All councilmen were present with the exception of ' Councilman Brownson. The Judiciary Committee had no report. The bills were presented by the Finance Committee at this time, and on motion made, seconded, and carried, these bills were allowed. I: The Finance Committee recommended that these offers be accepted, and the recommenda- r: tion of the Finance Committee was adopted. t,f 1.1 Councilman Barette, reporting for the Street Department, referred to the letteI'i II from Harold J. Turner, secretary, Oregon Railroad Association, dated December 8th, il to which was attached a petition and a form of Ordinance concerning the placing 1'1 of stop signs at railway grade crossings in the city. Mr. Barette ,stated that he 'i thought the request was reasonable and that the City had the stop signs on hand and i he believed that they should be installed. Engineer Club'b .suggested that there 2! really should be reflectors so tha t the,$igns could be seen for night driving. ;~ Councilman Farrington stated that if the railroad was requesting that the City I' put up these stop signs, he thought the railroad companies should cooperate by ,! putting up traffic signals at some of the worst intersections in place of stop il signs which are now used there. A motion was made by Barette and seconded by Stewar ii that the Street Department be instructed to put up the stop signs to comply with ~ the request as asked by the Oregon Railroad Association. This motion wa~ carried. ~ In regard to the passing of the ordinance requesting this matter, it was referred !: to the City Attorney and the Judiciary Committee to report back at the next Council II meeting. ~ Councilman Barette also brought up the subject of the recent flood of the 11 Amazon ditch, and referred to an article in the Guard concerning the opening up Ii of the channel outside of the City limits. rifIr. Barette stated that until this was 11 done it would be impossible for the City to control the water in the l~azon. In ,i order to make a satisfactory improvement it was pointed out that the ditch \^.QuId I 11 have to be opened up outside the City limits and the bottom of the Amazon inside 3 II the City limits lowered so as to give a better fall. Mayor Large pointed out that ,i there should be a drainage district established just outside the City limits. It I'was stated that after the Amazon had been dug out outside the City limits, it would II improve the property it went through. Councilman Stewart suggested that it might II be wise to send a letter to the County Court regarding the matter, and see if some II acti9n can not be taken. Councilman Koppe suggested tha t a drainage district _ ':, should be established at both ends, one in the City and one outside the City. After !t some discussion, Mayor Large referred the matter to the Judiciary Committee to I; take the ma tter up with the County Court and see what could be worked out. '! -, II The :F"ire and Water Committee, Health Committee, Parks Committee, Sewer Committe li and Police Committee had no report. 'I , - Ii Reports of the Police and Police Metron for the months of November, the Engineer'" !! report for the month of November, the Library report for October and November, if and the Fire Department .report for the month of September were all read at this ~time and ordered placed on file. iil An application for a curb cut at '741 Olive Street was received from F.L.Chambers. 4 [The City Engineer recommended the cut be granted, and the recommendation of the IEngineer was approved by t~e Council. I I'! A letter from J. F. Cr'amer, Superintendent of Eugene Public Schools, stating :: tha t a certain deed issued to Austin Dodds for Lot 11, Block 11, Hendricks Amended 5 I:Addition, had been lost, was read. This deed was delivered to Mr. Dodds in October, U1940, and the School Board is asking the City to issued another deed. The deed II had been prepared by S. M. Calkins, City Attorney, and a resolution authorizing I! the Mayor and Recorder to sign this deed was passed by the Counc il. I, II RES 0 L UTI 0 N I! A call for bids was advertised in the Register Guard, but later it appeared that it would not I ~~ be advisable to open the bids at this time. The oil companies were notified by Lli}';; letter that the bids would not be opened at this time, but the opening would be __ deferred until ,the Council meeting to be held on December 28th. A motion was made, seconded, and carried that the hearing regarding these bidds be adjurned to adjurned to Monday, December 28th at 7:30 P.M. i The Recorder reported that the applications of the East Side Tavern for renewal ;of their Class "E" liquor license had been held up from last council meeting and ithat there were twentyffive other applications to be passed on by the Council at ithis time. Mr. Tony Raming had made a report to the Recorder's Office that he was ,having