Council Chambers, Eugene, Oregon ~: July 27, 1942 1- Iii The minutes of the regular meeting held Monday evening, July 27, 1942, ~~w !'I at 7:30 P.M. All councilmen were present. ...n H i; Mayor Large explained that the Judiciary Committee had asked him to : contact the County Court in regard to some kind of'a working agreement between i' the City and the County for licenses for circuses and carnivals. Mayor Large I, explained tha t he had talked to Mr. Knox and Judge Hurd. and tha t la tel' he had 1 " had a meeting with the two of them; that he had an understanding with Mr. Knox Ii and Judge Hurd, but that it had not been acted on by the County Court, and until ~ that time there was nothing that could be settled. It was reported that the ;; West Coast Carnival would be showing unde~ the sponsorship of the Disabled ~; Veterans about August 10th, and members of the Council felt that whatever , arrangements were made with the County should be completed before this carnival I came to Eugene. After some discussion a motion was made by Farrington and .' seconded by Noppe tha t l'v~ayor Large be ins tructed to complete his arrangements with the County Court. The motion was carried. 1'1 I Councilman Farrington, reporting for the Finance Committee, stated " they had an offer from Mr. Wick?trom, through L. Clifton Culp, realtor, for the north 100 feet of Lot No.5, Block No.6, Croner's Addition. An offer of $300.00 had been made. Councilman Farrington stated that the Finance Committee 2 felt that this was not enough money for the lot, and were making a counter offer of $400.00. By motion the recommendation of the Finance Committee was !, adopted. , ;; Councilman Barette, reporting for the Street Department, said tha t repairs I to the bridges over the Mill Race had been completed, and that they now were 3 I. working on bridges over the Amazon Slough. He said that there had been con- ; siderable work to do on the bridge at 16th and Willamette but that it was :: almost completed. I, t; Councilman Stewart, reporting for the Fire and Water Committee, stated - that Phil S8rgent and Loren.A. Skirvin had been called to the Army, and that in I I the last six weeks three men had left the Fire Department for other work. He" " stated that other men had been recruited for the service and the Mayor had made 4 I appointments to replace the men they were shott, and that the Fire Department , was really short only one man at the present time. He also stated that the 1l :: Fire Department had installed the plywood on the walls and ceiling of the new room of the Fire Department which had been opened last winter. . I: ;: Councilman Bond stated that he had received a request for a new light at 5 24th and Olive. Councilman $tewart said he knew nothing about the request and that consequently he had not made an investigation, but that he would investigate and report back at the next Council Meeting. At this time Mayor Large said he wished to have the Council confirm tem- porary appointments for firemen as follows: F.~~ Von Appen, W.R. Fosnaugh, Victor 6 " R. Moore, and Charles H. Walker, and he also wished to appoint Vera Fair '; stenographer in the Recorder's office, and Dorothy Brown as assistant in the " Recorder's and Treasurer's offices. A motion was made by Bond and seconded by Hawn that these appointments be confirmed and that the names be placed on the monthly payroll. The motion was carried. :4 ~: At this time Mayor Large reported that Robert Lemon hhd stated the 1941 7 audit would be completed in the next two or three days. !, Councilman Brownson, reporting for the Health Department, said that 8 'I the garbage haulers were having some difficulty with the O.P.A. regarding the last raise in prices allowed by the Council. ,:1 Mr. Brownson also reported that he had been out of town and had been 9 unable to have a meeting with the committee regarding sick leaves fior City employees. He stated that he would make arrangements for a date for this Committee meeting. Councilman Hawn said that he had no report regarding the Parks, but that 'I~ had had been cont.acted by Ed Turnbull and Mr. W. F. Gordon regarding the unpaved strip in front of the library between the sidewalk and the curb. He said they 10 stated in their request that since the trees had been cut down, the public I seemed to come across this unpaved parking strip more than before, and this ;! resulted in a great deal of mud and dirt being tracked into the library. There ,I was some discussion regarding the City paying for this work in addition to the ,: regular budget which had been allowed the library. A motion was made by Hawn :; to refer the matter to the Street Committee to report back. This motion was ;. seconded by Pennington and on voice vote was denied. After some further discussion ,i a