All Councilmen were present with the. exception of Mr. Hawn. ~~, I The Judiciary Committee had no report. I Property.offers were presented by the Finance Committee at this time. The II. offer of J. M. Kennedy, $200.00 for the north 60 feet of lot 1 in block 6, Shelton' I' Fir~t Addition was rejected, ~nd a count~r offer of $250.00 was made. The offer ) of.l:!i. G. Blown to trade a str1.p of land 1.1;1 Tyler Street 13'.33 feet wide from ~ 8th to 9th, for city lot 40.2 feet by 59.92 feet at N. W. corner of 9th and Tyler 111 Streets was accepted. The offer of John Allum of $210.00 cash for lot 10 in , block 3 of Pearl Addition except that part in the Amazon ditch, was accepted. I: The offer of J. P . Galvin, $50.00 cash for the west 59 feet of lot 4 in block I: 3, . Agate Plat, was rejected, but a counter offer of $75.00 was made. The offer III of the. Sam Rugh Realty Company for Frank Wills, $1,000.00 cash for 'the. East 90 ~ feet of lot 6 and the south 40 feet of the east 90 feet of lot 5 in block 13 I; of College Hill Park, was rejected, but a counter offer of $1,260.00 was made. Councilman Farrington stated tha tthey hael a request from O. A. Prince in. : which he asked a. price on a metes and bounds tract starting" 80 feet west of Pearl ! Street and just north of a road leading around the south side of the Butte. . This !! tract formerly belonged to the Eugene'. Box Company ahd was foreclosed on by the. 3 It: City of Eugene for liens. The amount of the certificate issued to the City of' i Eugene June 18, 1940, was $321.60 and Councilman Farrington said it was the ,i recommendation of the Finance Committee that this amount, together with interest I: and penalties, should be paid by IvTr.. Prince. The total amount of this figure up j to N6vember lOth would be $412.81. Tn addition to this, there would be t~~es I: Mr. Prince would have to pay in order to clear the property. Co. 4.55 . Councilman Barette reported reg,.rding the request of property owners abutting ; on Hamble Street to reduce this street from a width of 50 feet to 25 feet. Mr. i Barette stated that the Street Committee and other councilmen had looked at thms : property. He also stated that if theywould narrow the s.treet down to 25 feet, ; road equipment and fire trucks would not be able to make the turn in this street. i Mr. Barette also stated that there were no trees of consequence in the 50-foot i street. _ He stated tha t it was the recommendation of the Street Committee that this request be denied and that.he was making a motion that this request for narrowing this street should be denied. This motion was seconded by Stewart. Mr. G. B. Fedde was present and stated that he wished to take issue with Council- man Bare,tte in regard to his statement about trees on this property. He said that there were eight walnut trees, two peach trees, four catalpa trees and a cluster of oaks on the north side and another cluster on the south side of this street. He stated that it was the original intention that this street should be only 25 feet wide and that these trees had been planted with that understanding and that the , narrowest place in the street free of trees was 27 feet and 6 inches . Mr. R. A. 4 : McCully was pr,esent and stated tha t he was, on the Counc il when this addi tion was I i platted and that it ,was through a misundersta~ding on his part at that time in allo - J ing the street to be more than 25 feet wide. He said that in the proceedings after~ i ~he tract had been platted, Hamble Street was listed as belonging to Mr. Ramble and i that he propo~ed moving an old red house on this street and that the property owner , had to buy a couple of lots from Mr. Hamble in order to have this property deeded a ~ a street. Mr. McCully stated that there were many other narrow streets in Eugene J I and that Longview, running off of Fairmount Boulevard, also was a narrow street and I did not even have sidewalks. Councilman Pennington stated that as long as all the : property owners were in favor of having this street narrowed down to 25 feet and tht : there appeared to be no opposition, he thought the Council should grant them their I : request. Councilman Brownson stated that he felt the same way abouti t. Councilman I Stewart stated that it was not the intention of, the committee to be unfair in i this situation, but he wished to stateJ,that there, was only 50 feet between the ; present Hamble Road and the road leading into Hendricks Park, and he wondered if i it would be satisfactory to the property owners'.tovacate all Hambel Avenue. Mr. : Fedde stated that he did not think that would be satisfactory. The question was I called for and Councilman Barette was the only member voting aye, all other,council- : men voting no, and the motion was declared lost.. On motion made, seconded, and i carried, the City Attorney was instructed to bring vacation papers to narrow the i street to 25 feet as requested in the original petition. , ! Councilman Farrington stated that the committee had looked into the matter ! of the use of the sidewalks by trucks in certain locations in town, which had !previously been referred to the committee. He said that they had made quite a : study of this situatioIiand had a written report which he was asking Mr. Brownson :to read. This rep ort was read by Mr. Brownson. The investigation had concerned : the Pacific Fruit and Produce Company at 4th and Charnelton, the Pacific Coop- 'erative Producers at 5th and Olive, the Medo-land Creamery at 675 Charnelton, . 'Swift and Company on High Street, the Drive-In Market and Dutch Girl at, 1222 5 Willamette. The typewr~ tten' report was sent in for record in the Recorder's office. Councilman Barette stated that it was impossible for the Street Department to enforce ,any of these ordinances, but that the City had authority to enforce the ordinance iregarding trucks and vehicles parked on the sidewalks and that it was the recommend- I :ation of the Street Committee that these ordinances should be enforced. A motion '(was made by Barette and seconded by Koppe that the Chief of Police be held respons- iible/for the enforcement of these ordinances. The motion was carried. Councilman ,Brownson suggested that the Chief of Police call on the different firms and he lbelieved that if the situation was explained to the firms they would probably :cooperate in cleaning up the situation. I I The Fire and Water Committee, Health Committee and Parks Committee had no re~. " 1 '> III ~>>\.l., Councilman Pennington also reported th. at the bill of E. E. Thorn in the amount i of $6.00, referred from the previous council meeting, had been investigated, and /~ 7 ,i that facts were found to be as stated by Mr. Thom. A motion was made by Pennington'~ I and seconded by Brownson that the $6.00 be refunded to Mr. Thorn. The motion carried. 