M. Mayor Elisha Large presided over the <meet~ng. Councilmen present were: Sam C. 'Bond, Louis Koppe, E. A. Barette, Ira o. STewart, Orren Brownson, A. L. Hawn, John Pennington and A. C. Farrington; absent: none. 2 The mintues of the previous meeting were presented and ordered placed on file. The meeting was herewith called to order. Mayor Large called on Colonel Waller to explain what he considered needed at the North end of the old Airport to accommodate the troops that will be < passing through Eugene. Colonel Waller explained that not only the troops that had gone South would be coming back but also the troops at those pre~ent stations would be coming up North this' fall. He explained that this ,movement of troops back and forth~would probably be going on for the next three or fout'years at least. He explained that there was no accommodations at the airport at the present time at all and what troops had already stopped there had been invited down to the Armory to take their showers. However, this could not be done anymore as the Armory was now occupied by the Gov't Engineers. He stated that ~ater should be run in out there and that there should be at least 12 toilets and 12 shower heads and that hot water for the showers would be greatly appreciated Colonel Waller added that if 2000 troops stopped there overnight there would probably be a $1000 spent for supplies to say nothing of the boys who would come down town and spendconsiderable money. It was pointed out that there was no sanitary sewer at the airport and that 12th and Polk would be the nearest connec- tion, and that a sceptic tnak would probably have to be used. Councilman hawn , stated that he thought that something should be done at once and that this should be referred to a committee. He stated that the approximate cost of a tiolet unit would be around $50. After some discussion by the Council this matter was referred to Councilman Stewart head of the Fire and Water Committee, Councilman Farrington head of the Finance Committee and W. C. Clubb, City Engineer, and Mr. J. W. McArthur of the Eugene Water Board to investigate and report back at the n~xt council meeting. j, 3 4 Mr. Myrmo was present and asked for some solution in regard to cars parking in front of his place of business at 1937 Franklin Blvd. He explained that t.q.e cars cannot stop OIl the p,ighway and that there is not room enough between the highway and sidewalk for a cal< to park without being partially on the' sidewalk. It was suggested that there was ~ery little sidewalk traffic in that neighborhood and that it might be possible for them to park partially on the sidewalk. Council- man Bond said that he did not believe that permission should be ,granted without further investigation. The matter was referred to the Police Department to report back at the next council meeting. Councmlman Koppe reporting for the Judiciary Committee brought up the matter of the $21.75 bill from Mrs. Mary B. Wheeler in connection with an acci- dent on the sidewalk of 10th and Pearl Streets. At this time an additional bill that had been received from Mrs. Wheeler was read, the amount of which was $11.00. Councilman Koppe said it was the recommendation of the Judiciary Committee that these two bills be not allowed and he made a motion to that effect. This motion was seconded by: Councilman Hawn and carried. The Finance Committee recommended a counter offer of $500 cash on the offer of $475 by Edith Gardiner for a client for a lot 80 x 105.03 on the South side of 10th Avenue West between Polk and Taylor Streets. Upon motioh made and seconded the motion was unanimously approved. The offer of $470 cash by Edith Gardiner for a client for Lot 2, Block 2, Gilrnore Addition (180 feet West of the Northwest corner of 10th Avenue and Polk Street) was presented with the recoIllmendation that the offer be held for the appraisal price of $520 and upon motion made and seconded the motion was unani- mously approved. The offer of Julian Stalsberg of $50 for Lot 9, Dlock 1, Hollenbeck Additio (100 feet East of the Northeast corner of 14th Avenue and Washington Street) was presented with recommendation that the offet be accepted and upon motion made and seconded the recommendation was unanimously approved. The orfer of Harold Moell of $500 cash for Lot 1, Dlock 5, Hollenbeck Addition (Southeast corner of 15th Avenae and Washington Street) was presented with the recommendation that the offer be accepted and upon motion made and secon- ded the recommendation was unanimously approved. The offer of H. E. Cully fDr a clieht of $500 cash for Lot 4 Block 9 Hollenbeck Addition (113 feet South of the Southeast corner of 17th' Avenue a~d Wash~ngton S~reet) was presented with the recommendation that the offer be accepted and upon motlon made and seconde~ the recommendation was unanimously approved. 6 6 7. 