The minutes of the fegular meeting of the Common Council held on
Monday evening, May 12, 1941, at 7:30 o'clock p.m. : Mayor Elisha Large pre-
sided over the meeting. Councilmen present were: , Sam C. Bond, Louis Koppe,
E.A. Barette, Ira O. Stewart, Orren Brownson, A.L. Hawn and John Pennington;

The mintues of the previous meeting were presented and orderee
2vplaced on file. The meeting was herewith called to order.
Mayor Large asked if there was anyone in the audience who wanted to
address the council and there being no reply, committee reports were called for.
The Judiciary Committee had not report. Councilman Barette, Chariman of the
Street ~ommittee, said the committe had investigated the alley rUlli~ing through
Block 2 Hamble Addition which Mr. Harmpham had requested the council to vacate
and it was the committee's recommendation that the alley be vacated': Council-
man Barette also reported the committee had investigated the request for the
improvement of Harris Street between 23rd and 24th Avenue and it~s the
corrmlittee's recoir~eddat10n not to improve the street uhless the property owners
~ wished to pay for the same. On motion the recolmneddation of the Street
3 Committee was adopted. .
Councilman Barette reporteduthat Mr. Lamb, Park Superintendent,. was
in need of screens for his house. He said they had contacted Mr. Wm. Lyons of
the NYA and learned they would be glad to make the screens if the city would
furnish the wire and the mOlding. Councilman Barette statedth'at fastenings
for the sdreens were already on the windows and he and Mr. Lamb would make the
4~measurements and turn the job over to Mr. Lyons.
Councilman Barette also brought up the question of the paint job on
the street sweeper reporting he had been unable to contact Mr. Parker, repre-
sentative of the Howard Cooper Corporation, on account of his having been out
of town. The Recorder reported that the Finance Committee had held up payment
for the street sweeper on account of the paint job. However, it was the re-
commendation of the council that the bill for the street sweeper whould be paid,
at this time in order to save the $122.92 discount. The Mayor explained that
)Mr. Parker had said he would take care of the paint job and he WetS sure he

Councilman Stewart, Chairman of the Fire and Water Committee, re-
ported that the property owners living on east 26t~ Street had received the
6~hydrant they had requested.

Councilman Brownson, Chattman of the Health Committee, reporting on
the request of the Eugene Fruit Growers for special action regarding the
handling of their refuse from the canning plant, stated the committee felt this
was a just request and that something should be done for the company. He said
the request was only to haul to the dumpgrounds a certain kind of refuse and
aside from this there would be between 150 and 200 loads of garbage during the
year that the garbage haulers would get f rom the plant. Councilman Brownson
at this time made a motion seconded by Councilman Bond that the Fruit Growers
be allowed a special license at a fee of $20 a year to haul garbage only for .
their own use. At this time Councilman Farrington arrived. Councilman Hawn
suggested that the motion made by Councilman Brownson should be limited to dry
burnable refuse and a fter some discussion th'is was included in the motion.
Icouncilman Hawn also replOrted that the Eugene Frui t Growers had three types
of .garbage, one that went to the farmers to be used as fertilizer, this dry
'refuse that they wer e aSking for a special permit on and also other wet refuse
ifrom the plant,.__ Councilman Barette suggested he thought the fee whould ae
placed at. $40 'per year. At this time City Attorney Calkins pointed out t)la t
~reviously they had'experienced considerable trouble with the garbage ordinance
land a special license,' to the Fruit Growers probably would not meet With the
bpproval of the licensed garbage haulers. Councilman Farrington and Pennington
'said they were afraid that the proposition of granting a special privil~ge to
~he Fruit Growers ws not just the right thing to do. After ~onsiderabilie
aiscussion Councilman Brownson said he would be willing to withdraw the motion
hnd Councilman Bond said he would be glad to withdraw his second. The matter

Councilm&n Farrington, Chairman of the l!'inance ~ommi ttee, presented
Ithe property of.ters beginning with one offer of G.E. Ow.~ $500; $100 cash and
~he balance at ~10.00 per mpnth plus interest at 6% for the lot at the northwest
porner of 4th and Filmore S.reets (243 feet on 4th and 160 feet on Filmore)
Iri th the recomrnedd~tion that the property be held for the appraised value
pf $775. uPon mot1on made and seconded the reco~meftdation was unanimously