trouble with Dean's Place at 865 Willamette and the Star Club, 663 Willamette. IA motion was made by Councilman Bond and seconded by Councilman Farrington that lall these beer 'application be granted except the Star Club, Dean's Place, and the 7 East Side Tavern. This motion was carried. Attorney Calkins was asked whether the State Liquor Commission was bound by the action of the Councilor whether the taction was only advisory. Attorney Calkins stated that he was not exactly clear iin regard to the matter but he thought it was only a rule of the Commission that : they ask an endorsement by the Council and he did not believe the Council action ,: was binding. A motion was made by Stewart and seconded by Penning'ton that the ,I applica tions of the Star Club, .Dean' s Place, and the East Side Tavern be not I granted. This motion was carried, the only vote opposing the measure waB by .!Councilman Bond. Mr. Bond explained that he was voting no because all three of !the places were being treated alike and he did not believe that they were exactly allke. At the Council meeting November 23rd, the Planning Commission had been directed to hold a hearing on the reclassification of the following described area:(See :description in resolution below) A hearing had been held by the Planning Commission :in the Council Chambers December 1st at 7:30 P.M., and the Planning Commission at :this time was presenting its permanent report to the Council. An ordinance had been iprepared authorizing the caange of classification from a residential district to :a multiple family district and had its first reading at this time. Dr. Lambert, one of the parties requesting the change of this zoning was present and stated :that he and his associates had purchased this property about a month ago and were I :anxious to have the proceedings finished as soon as possible and requested that .an adjourned meeting of the Council be held at an early date. He stated that it - .would take another 30 days to put the building in shape for use and further that ,one of his associates was out of the state and did not care to dilispose of his busin :there until satisfactory arrangements could be made for the use of the property. ICouncilman Barette suggested that this matter should be put off until the regular :meeting to be held on December 28th and stated that often times when the Council ;was in a hurry to complete actions of this kind that they found out they were in 8 :error. There was some discussion as to whether the matter should be put off till -:the regular Council meeting on December 28th, or whether the request for an earlier meeting by Dr. Lambert should be granted. Councilman Bond stated that this zoning :change was probably affecting him as much as any other one but that if an earlier ~meeting was granted he would see that property owners in that district were notified ~hether they read the advettisement in the paper or not and that he wished to :make a motion that the matter be considered at an adjurned meeting to be held 'at 7:30 P.M. in the Council Chambers, Friday evening; December 18th. This motion :was seconded by Hawn and carried. The following resolution had been prepared and mas read at this time and on motion made, seconded, and carried the resolution ~as adopted. . , RES 0 L UTI 0 N ---------- : ~nEREAS, heretofore the Common Council has submitted to the Planning Commission certain changes in the classification of the following described area: Beginning 320 feet South and 331.5 feet West of the Northeast corner of Claim 54, Township 17 South of Range 3 West of the Willamette Meridian, which said point is the Northeast corner i of the intersection of Madison Street with 9th Avenue West in . the City of Eugene, run North along the East line of Madison Street 145 feet to the alley between 8th Avenue West and 9th : Avenue West, thence East 82 feet, thence South 55 feet, thence West 2 feet, thence South 90 feet, and West along the North i line of 9th Avenue West 80 feet to the place of beginning. , and the Planning Commission has held a hearing, adopted a .tentative report I ' and converted the same into a permanent and final report and resubmitted it to the Common Council with the recommendation that the same be enacted i into an ordinance, and the Council has prepared and given its first reading of an ordinance enacting said permanent report. These bills had been incurred by the Junior t~ I Chamber of Commerce and one of them was dated as early as July 24th. Councilman !: Hawn stated tha t when these bills were presented to him a s a member of the Finance I: Committee he was surprised at the amount but that after taking the matter up with I.! Mr. Hitchens and getting his side of the story he had felt that the bills probably ) should be allowed and had O.K. 