i! 7:30 P. M. Councilmen present: Bond, Koppe, Stewart, Brownson, Pennington;

;1 Dave Evans addressed the Council stating that he had been asked by the '
:.'1 employees of the Police Department as their spokesman in regard to the recent
!I cancellation of the six-day Sick Leave. He said it seemed to him that there was
11 a great deal of merit in the Police and Fire Department asking that the time off
ii for Sick Leave be restored. He said that the employees in these departments
:11 were not overpaid and that these two departments did not have the holidays off
I that the other City employees have. At this time Councilman Farrington entered
;: the room. Mr. Evans stated that the members of the Police Force had made some
,j investigation of the different businesses in Eugene and that they would like to
I: have the matter of the Sick Leave investigated farther. Councilman Pennington
II Stated that he would like to hear what the Police Committee had found out regard-
1 I) ing other businesses. Mayor Large stated that perhaps the businessmen in Eugene
:, did not understand all that the City was doing for the employees in the way of
i~ carrying insurance and stated he doubted if many of the other ci ties in Oregon
! were carrying insurance to protect their employees. Councilman Bond stated that
H it was not the intention of the Council to impose any hardship on the employees,
il but that the privilege of Sick Leave had been abused. He stated that counting the
'I two weeks vacation with pay, the hCIlidays, and the 6-dayle'ave of absence amounted
l~ to almost an entire month, and that he did not believe the business firms were
I paying their employees a full yeart:s wages for working only eleven months. Council.l
II man Farrington stated that he believed that doing ~way wi th the Sick Leave would
Ii improve the health of the City employees, and stated that it was a fact that
:1 the Sick Leave had been abused. Councilman Stewart said he was .absent when the
11 last resolution had been passed, but that he wanted to go on record as favoring
:i some kind of Sick Leave arrangement for Ci tyEmployees, and th at he believed the
! City would get value received from an arrangement of this kihd. Councilman
,: Brownson stated he thought that this matter should be discussed further if not at
;! this time at some future date. At this time Councilman Barette entered the room.
:\ Mayor Large asked Chief Bergman if it was not a fact that in 1940 a certain police-
I :i man had been off a full month for which he received pay, and that in addition he
; 'i ~ad his two-weeks vacation. Chief Bergman said the~e was such an occurence either
- I 1n 1939 or 1940. Councilman Farrington also aSked 1f it was not the case where
. :; an employee was supposed to be siCk and was seen in Portland. The Mayor stated
:1 that that was a fact. At this time Chief Bergman said he wished to make his
'I answer a little clearer, and'that Officer Dyer was the one that had been off for
:; a month, and that was on account of an appendix operation, and that he did not feel
" that this could be construed as Chiseling. He said that previous to the time that
ii Mr. Dyer was off, there was another officer that was off a: considerable length ""
;1 of time. No action was taken by the Council.

!j At this time Mr. Broderson, manager of the Telephone Company, stated that
:, the Telephone Company was asking to make certain paving cuts on Hign Street.
II Engineer Clubb stated that the Telephone Company wished to make the cuts and to
:: repair the paving themselves, whereas ordinarily the City was in the habit of
II repairing the paving after the cuts had been made. He said-the Engineer's,
il Department was perfectly willing to allow the Telephone Company to make the
:! paving repairs providing that the Telephone Company would reimburse the City for
2 ,; the Inspector on the job at the rate of $1.00 an hour. Mr. Broderson said that
! this arrangement would be satisfactory to the Telephone Company. The paving cuts
:l to be made to be as follows: Commencing on High Street at the Alley between 8th
, and Broadway, thence North to 3rd Avenue, thence east on 3rd to Ferry Street, thence
;! north to Ferry Street Bridge. On motion by Barette, seconded by Brownson, and
Ii carried, permission. to make these paving cuts as outlined above was granted.

