M.' Mayor Elisha Large presJbded~'over the meeting. Councilmen present were: Sam C. Bond, Louis Koppe, E. A. Barette, Ira O. Stewart, Orren Brownson, A. L. Hawn and John Pennington; absent A. C. Farrington ~~ ~'-'.... , "'~'.., ~- 1 I The minutes of the previous meeting were presented and ordered placed on 2 file. The meeting was herewith called to order. Mr.H. E. Cully addressed the council in regard ,to recent action by the Eugene Realty Board condemning the City and County action concerning the sale 'of tax foreclosed property. Mr. Cully explained that he is not in accord wit'h the real estate board's action and that he did not believe that city lots should be sold at just any price to get them back on the tax rolls. In fact he thought some of the city 10ts were priced too cheaply. He said he was speaking only for himself and not for any group. He further stated that he thought the worst situation regar. ding the city lots was a feeling that there was no established price and the public felt by coming to the city they could get a reduction on the prices asked. It was pointed out by the Finance Committee that they had been adhearing rather closely to the appraised price only when customers had agreed to build within a certain 3 length of time then some concessions had been made. I Dr. Paul E. Anderson acting City Health Officer was present and asked that he might be allowed to read two letters. He read a copy of a letter that had been addressed to the Mayor and the Common Council some two or three weeks previous and also a letter dated June 9th, stating that unless the council would be willing to give him a vote of confidence for both pas t services rendered and new services anticipated he desired the council to accept his resignation as City Health Officer He stated in this letter that he would like it clearly understood that he was actin as City Health Officer only because he felt it a chance to serve in the national emergency rather than for ulterior motives. A motion was made by Councilman Brown- son and seconded by Councilman Hawn that a vote of confidence be extended to Dr. Anderson; Mr. W. L. Van Loan, Chariman of the Lane County Health Service, addresse the council and stated that he thought too t there 'was more or less a misunderstandi in regard to Dr. Anderson's work. He explained that the request for examinations by the Civil Service Board was expressly limited from Dr. Anderson's work. He explained that the budget of the Lane County Health Department amounted to about $30,000 a year but at this time Dr. Anderson was receiving a salary of only $50 a month. He further explained that Dr. Anderson felt that these examinations for the Civil Service Board ,should not be perforrned by him in the capacity of his health work. Councilman Bond asked Dr. Anderson if he had'nt always had the full cooperation of the City Council in his work and Dr. Anderson replied he had. Dr. Anderson stated that rather than have any misunderstanding regarding the present Civil Service examinations, that he would perform this work free of charge at his private office when not working as a Health Officer. Councilman Bond asked Mr. Van Loan what he thought should be done about the Civil Service rule asking the Health Officer to make the examinations and Mr. Van Loan stated he was not prepared to answer that question. Mr. Van Loan said that school teachers were required to have a physical examination once each year, at their own expense and that this repo had to be approved by the City Health Officer. Councilman Hawn stated he thought there was a wrong conception of the work of _the Health Department, and that the Department was responsible to some thousand people for work and that they should be supported by the City Council. Councilman Brownson stated that he thought applican s for Civil Service positions should pay for their own physical examinations and Councilman Bond said that he would agree with that but di~ not quite understand what to do about the rule of the Civil Service Commission in regard to the matter. Attorney Calkins was asked to explain the situation as th the Civil Service making the rules. Attorney Calkins referred to the charter amendment establishing the Civil Service Commission and stated that there was nothing in that regarding the Commission's rights to make the rules. In the last analysis the Council could do whatever they saw fit in the matter. After considerable discussion the question was called for and Mr. Brownson's previous motion, extending a vote of confidence to Dr. Anderson, was carried. The Council then asked that the matter of phy~ical examina tions fort:1the,:'?