motion was made by Farrington and seconded by Stewart that the City not pave , the strip for the library. On voice vote the Mayor declared the motion carried, : but Councilman Pennington asked for a roll call. He stated he had not voted 'I but would like to vote no. The , motion was declared carried, five to three. &;1 Councilman Pennington stated that he had had a call ragarding the condition I LA' of the water in the sewer at 18th and Washington Streets. He said stagnant water was standing there and was a breeding place for mosquitoes. Engineer Clubb 11 explained that this was a catch basin where the wateI' ran into a catch basin on one side of the street and came out from under on the other side, and tt~t at this time of the year the only thing that could be done was to use lime or oil on the water to destroy the mosquitoes. During the rainy season there was enough water going through to keep it from getting stagnant. 12 Councilman Pennington also requested that the City oil the alley way where Tenth Street would come through between Hilyard and Alder. Councilman Barette : stated the Street Department would attend to this as soon as they could get to it. I I Councilman Bond reporting for the Police Department, said that a Mr. J. R. I Wright of, Irving contacted him regarding the mowing of private lots. He said that i Mr. 'Wright had a power mower and was just finishing up working in Springfield i and that he would like to mow private lots in Eugene, charging about $2.00 for 13: a regular sized lot. The Recorder was instructed to furnish the name and the addre s i of this party to the Engineer, Police, and Fire "Department, and that when calls regarding private ,lots were received, that they were ,to be given the information that Mr. Wright would be glad to do the work. I At this time Councilman Farrington requested that the matter of double I parking on Oak Street between 9th and lOth in front of the liquor store, he 14: strictly 'enforced. Councilman Hawn suggested that it might be well to cut down : the parking time on the east side of this block to ten minutes, but the matter ~ was left in the hands of the Chief of Police to enforce the double parking ordinance. i I ! Councilman Stewart said that he had been told there were two small boys 15!working at the shine parlor in Dean's place. This matter was re~erred to the I Juvenile Officer for investigation. i I i A request for a curb cut had been received from Chris T. Wilde, 1193 VanBuren 161 Street. ~he Engineer recommended that the cut be granted, and the Engineer's I , i recommendation was adopted. i I A report from the City Engineer for the six months ending June 30, 1942, 17 regarding the Engineer's office, building permits, valuations for the last ten years, the Lien Department, Street and Sewer Departments, and the City Hall, was read and ordered placed on file. The Recorder reported that communication from the State Industrial Accident 18 Commission, stating that the City would be allowed a 25% reduction from base rates ,for the year commencing July 1,1942, had been received. I , Communications from the F'ublic Utilities Commission regarding request for !hauling logs and piling over the streets of Eugene was read. The request of the :Douglass Lumber Company and Charles McCullock were read and on motion by Bond and 19: seconded by Stewart, permission was granted. The Recorder was instructed to write ~to the Public Utilities Commission and request more deflnite details regarding :the routes for: Kenneth Holbrook, Monroe Lumber Company, Fred Lengacher, McKenzie !Lumber Company, L.M. Chapman, Kenneth E. Babcock, Marvin C. Jackson, and Lewis ~Doughty. I I A request from Phil Sargent, employee of the Fire Department, requesting a leave of absence for the duration of the war, on account of his entering the United 20'States Air Corps was read. Also a letter from Loren A. Skirvin, employee of the Fire Department, making the same request, was read. On motion made, seconded, and icarried, these two requests were granted. : I A letter from Charles E. Lindsay, employee of the Police Department, asking , 'for a year's Leave of Absence was read. His letter only stated that it was in ;accordance with Rule No. 26 of the Civil Service Commission, and did not state why . he was requesting a leave of absence. Chief Bergman stated he did not think 21 Mr. Lindsay was going into the Army. A motion was made by Stewart and seconded :by Hawn that this request be denied unless Mr. Lindsay could show that he was going into the armed forces. I .! A resolution prepared by S. M. Calkins, City Attorney, regarding the payment I !of certain taxes on the new municipal airport wes read. Goodwin, chairman of the Eugene Safety Council, regarding the recent enforcement of traffic conditions was read. He said as a 25 result of this work Eugene was now rated in second place among the cities of our class for safety. i~ 26 :\ A new peddler's ordinance had its first readihg and was laid over. 1:1 " " Councilman Barette sta~ed that Neil Bond, an employee of the Street " , 1\ Department had been off for three days on account of the death of his father, , i' George Bond, who was an old employee of the City Street Department. He asked .ir I 27 i: what the Council wished to do regarding the pay for the three days that Neil I' :'J Bond was away from work. Councilman' Koppe stated that in a case of this kind 'I he did not think it hardly right to deduct pay for the three days. August, 10, 1942 ..