8 9 ..... ~494 .~~...." The offer of Harold Moell for $500 cash for Lot 5, Block 9, Hollenbeck Addition (113 feet North of the Northeast corner of 18th Avenue and Washington Street) was presented with the recommendation that the offer be accepted and upon motion made and seconded the recommendation was unanimously approved. The Finance Committee recommended a counter offer of $500 cash on the off r of Maurice Weis of $350 ca.s,h for Lot 10, Block 11, Hollenbeck Addition (Northwest corner of 19th Avenue and Washington Street).' Upon motion made andseconded'the motion was unanimously approved. I j:l fYX~ ~ ~ ..... ~ ~ The request of Dean M. Duvall to redeem Lot 10, Block 8, College Hill Park Addition (120 feet North of the Northeast corner of 21st Avenue and Lincoln Street) was recommended at $196.27; i down and the balance at.$lO per month plus 13 6% interest. Upon motion made and s,econded the motion was unanimously approved. . The Finance Committee recolMlended a counter offer'of $675 cash on the off r of James C. Peebles, of $500 cash for Lot 15, Block 4, Fairmount Addition (200.1 feet North of the Northeast corner of 15th Avenue and Agate Street), with $75 re- turnable if construction started within 90 days. Upon motion made and seconded the 14 motion was unanimously approved. I At this time Mayor Large asked that a communication from Dr. H. H. Norton regarding conditions at the old airport be read. This letter referred to a recent accident.at the airport in whi.ch damage to two or three planes amounting to several thousand dollars was rl~ne and it was recommended that something be done to enforce regulations to keep 1rresponsible perso'ns from tampering wi,th the planes. The letter also pointed out that there was insufficient hanger space at the present time and asked that private flyers be permitted to erect their own hangers. Councilman Brownson and Farrington explained tha t earlier in the year the matter of pri vete _' flyers erecting their 'own hangers had been taken up b~t no definite agreement had been reached. It was pointed out that Mr~ Harrell has a lease on the field and that any arraggements about hangers for private flyers would -have to be taken up with him. The question arose as to whether hangers constructed by the private flyers " should be the property of the city or if they should be allowed to remove the hanger when notified by the city .to vacate.- Dr. Norton suggested that he did not think it would be fair for individuals to pay for construction of the hangers and then not be allowed to dispose of them to someone else or remove them from the grounds if they so desired. He added that the private flyers might be willing to pay a nominal rental for the ground, say $1.00 a month, and that the hangers belong' to whomever constructed them and not the city. It was suggested that this rental of $1.00 a month might go to Joe Harrell because of his contract with the city, but Dr. Norton said that there was lots of room on the North end of the airport and that he was sure Mr. Harrell would be willing to cooperate with the city if the private flyers were allowed to erect their own hangers. A motion by Councilman Brownson seconded by Councilman Stewart that the private 'flyers be allowed to erect the hangers under the supervision of the city engineer and that they be permitted to remove the hangers on 90 days notice from the city. Councilman Farrington said that he would be glad to cooperate wit~ the private Clyers but he felt that this matter should have further_ consideration. A motion by Councilman Hawn, seconded by Bond was made that the Brownson motion be lai'd on ,the 'table, Was carried. The Mayor then referred this matter to the Judiciary Committee and the City Attorney 15 to report back. Councilman Barette re ported that he 'and the Ci ty Engineer investigated the complaint at 3rd and Monroe about the sidewalk and they found that this was on Southern Pacific property and that it would probably be taken care of by the 16 Southern Pacific Co. I Councilman Barette and the City Engineer reported regarding the light asked for at the intersection of the S. P. railroad at Monroe Street. Barette said that they investigated this at the same time and found that there were several trees that needed trimming and the light already in would be moved to the East side of the street. This would be all the light necessary. Mr. Clubb, City Enginee stated that he thought that the Water Board would be agreeable about moving the 17~light and that would solve the situation there. I Councilman Barette said that he had talked with Mr. Parker regarding the painting of the street sweeper and had made arrangements with the Department to deliver the sweeper to Mr. Parker on Wednesday and it would be re-painted over the 18 meekend. I Councilman Barette also reported that he and Mr. Clubb had looked at the