All councilmen were present. If ....1 \?j. .'" The minutes of the previous meeting were read and approved and the "- 2 meeting herewith ~alled to order. - Mayor Large called for anyone in the audience wishing to talk to the Council. C. F. Hyde, spoke Qn a.pposition to allowing a building permit for a grocery store on Lot 9, Block 7, Kincaid Park Addition.. He explained that all I deeds to tIlis.tract carried certain limitations and that no business of any kind could be allowed in that section. Permit to erect a grocery store under certain conditions had been granted at the Council meeting on June 24th. Attorney Calkins stated that he believed notwithstanding the limitations in the deeds, that the Planning Commission could make othe~ recommendations and the Council if they desired could carry out these recommendations. He said he was not .positive of this and would want more time to look into the matter. Councilman Hawn said if reservations in'the deeds expressed that this Should be only residential district . that he believed the Council should respect their wishes. After some discussion this. matter was referred to the City Attorney and Judiciary Committee to report back at the' .next Council meeting, with the understanding that the Building 3 Inspector would not issue any permits until after that time. ; , Otho E. Garver, representing the Standard Oil Company and the May and ~eadeMotor Company, asked for permission for the May and Meade Motor Company to install a computing gasoline pump at the curb in front of their place. Mayor Large explained that it had been the policy of the Council not to allow anymore c.urb pumps and that none of the old ones in town could be exchanged for the newer ones or any extensive repairs made on them in case 0.1' an accident. Mr. Garver .explained that there had recently been a new one put up by the Texaco company in front of the Willamette Motors. City Engineer Clubb said that there had been ,no .permit issued for this pump and he did not know there was one there. Council- ,. . . man Barette made amotion that the request of the May and Meade Motor Company be held up and that the Street Committee investigate the installing of the pump c at the Willamette Motors and that if the pump had. been installedwfuthout permission I from the Building Inspector, that they be instructed to take the pump out and 4 pay a penalty for having installed it. Motion was seconded by Brownson and carried. At t~is time the Whiskalantes entered the Council Chambers and deposed t~6 Mayor and took over the meeting. They held a session of their court and Mayor Large, City Attorney Calkins, several member~of the Council a~d three or 5 four from the audience were fined by this or:gafl.:fuzation.. ~ . B. .P. Dutke spoke to the Council at this time inregard to certain charges for repairs on his property located as. follows: Tract #64, Lot 4, Block 2, Shel- ton's Addition. He was ~nstructed to take this matter up with Engineer Clubb 6 and if adjustments were in order Mr. Clubb would see to the matter. . Jess Hayden add!essed the Council in~, regaf>d to his claim for damages to his motor car at 6th and Charnel ton Streets where he claimed the damages were done by the Stop button in the middle of the streetl He stated that he was proceeding down the street in an orderly manner and not at an excessive rate . . of speed and he thought the Council should reconsider their action 'and allow the , repair bill which amounted to $27.21. Motion was made by Farrington and seconded .7 by Bond that this request be placed on file. Motion was carried. Mrs'. Mary Ruth Campbell at 284 Pearl Street made. objections to Constructio of sidewalk repairs by the City to her property. She claimed she had recieved - notice from the City to repair her sidewalk and secured the services Of a private contractor and paid him for the work. Some.time after this the crew from the City I came out and started tearing up her sidewalk and cut into a tree that she didl:.:. not think was necessary. She claimed the sidewalk they tore up did not need repairing and that they left a considerable amount of dirt that she had to have hauled away ather expense. As a result she objected to paying for the work done by the City. A motion by Brownson and seconded by Farrington was made that this 8 be left in the hands of the Judiciary Committee and the City Attorney to investigat . A. J. Snider made objections to the cost of repairs for sidewalk on I property that he owns. He claimed that thesid-ewalk repairs were made in the fall of 1940 and