All members of the Council were .present, and in the absence of Mayor Large the president of the Council, Mr. Farrington, acted as presiding offic,er., ~ {~. .....~..... "':.a,. Mr.. Roy K. Reed. addr,e.ssed the Council regarding members of the C,ivil Air Patrol acting as guard,s for gov er.nme nt, planes landing at the new municipal airport. He expla.ined that there had bee,ns.e:v:eral Army planes land on the field and that these men. were acting as armed guards. He said it was nece,ssary that, the guards be armed and he would like to have the legal status of these men acting as armed on City of Eugene prop,e,rtyclarifi,ed. He stated ,that he, as commander o.f these guards., was having:, them work .twoat a time in four-hour shifts., He, explained that there were seven"ty, or .eighty of these Civil Air Patrol men in the work and he was at. .a. loss. to, know how they should ,be deputiz.ed. Councilman Hawn asked ~r. Reed if he .thought. the entire, forc.e, should be deputiz.ed and Mr. Reed said he did not think that was pra.cticable" and Mr,. Browns,on asked if he had one or two men tha t he thought should b,e deputized.. ,Mr.. Reed stat,ed that different ones worked at differen,t ,time.s. and he had no particular ones in mind who should be deputized. After some discussion by the Council thematter was referred to the Judiciary Committee and the City Attorney wi~ power to act, and to report back at the next Council meet~ing;. Olson offered $100..00 cash for the west 75 feet 2 of lot 8, block 30, Gross Addition. It was the recommendation of the Finance Committee that both thes~ offers be rejected, and on motion made, seconded and carried the recanmendation of the Finance Committee was adopted. The Street Committee had no report, but Mr. Barette reported that they were still very busy Cleaning up after the recent storm, ahd that in another week or two they woUld have the work pretty well in hand. Councilman Stewart of the Fire and Water Committee reported retgarding the use of gasoline fram the City pump by Fire Chief Nusbaum. He stated that the 3 i Committee had had a IDeeting and felt that it was not wise to curtail the travel of'Mr. Nusbaum at this time, and the Committee was recommending that he be allowed thirty gallons of gasoline a month for his car from the City tank. He stated he was making that in a form of motion and this motion was seconded by Brownson and carried. Mr. Stewart stated that the Fire Department had designated one day each week for inspections and that the fireman making the inspections was to take along with 4 him one of the new men in order that the new men might become familiar with the i conditions and to familiarize themselves with-the entrances to the different buildings. The Health Committee had no report. 'i :i Councilman Hawn, reporting for the Parks Committee, stated that a letter had been received from S. L. Smith regarding the condition of the bird cages back of the butte and the way in which the birds were being taken care of. He said this letter had been referred to Mr. Lamb to see w~at should be done regarding the m matter. The Sewer Committee had no report. 'I ! ~. 'I Councilman Pennington, reporting for the Police Committee, said ti was the l, the recommendation of the Police Committee that that part of Columbia Street runnin II down the hill from Fairmount Boulevard, going south, to 22nd street be made a II one-way street. Mr. Hawn stated that the only ones tha t would be inconvenienced 5 !', by making this a one-way street would. be the bus lines, and the Recorder should I notify them of the proposed change. The Police Cammittee also recommended that ,I the intersection of 21st and Agate be made a stop street where 21st Street from Ii the' Washbourne park enters Agate Street. A request from Frank Monroe for a new Retail Class "B" beer license at 47 East 7th Street was read. This is the location formerly known as the East Side Tavern and was operated by Joe D. Hale and Merle Short, who were refused a renewal license by the Council. Accompanying the application there were three character reference letters read at this time. Mr. Monroe was present and addressed the Council. He stated that if granted permission for this license he would conduct the placew the best of his ability and in such a manner as to make it an honor to the City and that he would piCk his clientelle and weed out all the undesirable characters and would want to run the place so that any member of the Councilor the Council as a whole could inspect the place at any time. Councilman Barette stated he was opposed to giving any more licenses than the City had at this time. He said he did 'not think it was a good policy to recommend a new'license. He stated that the Council was under