Also, such other business as may come up. Eugene, Oregon }Vl'ay 5, 1941 /s/ Elisha Large, Mayor * * * * * * * * * * * * * * * * * Council Chambers Eugene~ Oregon May 5, 1941 The Council met in special meeting pursuant to the call of MaYIDr Large with all councilmen present wxcept Messr. Farrington. 1 The meeting was called to order by Mayor Large. Dr. D. R. French and Marion I~cClain were present in behalf of the Lane County Humane Society and Mayor Lorge call ed on Dr-. French to present their case. Dr. French stated that the Lane County Humane Society now had a membership of about 100 members and a Board of Directors of eight members. They wanted to have a full time officer to take charge of all the dogs and cats and in fact any other stray animals that it rnight be necessary to look after. They also wanted to enter into some kind of a contract 'with the city whereby they could secure the fees from the dog licenses It was their desire to establish permanent quarters for the impounded dogs and other animals and they needed a building where the animals would be under cover. He said they would like to have a location on the east side of Lincoln Street imnIediately north of what is novv used by the Street Department, just above 3rd street. This would be a part of Skinner Butte Park. If it was not possible to have sufficient funds at this time to build a desireable buildinG they might be able, with the city's consent, to occupy a part of the Street Department buildings at 3rd and Linco n Streets. He reported the Hunlane Society was operating in Portland, Klamath Falls, Medford, Marshfield and Astoria. The Society expected to build up funds through membership dues and hoped to get SOllie donations. They also hoped to be able to ente into a contract with Lane County regarding the dog license fees. Councilnlen Barette Hawn, Brownson, Pennington and Bond indicated they would like to see some kind of an arral1gernent Worked 'out other than the present system of a part time dog catcher. After some disxussion, motion was made by Councilman Pennincton, seconded by Council , man Hawn that the matter be referred to the Police Committee to enter into any reaso _ 1 able contract and the motion was carried. I A resolution from the State Highway Co~nission was presented asking the city for permission to construct West 7th Avenue from the West City limits East to Polk Street and a resolution from the State Highway Commission was presented establiShing grades for this section of West 7th Avenue. Mr. W. M. Tugman of the Eugene Register Guard was present and explained it was his information that the State Highway Department had established these grades with the idea of further improv(-~ments and connections at a future date and they probably had been working to connect up the Cloverleaf intersection with West 11th Street Connection. Also, the State Highway Commission would probably have to widen the highway from the overhead crossing to Junction City and that would mean that would mean that the overhead crossing would have to be widened and it was built with that idea in view. After a brief discussion by the council, motion was made and seconded unanimously adopting ~ both resolutions. RES 0 L UTI 0 N 1 ~mEREAS, State Highway No. 1 of the State of Oregon, known as the Pacific Highway, is routed through the City of Eugene, Lane County Oregon, a municipal corporation and the route officially adopted for said highway by the State Highway Commission traverses the following street or streets, or avenues, or roads, of said city; to wit: West 7th Avenue, from the West city limits of Eugene to West 7th Avenue and Polk Street Ahd, WhEREAS, the State Highway Commission of the State of Oregon desires to improve said Highway, And, V~~REAS, the State Highway Commission of the State of Oregon has caused a survey to be made, and plans prepared for the improvement ~ ~~4 1-- ~; ~., ~' ~ ~ - of the State Highway traversing the street or streets, or avenues, ~xxx OCOCX1Xmx or avenues, or roads, as described herein, And, ~~EREAS, if said proposed street improvement is carried out, the work will be done pursuant to a grade or grades fixed and established by the Highway Commission, And, vVHEREAS, the grade or grades and el evations to which the proposed improvement will be made are indicated upon the maps and plans prepared for the proposed improvement which are on file in the office of the Oregon State Highway Cornmission, at Salem, Oregon, copies of vihich have been submitted to the city for its record and for its approval, said grades::, being