All councilmen were present with the exception'of Stewart. ~ 21'" Mr. Roy K. Re~d stated that he had an agreement with Louis W. Soukup to buy a building ,at the old airport grounds, 'this being subject to the approval of the Council. He said that the building would be moved from the grounds in two or three weeks. Councilman Bond stated that it was his understanding that all buildings on the airport grounds were to revert to'the City when the owners were through with them at the airport. It was pointed out that this kind of an agreement was in the contract with Joseph Harrell,' but that this building had been put up by ~r. Soukup. Councilman Koppe stated that as lon~ as the building was not to be moved for two or three weeks that he would like to see the matter laid over at this time. A motion was made by Councilman Koppedand seconded by Councilman Bond that this matter be referred to the Judiciary Committee to report back at the next Council Meeting, was carried. Mayor Large stated that there were several of the oil men present at the meeting, and perhaps it would be better to dispose of the subject at this time. A contract that had been drawn up giving the Standard Oil Company an exclusive right to store, handle, and sell at the City's new airport all Petrolewn products for a period of five years beginnigg February 1, 1942, was read. 'rhis contract provided among other things that the Standard Oil Company should pay the city of Eugene one cent pergallon for all gas dispensed at the airport except th~t part sold or delivered to the United States Govern- ment or any agency thereof or to any regularly established airline equipment. Mr. Brown, Manager of the Shell Oil Company, addressed the Council and objected to any oil company having an exclusive right at the new airport. He stated that the Shell Oil Company and other oil companies would be willing to pay the City a cent or a cent and a half per gallon for gas dispensed at the airport. Mr. Hodley, representing the Associated Oil Company, stated that there was no other airport in Oregon where one oil company had an exclusive right. Councilman Bronson stated that there seemed to be some points not as clear as they might be and that he would like to see the matter put over and if there was an emergency for this to be settled at once, to have a special Council Meeting tomorrow. Mr. Brown stated that he did not understand that there was an emergency at this time as the Government's needs were being take n care of. Councilman Bond asked Mr. Brown that if the Government requested them for service at the airport, would they have to go to the Standard Oil Company to get the gas. Mr. Brown stated that they would not have to and stated that there was Government storage of gas in Eugene at three different oil companies, which was to be delivered only at the direction of the Gover!lillent. Councilman Bond asked Mr. Brown if the Government would put a supply officer here, and Mr. Brown stated that they would. Councilman Hawn said that he thought some steps should be t~ken,immediately so that facilities could be provided at the airport. A motion WaS made by Councilman Bronson and seconded by Councilman Bond that the matter be t)),rned over to a committee. May,or Large suggested that the supplying of gas for the duration of the war might be thrown open to all of the companie s. Councilman Hawn stated that he thought the Council'l first duty vvas to see that the Government's requirements were met and second that the City protect their own interests. Councilman Pennington favored making contracts with whoever would be willing to pay the city the one cent per gallon. Councilman Bronson wanted to know if the other companies would be willing to supply facilities at the airport the same as the Standard Oil Company and Mr. Brown stated that they would. Councilman Bronson at this time stated that he would be willing to withdraw his motion and Councilman Bond stated that it was agreeqble with him. After some further discussion a motion was made by Councilman Bond that the furniShing of gasoline at the new airport be thrown open for the duration of tre war to all of the major companies who wish to sign a contract to furnish facilities and pay the City one cent a gallon except where gasoline was furnished to the United States Government or any department or agency thereof. This motion was seconded by Councilman Hawn and carried. A"" r ;::r .:"~,,'<i'''~ 3~ At this time Councilman Stewart appeared. The Judiciary Corami ttee had no report. 4 ..-.: The Finance Committee reported that the bills had been audited and recommended that warrants be drawn. On motion made and seconded this recommendation was adopted, on Roll Call all councilmen present voting "Aye". Councilman Farrington at this time stated he would like to see some action taken by the Council in regard to the United States Treasury drive to tax Street and Municipal Bonds. Councilman Koppe stated that he thought the City should do something themselves and also request the League 01' Oregon Oi ties to take the matter up. The motion was made by Councilman Farrington that the Mayor be authorized to wire the Oregon Representatives at Washington to use their best efforts to defeat this measure and also request the League of Oregon Cities to wire the Oregon Representatives. The motion was seconded by Councilman Bond and carried. / 5 ~ 596 Councilman ]!'arrington stated that the committee was not ready at this time to report on the matter of fire insurance for the city equipment but would P.' make a report at the next Counc il meeting. 