i! At this time Mr. L. C. Culp addressed the Council in behalf of Mr. E. E. Foss
:; who had just in the last day or two taken over the M & M Shingle Company, just
ii outside of the City limits. He stated that Mr. E. E. Foss had alread~ deposited
,! with the Citf. $100.00 to cover fire protection, that under the present circum-
:3 ,I stances the '100.00 would only apply for the balance of the calendar year, and that
i he felt that ~n adjustment should be made on a prorated basis, rather than charge
: Mr. Foss the $100.00 for the remainder of the calendar year. Councilman Pennington
;1 stated tl~t Mr. Foss had contacted him and that it was his opinion that some
1- :,~ adjustment should be made, and Councilman stewart stated that Mr. Foss had also
'; contacted him. The Recorder pointed out that on June 30 the City would have to
i' Change over from a calendar year back to a fiscal year basis, and suggested that
.: this $100.00 payment might be allowed' to run from.July 1, 1942 to June 30, 1943.
I; After some discussion between the Councilmen, a motion was made by Bond, and
:1 second~d by Farrington that this $100.00 payment be allowed to run from
I I: July 1; - 1942 to June 30, 1943, under conditions provided in Resolution No. 280
Ii adopted April 28, 1941, and that Mr. Foss would also hav~ protection for the
~ balance of the month of this June. On vote this motion was carried.

had an offer on a small lot, being part of the north 110 feet of Lot 13, Block 11,
4 Driverton Addition, the offer signed by Earl C. Hefner. Councilman Farrington I
~ explained that he had not had an opportunity to take this matter up with other
,.,~ members of the Finance Committee and this could layover till the next meeting.

Councilman Barette reported for the Street Committee regarding the
request of Mr. George 1'. Hall that the City widen the alley running North fram
5th Street between Willamette and Charnel ton along the East side of the lot
owned by the City. He said it was the recommendation of the street Con~ittee
, that this alley not be widened, but that a larger corner be cut off of the

I City lot at the North end of this alley in order that the trucks might be able
i to make the turn and that the Street at the corner of 5th and Charnelton be
i rounded so that the trucks would have better opportunity to make the turn,
I changing the radius from a two foot turn as at present to a twelve .foot turn.
I On motion by Bond and seconded by Koppe, the recommendation of the Street .Comrni ttee
,
was adopted.
Mr. Barette also reported regarding the request of VerI Thayer for
permission to erect a garage on his lot at 809 West 3rd Street. . Mr. Barette
6 explained that this was a very small lot and an arrangement as requested by
Mr. Thayer could not be very well carried out, and it was the recommendation of
the Street Committee that this request for the building of the garage be denied.
i On motion by Barette and seconded by Farrington this recommendation was adopted.
': Mr. Barette also reported that the Street Committee had gone over the

7 bids for reroofing the City Barn at 101 W. 5th Street and that the Committee was
recommending that the bid of Ray Jacobs in the amount of $1027.85 should be
accepted, stating that this was the lowest bid. On motion made, seconded and
carried, this recommendation of the Street Committee was adopted.
.1 Mr. Barette also stated that the sewer now being constructed by the City
8 i. to accomodate Mr. Sweet and Mr. Shumaker was practically completed and that the
I cost for this improvement would be assessed against these two properties.

I At this time Councilman Farrington stated that a report had come to him
: that a rubber tire was in the bear cage back of the Butte. It was reported that
Mr. Lamb, Park Superintendent had already taken the tire out of th bear cage
9 and turned it over for the rubber drive. Mayor Large stated that he had 'just
,[ made a trip to Spokane and back and that the rubber drive seemed to be progressing
, very well, and that there were stacks of rubber all around.