trees on lOth and WaShington and they were old trees and in bad shape, but he had 19 done nothing about them as yet. For the Fire and Water Committee, Councilman Stewart said that the matter ~Of the light at 3rd and Monroe had been referred to his committee, but since Mr. 20 Barette had made the report he had nothing further to offer. I 22 I 24 Councilman Brownson also reported on the letter from C. E. Wethered in regard to conditions of ~ubbish and garbage in the 1200 block on East 20th Street. He said he investigated and equId 'find nothing out of the way and did not know whether it had been removed before. he arrived or not~ He stated tha t there was ".' a new house under construction in the block and there was the usual rubbish from th .t": out in front but further than that he could find no nuisance there. '~~t. ~ ~ ~, 23"-> Councilman Brownson stated that he had been asked by the pageant conwitte to allow them to stretch a banner .across Willamette in front of the pageant head- quarters and on motion by Bond, seconded by Brownson this permission was granted. Councilman Hawn reported that some free work had been done for them on Park Road. Mr. Rostein had called him and asked if the city would like to have him run the grader over some of the highplaces in the Park Road and Hawn had assured him that they would be glad to have him do that. Mr. Hawn stated that a little later he hoped they could make some improvements on the Park Road through the Street Department. ' Councilman Hawn also reported that there had been some change in the W. P. A. set up and that some of the activities had been taken over by the school board and the playground committee. Mr. Bailey is not with the Adult Education work anymore and the work is being handled through a traveling man out of Salem. Mrs. C. Neuschwander is the contact party for W. P. A. in the 25 Playground Office, and also helps Mr. Fisher when she is not husy. Councilman Pennington said that the matter regarding a sewer for the D. J. Koupal property at the N. W. corner ofn19th and Hilyard had been referred to his committee. He said tha t Mr. Koupal explained he had paid $125.,99 for a sewer 0 Lots' 5 and 6 in Block 9, Driderton Addition, but that the sewer was clear across th paved street from his lots. Mr. Pennington, stated that he had taken this matter up with the engineer and found that the contract for paving 19th Street had been le tb two different cont:r1actors; one rgnning from Willamette to Hilyard and the other from Hilyard on East. The contractor from Willamette to Hilyard had not put any ny's" across the st.reet flDr sewer connections on the north side,of 19th, but the contractor east of Hilyard Street had put these in, and an additional amount had been charged where the "Y's" were put. It was pointed out that the city owns Lots 7, 8,'9 in this same block where Mr. Koupal's property is located and that these lots are in the same condition regarding a sewer as Mr. Koupal's. Pennington said this connection of the sewer on the south side of 19th Street to the north side of' 19th Street could be put in for about 65 rt per foot. It was the recommendation of the sewer cornmittee that'if Mr. Koupal would pay this additional charge of 65rt) per foot that the city should put in the connection and that it would serve for ' Mr. Koupal's lots and for the three lots that the city owns in that block. A motion by Councilman Pennington, seconded by Councilman Hawn that the connection be made if Mr. Koupal pay this additional charge was carrred. I 26 Chairman Bond of the Police Committee reported that the stop and go traffic signal lights at 13th and Willamette had been completed and were working fine. He made a motiq~ that the bill of Castello and Stocker for this work as per contaact amounting to $1073 be allowed at this time. The motion was seconded by 27 Councilman Barette, and on roll call all councilmen voting aye. Councilman Bond recommended the, transfer of a Package 01ass A Beer Licens from M. B. Merrill (Merrill's Grocery) 94 West ffith to J. A. Morgan and Carroll Kerinedy at 1597 West 11th Street be granted. The motion was made, seconded and carried. - 28 I 29 ....