-pplicants be referred to the Civil Service Board with the request that they change their rule asking that the work be done by the Health 4 Officer. I, 1 I Councilman Barette brought up the question of the curb cut for the Union Oil Company station at 591 Willamette Street. Mr. Zenger representing the Union Oil Company was present and stated that the additional space for cuts asked for at the station would not reduce the parking space on the street. He said the amoun of cuts they now had was 53 feet and they were asking for 57 feet but they would be located ~1fferently from the ones they now had. Helexplained that the new station at 6th and Willamette would be just like the new one at 11th and Willamette. What they were asking for was that the cut on Willamette extend closer to 6th Street. The difference would necessi tat,e the moving of the ornamental light post but that there would still be plenty of room for it just behind the traffic signal light. He stated that the company would be satisfied with cuts located the same as the cuts for the station at 11th and Willamette. Engineer Clubb was asked to explain regal ding the situation. He said it was his recommendation that cuts be allowed ~ r 500 ! -~-:: ~ the same as for the 11th Street station with the exception that the cut on Willa- mette Street should not come closer than 6 or 7 feet to the 6th Street line and (...'1 tha t no left hand turn onto Willamette Street be allowed coming out of the stat ion. c~~ Also, the oil company maintain an arrow directing the traffic so that no left hand C;~ turn would be made. Upon motion made and seconded the matter was referred to the ~' Street Committee and the Engineer with power to act. The Judiciary Committee asked that the request of Dr. Norton regarding- hangers for private flyers at the airport be laid over until next council meeting.. 6 The Committee had nothing further to report. The Finance Committee reco~llended a counter offer of $2150 on the offer' of M. P. Fraley for $1500; $600 for the 100 x 100 tract facing West Broadway; $600 for the 100 x 100 tract facing West lOth and $300 for the remainder of the property, all on the East side of Taylor Street. Upon motion made and seconded the recommen- 7 dation was unanimously ap~roved. A counter offer of $750 was recommended on the offer of $650 by Henry F. Halverson, for the East 55 feet of Lots 11 and 12, Block 7, College Hill Park Addition, with a $50 rebate if construction of a house is started in 6 months. 8Vo Upon motion made and seconded the recommendation was unanimously approved. A counter offer of $750 was recommended on the offer of $650 cash, by Frank Tripp, for the West 50 feet of Lots 5 and 6, Block 7, COllege Hill Park Addition, except the North 6 feet, with a $50 rebate if construction of ,a house is started in 6 months. Upon motion made and seconded the recommendation was unani- 9 "mously approved. The offer of John N. Davies of $500, $100 down and the balance on or before October 1, 1941, at 6% interest for the West 63 feet of the South 90.9 fee~ of Lot 3, Block 17, Fairmount Addition with the exception of the garage,that is on this property, was presented with the recommendation the offer be accepted. l~ Upon motion made and seconded the offer was unanimously approved. . The offer of H. E. Cully for clients, Mr. and Mrs. Arthur Riehl, of $1500, $300 down and the balance at $25 or more per month plus interest at 6% for the East 97 feet of the South 90.9 feet of Lot 3, Block l7,J!'airmount Addition including the garage on the West end of the Lot, was presented with the recommenda- tion that the offer bea9cepted. Upon motion made and seconded the offer was approved. 111 I I I A counter offer of $400 on the offer of $300 cash by F. R. Robinson for the North 50 feet of Lots 1 and 2, Block 1, McCUlly's Addition and the right to reser~e right of way for sewer in the rear, was presented by the Finance Committee. 