~ The minutes of the regular meeting held August 10th, 1942, at 7:30 P. M. I ..~ Councilmen present: ... Bond, Barette, Stewart, Brownson, Hawn, and Pennington. Councilmen absent: Koppe and Farrington. Hale G. Thompson addressed the Council, reporting for the Junior Chamber of Commerce. Mr. Thompson, on behalf of the Junior Chamber of Commerce, was aSking permission to show a live gorilla, for the week beginning August 17, 1942. He said that they had received permission from the County to have the cage and stand for the gorilla located in the park block next to the jail. He said that they would 1 like to have the City wave the ,usual license fee. Councilman Hawn stated tha t it seemed to him that this was a reasonable request. At this time Councilmen Koppe and Farrington arrived. After some little discussion by the Council, a motion was made by Hawn and seconded by Brownson that the request of the Junior Chamber of Commerce be granted with the understanding the County Health Doctor would pass on the sanitary facilities. The motion was carried. Iv1r. Crawford, reporesenting the Public Utilities Commission, addressed the Council regarding applications of various parties wishing to transport logs and piling over City streets. He asked that some kind of an arrangement be made whereby, the Recorder's office or the Engineer's office could pass on these requests at once I instead of having them all go before the Council. The following requests for permits for transporting logs and piling over City streets were read by the Recorde~ and permission for these was granted by the Council. McKenzie Lumber Company: Enter City from South on Franklin Blvd., Franklin Blvd. to Broadway, west on Broadway to High, north on High to 6th, and west on 6th to City limits. Marvin C. Jackson: Enter City on West 11th Ave., east to Polk Street, north on Polk to 6th, west on 6th to City limits. Kenneth Babcock: Enter City on Franklin Blvd., Franklin Blvd. to Broadway, west on Broadway to High, north on High to 6th, west on 6th to piling yards. Also enter City on West 11th, east to Monroe, north on Monroe to Blair, and Blair to the piling yards. Fred Lengacher: Enter the City limits on West 11th,. east on 11th I' to Polk, north on Polk to 6th, west on 6th to City limits. 2 L. M. Chapman: Enter the City limits on West 11th, east on 11th to Polk, north on Polk to 6th, west on 6th to City limits. Monroe Lumber Company: Enter City limits on Franklin Blvd, Franklin Blvd. to Broadway, west on Broadway to High, north on High to 6th, and west on 6th to City limits. Also enter City on west 11th, east to Polk, north on Polk to 6th and west on 6th to City limits. Frank A. Tripp: Enter City limits on Franklin Blvd. Franklin Blvd. to Broadway, west on Broadway to High, north on High to 6th and west on 6th to City limits. A motion was then made by Hawn and seconded by Bond and carried that these requests could be cleared through the Engineer's and Recorder's office without taking them before the Council unless there were some special cases that they did not care to pass on. The routes designated by the Council were: Entering the City from the last on Franklin Blvd., Franklin Blvd. to Broadway, west on Broadway to High, north on High to 6th and west on 6th to City limits, or turning north on 6th to Blair Blvd., also entering the West City limits on 11th Street, east on 11th to Polk, north on Polk Street to 6th Ave., and west on 6th Ave. to the City limits; : also entering the West City limits on 11th Ave, east to Monroe Street, north to 18th Ave., and then north west on Blair Blvd. A letter from the Oregon Motor Stages, asking permission to make certain changes in the routing of their busses on City streets was read. "We would like to eliminate on Fairmount Loop Schedule from 22nd and Emerald to 23rd and Emerald, from 23rd and Emerald to 23 and Agate. Then we would like to operate from 22nd and Emerald 22nd and Agate then to 23rd and Agate. This will eliminate two turns that will help save rubber and brakes besides making a better schedule to save time. We would also want to eliminate from 13th