Attorney Calkins stated that. a large pile of rubber tires had been
10 pointed out to him in the weeds just back of the number 17 tee on the Country
Club Golf Course. Mr. Moore, reporter for the Guard, was present and said that
he would take this matter up with the management of the golf course.
At this time Councilman Pennington reported regarding a letter received
from Mr. Lewis Hoffman, Attorney, regarding the S. A. Peters sewer charge by the
i Chase Plumbing Company in the sum of $21.75. Mr. Pennington said that the first
report he had from the Chase Company was that the repair work was done on private
property, but that after he. had contacjjed Mr. Peters, Mr. Peters had contended
11 that the repair work was just outside of his property line and on the City Sewer
Line. Mr. Pennington said that he contacted the Chase Company again and on
further investigation found that the party that did the work was only a temporary
man and that he was not in the employee of the Chase Company at the present time,
, that the digging for the repair was so close to the property line it was impossible
I to say whether it was on Mr. Peters private property or on City property. There 1
was some discussion regarding the matter and the i~temizedbill showed that a join
./ of four-inch sewer pipe and a joint of four-inch bend had been used in the repairs
and Mr. Clubb pointed out that thi~ must have been on the private property as the
sewer belonging to the. City was a six-inch sewer and would have to be made in
six-inch repairs. A motion was made, seconded, and carried, that the bill be
not allowed.
At this time Councilman Bond stated that Mr. Boggs had paid into the
City the sum of $0.00 as liquor investigation charges concerning the Fir Tree Inn. I
That later he found he could not get a lease from the Highway Commission, and he
had withdrawn the request for a transfer of the license. Councilman Bond stated
inasmuch as no investigation had been made and that the matter had not been
12 before the Council, he wished to move that Mr. Boggs be refunded his $5.00. This
motion was seconded by Mr. Farrington and carried.
The matter'of 'the claim of Mr. McDonald in the sum of $200.00 was left
in the hands of the Judiciary Committee to report back at the next Council meeting.
A letter from:L. K. Shumaker, O.C.D. Commander, regarding activities for

!I Mayor Large stated that the O.C.D. was aSking for more phones to
- Ii be installed in their headquarters in the Fire Department. Councilman Barette
I II stated tha t he. was up to Selem a short time ago an~ that Salem had furnished ,~.,
!I the O. C. D.w~th twelve trunk line phones. Counc~lman Bond stated that ~
Ii while he hated to incur extra expense, that these men were giving freely
~l of their time toward this work, and that it seemed to be hard for them to
14 II get along with only one phone as now furnished by the City. Mayor Large
il stated that it was his opinion that they should be allowed possibly two or
: three more phones. A motion was made by Bond, seconded by Barette, and
~ carried that two more phones be installed for the use of the O.C.D.

';1 A ,letter from. the State Fire Marshall t s office regarding a school to be
;: held on the campus of the University of Washington at Seattle was read. This
15 ~ school had to do with chemical warfare and its d~fense, and would be carried on
!J in ten-day periods during the summer. The matter was referred to Councilman
;; Stewart and he stated he would endeavor to find out if such a school could not
~ be carried out in Eugene a little later.

Ii Mayor Large said that he had reported previously that the War Production
;1 Board had contacted him regarding the taking up of the street car steel rails,
16 I: and tha t Attorney Calkins had written the Southern Pacific Company a letter
i'l regarding the,se rails and that the reply from the Southern Pacific Company
:1 was that they had surrendered all rights to the rails.

II A letter from Mr. D. T. Bayly, Attorney, regarding an accident at 7th
:1 and Polk Streets wi th a Fire Department truck was read. Attorney Calkins
II pointed out that the City did not carry liability insurance on its ~ire trucks
17 l and that he was of the opinion that the City was not liable in this case. He
:1' said it was possible that a suit might be brought against the driver of the truck
:, but he did not think the City was liable in any way. Councilman Stewart stated
:1' that he thought it was unfair to the drivers of the City fire trucks that the
, City did not carry liability insurance. --The letter was or,dered placed on file.

II' A request from the American Legion Post No. 3 for the Pollack Bros. Circus
18:, at the Fairgrounds on June 26 and 27 was granted.

'I .1 A letter from C. M. Coffee regarding street assesments for his property
19 Ii at 825 West 6th Street for the paving of Monroe Street was read and this matter
;1 was referred to the ,Engineer for a report back at the next Council meeting.
;1 A letter from Jack Thomason, 2457 Agate Street, regarding the condition
:j of the alley in his neighborhood was read. It was pointed out that this was an
20:1 unimproved alley and the matter was left in the hands of the City Engineer to
Ii explain to Mr. Thomason the conditions under which he could have the alley
;j improved.

~I A letter from Roy E. Morse regarding certain streets in the Fairmount
21 t! district was read and it was pointed out that owing to the late spring the Street
.j Departmenllt had not been able to make repairs, but that they would be getting
:t at these streets in the near future.
I~ A letter from the Southern Pacific Company signed by Mr. P. M. Krutzler,
1; Roadmaster, regarding the crossing on Monroe Street was read. Councilman
22:1 Farrington stated that the reply was very unsatisfactory and that the crossing
:' was still in bad condition and instructed the Recorder to notify Mr. Krutzler
~ to this effect.