1 Upon motion made and seconded the recommendation was approved. The Finance Committee recommended a counter offer of $650 on the offer of $500 cash by C. I. Collins for Lot 8, Block 31 of the Replat of Lots 5-6-7 and the North ~ of Lot 8, Block 31, Fairmount Addition. Upon motion made and seconded l~ the recommendation was approved. The offer of Harv,ey A. Wheeler, of $100 cash, for the West 25 feet of Lot 1, Block 4, Victoria Heights Addition was accepted with the provision that the city give a deed to this strip after the city secures insured title to all property l4'in this area. Upon motion made and seconded the reco~~endation was approved. A counter offer of $160 and a warranty deed, no title insurance, was made on the offer of R. Bogstad for $75 cash, for the North 67 feet of Lot 2, Block 15 6, Ellsworth Addition. Upon motion made and seconded the recommendation was approve . The Finance Comm:i,ttee reported that the bills for the month of May had been audited and moved that they be allowed. The roll was called with all present 16 voting aye. Farrington absent. Councilman Barette r~pDrting for the Street Committee asked that the request by Mrs. Maggie Burbach that the city build a retaining wall on the Amazon be held over until the next meeting. I :t..6: ~' , "'... Councilman Brownson reporting for the Health Committee'brought up the matter of the Eugene Fruit Growers request for a permit to haul burnable material to the City Dump. He said it was the committee's recommendation that a special permit be granted for hauling burnable material and moved that the Recorder be authorized upon the payment of an annual fee of $25 to issue a permit to allow the delivery of burnable material to the City Dump. Motion was seconded by Bond and carried~ ' ;""1 ".. ~.'. '--" ~ 19~ 20' Councilman Hawn reporting for the Parks said they had a new citizen in the Park, an elk and he would appreciate a recommendation from the press for a name I Councilman Bond reporting for the Police Committee said that the new law passed at the last legislature regarding traffic would go into affect June 14th and that he would like to have the backing of the entire council in enforcing traffic regulations and he would likeLto have the backing of the council for'the Recorder in imposing fines for traffic ~iolations. Councilman Hawn said that he thought the Stop Street violations should be dealt with more harshly and that the fines for this violation should be increased. Upon motion made and seconded these recommendations were carried. 21' 24 Councilman Bond brought up again the question of the violations at the Firestone Station at Pearl and 11th Streets in regard to occupying the sidewalk. Mr. Bond explained that this matter had been up several times and he thought that something should be, done to put a stop to it. Engineer Clubb, stated that they said they would like to put the matter off for another 2 or 3 months but that if the council directed they would attend to this matter at once. A motion was made and seconded that the company be required to put in barriers to prohibit this practi~e. Motion was carried. The fOllowing applications of the Civil Aeronautic Administration for renewal at the old airport were granted: Remote control quarters and storeroom; Eugene Antenna PoleR/W and the Beacon Site 465 Mile, all of Eugene, Oregon. The leases to run from July 1, 1941 to June 30, 1942. A request from the Union Oil Company that they be allowed to install underground gasoline storage tanks at 6th and Willamette 'as follows:two 2000 Gallon tanks; one 1000 Gallon tank; one 550 Gallon tank, was read and upon motion made and seconded this request was granted. The following recommendations by the Boatd of Appeals were adopted by the Council: Request was received from Milton Jackson asking for a ten foot set-back on the South side of 21st Avenue for the Lot on the East side of Jefferson Street. The Board recommends that he be granted a twelve foot set-back. I 22' 23'\ 25 A request was received from Katherine H.Hacker asking for a waiver of set-back on her property at Southwest corner of the intersection of Onyx Street and 14th Avenue. 'l'he Board re commends that Mrs. Hacker be required to observe a fifteen foot set-back on 14th Avenue and to keep "the same set-back on Onyx Street as her present building. The Board makes this recommendation on account of traffic hazards. 26 A request was received from C. A. Coulter asking for a fifteen set-back for a proposed residence on the rear of Dr. Faust's property at Southwest corner of the intersection of Hilyard Street and 17th Avenue. Hall aSking to be allowed to place a sign 7i feet by 2i feet on the roof of his' building at his golf practice range at 19th and Ferry Streets. The Board recommends that the request be granted. 