and Lincoln to 19th and Lincoln. Then we would want to have from 17th and Willamette to 17th and Jefferson. This would save two turns and also four blocks. We have a 30 minute over 19th from Friendly 3 to Willamette that would take care of W. 19th. As equipment is not 1 available now these four blocks .on W. 19th will give us a chance to go farther out on the River Road to give the people in that district service as far as the Cozy Cour~s. We would also like to operate from 11th and Alder to 11th and Franklin Blvd. From 11th I and Franklin to 13th and Franklin." !Mr. F. E. Smith, representing the Oregon Motor Stages, was present and he : explained why they were asking for these changes. On motion made, seconded, and .: carried the request was granted. The Judiciary Committee had no report. I I .,~ At this time. Councilman Hawn brought up thequestio~ of the City investing .~~ City funds in War Bonds. He stated that there was some $18,000 in the Swimming ~..I Pool Fund and about $39,000 in the Sewage Disposal that might be invested in these bonds. After some discussion this matter was referred to the Finance Committee I to report back at the. next Council meeting. Councilman Stewart, reporting for the Fire and Water Committee, said he 6 had investigated reg8;rding the request for a new light at 24th and Olive, and that the committee was recommending that thisre granted. On motion made, seconded, and carried, this light was ordered installed. The Street Co~~ittee had no report. Councilman Brownson, reporting for the Health Committee, said that the Health Committee had met with the citizen's committee and Attorney E~ans regarding the matter of sick leave for City employees, which had been referred to his committ e. 7 He said it was the Committee's unanimous recommendation that City employees be allowed twelve working days sick leave during anyone year, and this waw not cumulative; no carry-over from one year to another would be allowed, and this take effect for the fiscal year beginning July 1, ,1942. Also, that standard forms be prepared 'for the employee to sign stating that he had been sick and that this form was to be O.K.'d by the head of the department and turned in to the Recorder. A I motion made by Stewart and seconded by Hawn that the recommendation of the Health'" : Committee be adopted, was carried. ! , Councilman Brownson also reported that there was some discussion among the 8 ~: garbage haulers regarding the O.P.A.' ruling that the advance in rates allowed by : the Council shouldn't be put in effect by the garbage haulers. Councilman Hawn said he had no report regarding the Parks, but that the 9 playground commission had completed negotiations with the University for the use of the swimming pool in Gerlinger Hall, and that arrangements seemed to be very sucdessful. He report~d that there had been $105.95 collected so far. The Sewer and Police Committees had no report. II i The Recorder presented the bills of the League of Oregon Cities in the amount ,. I of $416.76 which would be dues from July 1, 1942 to June 30, 1943. Mr. Virgil ! Langtry of the League of Oregon Cities was present and explained to the Council : work that the League is doing for the various cities. A letter from the League ! attached "to the bills stat~d that on account of" changing conditions it was necessar :! to raise the rate per capita from one cent to two cents. Mayor Large asked Mr. ~ Langtry if Bortland was corning in under these 90nditions and Mr. Langtry stated ! that the City of Portland was paying in about $5,000 and in addition had made a : special payment of $2,000 for some extra work. Councilman Koppe stated that he ~was in favor of maintaining membership in the League of Oregon Cities. Councilman 10 ! Stewart said that he was also very much in favor of maintaining membership in the I League. There was some discussion about what the Eugene Water Board paid the League of Oregon Cities for their part of the membership. Mr. Langtry stated tlEt . he was not sure what the payments were but he was of the opinion that they were : for legislative purposes only. A motion was made by Hawn and seconded by Bond : and carried that the matter of payment of this bill be referred to the Finance : Committee and that the Finance Committee take the matter up with the Eugene Water : Board wi th regard to what part should be paid by the Water Board. At this time the Recorder .read a letter from A. C. Dietz, Juvenile Officer, I regarding the two boys working in Dean's Shine Parlor at 865 Willamette. Mr. Dietz said that he found that these boys were both from poor families and had beenworkin I there for some time, making about $40 or $50 per month. He reported that the law : states that there shall be no minors or juveniles employed any place where beer i