as follows, to wit: 1 1 Description of Center line grade: BeginninG at elevation 409.72 at the intersection of the center line of \'iest 7th Avenue with the west ci ty limits of Eugene; thence to elevation 410.16 at the intersection of the center line of West 7th Avenue and Filmore Street; thence to elevation 410.80 at the intersections of the center line of West 7th Avenue and Almaden Street; thence to elevation 411.43 at the intersection of the cent er 1 ine of \'[est 7th Avenue and Tay lor Street; thence to elevation 412.07 at the intersection of the center line of West 7th Avenue and Polk Street. \ And, VffiEREAS, pursuant to Chapter 88, Oregon Laws 1931 and Chapter 529, Oregon La~s 1939, it ~s reQuired that as a condition precedent to the change of the grade of any such street by the Commission, such grad.e change shall be consented to by the city. N6W THEREFORE, IT IS HEREBY RESOLVED by the Common Council of the Ci ty of Eugene, Lane County, Oregon, tha t the grades established by The State Highway Commission for the proposed improvement of the street or streets, or avenues, or roads, as described herein and which are trav- ersed by State Hi[,hway NO..l of the State of OrE::gon, knoVJn as the Pacific Highway, the plans for which proposed improvement are on file in the office of the State Highway Conmlission as Salem, Oregon, and a cllipy or copies of which are on file in the records of the city, said grades beinG as follows, to wit: 1 Descriptmon of Center line grade: Beginning at elevation 409.72 at the intersection of the center line of Vvest 7th Avenue with the west city limi ts of Eugene; thence to elevation 410.16 at the intersection of the center line of Vlest 7th Avenue and Filmore Street; thence to eleu-ation 410.80 at the intersections of the center line of West 7th Avenue and Almaden Street; thence to elevation 411.43 at the intersection of the center line of West 7th Avenue and Taylor Street; thence to elevation 412.07 at the intersection of the center line of West 7th Avenue and Polk Street. are hereby approved, and consent is hereby given to such change, and the State Hi[,hway Commission hereby is permitted to construct, reconstruct, improve, repair, and/or maintain the said streets in accordance with said grade changes. ~ Passed by the Common Council of the City of Eugene, Lane County, Oregon, this 5th day of May, 1941. BE IT FURTHER RESOLVED, that the CoronIon Council does hereby agree, within its lawful authority but without financial obligation or liability, to cooperate with and aid the State Highway Commission in the accomplishment of such street constructioh, reconstruction, improvement, repa' , and/or maintenance. JLDd, \VHEP~AS, The State Highway Commission will not construct said highway until and unless the said City of Eugene will gU6rantee by resolution officially adopted by the City Council of said city, that no encroachments will bepermi tted upon the right of way of said highvvay within the corporate limits of said City, which will permanently obstruct or interfere with the .free and convenient flow of traffic over said highway through said City; and will so regulate parking of vehicles on s~id streets or avenues traversed by said hi~~Jay that the free, convenient and safe flow of traffic shall not be impeded; and agree not to impose unreasonable limitations of speed upon said highway, no~ impose any regulation of traffic which will operate to discriminate against traffic upon said highway by giving undue preference to traffic upon other intersecting streets or avenues. 1 NOW, THEREFORE, IT IS HEREBY RESOLVED by the Common Council of the City of Eugene, Lane County, Oregon that no encroachments will be perm~tted on tne streets and avenues traversed by State Highway traffic along said highway; and will so regulate the parking of vehicles along said streets and avenues as not to impede the free, convenient and safe flow of traffic; and will not impose any unreasonable limitations of speed upon said highway, nor impose any regulation of traffic upon said highway which sahlI unduly discriminate against traffic upon said highway by gibing undue preference to traffic upon other intersecting streets or avenues. It being understood that nothing in this resolution of agreement by the City Council shall be construed so as to prevent or impair proper police regulations and the enforcement of all existing ordinances and regulations respecting the use of streets in said City, nor to prevent such temporary obstructions to traffic as may be necessitated by the construct- tion of water