1:.J'l ~ Councilman Farrington stated that he had had some complaints regarding C::~ the situation just West oi'Polk Street on Seventh Street on account of the one way street. He stated he would like to have the City Attorney's opinion regard- ing allowing West-bound traffic on West Seventh for the short distance in order to get into their places. Attorney Calkins stated that this matter would have to be taken up with the ctate Highway Co~nission and he doubted very much if they would allow anything of the kind. Councilman Stewart stated that there was one or two unimproved streets between Sixth and Seventh just Viest of Polk that might be graded and graveled. Councilman Hawn stated that it appeared to him the Council VJas taking up something that was not too much: of their concern. He stated that Sixth and Seventh Streets had been made one way streets in order to improve traffic conditions and if there were some people out there that were inconvenienced 7 _ that it was up to them to remedy the condition. I I At this time, Mayor Large brought up the question of City Employees buying Defense Bonds. He said it had b~en suggested that the heads of the Departments should contact the employees under them. A motion was made by Councilman Brons on that it be recommend edt th.L t the heads of the Departmen ts contact the various employees in regard to signing up for stamps or bonds to be taken out of their salaries at the end of each month. The motion was seconded 8 by Councilman Hawn and carried. The Street Comnittee had no report, only that they were still working 9 on trimming trees and opening plugged sewers. Councilman Stewart brought up the matter regarding the balance due on the new Fire Truck. He stated that the total amount was $9,506.00,on which $6,000.00 had been paid already. The balance could be paid without interest up to March 1, 1942. He stated that they had no further inforrnation as to when the ladders for the truck would be furnished and that a substantial amount should be held out for these ladders., A motion was made, seconded, and carried 10 that $2,000.00 be paid on the truck at this time. Councilman Stewart, reporting for the Fire and Water Committee, stated he had a request from three citizens that a new light be installed on Sunset Boulevard. He stated that there were sharp turns on Sunset Bouievard, and that a street light placed on the second pole up from Fairmount Boulevard would materially relieve the situation, and that he would make a motion that the light 11, be so placed. This motion was seconded by Councilman Bond and carried. I Mr. Stewart reported that all of the out-lying districts and Mills 12 except one had paid up the ir allotment for fire protection for 1942. The Health Department had no report. Councilman Hawn, reporting for the Parr:s, stated tha t an item had been put in the budget for the purchase of pipe for Skinner Butte Park and that this pipe had been purchased and laid away so that there would be no question about 13/'.. getting it for the summer use. Councilman Stewart said that he had a request from the Water Board to install a gate across the road going up to the Reservoir on Skinner Butte Park. He stated the V/ater Board had employed one guard but that he was putting in his time at night between Skinner Butte Park and the Reservoir on College Hill. Mr. Hawn stated it seemed foolish to have on guard putting in his time between the two places. A motion was made and seconded and carried that the Water Board be allowed to erect a gate just above the Junction of the two roads leading to the Skinner Butte Reservoir and that this gate be closed at night time, and that i~ was recownended by the Cou~cil that a guard should be employed for each 14... Reservoir. I The Sewer Committee had no report;, The Police Committee had no report. An ordinance regarding Auctioneers in the City of Eugene requiring a license and imposing a penalty and repealing all former Auctioneer Licenses, having had its first reading on January 26 was read the second time and under suspension of the rules, passed its third reading. On Roll Call, all councilmen present voting "Aye". The ordinance VJas declared passed and nwnbered 8714. I l5~ An ordinance providing for the regulation, licensing operation and equipment of Bicycles within the City limits of Eugene fixing a penalty for ~iolation thereof, and repealing all other ordinances or parts of ordinances in conflict herewith, was read the first time and laid over. Councilman Stewart said that he had taken the time to read this ordinance in detail and, thought that it was very well drawn except for one situation. He stated that he thought there should be so~e regulation in the ordinance regarding this situation. ' Councilman Bond stated that thiwith the tags there had been a lead seal provided and that he thought that in ~'1 Section 3. a Dr'ovision should be made the t this seal should not be broken and that 'j~ he did not entirely approve of the provision ih Section 7, allowing the transfer of ::~ plates from one bicycle to another for persons renting bicycles and that Section 10 allowed no person to ride or operate a bicycle on the sidewalk except for delivery of papers or merchandize and then only in residential sections ~f the City. He stated that he thought that this should be changed to allow chlldren at least under a certain age to ride on the sidewalk. Councilman Bond also stated that there had been $189.56 contracted for plates, seals, and printed matter and that he thought that et., ieasit':.t$1.51~)€lOc sho1}:i:ld be set as ide for prizes. Councilman Hawn stated that he had a meeting during the afternoon with the Parent Teachers Association regarding the swimming pool and that the matter of the Bicycle Ordinance had been brought up at that time.. He said he was heartily 'in favor of setting aside a sum of money for contests for bicycle riders and that a suggestion had been made that the contest should be divided as to ages; that there should be one prize for the grade schoo~, one for the Junior Highschools, and one