--...:.1 30 I 31 32 At this time Mayor Large said that he had been asked several times to have Polk Street from 6th to 11th, Street be made a through street, and he would re- fer this to the Police Committee to report back at the next meeting. Councilman Barette stated that if grass from the graves in the I. O. O. F Cemetery would be placed in the aisles the city would remove this free of charge, but that it should be in the aisles not later than Wednesday evening and asked that the press make proper notice of this. Councilman Farrington said that he had a letter from A. J. McNeese re- garding a Master Plumbers License, number 284, which had been paid for in the sum of $50. A few days after Mr. NcNeese took out this license he suffered a stroke and had not been a ble to work since, and he asked that part of the fee be returned to him. The figures furnished by Engineer W. C. Clubb showed that only an amount of $8.33 on this license had really been used and a motion was made and seconded that $41.67 be refunded to Mr. McNeese. The motion was carried. CouncilruanFarrington said that he had the regular report concernign the conditions at the Walter's Seiffert Mill in regard to blocking 4th Street. After some discussion by the council this matter was referred to Councilman Barette to investigate and report back at the next meeting. ... r""496 Mayor Large stated that the Government Engineers occupying the armory had asked for a reservation for parki~g space at the armory for them. A motion ~ was made and seconded that the North side of 7th Street from the East line of ~,", Oak Street to the alley running North and South in the block be marked off and ~ reserved for occupants of> the armory. Motion was carried. '1.,.- A communication from the. Planning ,Commission regarding a proposed change If Lot 2, Block 2, Whitney's Addition from a.multiple family residence district to a business district was denied, but it was recornmended that the council issue a special pernlit for the business already occupying this lot. A motion was made 34 and seconded that this reCOmrrieridation ,be adopted. A card of appreciation for the use of Skinner Butte Park by 78 girls 35~of the Springfield League was read and placed on file. A letter from Mrs. Maggie Burbach in regal"d to a retaining wall on the 36~Amazon at 242 '14th Avenue WE'St was read and( ordered placed on file. A letter from the Planning vommission in regard to re-classifying 3 corners of the intersection of 19th and Hilyard was read. A res0lution directing the Planning Commission to hold hearing and initiate proceedings to re-classify the corners at 19th and ,Hilyard accept only the N. W. corner was read and adopted by the council. I I I 37 RESOLUTION " BE IT RESOLVED by the Common Council of the City of Eugene that a proceeding be initiated changing the Southeast corner;' the Southeast corner and Northeast corner, at the intersection of 19th Avenue East and Hilyard Street from a limited business zone to a multiple family classification, leaving the,Northwest corner of said intersection under the present business classification. And that co~y of this Resolution be forwarded to the City Planning Commission and that it be and it is hereby directed to hold a hearing on June 10, 1941 and to prepare a tentative report to be submitted at said hearing, and shall thereupon either adopt said tentative report as a permanent report or reject the same and report its action back to the council. A letter from the State Highway Commission regarding 11th Avenue from Franklin Blvd. to the Western city limits be designated as a through highway was read and ord~red placed on f~le. I 38 39 A second hand dealers license was granted to J. P. Brannen at 972 Oak St. Reports of the Eugene Public Library for the month of April and the Polic Matron for the month of May were read and ordered placed on file. The following recommendations of the Board of Appeals were adopted by , the council: 401 41 Request was received from the Oregon Lumber Sales for a permit to erect a small office guilding on'their property on the east side of Olive Street between Fifth and Sixth Avenues. The Board recommends that this request be granted. A request was received from Clarence N. Crocker asking for a permit to erect a temporary building, on the rear of the lot adjoining his place of business at 56 13th Avenue West. The Board recommends this request be denied. A request was received from L. C. Nicholl asking for permission to go into- the Gasoline and Lube Oil business on the Northwest corner of 6th and Filmore Streets. The Board recommends 'that this request be- denied. A request was recelve~ from the Church of Christ aSking for a permit to erect a church building on the ~outheast corner of the intersection of Mill Street and 16th Avenue with a set-back of eight 'feet from the sidewalk on each street. The Board recommends that they be required to comply with the regular set-back whic wCfuld be ten feet from prop,erty line on 16th and twenty feet from property line on 441 M:tll Street. I 42 43 I A request was received from Arthur Riehl asking for a permit to erect an apartment house on the lot at the southwest corner of the intersection of Ferry Street and 15th Avenue. Ordinance Nwnber 8677 amending K6ll was presentedcfor its first reading and under suspension fo the rules by unanimous consent of the council was pre-' sented for its second and third readings by title and pla ced for final passage. 