or gas mains, sewers and other public improvements, or to preclude the proper use of said highway for the placement of telephone or electric light poles or other public service facilities. D. Agerter, No. 857 forYTidewater Associated Oil Company and No. 858 for Pierce Auto Freie;ht Co. rJ.1he City Engineer recommended that the cuts be granted wi th the cuts for rI'idevvater Associated Oil Company and Pierce Auto Freight Company to be marked off by the Engineering Department and the reconrrnendation was unanimously approved. , 3 I. City Engineer Clubb said that the Eugene Water Board had contacted him regarding water connections at the old airport to acconrraodate the Army Cantonment, and reported that later on the Water Board probably would be so busy they could not get at it. Councilman Hawn said he had contacted Colonel Waller regarding this cantonment site and the army had acknowledged receipt of the plans but that was as far as he had heard. This being the case there was nothing further the council could do at this time. , 4 Mayor Large at this time brought up the matter of extra help in the Treasure and Police Department offices which Was approved at the council meeting of April 28. He said there had be~n some talk frG~embers of the council about this and there was some doubt about the advisibility of putting on a girl as extra help in these two offices. There was some discussion by different members of the council and Council- man Barette spoke regarding the necessary time for counting and wrapping the nickels and pennies in the Treasurer's Office which were taken in from the parking meters. He said he had contacted the bank and they might be willing to'take this money withowt.-:~it being counted or wrapped, thus saving this work in the Treasurer's ~ r--4 8 6 ~ ,a:;; ~~ ,Office but he had no assurance from the bank that they would take the money that way or if they did they would do it free of charge or want to make a small charge. After some discussion, motion was made by Councilman Barette, seconded by Council- man Hawn that the council rescind its former action regarding the hiring of a gril and that the Recorder's Office is to furnish Mr. Hambelton to the Treasurer's Office for counting and rolling the nickels and pennies but this be not over a 5\ couple of hours a day. The motion was -carried. '1-- , - ~ ~..;r Mayor Large said that the Chief of Police had requested the use of the Council Chamber room for a Police School and stated there seemed to be lots of requests for the use of the Council room. Councilman Bond said there had previously been a school held for the Fire Department members and that was conducted in the Fire Department quarters and he felt this Police School probably could be handled sithout going into the Council Chambers. Councilman Barette stated he thought - the council had better stick to its previous arrangements regarding the use of the Council Chrunbers and Mayor Large said he would notify the Chief of Police of ~' the Council's action. 1 Mayor Large stated that he had received complaints regarding the use of Sladden Park for the IncA girls living center. He stated that he had made explanation to the parties as to the nature of the set-up which would probably satisfy the complaints. It was explained that Mr. W. H. ~land had made some complaints regarding the use of the park for this purpose and Attorney Calkins stated that he was handling some legal affairs for Mr. Hyland and he ~ould take 7' the matter up with him on Thesday and the matter was left there. HE Councilman Ste.wart said he wished to report the findings of the Fire and Water COmnlittee in regard to the purchase of fire hose, bids for which had been read at the council meeting of April 28. He said it was his understanding that some of the unbranded fire hose offered at 60 cents and 65 cents per foot was of an equal value wi th "some of the branded hose priced at $1.00 and $1.10 per foot. It was the reco~~endation of the Fire and Water Committee that the city purchase from P. J. Hanns Company 600 feet of 2i inch Hewitt Brand fire hose at a price of 78i cents per foot as per Mr., Hanns' bid of April 21st, and further, that,the city buy from the R. A~ Babb Hardware Company, 200 feet made by Councilman Brownson, seconded by Councilman Barette that the city rescind its action of April 28, in regard to buying only branded hose at $1.00 and $1.10 per foot and accept the recommendation of the Fire and Water Committee to purchase the 600 feet from the P. J. Hanns Company and 200 feet from R. A. Babb Hardwar~ Company.