:1 A request from George T. Hall for a refund of, $5.20 on account of over.-
" payment of interest on his property on 9th Street was read. This request for
23 11 refund was OK'd by Mr. Clubb .and it was pointed out that it was a miscalculation
:i of interest. On motion made, seconded, and carried, it was ordered that the
;i $5.20 be refunded to Mr. Hall.

:i A report from the Police Matron regarding acti vi ties for the month of
24:1 May was read and ordered placed on file.

Block 4, Shelton Addition, there was no one present making objections and an
ordinance had its first readihg 6n June 8th was read the second time, and under
29 suspension of the rules was read the third time. On roll call all councilmen
present voting aye; absent, Hawn. The Ordinance was declared passed and
! numbered 8746 .

301 A resolution requiring that trucks transporting logs, poles, or piling, be
required to stop at Railway Bridge Crossings was adopted.

WHEREAS, heretofore the State Highway Commission has issued rules and reg-
ulations governing the transportation of logs, poles, and piling by motor trucks,
effective July 24, 1941 with ammendments, and
WHEREAS, the aforesaid rules and regulations have been adopted and are sat-
isfactory to the Public Utilities Commission of the State of .oregon, and
WHEREAS , the regulations are for the purpose of minimizing hazards involved
in handling such loads across grade crossings,
Now, therefore,
"BE IT RESOLVED, by the Common Council of the City of Eugene endorses the
foregoing regulations and recommends to the Public Utilities Commissioner
that the rules and regulations so issued by the State Highway Commission be I
imposed by the Public Utilities Commissioner's office in connection with, and
as a part of any orders which he may issue authorizing transportation of logs,
poles, or piling by motor truck within the City of Eugene.
A request from the Oregon State Highway Commission for the adoption of
resolutions pertaining to the construction of the new highway at Judkins Point
31 was read. The two resolutions that were asked for by the State Highway
Department were read and on motion made, seconded, and carried, both of these
resolutions were adopted.

municipal corporation, and the route officially adopted for said highway by

til and unless the said City of Eugene will guarantee by resolution officially

mitted upon the right of way of said highway within the corporate limits of said
City, 'which will permanently obstruct or interfere with the free and convenient
flow of traffic over said highway through said City; and will so regulate parking
of vehicles on said streets or avenues traver~ed by said highway that ,the free,
I convenient and safe flow of traffic shall not be impeded; and agree not to impose
unreasonable limitations of speed upon said highway, nor impose any regulations
of traffic which will operate to discriminate against traffic upon said highway
I by giving Undue preference to traffic upon other intersecting streets or avenues.
NOW THEREFORE, IT IS HEREBY EESOLVED by the Common Council of the City
of Eugene, Lane County, Oregon, that no encroachments will be permitted on the
streets and avenues traversed by State Highway No. 1 (U.S. 99) of the State of
Oregon, known as the Pacific Highway, which will permanently or unduly interfere
with the free and convenient flow of traffic along said highway; ,and will so
regulate the parking of vehicles along said streets ahd avenues as not to
impede the free, convenient and safe flow of traffic; and will not impose any
I unreasonable limitations of speed upon said highway, nor impose any regulation

It being understood that nothing in this resolution of agreement by the

WHEREAS, the City of Eugene with the understanding that the Government has
paramount and prior rights to the use of the city's airpor~ and airfield subject
only to actual ownerships of buildings and existing leases, therefore,
BE IT RESOLVED, by the Common Council of the City of Eugene that the City
of Eugene does hereby lease and let unto the United States of America its airport
and airfield located upon Sections 5 and 6 of Township 17 South Range 4 West of
the Willamette Meridian, 'subject only to outstanding leases and ownership .of
, buildings in the control of the City, and the Mayor of Eugene is hereby designated
by the Common Council and authorized and directed to represent the City and make,
execute and deliver that certain lease dated the 23rd day of June, 1942 between
: the City of Eugene and The United States of America.
