Councilmen present: Bond, Farrington, Barette, Koppe, r~ and Hawn; absent: Brownson, Stewart, and Pennington. Mayor Large stated that the meeting had been adjourned, among other things, to complete proceedings regarding the rezoning of the northeast corner of Madison and Oth Avenue West, and called for objections regarding this proposal. Mr. D. P. jPeterson, 858 Jackson Street, was present and addressed the Council. He stated ithat he objected to the rezoning of this piece of property as there were several Ihome~ in the ~eig~bOrh?od costi~g f:om $5,000.00 to.$7,000.OO and he was sure the :plac~ng ofa nosp~0al ~n that d~str~ct would deprec~ate the value of the property iand that rezoning in this place only meant that later on there would be rezoning ifafther west on the street. He said he felt there was sufficient places already in ;this multiple family district where this hospital could be located. Councilman IBarette asked Dr. Lambert if he intended to make this a fireproof building and IDr. Lambert replied that he did not think it was necessary. The question of Icomplying with the State Fire Marshal's regulations was brought up and Mr. Clubb Iwas asked to state what his requirements were. Mr. Clubb stated that the State 'Fire Marshal for a hospital would require outside stairways for the upper floor, iand also that there would have to be front and back stairways inside and the ,construction would have to be what is known as one-hour fire resistant and explained :that this would mean he probably would have to use metal lath and plaster. Dr. 1 iLambert stated that they were expecting to comply with all requirements in remodelin~ Ithe building. Mr. Peterson addressed the Council again and asked if it was not ;necessary before these proceedings were passed that a petition be circulated for :the ajoining property owners to sign and he was told that this was not necessary :but that petitions could be circulated and presented to the Council if either side :wished to do so. Councilman Bon~ stated that when he bought his lot and built, he 'did so because the district was designated as a single family residence district, :but that if sufficient property owners in that district were not enough interested ;to appear before the Council to make objections, that he could see no reason why ithe rezoning should not go through. Councilman Farrington said he had a call during :the afternoon from a crippled man living close to this property objecting to the irezoning, but that the man was not at the meeting this evening. Councilman Bond I said he also had a phone call from this same party. Councilman Farrington stated 'that he had also had a call from Mr. E. H. Peterson stating that he objected very much to the rezoning, but that he would be attending a class for Civilian Defense and could not be present at the meeting. Dr. Lambert was asked if he was expecting 'to put up any neon signs, and he'stated he was ot and that they expected to have la neat appearing place from the outsid~. There were no further objections and the iordinance had its second reading and was passed to its third reading by unanimous iconsent of the council by title under suspension of the rules. On roful call those ivoting aye: Koppe and Hawn, no: Farrington and Barette, absent: Brownson, Stewart, ;and Pennington; Councilman Bond not voting. This making a tie vote, Mayor Large cast his vote as aye and the ordinance was declared passed and numbered 8759 . ,. The matter of payment of the four bills for sirens for the Lane County Defense 'Council was brought up at this time. Councilman Hawn stated that he had nothing'. ~urther to add than the remarks he made at the meeting Dec. 14th, but that he had asked IVJr. Shumaker and Mr. Hitchens to be present at the meeting if there were any questions the Council wished to ask them. Mr. Shumaker stated that Mr. Hitchens was not present but that he had asked Hugh Currin, engineer for the Water Board to be present. Councilman Bond asked Mr. Currin if additional units could be added ;to these if it was found necessary to have a more ad~quate system. Mr. Currin state~ that he had had very little to do with these sirens as the Vkter Board had undertake I to develop a whistle, but that the Eugene Junior Chamber of Commerce felt that they ~ere not proceeding fast enough and undertook to work out something by themselves. ;He stated that these sirens were what the Junior Chamber of Commerce had recommended, ~nd that the ~ugene Water Board, at their direction had installed them and were operating them. Councilman Bond asked Mr. Shumaker if. it was not a fact that only $350.00 had been indicated in the O.C.D. budget for warning system and that now the bills presented were twice that amount. Mr. Shumaker stated that that was a fact, but that when the budget was prepared they had no previous experience to go ~y and did not know what the cost might be. Mr. Shumaker explained that the O.C.D. had a Finance Committee and that items in excess of a few dollars were always taken up with this Finance Committee and that he thought that when the $2,000.00 allowance 2 Was put in the budget for O.C.D. that they would be allowed to use it for what they ~hought necessary after thorough investigation. Mr. Shumaker stated that he did not I plaim the present system was adequate, but that it was all right as far as it went. ~r.Hugh Currin was asked if he considered the present system adequate and he stated that he, as representing the Water Board, did not caDe to go on record as stating whether or not the present system was adequate but that he would say that additional I units could be added to the present system. Councilman Farrington stated at this time that he would like to have the matter clarified as to whether the O.C.D. had full authority to make purchases from the $2,000.00 or whether the larger items Should be referred to the Council before purchases were made. Mayor Large explained that the committee members of the Council did not have authority to make purchases bf this size without first referring this matter to the Council even though items .~ad been set up in the budget for the depa.rtment. Councilman Koppe said he felt the matter should-be clarified at 3 I this time. After some further discussion a motion was made by Hawn and seconded by Bond that items not exceeding $50.00 could be spent by the O.C.D. without , referring them to the Council but the larger amounts than this should be taken t it up with the Council before orders were placed. The motion was carried. ! , Councilman Hawn stated that Mr. Fred E. Lamb of the Park Department and :~ Ii Mr. Clubb had reported that there were two trees in the parking that were I: dangerous and should be removed. One of the trees is on the south side of 13th, the second tree west of Kincaid and the other at the southwest corner of 4th and 4 Ii Jefferson. He stated that if these trees were removed the money would have Ii to be taken out of the emergency fund and that he would make a motion that Mr. Clubb be instructed to see what the cost of removing these trees would be and Ii to report back at the next Council meeting.