The offer of Franklin J. Drury, $50.00, $5.00 cash and the balance at
$5.00 per month plus interest at 6% for Lot 2, Block 4, Hollenbeck Addttion
(100 feet East. of the Southeast corner of 14th Avenue and ~ashington Street)
was presented with recommendation that the offer be accepted and the recommen-
dation was unanimously approved. .
The offer of Thomas W. Fisher, $450 cash, for Lot 10, Block 25,
College Hill Park Addition (120 feet North of "the Northeast corner of 24th
Avenue and Charnelton Street) intends to build about a $4500.00 home, was
presented with the recommendation that the offer be accepted and upon motion
made and seconded the recommendation was unanimously approved.
The Finance Committee recommended the acceptance of the offer of
Paul W. Campbell for client, Mr. T.O. Nelson, $1000 cash, for the west 114.5
feet of Lot 6, Block 3, Kelsayts Addition (Northwest conner of 16th Avenue
and Mill Street). . Contingent on request for permit to erect a duplex. Motion
was made and seconded unanimously approving the recommendation of the Committee.
The offer of Johm W. Gallagher, $200 cash, for Lot 6, Block 25,
College Hill Park Addition (Northwest corner of 24th Avenue and Olive Street)
was presented with the recommendation that the property be held for the app-
raisal price of $350 and the recommendation was, unanimously approved by the

The offer of Sarah Eaton and George W. Finney, $250, cash for the North
50 feet of Lot 3, Block 7, gross Addition (100 feet West of the Southwest
corner of 18th Avenue and Agate Street) was presented with the recommendation
that a counter offer of $305 be extended for their consideration and upon
1 motion made and seconded the recommendation was unanimously approved.
The Finance Conunittee recommended a counter offer of $1300 on the offer
of R. Bdgstad, $75 cash for the north 67 feet of Lot 2, Block 6, Ellsworth
Addition 173.5 feet West and 100 feet North of the Northwest corner of 15th
Avenue and Mill Street) Upon motion made and seconded the recommendati0n was
1 unanimoulsy approved.
The Finance Committee recommended a counter offer of $659 on the
offer of Christina Nelson, $500 cash, for Lot 5, Block 5, Teshn~r Addition
(135 feet west of the Southwest corner of 19th Avenue'and Oak Street) Plans
to build a $4200 hoJjJ.e within 60 days, and upon motion made and Seconded the
15Y recommendation was unanimously approved.
The offer of 'Christina Nelson, $400 cash for Lot 11, Block 12, Driver-
ton Addition (54 feet East.of the Southeast corner of 19th Avenue and Patterson
Street) intaads to build a $4000 home within 60 days, was presented with the
recommendation that the offer be held for the appraisal price of $700 and upon
16 motion made and seconded the recommendation was uhanimously approved.
Councilman Farrington presented the monthly bills for the month of
April with a recommendation that they be approved and warrants be drawn in
payment of the same. The ayes and nays were called, councilmen voting aye:
Bond, Farrington, Koppe, E.A. Barette, Ira O. Stewart, Orren Brownson, A.L
Hawn, and John Pennington; nay: none; absent: none. The recommendation was
'7 declared unanimously approved.

Councilman Hawn, Chairman of the Park Committee, reported on the request
for use of a room in the city hall to be used for the toy loan library stating
that the committee met with Mrs. Burch and Mrs. Bonch and viewed the suggested room
in lb.-a City Hall and it was the c armnitiBee:t s recommendation that the room be made
available to the church group for this p~ose reserving the right to withdraw at
any time the city might need the room. This room being the one that the 'Fire' and
~olice Department had been using. U~on motion by Councilman Pennington, seconded
18rby COllilcilman Bond this recommendation was adopted.
Councilman Pennington reporting for the Sewer 00mmittee regarding a
sewer for an industrial building on 11th Street be~ween Chambers and Almaden
said the committee had gone over the ground with the City Engineer and if the .
sewer was put in on the pres:ent"t;levels part of it would be out of the ground. He
said there Bee.med to be no way to construct a sewer there unless by using a pump
and it was the recommendation of the sewer committee that this project be not
19 ,,-undertaken. U~on motion the recorr..mendation was adopted.
Councilman'Pennington also reported that City Engineer Clubb had been
working on the Brenner Sewer situation and it was Mr. Clubb's recommendation
:that. the lines be changed and three small pipes be used instead of one large
pipe. The cost of, the material would be about $201 and the labor would be
about $50 which would make a total of $250. In this way the city's part would
be only $125, while preViously the city had agreed to spend up to $175. A motion
20t that the sewer be constnucted of three small lines was carried. ..
Councilman Bond reporting on the request of the Humane society for a
contract with the city explained that an item of $800 for fees collected as dog
licenses was included in this years budget as an income and it would be impOSSible
to do anytningfor the humane SOCiety this year because any money paid to them
would have to come out of the Emergency Fund and this was not advisable. He
reported that out of four cities the humane society had reported as operating
under this system, Salem and Marshfield had replied they had no such a contract;
Medford had not as yet answered and Klamath Falls was the only city that had a,
ODntract with the humane society. It was the Police Committee's recommendation
that nothing be done at this time and the matter would have to be brought up at
the budget meeting in the fall. A motion was made by Councilman Pennington,
seconded by Councilman Bond, thamttheerequest for a contract at this time be denied
21v and' it was so ordered.
Councilman Farrington rep~rted that Dennie Koupal had cont~cted him in
regard to a sewer for his two. lots located at the Northwest corner of 19th and
Hilyard Streets. He said he told Mr. Koupal this was out of his line. Councilman
Farrington said he would like to have this matter referred to the Se~~r Committee
Mayor Large said if there was no objection this would be referred to the Sewer
Committee to report back at the next council meeting.