that he purchased the property in December, 1940, and the owner of the property claimed there were no liens against this property. City Attorney Calkins explained t~at if the assessment had not been made when he purchased the property there was really no lien against it even thought the work had been done before. Attorney Calkins added that the Ci ty had.,.a right to assess the cost of the repairs at. this time and Mr. Snider would hage to settle the dispute with the former owner. Mr. Calkins stated that it: it had been a newly shingled roof, he would have probably investigated to see it had been paid for and a new section of sidewalk 9 should have been warning that there might be a bill to that effect. A counter offer of $500.00 cash on the offer of Wm. Dion of $450.00 cash for Lot 2, Block 10, .Hollenbeck Addition was recomrnendedby the Finance 12 Committee and upon motion made and seconded this counter offer was accepted. I The offer of H. E. Cully for dlient of $500.00 cash, for Lot 4, Block 9, " Hollenbeck Addition was accepted by the Finance Committee. Upon motion made and 13 seconded this offer was acc~pted. A counter offer of $700.00 for 60 x 100 feet, 100 feet facing 23rd was recommended by the Finance Committee on the offer of Paul W. Campbell for a client of $700.00 cash for Lot 1,. Block 26, ~B~xxxXiocxxiExxw College Hixl Park 14 Addition. Upon motion made and seconded this recommendation was accepted. The offer of M. E. Batchelor of $950.00 cash for Lot 4, Block 2, Maple Croft Addition was accepted by the Finance Committee. Upon motion made 15 and seconded this offer was accepted. The offer of R. C. White of $50.00 cash and the balance at $5.00 per month plus interest at 6% for LotIO, Block 3, Pearl Additio~'.~as recommended for acceptance by the Finance Committee. Upon motion made and seconded this 16 offer was accepted. The offer of B. F. Kutz of $700.00 cash for Lots 5 and 6, Block 6, DrivertonAddition was presented with a counter offer of $900.00 by the Finance 17 Committee. Upon motion made and seconded this counter offer was accepted. A cqunter offer of $150.00 was recommended b[ the Finance Committee on the offer of Margaret M. Chase of $125.00 cahs for ot 16, Block 25, City I 18' Outlook Addition. Upon motion made and seconded this counter offer was accepted. A request by A. J. Gabrialfor refund of $100.00 on Lot 1, Block 5, Chula Vista Park was approved by the Finance,Committee. Upon motion made and 19 seconded thi$ request was granted. The offer of Mrs. AFthur 'Riehl of $400..00, $80.00 cash and the balance at $8.00 per month plus interest at 6% for the South 90.9 feet of the. West 63 feet of Lot 3, Block 17, Fairmount Addition was presented with a counter offer of 20 $500.00. Upon motion made and seconded this counter offer wa~ accepted. The request of Mr. and Mrs. Edward Walker to exchange property in Block 21, Fairmount was approved by the Finance Committee with no expense to 2] the City. . Upon motion made and seconded this request was granted. J - The request for W. T. Murphy to price Lot 8, Block 23, Gross Addition. was answered by the Finance Committee as $500.00. The offer of R. C. White of $400.00, $80.00 ca.sh and the balance at $8.00 or more per month plus interest at 6% for Lot 1, Block 2, WalnutRark . Addition was accepted by the Finance Committee. Upon motion made and seconded 23 thiS offer was accepted by the Council. J The bills for June, 1941, were presented to the Council and upon roll call with all councilmen voting aye, were accepted. Hulegaard, Treas. 2146.88 I Water Board Levy Eugene Water Board 1795.27 Councilman Barette reporting for the Street Committee, reported regarding the 'old barn on Elk Drive. He said Mr. McCully had agreed several times to wreck this barn but that it was still standing. The Recorder was instructed to notify Mr. McCully that if the building was not wrecked within 10 days that the City 25 would proceed to wreck it. , Councilman Stewart reporting for the Fire and Water Committee said he I hoped the Council would approve the Mayor's and his action in sending a fire truck ~o Maycola this afternoon. Mayor Large explained that as he understood the matter from Ray Hicks, the town was burning but that the mill was not effected at that tim and he and Mr. Stewart thought they might save the mill by sendihg the truck up there. He stated that the Fire Department had insturctions not to drive unneces- sarily fast so as to endanger the equipment. The people placing the call with the Fire Department stated that they would be Willing to