48 The roll was called with all councilmen voting aye. A resolution allowi~g the tidewater Associated Oil Company to erect a building or structure up to the property line of 6th Avenue West with the provision that any time the city of Eugene shall widen 6th Avenue West that the building 'shall be dismantled back 16 feet at no cost to the city, was read and 49 adopted. ~ ..~.... ~, ~ A motion by Dond and seconded by Drownson that the Mayor and the City Recorder be authoiized to enter into contract with the Tidewater Associatid 50 Oil Company, a corporation, to this effect was carried. RE~OLUTION The Mayor and Recorder of the City of Eugene be and they are hereby authorized and directed to enter into an agreement with the Tidewater .Associated Oil Company, a corporation, respecting the p~operty described in the hereto attached contract, perinitting the seid I Tidewater Associated Oil Company to erect a building orsturcture up to the property line -of Sixth Avenue West, with a provision that at any time the city of Eugene shall widen Sixth Avenue West that the l building shall be dismantled back for sixteen feet, and that no damages shall be claimed by said Tide- water ~ss0ciated Oil Company, or its successors in interest, except for the land taken. . Figures by the City Lngineer regarding the construction of a sewer to the Eugene Plywood Company was referred to the city attorney to bring in an 51 ordinance to the next meeting. The City Engineer also reported in detail on a bunch of sidewalk bills on which second notices had been sent out and to which no replies had been made. The City Engineer asked that these various people be assesed for this work and the 52 list was turned over to the city attorney to bring in the proper ordinance. Ordinance 8678 initiating the vacation of an alley described as follows: All of that portion of the alley in Block 2 of Hamble Addition to Eugene lying east and south of the extension of the north line of Lot 10 Block 2 across the alley, all in Lane County, Oregon; was presented for its first reading and under suspension of the rules by unanimous consent of the council was presented for its second and third readings by title and placed for final passage. The roll was called with all 53 councilmen voting aye. The Recorder reported that C. A. Horton had filed the final report for 54 the audit ending December 31, 1940, this was referred to the Finance Committee. Mayor Large reported that Dr. G. I. Hurley had resigned from the Boxing Commission and that he was appointing at this time Harry Talbot to, that 55 pos,ition. Motion made and seconded that this appointment be confirmed was carried. The Mayor reported that it had been suggested to him that a sign should be erected close to the highway Showing the entrance to the new Municipal Airport. Councilman Bond said that he thought there should be two signs, one for each road th t is intended to be opened. It was the opinion of .the council-that these signs should be erected. Councilman Hawn said that he believed that by allowing the contractors to use a part of the space that they could get these' signs erected free of charge. This was left in Mr. Hawn's hands to ,c,:mtact the contractors and see wha t could be done. 56 57 A letter from Colonel Lyon, head of the R. O. T~ C., stated that the end of the school year activities would be held on Howe Field, May 29th and all the councilmen were asked to attend. 58 Councilman Hawn remarked regarding $5,566,924.49 surplus carried on the city books and he further added that he would like to know of what that consisted. iRe said he understood that numerous pieces of equipment had been traded in on new !equiPment were still carried in that account. It was pminted out to Mr. Hawn that this matter had already been taken up with Mr. Lemon, who is additing the city books for this year and later in the year he would have a report on this subject. Councilman Stewart said that residents on East Broadway were complainin~ about the soot from the New Service Launq.ry Chimney. Councilman Koppe stated that he thought the WOI'st trouble wa when the plants were burnipg sawdust. The councilmen g~nerally thought this was a nuisa ce and that some remedy should be provided. A motion by Pennington seconded by Hawn that the matter be referred to ,a committee to draw an ordinance that would remedy this situation was carried. Mayor Large referred this to the Judiciary Committee and the City Attorney to investigate and bring in an ordinance regulating the 59 situation. ~' ~"", ...",# ~ , Councilman Farrington asked if the Police had made any endeavor to re- medy the double parking situation around the Post Office. He said that there had been no results and that double parking was going on continuously.t Councilman Farrington asked if any tickets for this district had come to the recorder's office b~t it was pointed out that these tickets would be handled in the. police office.
