Council Chambers, Eugene, Oregon June 23, 1941 / I The minutes' of the regular meeting of the Common Council held Monday ~'1 evening, June 23rd, 1941, at 7:30 o'clock. All councilmen were present with the Q 1 exception of Ira O. Stewart. ~ .;p......... " . The minutes of the previous meeting were read and approved and the meeting 2 herewith called to order. . . Mr. W. E. Hanson presented a petition pretesting against the change of West 4th'Street from Taylor Street to the West City limits from a residence distric I to an industrial district. The peititon contained between 90 and 100 names. David Auld, president of the First Federal Savings and Loan Association, stated that he had about $15,000.00 worth of loans on improved property in that district a that any change from a residential district would be detrimental to the neighborhoo . He stated that when the loans were placed it was with the understanding that it was a resid~ntial district abd that he would like to request the Council not to make the change to a business district. Councilman Bond stated that some if the finest homes in town were there and he did not see the necessity of changing it over to a business district. A motion that the request for a change to an in- dustril district be denied was carried. Mrs. Frank Dunlap was present and thanked the council for their action in the matter. She also entered a protest against the burning of pawdust at the edge of the City limits. She said that recently this sawdust had been moved in closer to the City and that the smoke was a nuisance. Mayor Large explained that the City would have no authority outside the City limits but that the State Fire Marshal had been here and was watching that district 3 and' would not allow this to become a fire menace. k .contract between the City and Dr. H. H. Norton to erect a hangar on the old City Airport was read. A suggestion was made that the hangar should be located a~ decided by the City Engineer and Mr. 'Harrell, who has a lease on the airport. The rent should be paid on the first of the month following the com- pletion of the hangar. Also, a clause be inserted in the contract that the hangar would be moved within~gO days after the City serves notice to that effect. ~ince the rent was only one dollar per month, a year's rental should be collected in advance. A resolution authorizing the Mayor and Recorder to enter into this I 4 , contract was read,and passed by the council. - RE SOL UTI 0 N BE IT RESOLVED by the Common Council of the City of Eugene that the hereto attached contract shall be executed on behalf of the City, by its Mayor and Recorder pro-tem, upon the same being tendered to the City with the si.gnature of H. H. Norton duly '" executing the same. The offer of Etta. O. Hopper of $275.00, $55.00 down and balance at $6.00 per month plus 6% interest for the two lots at the Northeast corner of 4th and Filmore Streets, was held for $275.00, cash. Upon motion made and seconded this 5 recommendation was accepted. The offer of M~ S. Barker of $700.00, $380.00 down and the balance in four equal payments, yearly for the Southeast corner of 6th and Polk Streets, was held 6 for the appraisal price of $1360.00 and the motion was carried. , The Finance Committee .recommended a counter offer of $400.00 on the offer of Clyde. McDougall, for $300.00, $60.00 down and the balance at $30.00 plus interes at 6% each 6 months for Lot 12, Block 1, Gilmore's Addition. Upon motion wde 7 and seconded this recommendation was accepted. I A counter offer of $800.00 was presented by.the Finance Committee on the offer of Mr. and Mrs. Scott Hastings by H. E. CUlly, for the tract of land at the Southwest corner of Broadway and .Taylor at $650.00., Upon motion made and seconded 8 this counter offer was accepted. A counter offer of $800.00 was presented by the Finance Committee. on the offer of-Me P. Fraley by H. E. Cully, for the tract of land at the Southeast corner of Broadway and Taylor at $650.00. Upon motion made and seconded this 1 9 counter offer was accepted. The offer of H. E. Cully for client, Charles 'Decker, of $250.00 cash for the tract of land on the East side of Taylor Street between Broadway and 10 th 10 Street was accepted. Upon motion made and seconded this motion was carried. A counter offer of $400.00 was presented by the Finance Comnlittee on the offer of W. A.Craft's offer of $350.00 cash, $100.00 down and the balance in 24 monthly payments for part of Lots 4 and 5, Huddleston's Addition. Upon motion 11 made and seconded this counter offer was accpeted. '00 IJ:. $120.00 down and the balance on a three year contract for Lot 10 and the South t of Lot 9, Block 5, Fairmount Add~tion was presented and upon motion made and 14 seconded this was approved. A counter offer of $400.00 on F.R. Robinson's offer of $300.00 cash for I the North 50 feet of Lotsl and 2, Block 1, McCully Addition was presented and upo 15 motion made and seconded bhis was approved. A contract allowing W. M. Swanson to construct and maintain a sewer across the East 3 feet of the South 58 feet of the following described property, to-wit: Commence at the Southwest corner of Lot 3, Block 1, Chambers Addition to Eugene, run thence North 160 feet to the South line of 10th Street if extended thence West 79 feet, thence South 160 feet to the South- east corner of Lot 11, Block 1, in said addition, and thence East 79 feet to beginning: was read. It was explained that this lot lay in such a position that there was no other way for a sewer to be laid and the property they would have to move across was owned by the City. The three feet where the sewer would be constructe was next to a property line where no building could ever be placed. A resolution authorizing the Mayor and Recorder to enter into a contract with W. M. Swanson 16 was read and carried. RES 0 L UTI 0 N BE IT