pay the costs of making the run. It was the op.ini6n of the Council that in spite of recent restrictions placed on runs by tlle Eire Department outside of the City, it was wise to send the .truck up to Marcola. A motion by Hawn, seconded by.. Pennington that a vote of confidence 26 be given the Mayor and Councilman Stewart for their action was catried. ~ r514 - - J -- -- - - -- - Councilman Stewart spoke of a letter he had re~eived from the Pacific Coast Fire Chief's Association, in which they were askipg that Chief Nusbaum be sent to Reno to the convention. Mr. Hawn reporting for the Park Department, ~ done-. on the buildings in Hendrick's Park wi th the view to make them more. sani-tary. .,.- CounCilman Bond, r.eporting for the Police Department, stated that he had . requests from ,two police _officers for leaves of absence. J. T. H. Cullender and Richard Spies. Cuililender was asking tor 60 dayscwithout pay startigg July 16th and Richard Spies asked for 6 mon~ns without pay., starting July 23rd. Bond stated that.. these requests were approved by the Polic-e ComIni ttee. It was pointed I out that at this timei twas almos-t impossible tD get men to accept temporary appointments on the Police Force. Councilman Farrington moved that these requests be not allowed, seconded by Barette and carried. Councilman Bond and Brownson 29 voting no. Councilman Bond reported that the o~ld "New Deal Bowling. Alley"- was asking . foroermission to move from their former adress at 962 Willamette -to number.29 West~llth and that the place was changing ownership, from H. H. Weiss ancl Roy Northam to Roy Northam, Ted McKy, Vernone McRY, and Gilien Dodson, to be known as "U Bowl". They'.::were also asking for a transfer of the heer license from the same _location to the new one under the name of the new ownerShip. A motion bypenningto . 30 seconded by Bond that this change be granted was carried. Councilman Bond presented a letter to be- read by the City Recorder. This letter was signed by 18 civic groups pledging their Elupport to the Eugene Police Department in enfording all traffic regulations,; and urged that all violations be promptly and summarily prosecuted w~thout fear or favor. Councilman Bond stated. in view of the new speed law, he believed that a more strenuous effort be carried on by the Police Department to improve the. traffic situation in Eugene. After some disucssion on this subject a motion was mad.e by Councilman Hawn to the effect that. the Recorder no~if-y. Chief Bergman in a letter that it was the wiSh of the Council that a more strenuous effort be made on the part of the Police Department to improve traffic regulations as to speed, unne.cessary noise of horns and other 3] violations. This motion, was seconded, by Barette, and carried. . I . Councilman Brownson was excused at this -time. Chief Bergman asked if it would be in order for.him to ask for two new men .on the Police Force, he explained that he thought their salaries could be paid. out of the Park.ing Meter fund.. It was suggested this would probably be a good. move but Councilman Bond as Chairman of the Police Committee said he wanted to take this matter up with the Finance Committe.e before anything was done. Hunt requesting for rezoning of his property at the Southwest varner of 7th and Polk Streets was read. This matter was referred 33 to the Planning Commission.to report back. This was t~e time set for hearing of objections for the rezoning of West 7th Street in that the classification of all property from Taylor Street West to the city limits on each side of 7th Avenue West extending to the alley on the north and to the alley on the sout~, in the City of Eugene, Lane County, Oregon, be and the same is hereby changed from a single famiiliy residence district to a business district. There being no objections, Ordinance 8680 was presented for its first reading and under suspension of the rules}by unanimous consent of the council was presented for its second and third readings by. ti.tle and placed for 34 final passage. Roll was called with all present voting aye; Brownson absent. Objections were heard in regard to the vacation of the alley in Block I 2, Hamble Addition lying east and south- of the extension of the north line of Lot 10, Block 2, across the alley, there being no objections Ordinance 8681 was presented for its first reading and under suspension of the rules by unanimous consent of the council was presented for it.s second and third readings by title and placed for fina.l passage. Roll was called with all councilmen voting aye; 35 Brownson absent. A letter dated July 2nd from the Planning Commission was read as follows: . To the Hon. Broadway from~the alley East of High Street was read as follows: I To the Hon. Mayor and Common Cquncil of the City of Eugene Eugene, Oregon Gentlemen: At a meeting of the City Planning Commission on July . . 