At this time Councilman Stewa~t asked Councilman Bond if the city had
.a dog catcher working now. vouncilman Bond replied there was no~ dog catcher at
the present time and Mayor, Large explained it had not been the council's policy

City Engineer,- and Police Department:'" A statement of sewerage charges billed and
collected for the month of April, 1941,was presented from the Eugene Wa~er Board.

This was the time set for a pUblic hearing on rezoning of Block 1, Harris
Addition and objections and remonstrances were called for. There wa~eno objection
from the audience and the ordinance was read the second time. Councilman Koppe
said he could see no reason why this business district should' be exte4ded any
farther. Councilman Barette said he had looked over the area and if this extension
was granted some very good resid~~~~% in that neighbor-hood would have a lumber yard
ar a wood yard at their back door and he did not feel it was the right thing to
change this to a light industrial district. Councilman Stewart 'said he had looked
at the property and would not ~avor the extension..Upon motion by ~ou.n:cilman

Request from R.E. Buck asking for a reduction in. the cost of a
pavement cut at 710 West 13th Street was read. City Engineer Clubb reported
that Mr. Buck had put up a deposit of $10.00 for this work~ There had been
two cuts made and the bill amounting to $16.00 had been com,guted at the same
ratio as other paving cuts. Motion was m~de by Councilman ond, seconded by
Councilman Farrington denying t~is request and it was so ordered.

Communciation was presented from the Board of Appeals presenting the
request from Paul W. Campbeilil for client, Mr. T.O. Nelson, asking for a permit
to erect a duplex on the lot at the northesast corner of 16th and Mill Streets.
This request is geing made for the reason that a title could not be secured
on the lot at 16th and Ferry $treets without court action. The Board recommends
that this request 'be granted' and upon Jjlotion made and seconded the recommendation
2~was unanimously approved.
Request was also received fromEdi th F. Gardiner for a c.leieilt as.king
for a permit to convert int'o a duplex the old building at 1065 Eighth Avenue
West fDrmerly used by the Adventists as a school building. . No exterior
changes contemplated. The Board recommends that this request be grant.ed and
motion was made and seconded unanimously approving thy recommendation.

A bill in the amount of $21.75 from Mary B. Wheeler, 310 East 14th
Street,. was presented on accouht of injuries received in a fall at the South-
west corner of 10th and Pearl Streets. The matter was referred to the city
3011 Attorney and Judiciary Committee.
A petition f'rom the residents at the .north end of Monroe Street
requesting the installation of a street light at the intersection of the Southern
3l~ Pacific Railroad and Monroe Street was referred to the Fire and Water Committee.
Curb cut applications were presented from the following: C.W. Robin,-
No. 865; Ira Lynd;- No. 866; G.E. Mahaffy;- NV. 862; and No. 863; James Kennedy j_
No. 864 and John P. Williams, No. 860; Clyde McDougal~, No. 861; An applica-
tion for Safew~y Stores, No. 801, was presented for a 17 foot cut. Mr. O.R.
Blair'representing the Safeway StorES was present and explained tha:t they now
had a 35 foot cut that was poorly located and they wished to close up this cut
and make the 26 foot cut as shown on the blue orint attached to the curb cut.
The City Engineer recomnlended that the cuts be. granted and the recommendation
was unanimously approved. A curb cut application was also presenllLed from
the State of Oregon for the University of Oregon, No. 859. The City Engineer
recommended one six foot cut at the alley and one 20 foot cut, both cuts to be
measured off by the Engineering Department. The recommendation was unanimously

A renewal of Package Store Class A license for H.B. Merrell of
Merrell's Grocery, 94 West 4th Avenue, was presented and upon motion by Council-
33~an Bond, seconded by Councilman Barette the license was granted.
Resolution in which the City of Eugene makes application to the
State Highway Commission for e'stablishing 11th Avenue from its junction with
Franklin Avenue to the West City limits as a state secondary highway was pre-
sented and upon motion made and seconded unanimously adopted.