RESOLVED, by the Common Council of the City of Eugene that the mayor and Recorder be and they are hereby authorized and directed to execute that certain bargain and Sale Deed for a sewer easement, 1 a copy of which deed is hereto attached. Councilman Barette reporting for the Street Committee regarding the com- plaint of Maggie Burbach that the Amazon was undermining her property, sta ted 17 this was nothing for which the City was: liable. In the absence of Mr. Stewart, Councilman Pennington reported regarding the situation at the old airport for lights and water to be used by the Army~ He stated the Water Board would supply the water line and light wires on Chamber' Street but that the City would have to make provision for going ,any further. It had been the original intention when, the showers we Be proposed that the water lin would extend to the middle of the tract, but Mr. Clubb stated that he had talked to Colonel Waller who Ilad agreed that a hydrant just inside the airport property would be satisfactory. After some discussion a motion was made by Farr'ington and seconded by Brownson that Engineer Clubb be authorized to complete the project from where the Water Board stops in a way satisfactory to the Army. However, the expenditures should not exceed $200.00 to be taken out of the Emer- 18 gency Fund. The motion was carried. Councilman Pennington alEO reported that the matt~r of the smoke nuisance 19 was still being considered by the Committee and that a report woudl be made later Councilman Hawn reporting for the Parks said the Recreation Committee and the Park Corunittee were still considering the swimming pool. He had gathered 1 some information from other cities and during the last week had the opportunity to inspect the swiwning pool at the Dalles. Their pool is 50 x 164 feet and cost $52,000.00 to construct.. It has a bath house a very complete and neat job. They employ 8 attendants besides the manager and in the year of 1940 they lost $1400.00. The work had been done by the W. P. A. and the City had put up $25,000.00. Councilman Hawn did not believe this size plant would be large enoug 20 for Eugene. A letter was read from the Planning Commission in regard to the change of 1 classification of the property at 19th and Hilyard Streets. The Commission state that originally a suggestion was made that three of the corners at 19th and Hilyard be changed to a residence district excepting the Northwest corner and later a request had been made that all four corners be changed. to a residential district. The Planning Commission had inspected the area and laid the proposal to Dlake any change on the table and was referring the matter back to the council. It was pointed out that Dennie J. Koupal owner of the Northwest corner of the in- tersection had sold a part of his holdings for a service station. It seemed to b the policy of the council thbt Mr. Koupal had some rights and they should be re- spected, in that this had been m'ade a business district by the Planning Commissio some time ago. Councilman Hawn asked if there was any other corners in town where a change had been made, making three corners a residence district and the ~'l I other corner a business district. It seemed that there were none on record and -- Mr. Hawn thought it would set a bad precedent to so designate this corner. After "-' ~ considerable discussion a motion was made by Bond and seconded by Farrington ,!..~~ that the ghree corners be changed to a multiple family district excepting only '.':t... the Northwest corner and that the matter be referred to the Planning Commission ~X' to hold a hearing and set a date for a public hearing. The roll was called and those voting aye were: Farrington, Koppe, ~arette: no: Bond, Br~vnson, Hawn and 21 Pennington; Stewart absent. Motion was declared lost. 1 A request from J. E. Mencke and AliceE. Mencke that the I;;;loutheast corner of 11th and Ferry Streets be changed from a residence district to a business district was read. This was referred to the Planning Commission to investigate ' . 22L. and report back. A letter from the Planning Commission stated that on June loth the Cow~issio took up the question of granting a business district from Willamette to the West City limits for both 6th and 7th Avenues and this matter was laid over for f 23 further investigation. A letter from the Planning Commission regarding an application from Chet Lawson for a permit to erect a Cottage Grocery on Lot 9, Block 7, Kincaid Park was read. The Commission explained they had visited the property and had re- co~ended to Mr. Lawson that he submit plans and specification for a building suited to the distridt and providing that the architecture is in keeping with the residence district. A permit then be issued by the council and no further action 24 taken. A letter from the Planning Commission was read in regard to the propriety of requiring business property to provide parking facilities where new building permits were taken out. It was the Commission's recommendation that the council give consideration to the drawing of an ordinance that any business building or buildings in the future pr6vide parking space equal at least to 100% of the floor area of the building. After some consideration this matter was laid over 25 for further study. I Curb cuts for the following were recommended by Engineer Clubb: #878, Wm. M. Walter; #879, W. B. Shaw; #880 Frank S. Hallock; #881 Frank S. Hallock; 26 #882 Radabaugh's Auto Court. The following recommendations from the Board of Appeals were presented to the council and accepted. Request v>Jas received from William G. Guske aSking for a permit to repair and enclose an outside stairway at 31 8th Avenue West. The Board recommends this 27 request be held for the submission of plans and details of the proposed alteration. A request was recieved from Mrs. Velma,Dickson