obligation to the parents of the students at the Uniyersity to see that too many of these ppaces were not granted licenses. He said he was making a motion that no more.licenses be granted other than those now being operated. There, was no second to this motion.. . Councilman Hawn sta ted that he would have to disagree with Councilman Barette and thought the former objections were to the way the place had been run, rather than the location. He stated that he had talked to Mr. Monroe and believed he:would be able to run the place in a satisfactory manner and he thought this matter should be referred to the proper committee for further investigation. Councilman Koppe said it was his understanding that the Council had gone on record as not ravoring any new licenses, but that as two 'had already been refused this would leave two places that might be filled in. Mr. Monroe addressed the Council again and stated that he had worked for five years for a wholesale grocery house in Nebraska and that they had handled wholesale beer; that he had been in practically every beer licenses place in south-eastern Nebraska and felt that I i he was familiar with the different conditions and believed that he could run this II' .place in a manner that would be satisfactory to. the Council. He said it was the recoromendat'"on of thePolice Corom ittee that the offer of the Silva Chevrolet Company should be accepted and he wished to make this in the form of a motion. This motion was seconded by Brownson and carried. , - The Police Matron's report, Sewerage Disppsal report, Police Department report, Engineer's report and the monthly report of the Public Library were read and ordered placed on file. Councilman Brownson stated at this time that 'he wished to ask that Mr. Sam Monsher, Building Inspector, be instruct~dto investigate the 60nditions of the roof at the Comfort Station at the Park Blocks, and see what could be done toward fixing the lea$:s~ 'This matter was authorized by the Coun,cil. ' Mr. Brownson also stated that h~- would like to have -8. 'report' regarding the condemnation proceedings of the New York Rooms and the apartments over the Cosmo Cigar Store on north Willamette Street. Attorney Calkins 'stated there were certain changes in which they had 30 days to comply with and it was his understnading that this work was being done. Engineer Clubb stated that he thought a plumbing permit had been taken out for work over the Cosmo Cigar Store and Councilman Brownson asked the Recorder to inform Mr. Mosher that a written report regarding these two places should be presented to the Council at its next meeting. The Fire Department presented five reports in which the State Fire Marshal had accompanied the Fire Department on certain buildings down town and also that there were twenty-five other individual down town inspections that had been made by the Fire Department in January and February. These were ordered placed on file and the Fire Department was requested to have a report at the next Council meeting as to whether the improvements asked for at the various dance halls had been complied with. A letter from the Board of Appeals regarding the request of Norman A. Johnson to convert the residence at 2013 Charnelton Street int~ two apartemnts was read. Mr. Johnson. addressed, the Council and stated that while this was an old house it,. was on a, good stone, foundation and well built and. that ther,e, would be no. exterior changes in order to make the up- stairs in.to an, apartment; tha.t the only ,improvement needed would be a sink. Councilman Bare,t.t,e stated that in view of the, shortage of hous.es that this should be fur.ther, investigated.. Councilman. Pennington stated that he thought in view of this shor,tage of houses, and that there were to be no exterior changes, he would like to see the request granteq,. Hown" caretaker of the rest.cotta.ge in the, park blocks, s.ta.ting that. $2,.50 Victory Tax had been. deducted from his January pay. reducing the amount he had received to $47.50 was, read. He stated he felt he should be entitle to the regular $50.00. It was explained that the Council had no option in regard to..the Victory Tax and there was nothing the Council could do until the-next budget, meeting. ".,:. The Recorder reported the remittance of $516.05 for refund of gasoline tax, and a franchise tax for the year 1~42 for the Oregon Electric Railway.in the sum of $535.45. e.,J' ~; 12 An ordinance re-establishing just and equitable rates for sewerage charges as 13 provided for in section six of Ordinance 8610 had its first reading and was laid over. 15 An ordinance to regulate the storage of explosives and regulating combustible 14 materials and rubbish of a combustible nature, having had its first