~ The regular meeting of the Common Council held Monday evening July 28, I
,.-~'". 1941 at 7:30 o'clock. Councilmen present were: Pennington, Bond, Farrington,

~ Koppe, Barette, and Hawn and Stewart; absent, Browson..
The minu~es of' the previous meeting were read and ordered placed on file,
2 and the meeting herewith called to order.
Walter S. Garrett addressed the council in regard'to a special set-back
for a garage at his new home at 23rd and Lincoln. The garage was to be under the
house and the entrance to the garage was to be on .Lincoln Street. The regular I
set-back as designated by the building inspector did not give him enough room
and he asked the council if he might be permitted to extend the. garage out four
feet farther than the set-back designated by the building inspector. This would
place the garage about 11 feet from the lot line. Mr. Garrett explained that he
owned a strip of ground 75 feet on 23rd and running back North 180 feet on Lincoln
Street. There was no sidewalk North of 23rd on Lincoln and, he did not believe
that there would ever be a sidewalk placed there. Councilman Barette tnought
the council should not be too hasty in granting this request and added it was not
a good plan to make the change tonight. After some discussion by the council, a
motion was made by Hawn and seconded by Pennington that the City waive the set-
back as established by the building inspector and allow Mr. Garrett to build out
the extra four feet as requested. Motion was carried with all councilmen present
3 except Barette voting aye.
Councilman Koppe reported on the sidewalk for Mrs. Mary Ruth Campbell at
284 Pearl Street, that hadtbeenreferred to him from last meeting. He said it
was the Judiciary Committee's report that Mrs. Campbell. may have made some repairs
on the sidewalk but that she had not cut out the roots to the tree that was causimg
the trouble. The Committee thought the City was justified in doing this work and
cutting the roots of the tree. A motion was made, seconded and carried that the
4 report of the Judiciary Committee be adopted.
Attorney Calkins reporting for the Judiciary Committee in regard to the
application of Chet Lawson for a Cottage Grocery in Kincaid Park Addition, stated I
that he had looked up the law on this matter and he believed that the Planning
Commission and the Council would not be allowed to over-rule the restrictions
that were placed in the deeds in this tract. He said that in some cases courts,
had ruled otherwise but that their ruling would not hold in this case. A motion
was made by Bond and seconded by Stewart that the recommendation of the Judiciary
Committee and City Attorney be carried out and that the building inspector should
5 not allow a permit for the. construction of this grocery store.
A counter offer of $425.00 was made by the Finance Committee on the
offer of T. H. Gredvig of $350.00 cash for Lot 10, Block 2, Hollenbeck Addition
kN.W. corner of 14th and WaShington). Upon motion made and seconded this counter
6 offer was accepted by the council.
The Finance Committee accepted the offer of R. C. White of $400.00, $80.00
cash and the balance at $8.00 or more per month plus interest at 6% for Lot 8,
Block 3, Pearl Addition. Upon motion made and seconded this offer was accepted
7 by the council.

The offer of M. S. Barker Df $700.00, $140.00 cash and the balance at
$140.00 per year plus interest at 6% for the West 110 feet of Lot 10, Block 5,
Kelsay's 2nd Addition, was accepted by the Finance Committee. Upon motion made
8 and seconded this was accepted by the council.
* counter offer of $500.00 was given by the Finance Committee on the offer
of C~ H. Cooper of $450.00 cash for the East 60 feet of Lots 7 and 8, Block 23, I
Gross Addition. Upon motion made and seconded this counter offer was accepted by
9 the council.
The offer of M. S. Barker of $1,000.00, $200.00 cash and the balafice at
$200.00 per year plus interest at 6% for the North 90 feet of Lot 6, Block 2,
R. F. Scott's Addition was accepted; subject to encroachment of the house on the
south side of the property. Upon motion made and seconded this offer was accepted
10 by the'council.
The offer of F. R. Robinson of $100.00 for the North 50 feet of Lot 3, I
Block 1, McCully's Additioh was accepted by the Finance Committee. Upon motion
11 made and seconded this offer was accepted by the council.
A counter offer of $500.00 with $25.00 refundable if construction is
started within ninety days was presented by the Finance Committee on the offer of
Arthur Riehl of $450.00 cash for the South 90.9 feet of the West 63 feet of Lot
3, Block 17, Fairmount Addition. Upon motion made and seconded this counter offer

The offer of Herbert L. Large of $750.00 cash for the West 60 feet of

The Finance Committee recommended that the offer of Cordelia Evans of a",

$1800.00, $360.00 cash and the ba~ance in semi-annual payments for Lots 1 and 16, ~'
Block 7, Fairmount Addition, be held for the ,appraisal price. Upon made and secon-

The offer of Cordelia Evans for a cllent of $375.00 cash for the North 85
feet of Lot 2, Block 4, Rughts Addition was accepted by the Finance Committee.