1, 1941, I was directed as Secretary to transmit to the Council a letter asking that a reclassification proceeding be instituted to re.classify both sides of Broadway from the alley East of High Street to the railroad track, as a business district. Very truly yours, Eugene City Planning Commission by: S. M. C. Councilman Stewart pointed out that the State Highway east of High Street had not been definitely settled and that he did not think. that it was wise to make the reclassification at this time. Councilman Hawn said he understood that the idea of rezoning West 6th and 7th Streets would be before the council at a later date and he wondered what position the council would be in if they turned down. the East Broadway change at. this time. Mayor Large explained that there seemed to be considerable demand for extension of the business area and that some changes would have to be made eventhough it would hurt some property owners. Gouncilman I Koppe explained that he did not feel that it was right ot make these changes unless a majority of the property owners were in favor of the change. A motion by Stewart seconded by Pennington that this change be not made at this time was 3'7, carried. The following recommendations from the Board,of Appeals were accepted by the Council. A request from Elmer H.. Hunt asking to have Lot 1, Block 4, Campbell's First Addition--located at the southwest corner of the intersection of Seventh Avenue and Polk Street--rezoned as business property was referred to the Planning 38 Commission. A request from R. A. Workman asking for a permit to build a residence at the southwest corner of the intersection of, Washington Street and 16th Avenue with a. "set-backtt of ten feet from 16th was presented with the recommendation 39 that this request be granted. A request was received from J. J. McGinty for the Texas Oil Com~any asking for permission to replace a 550 gallon gasoline tank with one of 1000 gallon cappcity at their station at 11th and High~ The Board recommended that this 40 request be granted. A request was received from Ronald M. Wiesmore asking for permission t.o conduct a cleaning and pressing business in the Watson building at 46 11th I 41 Avenue East. The Board recoJllil1ended<that this request be granted. A request was received from Elmer Surdam asking for a permit to be allowed to include a small apartment for his mother in the house he plans to build on Lot 9, Block 6, Teshner's Addition. The Board recommended that this 42 request be -granted. 43 A prppertyoffer from W. Logan Jones was referred to the Finance Committee I A letter from the Pageant Committee suggesting that the City have a 44 float ,in the parade was read and no action taken. A letter from the Civil Service Commission regarding the hearing before the commission of Roy Wilcox was read and the decision of the Civil Service "'- Commission was as follows:- "That the order of the COIT~on Council suspending Roy Wilcox for a period of thirty days without pay and demoting him from the rank of sergeant to that of police patrolman is re~ersed and it is ordered that his 45 rank be restored and his pay be retroactive." A letter signed by Thomas E. Carey, W. A. Cummings and R. H. Parsons representing the business people in the 500 and 600 blocks on Willamette Street requesting that the industrial and pioneer parades fro the Pageant be so routed a~ to inclue that part of Willamette was read. A petition to that effect had ~ 516 - .~~ . . -- - --.... -. - - ._-......- already been presented to the Pageant Committee and no action was tak~n by the 46 Council. ~'!, Application for curb cut by the Jim Brannen Tire Company was not granted. I ~ The following curb cuts were granted by the Council: #883, Dr. F. D. Walker; d:' 884, Merle Short; 885, E. A. Stacks; 886, C~ jL~Felsh; .88?, Anna H. Green; 888, 4? Marion F. McClain; 889, Arthur Riehl; 890, Scott Hastings; 891, V. E. Hoven. A letter from the Shell Oil Company requesting they be given a lease to install equipment to furnish gasoline to the new airport was read. In addition to the letter was a specimen contract that they suggested. The Mayor explained it was impossible at this time to tell just what the require~ents there would be. I