'd them for payment. He said it was true that the 1,: bills had been incurred without the authority of the Defense Councilor without the ~ knowledge of the City Council and while that was irregular he felt that the ~ situation had been thoroughly considered by the Defense Council and it was his 9 I: recommendation that the bills should be paid. Councilman Farrington said that II he could not agree with Mr. Hawn regarding this and he sa,id if these bills were : allowed by the Council it would be hard to tell what might be presented at the Ii next meeting. Councilman Pennington stated that he would like to remind the Council I,; that this same condition came up regarding the Casualty Station and that it had . !: also been handled wi thout proper authority. It was pointed out' that bills of this 11 size should not be incurred without g~tting requisitions for them. Councilman !i Bond stated that this was all new to him and that he thought the Council should I,' have time to consider the matter and suggested that too bills be held up until II the meeting to be held Friday, December 18th. Councilman Hawn explained that an 1,1 item of $350.00 for a siren had been placed in the budget for the O.C.D. that was I presented to the 9udget committee. He said he was sure the Defense Council felt ~ that inasmuch as $2,000.00 had been placed in the budget that they. could use their I! best judgement in regard to the use to which it was put. He stated there was some I! $1,300.00 left in the budget at, the present time and that if these bills were I'll allowed it would leave between ~500.00 and $600.00 for the Defense Council for the I remainder of the year to July 1st, 1943. At one place in the letter. addressed I; to the Council by the Defense Council, the statement was made that owing to the I; present condition of the budget for the Defense purposes that the City Council ~ should be warned that it might be a necessity for further appropriations from the I;! City emergency fund and it was suggested tha t the Council should make note of thi s 'I.,! statement. Mayor Large stated that the bills would be held over for further :1 discussion at the adjourned meeting on December 18th. 1 " 1 At this time the Recorder read a letter addressed to the Council from the IlLane' County Humane Society signed by D. R. French, President, and Sid Claypool, !i Secretary-treasurer. The letter explained tne acti vi ties of the Humane Society \:for the first eight months of 1942 and explained at that time their funds had l:lJeen exhausted and that they had been unable.to carryon since that time. They ii stated that the arrangements wi th the Council.for the year. 1942 had been that they ~were to be allowed only 50% of the Citl's 80 % of the Dog Fund, and that they ti:had received from the City the sum of :jji426.30. They said they were very anxious ill.: to continue in this work and that they weI;'e requesting that the Council for the :year 1943 allow them all of the City's part of the Dog Fund, in place of the I; 50% in 19L12. Mayor Large explained that Mr. French was present at the Council !lmeeting and would answer any questions that the Council members cared to ask him. 101: Councilman Stewart said that he felt the City wa~ fortunate in having an organizatiol!l. , 'i: such as the Hwnane Society; one that was willing to' put in their time and work, iiand he felt that the City owed them a vote of thanks and that they should ha,ve /, funds to carryon their work. Councilman Farrington said he felt the Society ~had done very good work considering the limited funds at their disposal and he Ii thought their request for 1943 was not far off.. Councilman Barette said that he Ii agreed with Councilman Stewart and Councilman Farrington and did not feel the i~request for all the funds were unreasonable. Mayor Large stated that he would ,:refer this matter to the Police Committee to make a report back at the Council limeeting to be held December 28th, and asked Mr. French that he make a further lireport to the Police Committee so that they could act intelligently in the matter. t This was the date set for a hearing of completion of the vacation of the alley !i in Block 34, Fairmount Amended Addition. Mayor Large called for objections and I; there being none an ordinanc'e vacating the area was read the first time and passed I~ to its second and third readings by unanimous consent of the, Council by ti tIe under ~suspension of the rules and was placed for. final passage. The ayes and nays were t:called; Councilrnen voting aye; Stewart, Hawn, Barette, Pennington, Farrington, Bond {land Koppe; voting no; none; absent, Brownson. The ordinance was declared passed liand numbered 8757. Section four of this ordinance directed the Recorder to file 1- I,..!,.a certified copy of the proceedings wi th the Lane County Recorder, the Lane County rSurveyor and that a blueprint of the district be attached to these reports.