asking for a permit to build a duplex residence on th~ rear of her lot at 1361 West Broadway. The Board 28 recommends that this request be denied. A request was recieved from R. E. Harrell asking for permission to develop the lot at the southwest corner of the intersection of Washington Street and 7th Avenue for bUSiness purposes. The Board r~colnmends that this request be referred 29 to the Pilianning Cormnission. A bill from Jess Hayden on account of $27.21 worth ~f damages to the crank case and engine of a 1941 Plymouth by striking the red stop sign in the center of the street at 6th and Charnelton, was read. A motion by Farrington seconded by 30 Barette that the bill be not allowed was carried. I ~ A permanent report froIn the Planning Commission regarding the extension of a business district on both sides of 7th Avenue from Taylor, West to the City 31 limits was read. An ordinance had its fir'st reading to re-classify certain areas in the following places. That the classification of all pIDoperty from Taylor Street, West to the City limits, on either.side of 7th Avenue West, extefiding to the alley I on the North and to the alley on the South in the City of Eugene be and the same is hereby changed from a single family residence district to a business district. A resolution was passed authorizing the Recorder to publiSh a notice in the Eugene Register Guard not less than three times of a Notice of Hearing to be held at the regular council meeting on Monday, JUly 14, 1941, at 7:30 o'clock P. M. Said 32 notice,to be published within the week of July 7th. Now, Therefore, the City Recorder be and he is hereby directed to prepare and casue to be published not less than three times in the Eugene Register Guard in Eugene, Oregon, a. notice of hearing to. be held at the regular council I'" meeting on Monday, July 14, 1941, at 7:30 o'clock P. A letter from Leonard Keanney, Police Officer, asking for a leave of absence for a year because he has been ~alled for military duty 'with the 20th Radio Intelligence Company at Fort Lewis, was read.' This request is to become effective of June 30th, 1941. It was pointed out that Officer Kearney was on' his vacation the last 2 weeks in June and the ~uestion was r~isedag to wh~ther. or not he 'should be paid for his two weeks vacation at this time. Couhcilman' F~rrington thought t.he council should establish a policy regarding vacations at this time and in the future adhere to it. Councilman Hawn said he believed Mr. Kearney was entitled to the two weeks vacation but to get the matter before the' house, he would make a motion that City employees be granted 'two weeks vacation with pay when they had served for a year or more, but when they were leaving the service, th~ vacation should be prorated as to the amount of time they had served for the year. This motion was seconded by Pennington. Councilman ' Brownson said he felt Mr. Kearney was entitled.to a two weeks vacation with pay' and Councilman Pennington agreed. Af,teT considerable discussion Councilman ' .Hawn said with the consent of his second, he would be glad to change his motion allowing Mr. Kearney the two weeks vacation. Mr. Pennington gave his consent whereupon Mr. Hawn moved that Officer Kearney be allowed to have his two weeks -, 33 vacationwith pay. This was seconded by Pennington and carried. The Library report for the month of May, 1941 was read and ordered " 1 34 placed on file. A letter fronJ, Mrs. G. B. Hirschy of Wabasha, Minnesota, thanking the City for the use of Skinner's Butte Park for a birthday party attended by 42 people was read. She also expressed her appreciation for the fine co-operation received 35 from Mr. and Mrs. Lamb. At this time Councilman Penningt.on was excused from the Council meeting. . Ordinance 8679 completing the vacation of an alley running East from Olive Street between 23rd and 24th Streets in Block 3, Rugh's Addition was presented for its first reading and under suspensi-on of the rules by unanimous conse.nt of the council was presented for its second and third readings, by title and placed for final passage. Mayor Large called for objections and there being none asked 36 for roll call. All councilmen present voting aye: absent Stewart and Pennington. , , At this time, Mayor Large asked that the name of Melicent McKinney be Plac d on the regular payroll as an employee in the Recorder's Office at a salary of $85.00 per month. A motion by Farrington, seconded by Bond to this effect was 37 carrie~. . Mayor Large again brought up the .objections to the musical horns on the automobiles at night. He also referred to the excessive speed by the ambulance drivers. The Chief of Police was instructed to see what could be done in regard 1 38 to these conditions. CounCilman Brownson reported that the pageant committee would like to ereC a permanent sign at both entrances tb the City of Eugene. The Sign to 'be about bill boar~ size. He said he had seen the sign as started and that it would be very good looking. The top of the sign would read that Eugene was the home of th pageant and the lower part of the sign would have a remova'fulepanel on Which othe attractions could be advertised. Mr. Brownson stated that the pageant committee had contacted the Water Boar'd and they were providing the lights for these signs. 'I .The cost of the signs would be approximately $150.00, and the pageant committee , was asking the Fair Board, The Chamber of Commerce, and the City to contribute . $35.00 apiece. CounCilman Bond asked where the money would come from, surely . - not out of the Emergency Fund. Councilman Hawn suggested that the money might come out of the Park Fund, but Barette said he thought that impossible. Hawn suggested the pageant cornmittee might get their money back by making ,a $5.00 char e to any orgalhization wiShing to use the removable panel.