BE IT RESOLVED that the Common Council of the City of Eugene
does hereby make application to the State Highway Commission
of thi State of Oregon that Eleventh Avenue from its junction
with Franklin Avenue to the west city limits be established
as a state secondary highway.

State Highway Commission as an application to that body

Communication was presented from Mr. C.G. Briggs, President of the
Booth Kelly Lumber Company asking for some other arrangement for fire protection
to industrial plants outside of the City of Eugene then that which had already
been adopted by the Council. He said that estimate of 2! mills on the assessed
valuation on the Booth Kelly Lumber Company and the Springfield Plywood Plant
would be about $740 and said that would be entirely out of the question for
them. It was pointed out in his letter that they had fire mains, hydrants

and fire fighting equipment. Also, in the last 30 odd years the city of Eugene
~ Fire Department had only been called twide~ once at the Springfield plant and once
.i<;", at the Wendling plant. Mayor Large asked vouncilmen Stewart, Chairman of the
~~ Fire and Water Cornmitte'i, if he had any recommendation to make regarding this
request and he stated the council had passed a resolution providing for fees for
industr'ial plants outside the Ci-ty of Eugene and felt there Bh61l1d be no change
there. Both Councilmen Farrington and. Koppe explained theSe were firms inside the
cityllimits tha~ had fire fighting equipment of their own and yet they were paying
2i mills as a levy to support the fire department. After considerable discussion
among the council members a motion was made by Councilma.I.1 Bond, seconded by
Councilman Farrington to deny the request and it was so ordered. The Recorder was

An ordinance initiatin~ the vaca~ion of the alley runnigg east from Olive
Street, between 23rd and 24th S reets in block 3, Rughts Addition was presented for
its first reading, and passed to its second and third readings by title under sus-
pension of the rules by unanimou.s .consent of the council and placed for final
passage. The ayes and nayes were called, councilmen voting aye: Bond, Farriggton,
Koppe, Barette, Stewart, Brownson, Hawn, and Pennington; nay: none; absent: none.

Mayor Large reported that Willard Hambelton had 'been employed to take
over the work formerly done by Mr. Johm Fields and he had been working since thea' )
middle of April. At this time he wished to appoint him as an employee of the
City at a salary of $100 per month and the Recorder was instructed to place him
on the regular payroll. . Motion was made and seconded unanimously approving the
37 appointment.
Councilman Barette aBked the Recorder to notify the Eugene Neon Sign
Company that it was necessary for the city to use the lot.,. no.wi:occupd:ed by them

Councilman Barette also reported that Dr. George A. Simon .had contacted
him in regard to a ffrooded condition at 15th and the WGst side of Willanlette Street
He said the curb had been broken out in front of the property and the water over-
flowed onto the lots. The streets seemed to be lower at 15th than at 16th. City
Engineer Clubb stated there was a catch basin on the East side of Willamette that
was supposed to take care of this situation. Dr. Simon was present and further
explained the situation stating he .had previously referred the matter to Mr. C.A.
LeVan, Engineer Clubb and Councilman Barette but nothing seemed to be done~ The
39 matter.was referred to the Street Committee and City Engineer to report back.

Councilman Barette brought up the question of allowing cars to be parked
on what is known as the pakking strip, between the curb and the sidewalk. He
said there were several places around town whele this strip had been cemented
and it was a common ocq\.l.;j;lence for cars to be parked on this strip. Councilman
Barette said he wished to make a motion that this habit of parking on the
parking str~p be investigated. Councilman Hawn stated that it seemed peculiar
tb him that a motion of this kind should be necessary when we already had on
ordinance coverfungthis situation but he would second this motion~-i. On vote the
mOjion was carried. City Engineer Clubb reported that this same situation at
~lth and Pearl had been.prOTIlised several times to be takencare of but up to date
p,othing had beenddoae about it. The Council authorized City Engineer Clubb to
notify the tenants in writing that if this situation was not remedied at a certain
40 date, the date set by Mr. Clubb, the city would make the necessary barriers.
Councilman Farrington asked if. the Police ~ornmittee could not see that the e
was some relief about the doubl~ parking around the post office espcially on
Willamette Street. Councilman l:)ond said he would have the Chief of POl"ice check