for the Highschool, and that he recommended the amount of $100.00 be set aside. The matter was left in the hands of the committee to work out amendments to t~e present ordinance. At this time, Councilman Hawn was excused from the meeting. -I 1 Mayor Large repar ted that two dog 1 icenses had be,en purchased one day for the same dog for the H. M. Wheeler family and that they were requesting a refund for one of the licenses, No. 1174. On motion made and seconded, it was 17, ordered that this refund be made. A request from Mrs. J. H. Brown for a refund of fifty cents for a Sewer permit, No. 97Q4, at 1490 West Fifth Avenue was read. Mr. Clubb explained that this permit was not used and on motion made and seconded, the request for 18 __ refund was granted. I A letter from the Board of Appeals was read, stating that they had received a request from L. J. Zumwalt, owner of the business block located at the northea'st corner of the intersection of Willamette Street and Seventh Avenue, asking for a permit to erect a balcony in the office room at 9 East Seventh Avenue. This room is twelve feet by forty-two in dimension, and he asked that he be allowed to erect a balcony twelve feet by twenty-six feet. This is more than 50% of' the floor area and the Building Code allows only 33 1/3%. The letter also stated that they felt, owing to the uncertainty of the class of merchandize stored, tha t the request should be denied. On Illotion made and seconded, the 19_ recommendation of the Board of Appeals was adopted. 20, The following eurb Cut applications were presented: Clyde McDougall, 1418.West Broadway, and T. A. Schofield, 1144 Polk Street. On Motion made and seconded, the requests were granted. Departmental monthly r,eports were read and ordered placed on file. They included the Public Library, Police Department, and Sewage Charges. The Enging~ers monthly report, al so the yearly report of the Engineers, was read and ordered placed on file. 2~ A letter from Mr'. and Mrs. L. G. McCall regarding their curb pump located at twenty-second and Emerald Street, was read. They were requesting that they be allowed to keep the pump in service,their excuse being that it was located so far out and that it was a means of helping them out with the revenue for the store. It was the recoITlliendation of the Council that the pump would have to be removed. 22... 1 A letter from City Engineer, C~ubb, statigg that complaints had been received because the children going to school on Viest Broadway have to walk in the street on account of no sidewalk between Ven Buren and Taylor, was read. The letter explained that there were funds left in the Sidewalk Revolving Fund that could be used to contract this sidewalk if the Council so desired. A motion was made and seconded and carried that the proper steps be taken to provide this sidewalb, and that the Recorder be instructed to advertize 'for bids. 2~ I 24' A letter from D. R. French, representing the Lane County Humane Society, requesting that Lawrence Buckley be deputized as an officer for the Dog Control Board, was read. 'On motion made and seconded, this request was granted. 2fil, 'l'he Recorder reported tha t the Northwest Cities Gas Company and the Oregon Electric Railway Company had paid their Franchise taxes for the year 1941. There had been a request from the Studley Estate for the cancellation of a Lien on Lot 6, Block 7, Huddleston Addition and at this time a resolution authorizing the Mayor and Recorder to issue a Q.uit Claim Deed to the Studley Estate was read. On motion made and seconded, this resolution was adopted with the provision that Attorney Calkins was to examine tlle records at the Court House and that if he found that the City had lost their rights, that the deed would be 26 \ issued. ~ 5:98 I - RES 0 L UTI 0 N :1,[ It: ~~l 1NHEREAS,: oh~,the,;.2~t.hCdayc6f March, 1919, Lane County, Oregon executed and delivered to Eunice Studley a tax sale deed for Lot 6, Block 7, James Huddleston's Amended Addition to Eugene, Lane County, Oregon, as best bidder at a tax sale, which deed was files April 2, 1919 and recorded at Fage 524 of Book 119 of the Deed Records of Lane County, Oregon. 1 " . '\."..9 C): .;x That at the session of the Legislature in 1919 which occurred after this foreclosure and deed, there was a provision inserted that the city could not be forec~osed of its municipal liens by a private purchase butthi~ foreclosure took effect before the, law was enacted. I As a result of this, the city was served December 20, 1918 with summons and failed to answer and as a result was f'o.reclosed of its lien and lost all right to the property, Therefore BE IT RESOLVED that the Mayor and City Recorder b~'and they are hereby authorized and directed to make, execute and deliver a good and sufficient quit claim deed to Eunice Studley from the City of Eugene for the above described land. At this time, a letter of resignation of Fatrolman P. J. Jorgenson 27 was read and on motion made and secomed, the resignation was accepted. At this time, Mayor Large stated that the Street Department had installed some new ideas and was requested that anoth'er man be hired and he stated that he wOlild like to appoint Mr. H. K. Evans of 1636 Fairmount Street for this work. On ,motion made by Councilman Bond and seconded by Bronson this 28 appointment was confirmed. Councilman Bond stated that in front of the Hoffman Jewelry Store, there was a light post in the sidewalk very close to the' street and that one party's fender had been damaged on this post. This matter was referred to the 29~ Street Department for investigation. At this time, bids for the Grading and Gravelling Of Washington Street from the North of Twenty-Second Aven~e to the South line of TWenty-third Avenue and also for the construction of a sewer on the same property were opened.