I Councilman Barette reportedrconceril:ilggtthe:gasoline'pw,np requested by
May and Meade Motor Company. He said it was the opinion of the Street Committee
that unless the other gasoline pumps along Pearl Street should be ordered taken
out that the Council should grant the request of May and Meede. Mr. Barette
stated that the street committee and Mr. Clubb were of the opinion that all curb
or sidewalk pillnps now in use should be ordered removed at some date, whether that
date should be sixty days or six mofiths, he was not sure. Councilman E'arrington
stated that these curb pumps probably dated back to tbe horse and buggy days and
that most of them had a visible supply of gas and were a fire hazard in case of an
accident. Councilman Bond said these pumps were a pioneer of the industry and
were probably put-in before the service stations were being used. The amount of
gas pumped through them probably would be surprising, as they were not used only
for the convenience of the occupant of the building. Councilman Barette stated
that the recommendation of the Street Committee was that a resolution should be
passed ordering these pumps removed. Attorney Calkins explained that if action of
this>kind was to be taken it should be by ordinance. There was some discussion
as to what pumps should be removea, JUSL. vue business district or all outlying
districts as well. Attorney Calkins was instructed to b~ing in an ordinance at
the next meeting to the effect that all of these pumps should be removed, including
outlying districts, not later than January 1, 1942 and that a penalty be included
17 in the ordinance for pumps not removed by January 1, 1942.
Councilman Barette reported that the McCully barn on Elk Drive had been

I Councilman Barette reported that Mr. LeVan and Mr. Clubb had been successful
in handling the pageant crowds in that the seats were promptly provided and promptly
removed and the streets were cleaned up in excellent shape as soon as the pageant
19 was'.'over.
Councilman Stewart asked to have more time concerning the request for an
additional electrical inspector. The Fire and Water Committee would meet again
20 Tuesday evening, July 29th and would have a report for the next council meeting.
Councilman Pennington reporting for the sewer department, said that the
amount of $1500.00 had been set aside in the budget for the construction of a
sewer at 24th and Onyx and if sufficient tax money would be available the department
would ~ike to go ahead with this work as planned. Attorney Calkins explained
that even though all of the money might not come in, the law would allow issuing
warrants against this levy. Mayor Large stated current tax collections would
amount to about 90% and back tax collections would probably bring collections up
to 100% of the current levy. Councilman Pennington said under these conditions
21 they would start to work'i~nediately.
Councilman Bond said it was the recorunendation of the Police Committe that
Fred Haley now making meter collections and repairing the parking meters, be
sworn in as a special officer. Councilman Pennington raised the question of Mr.
Haley being uncer civil service if he was appointed special officer, and Mr. Bond
said that was not the intention. Councilman Bond made a motion to the effect that
I Mr. Haley should be sworn in as a special officer with the understanding that he
was not to be considered a policeman nor under civil service ruling. Motion was
22 carried.
Ordinance No. 8683 levying assessments for sidewalk repairs had its first
reading on June 9, 1941 and its second reading on Jgly 14, 1941 and its third
reading on July 28, 1941. The Mayor called for objections and there being none
asked for roll call. Roll was called with all councilmen present voting aye.
( 23 Brownson absent. Ordinance was declared passed.
I A ordinance amending section 13 of Ordinance 8413 providing for a 16 foot '\
set-back on each side of 7th Avenue from Pearl Street, West to the West city limits.
and a 16 foot set-back on both sides of 6th Avenue from High Street, West to the \
West City limits, was read for the first time and under suspension of the rules
had its second and third reading. The Mayor asked for roll call. On roll call
councilmen present voting aye were: Pennington, Bond, Koppe, Hawn, Farr ington, I
Barette. Stewart no: Brownson absent. The ordinance was then laid over for a
24 third reading at the next council meeting.

Ordinance No. 8684 regarding the use of motor vehicle horns had its first
reading and under suspension of the rules was given its second and third reading.
Roll was called with all councilmen present voting aye. Ordinance was declared

v'l for a sewer connection for Mrs. Carrie T. Anderson, who lives outside the City was
t.:i read. Mr. Clubb stated that Mrs. Anderson contended that certain right of way had
.-.... been granted to the City which entitled her to use the connection without paying

the $5.00 annual charge. Mr. Clubb stated he had some correspondence concerning
this with Mrs. Anderson and could go no further until he ,had instruction from the
council as to what to do. Attorney Calkins reGd the contract that had been given
the City regarding the sewer right of way and said it was his opinion that this I
sewer right of way did not exempt Mrs. Anderson from paying the $5.00 annual charge
A motion was made and seconded and carried that the Recorder be instructed to
notify Mrs. Anderson that the right of way did not exempt her from paying a $5.00
26 annual fee and that this would have to be paid if she wished to use the sewer.
A resolution authorizing the Mayor and City Recorder pro-tem to execute
a deed for a sewer right of way for certain property to Frank A. Tripp and Sadie
Tripp was passed.