'j Iii Councilman Bond, reporting for the Police Commi ttee, stated tha t he had not : had an opportunity for a committee meeting with the delegation regarding the curfew 8 I'; ordinance which had been referred to him at the last council meeting. He said he I: would have a report for the next council meeting. II . II Councilman Bond at this time stated that several men had been called to the Ii Army from both the Police and the Fire Departments and that others had left for ~ better paid jobs, and that he believed it would be a good thing for the City ;; to ask for deferment for some of the men in both the Fire and Police Departments I': and th.::,t he would like to hear from some other councilmen. Couhcilman Brownson Ii stated that he was very much in favor of asking for deferment for policemen and I firemen and he thought it was in the interest of public safety to do so. Council- 9 I: man stewart said that the minutes would show that Be~epe aft he had made a request ~ regarding this situation some time ago. He said this was quite a problem and I' he thought much study should be given the matter before any action was taken. . I! Councilman Pennington sa id he thought the matter should be taken up with the Draft ,1 Board before action was taken. Mayor Large stated that he was sure the Draft ~ Board would not favor deferment of these men and that it.was a question whether I; the City should ask for deferment at all. No adtion was taken by the Council. J I: Departmental reports were received from the City Engine er, Police, Police , . I! Matron and also the sewage report from the Eugene Water Board. These reports ~ were ordered placed on file. I I'! A curb cut application was received from C. M. Duree, 446 East 13th Avenue, 10 J and the recommendation of the City Engineer was that the cut be granted subject r to approval of the Park Committee for the removal of the tree. The'recommendation ~ of the Engineer was adopted by the Council. I.. Ii The bill of .the League of OregQn ,Oi ties for the year, commencing July 1st, 1942, " and ending June 30th, 1943,- in the sum of $416.76 was read again at this time. Ii Mayor Large stated that the Eugene Water Board had already paid the sum of $50.00 i to the League of Oregon Cities and that it seemed this amount should be deducted llt from. the City bill. A motion was made by Farrington and seconded by Stewart :1 and carried that. the amount of $416.76 less the ~50.00 paid by the Water Board, be I.i paid to the League of Oregon Cities, the money to come out of the Emergency fund. lIOn roll call all members present voting aye; absent, Hawn. It Mayor Large explained that he had a meeting with the County Court and that Il': they were favorable to making a trade with the City for location of the swimming I pool. He said that inasmuch as Councilman Hawn, chairman of the Playgrounds 1211 Commission was not present , that the matter would be put over until the next 'Il meeting, but that he understood the Playgrounds and Parks Commission had a meeting I arranged thi s week with the County Court. Ii II Mayor Large at this time stated that a League of Oregon Cities regional meetin@ 13 Ii would be held at Seymour's Cafe at 6:30 o'clock on Monday, November 16th, and that Ii all C,i ty officials were requested and expected to be present, at this meeting. II Mayor Large stated that he also had a request from Roy Woodruff that all Ii City officials take part in the Armistice Day parade to be held Wedensday evening, 141'1 November 11th, at 7:00 P.M. and that they should meet in front of the Post Office ,I at that time. He said the City had the promise that the County officers would be [, there and that they were anxious to make this a fine parade and that he hoped the II Council members would be present. III A request frmm superintendent Cramer of the Eugene Public Schools, that the l following people be deputized as special police officers was read: H. B. Johnson, ill., Marvin Mason, R. L. Phillips, A. R. Hart, W. L. VanLoan, Ray Taylor, Mrs. Lillian 15 ,. Van Loan, Arch Brown, Dale Perry, Gaile H. Good, Virgil Reese, George Nelson, II Guy French, Mrs. Fay Robertson, Robert Christner, Melvin Moore, Winfield Atkinson, '.,.1. and James Clark. On motion made, seconded,'and carried, this request was granted 1-, on condition that it have the recommendation of the Chief of Police. 1:1 Mayor Large explained that Mr. E.H. I, il i: The report of the Fire Department for the month of Augus t was read and ordered Ii placed on file. Chief Nusbaum of the Fire Department, reported tha t the local Fire _ II..: Department and the State Fire Marshal's representative had inspected thirty-three 1 I fraternities on the Univermty of Oregon campus and also many private houses where ~ students were housed and also the Farmer's Union Warehouse and the Miner Building 10!1 on East Broadway. Printed copies of the recommended corrections were left at each 11.., of the houses with instructions to mail them back to the State Fire Marshal's offffic :; as soon as the instructions had been .carried out. Chief Nusbaum had stated that I: the state Fire Ivlarshal would have a representative here at an early date to _go !!; back over these premises to see that the corrections were made. , ~ The Recorder reported that the present gasoline contracts would expire I:: December 31, and on motion made, seconded, and carried, the Recorder was instructed ll~ to advertise for sealed bids for the City requirements for gasoline for the year I: 1943, to be opened at the Council meeting December 14th.
