall at 24 west 7th Street; Pearl Forncrook for Winter Garden Hall at 8th and Charnel ton Streets; O. H. Jones for Townsend Assn. of Lane County at W.O.W. Hall, 291 West 8th S . An application for a skating rink license was presented from D. O. Soasey for the Paramount Skating Rink at 25 West 7th Street. Curb cut applications were presented from Merle Short~W824), 760 West 8th Street; C. C. Mongold'No. 822, 1708 Columbia Street; and Gordon Ramstead;-No. 823, 158 West 21st Street. As the City Engineer recommended that all cuts be granted, motion was made and seconded approving the recommendation of the City Engineer. 1 31' 32" The City Recorder reported to the Common Council that Mrs. Eva Foster had received an injury when she fell on the sidewalk on the East side of Willamette Street between the Vogue Shop and Block's Shoe Store. She had re~uested the ' City to pay her doctor bill covering the treatment, an amount of $2.00, whereupon the Recorder's Office had issued a revolving fund chedk to Mrs. Foster and secured her signature on a statement releasing the city from any further claims as a result of the injury. The statement was ordered placed on file. Resolution was presented authorizing ahd directing the Mayor and City Recorder to enter into an agreement with Duane Crabtree regarding the set-back on Fifth Avenue at the corner of Oak Street. Motion was made and duly seconded, approving the passage of the resolution. - 1 33- RESOLUTION The Mayor and City Recorder of the City of Eugene be and they are hereby authorized and directed to enter into an agreement with Duane Crabtree respecting the North 72 feet of Lot 1, Block 2, Skinner's Donation to Lane County, Oregon, permi tting the said Duane Crabtree to erect a building up to the property line of Fith Avenue, with a provision that at any time the City of Eugene shall widen Fifth Avenue that the building shall be dismanteled back for seven feet, and that no damages shall be claimed by said Duane Crabtree or his successors in interest, except for the land taken. Specifications are on file in the office of the City Engineer. Councilman Bond raised the question of salary payment ~ J. M. Scroggie. Councilman Farrington pointed out that Mr. Scroggie had worked for the city for one year and should receive a salary increase.