or wines are solk, and that he had given the mamagement till Saturday, August 8th, 11. to obtain other help. He stated also that he had checked all the places in Eugene where they have a shine parlor and where they also sell intoxicants, and had re- I quested them to obtain older help if they had juveniles working for them~ Mr. Diet ! was present at the meeting and stated that the two boys in question were about I 10 and 15years old. He also stated that he wished to thank the Police for the kind consideration shown him since he had been engaged in this work. CO\lncilman Bond spoke of the small boys selling newspapers Eiround the depot I I and on the streets after 9 o'clock at night. Mr. Dietz said this was a hard : situation to handle but that he had asked the agents for the Oregonian and Journal ~ to help keep these small boys off the streets after nine. He stated that after 12 I school statted he hoped to be able to keep all of the smaller children off the strets after the curfew time. He said later on he might ask the Council that the curfew be extended from nine to ten, but that he was not ready at this time to make that kind of recommendation. Baker asking ~ for a permit to build a six foot a~dition on the front of her house at ,I 1107 Twenty-fifth Avenue East. This addition would bring the front of the 14 :1 house wi thin thirteen feet of the sidewalk. Councilman Barette stated that this was a vacant :; corner and Mr. Hyland had pruchased it for business purposes and that he thought i' it was in much better condition since Ivrr. Hyland had taken it over. The peti tion :1 stated that there was lumber piled in the street and this matter was referred to the Street Department to report back at the next meeting. A request from H. P. Dixon for a leave of absence on account of being called to the Army was read and also a request fronl Ray Hicks, Jr., for a leave of 16 absence on account of betng called to the Army, and on motion made, seconded, and carried, the request of both of these gentlemen,t were granted. . ~ The resignations of Douglas E. Volz from the Fire Department and Charles 17 C. Lindsay from the Police Department were read and ordered placed on file. A request of Cole Bros. Councilman Hawn asked regarding reports of inspections by the 1!'ire Depa rtment. h He said he knew the Fire Department had had some difficulty regarding employment, 21 I: but tha t he thought these inspections should be kept up. Councilman Hawn stated that his main objection to I .:~.,Z~ the appointment was that the man receiving the highest grade had not been appointed. v: i Councilman Brownson asked if consideration had been given to the wishes of the . Chief in regard to this appointment. The Mayor explained that Chief Bergman had said tHat ei ther of the men would be satisfactory to him. rrhe Mayor explained that there was only 6/10 of a point between the two highest grades and that the ma tter of seniority on the :F'orce had had some bearing on the appointment; that Skipworth had had almost twice as many years service as Brown. Councilman Hawn stated that he was not particularly impressed with the questions in the written examination for this appointment and that he thought in2a promotion to sergeant the 22 appointment should be made with the idea in mind that sometime these men,might be successors to the Chief of Police. Councilman Barette stated that he was acquainte with Officer Brown and that he seemed to be very muc~ interested in his work, and was very efficient and that he was favorable to the appointment of Brown. The question was called for and on roll call Councilmen voting aye; Bond, Farrington, Koppe, Stewart, and Pennington. Councilmen voting no; Barette, Brownson, and Hawn. A request by Elsie Miller for perm ssion to run a boarding house at 217 East 23 11th Avenue, which had been approved by the Chief of Police, was granted. The Recorder reported that a warrant for $566.62 had been received from the 24 Secretary of State for gasoline tax refund. ~",j . The Recorder also reported that $900.00 had been received from Rural Fire 25 District No. 1. .1 I At this time Councilman Farrington said the Finance Corrnnittee was ready to report on the property offer received from D. P. Husband, for clients, and tha t 26 the Finance Committee was recommending that the offer be accepted. On motion made, seconded, and carried, the recommendation of the Finance Committee was adopte . Councilman Koppe, reporting for the Judiciary Committee regarding the $100 license fee paid by the Russell Bros. Circus, stated that it!was the reconwendation 27 of the Judiciary Committee that this license fee be not 'refunded. A motion was I made by Bond and seconded by Hawn that the recommendation of the Judiciary Committe be adopted and the motion was carried.