reading on January 25th, was read the second time and laid over. An Ordinance regulating the parking of vehicles, including bicycles, upon the streets of Eugene, including parking meter regulations, had its first reading and was laid over. After the reading of the ordinanc~, Attorney Calkins said it would be necessary to have an additional section making it unlawful to park other vehicles in the space designated for the parking of bicyclex. The ordinance as read provided for a period of not to excede two hours for the parking of bicycles in the downtown districts. Councilman Stewart said he objected to plaCing a twe- hour limit on the parking privilege of bicycles and would move that this limit be stricken out of the ordinance. This motion was seconded by Brownson. Councilman Pennington stated he objected to this as some time limit would have to be in the ordinance in order to allow the Police Department to piCk up bicycles left for long periods of time or abandoned. At this time Councilman Stewart with the con- sent of Counci~man Farrington withdrew his motion t remove the time limit. After some discussion by the Council, a motion was made by Hawn and seconded by Davis that the time limit for parking bicycles be changed to four hours in peace of two. This motion carried. I A resolution regarding the Signing of Accident claims referred to the State Industrial Accident Commission and also regarding the payment of Claim No. 8170~4 by the State Industrial Accident Commission to JohnQuiner in the sum of $63.17 was read at this time. 16 RESOLUTIO,! BE IT RESOLVED BY THE COMMON COUNCIL of the City of Eugene that here after when any accident occurs to any City Employee other than those employed by the Water Board the portion of the claim to be filled in by the employer shall be signed by the Mayor or the City Recorder and a copy of the claim filed in the Recorderts office. Whenever such accident or injury shall result in lost time, compensated by the State Industrial Accident Commission, the employee shall receive no pay from the City for the time so compensated. Department heads shall instruct their employees that in case of an injury, the employee shall immediately go or be taken to a doctor without waiting to file the report. The City Recorder be and he is hereby directed to deduct 22i dayts pay from the February salary of John Quiner which 221 day reppresents claim no. 8170~4 for $63.17 allowed by the State Industrial Accident 'Commission to John Quiner for a 221 day period from October l~, 1~42. A motion was made by Koppe and seconded by Barette that this resolution be adopted and the motion ~as,carried. Ii ! The resignation of John W.' Pennington as chairman of the Police Committee was read at this time. He explained that he had been appointed Deputy District Attorney and on account of the associations he would have in that capacity with the Police Department he did not believe it-was wise to continue as chairman of the Police Committee. The resignation was accepted by the Council. Acting president of the Council, Mr. Farrington, stated that Mayor Large wished to appoint Councilman Hawn as chairman of the Police Committee, and that Mr. Penning- ton would assume Councilman Hawn's place on the Park and Playground Committees. A motion made by Barette and seconded by Brownson that this change be confirmed, was carried. ~ I, ;td} Councilman Barette explained that in the park back of Skinner's Butte, the NYA had abandoned the use of one of the buildings and that the Garden Club would like to have this building for their meetings. He stated that the building was no longer being used by the NYA and that if it was not moved off the premises it would be torn down. ,He stated that the Garden Club was willing. to stand all, the expense' of moving this building if the City would give it to them. Mr. Barette explained that Mr. Lyons, head of the NYa was perfectly willing that the building I be given to the Garden Club. MrthBanett.er1stated:J,thgt he would move that this building be given to the Garden Club with the understanding that they were to stand all the expenses of moving. This motion was seconded by Brownson. Councilman Hawn stated it was not quite clear to him whether the City had the right to give this building.~way, _but if a ruling of the City Attorney that it would be legal could be secured, he would like to see the Garden Club have the building. After some further discussion Councilman Hawn moved to amend Mr. Barette's motion that the matter be referred to the Judiciary Committee and the City Attorney with power to act. This ammended motion was seconded by Davis and on vote carried. The original motion of Mr. Barette's was then called for and the motion as ammended was passed. I Ii I!