29" A report of the Eugene Water Board regarding sewer charges for May; a report of the City Engineer for May and a report of the Police Department for May were read and ordered placed on file. 30 Five curb cuts were granted upon recommendation 'by the City Engineer: #872 Clyde 'McDougall'; #873 F. S. Halloc~; #874 John Tiffany'; #876 J. Stalsberg; #877 J. Roy Deal. I 31 A resolution that the Mayor and Recorder-be and are hereby ahthorized and directed to execute a bill of sale to J. E. Coldren for a barn located on the property formerly owned by him was passed. -\. Bergman, to Councilman Bond, Chairman of the Police Comrni ttee, that Joseph Cullender had been found guilty of discourtesy~totthe public and that he be suspended for 10 days without pay was read. Also a letter to Mayor Elisha Large signed by Sam Bond of the Police Committee endorsing this recommendation was read. The letter from Mayor Elisha Large ordering suspension of Cullender for 10 days without pay was read. Upon motion made and seconded this action was confirmed by the Council. Oopies of the above report were delivered to John ~lields, Secretary pro-tem of the 8ivil Service Commission. 33 (copy) LE T T E R Eugene, Oregon June 91;1 1941 Hon. Sam C. Bond Chairman, Police Cownittee Eugene, Oregon Dear Sir: I As Chief of Police of the City of Eugene I hereby prefer charges against Joseph Cullender under the provisions of Ordinance Nol 8469 as adopted by Ordinance No. 8475 pursuant to an initiative petition adopted by the electors of the City of Eugene, as follows: That the said Joseph Cullender has been guilty of discourtesy to the public, in this: That on the 26th day of March , 1941 that said Joseph Cullender was guilty of discourteous treatment of the public in the following particulars; that he undertooK to and did stop a motorcycle on the bridge on E~st Broadway, and thereupon entered into an altercation with and offered to fight the rider of the motorcycle, whereas his strict duty was to either reprimand the manr'1,and let him go or arrest him. I therefore recommend to the Police Committee of the City of Eugene that said Joseph Cullender be suspended for a period of ten days, without pay. ' Hon. It was recommended that he be suspended for 30 days without pay and demoted to a patrolman. Also a letter to Mayor Elisha Large signed by Sam Bond of the Police Committee endorsing this recommendation was read. '~", 9' " .... vl As Chief of, Police of the City of Eugene I hereby prefer charges against Roy Wilcox under the provisions of Ordinance No~ 8469 as adopted by Ordinance No., 8475 prusuant to an initiative petition adopted by the electors of the City of Eugene, as follows: I That the said Roy Wilcox has been guilty of inefficiency and inatten- tion to and dereliction of duty, in the following particulars: That he has en- gaged in a regular occupation for profit, in addition to his duties in the service, in that he has actually been operating what is known as the "Wilcox Cabinet Shop" immediately adjacent to the City of Eugene, for approximately six months past. I therefore recommend to the Police Committee of the City fo Eugene that said Roy Wilcox be suspended for a period of thirty days without pay and that he be demoted trom the rank of Sergeant to the rank of patrolman, henceforth. Bond and the letter signed by Elisha Large' are identica Councilman Brownson reported that the Pageant Committee desired to have, a parade on June 14th at 7:15 P. M., This would be thEhir first publicity stunt and they had requested thetright to rope off 7th Street running West from Willamett to the alley and that they be permitted to erect a temporary stand at that time. 35 Upon motion made and seconded this request was granted. A petition signed by 32 people pretesting against the carnival for the pageant committee allowing them to use the Francis Willard school grounds was read. Councilman Barette explained that he had just been informed by Dr. Cramer that the school board had decided at their meeting this evening to deny the carnival the right to occupy the school grounds and that Dr. Cramer was notifying the carnival cOlnpany to that effect. Owing to this action by the school board no 36 action was taken on the petition by the council. ' Councilman Hawn reporting for the Finance Committee said that the audit for the year 1941 had been presented by Mr. C. A. Horton and that it was a very 37 co~lete and fine report and moved that it be accepted. The motion was carried. Councilman Pennington reported that W. J. Smith, President of the Oregon Wild Life Federation, was present and would like to show the motion pictures regarding the pollution of the Willamette, River. Upon motion the Council adjounned 38 and the picture to be shown in the council chambers following the adjournment. I 1 ,I ~