Councilman Stewart suggested that probably the selling of gasoline at the new airport should be handled by the City as a source of revenue. It was the opinion of the council that considerable study should be given. this matter before any 48 contracts were granted and no action was taken on this at this time. An Ordinance specifying certain changes for individuals abutting on a certain sewer erected by the City from the west city limits to Garfield Street was.presented. It was pointed out by the City Attorney that a certain part of this sewer had been paid for by the Plywood Corporation and a certain part by the City and that the amount set out in the ordinance as to the service to property owners along the route on the se~er was the amount that should be paid by the people if and Y'lhen they desired to .'connect to this sewer. The Ordinance 8682 was presented for its.firs~ ~ea~ing ~nd there being no objections under suspension of the rules by,unanimous consent of the council was presented for its second and thir,p. rea~ings. py 'title and placed for final passage. Roll was called 49 and all voting"aye: -Brownson absent. '. A request from the S. P. Company asking for a franchise to construct three additional tracks on Lincoln Street just North of the present tracks was read. It was pointed out that the property on which these tracks would be located was S. P. property and that it was in order for the City to grant this franchise. 50 An ordinance had its first reading and was laid qyer. A letter from L.B. S:i.gwart, chairman of. the Electrical Board, was read'. This letter pointed out tha~there were many defects in old electric wiring and I that the prese4t ~lect'rical 'ins'pector c;lid not have the time to make the proper inspections when requests came in for changing wiring in the old houses. The letter stated that the electrical inspector spent about 60% of his time in new inspections and theC!ther 40% of his time on police radios, traffic lights, airport, and the city shops. The electrical board asked that temporary appointment of an extra man be made to inspect all business, apartments, industrial and public buildings. The salary and length of service of this appointment to be determined 5] by agreement. This matter was referred to the fire and water committee. This was the time to hear objections for assessing certain sidewalks. improvements and the ordinance had its first reading on June 9th and was presented at this time, but on account of three or four objections earlier in the meeting 52 this ordinance was laid over until next mee~ing. At this time Mayor Large stated that there was a vacancy in the Police Department on account of a year's leave of absence granted Officer Kearney and he wished to appoint D. W. Carley to be temporary officer in Kearney's place. Motion by Farrington, seconded by Kopp~ that this re'commendation be approved was 53 carried. Carley to be placed on the regular payroll. Mayor Large said that they had a bid from Mr. Coldren of $25.00 for an old machine shop on what was once his property at the new airport. He stated that at this time the shop was being used by the contractors at the airport and that it was satisfactory with Mr. Coldren that the shed be left there until the contractors were through witp it. .A motion by Farrington, seconded by Bond that I 5 this bid of $25.00 be accepted, was carried. 5J Councilman Stewart reported at this time that the smoke nuisance was still being studied and a report would be ~ade at the next council meeting. Mayor Large pointed out that complaints had been made regarding. the length of time the Comfort Station in the park blocks was being kept open. A motion by Hawn and seconded by Farrington that the Comfort Station be kept open from ? A. M. to 9 P. M. on week days and both toilet rooms be kept open for the same I hours on Sunday, was carried. ~he Recorder was instructed to so notify Mr. Bown, 56 caretaker of the Comfort Station. Mayor Large stated that it was necessary to secure a right of way from Mrs. ~cCully at the new airport for a drainange ditch. That the total of this right of way would consist of about three acres. He stated that the city had already offered $250.00 with the understanding that the City would be allowed to keep the fence on what was now the w~st line of the airport for fencing this ditch, but that the price offered by Mr$. McCully had been $300.00.and she be allowed to keep the fence. After some discp.ssiona ~btion was made and'seconded 5'2 that this be left in the handS of Mayor Large for settlement.