BE IT RESOLVED by the Common Council of the City of Eugene
that the Mayor and the City Recorder pro tem be and they are
hereby authorized and directed to make, execute and deliver to
Frank A. Tripp and Sadie Tripp a bargain and sale deed to the
following desciibed real property, to-wit:
A right of.way three feet wide in which to lay
down and maintain a sewer connecting the West
50 feet of Lots 5 and 6, Block 7, College Hill .Park
Addition, with the sewer on.Olive Street, all in
the City of Eugene, Lane County, Oregon, and more
particularly described as follows:
A strip of land 3 feet wide 'along the North line .1
of the East 100 feet of the South 54 feet of Lot 5, ,
Block 7, College Hill Park Addition to Eugene, Lane

A resolution authorizing the Mayor and City Recorder' pro "tem to execute -

The following'recommendations of the ~oard of Appeals were accepted by the
council.
A request was received from W. Logan Jones asking for a reclassification
of Lot 1, Block 5, Chambers Addition, located at the, 'southwest corner of the inter-
section of Taylor Street and 11th Avenue, for the purpose of erecting a service
29 station. The Boar~ recornmends that this request be denied.
A request was received from Harry H. HOOd asking for a permit to move I
the old house at the southuast corner of the intersection of Lawerence Street and
6th Avenue to the rear of the lot with a short set-back as possible. The Board
30 recornmends the permit be granted with a fourteen (14 ) foot set-back.
A request was received from Pietro La Calsi asking for permission to . ,
rent his house at l7~ Lawerence as an apartment house. He stated that he is 7? '
years old and has a pension of $16.00 per month and would like to obtain some incpm
from the property to help on his tax account. The Board recommends,t.hat his requ~s
31 be granted.

asking for a waiver of set-back for a new building to be erected on the south
side of Eleventh Avenue between Willamette Street and the alley to the east. The
Board recommends that this request be granted on condition that they file the
I 32 required contract with the City. ~,

, A request was received from Mrs. Grace L. Lindenood asking for a permit to ~
erect a duplex residence at 1461 Oak Street. As t.his property is just south of 1"':,~',
33 the duplex zone, the Board recommends that the request be granted. ;~:::j,
A request from the Standard Oil Company for permission to construct, maintai
5~ and operate a service pit at the new municipal airport was ordered placed on file.
I A request from Fred Roberts for a refund of $6.00 on building permit
#16008 was read. Mr. ..Roberts explained that due to complications he could not
35 build at this time. a motion was made and seconded that this refund be made.
Two curb cuts were recommended by City Engineer Clubb and granted by the
56 council as follows: #892, E. J. Kieth; #893, J. C. Watts.
The Library report for the month of June, 1941 was read and ordered placed
37 on file.
A request from M. E. Batchelor for permission to erect a garage within
2 feet 6 inches from the property line at 22nd and McMillan was referred to the
38 Board of Appeals.
The Recorder reported that a copy of the 1941 annual report of the Eugene
39 Water Board had heen filed with the Cityl
Councilman Barette reported that there were three bills for work done by
the Street department for private owners that had not been paid. These bills
were as follows: Mr. J. E. Moore, 260 W. 12th; Mr. Gordon Fish, 261 W. 19th; Mr.
A. V. Lewis, 2173 Alder. Councilman Barette stated that he did not care to read ,
the names in open council meeting but wanted to know what should be done in regard
to collecting them. A motion was made and seconded that these three bills be
turned over. to the City Attorney for collection. Councilman Barette further
r~ported that the Street department had been doing this private work without first
I securing a written order to have the work done. He felt that some kind of an
. ,. order sho~ld be prepared and signed by the person authorizing the wor~ before the
: ~ork was started. Upon motion by the council the Judiciary Committee and City ,
Attorney were instructed to prepare forms covering work done by the street depart-
40 ment for private parties.
Mayor Large reported he had a letter from Mr. Herman Kehrli about. Mr.
H. D. Freeman, Planning Expert from Portland, who would be in Eugene either the
latter part of thiS week or the first of next week and that he thought the diffe-
rent council members should meet with Mr. Freeman and accompany him on his surveys.
41 Councilman Barette thought Mr. Clubb should also be with Mr. Freeman at this time.
There being no further business the meeting adjourned.
