M. All members of the Counc il were present with the exception of ;:~ ; Councilman Pennington. ,I ~I ',! Harry Leaton address,ed the Council and stated tha t in making some improvements ! on the building at 1016 Willamette, he had allowed the brick construction to II extend four inches over the property line into the street. He stated this was an ! error on his part in not knowing just where the property line was, but that the II construction was only temporary and would be replaced by glass bricks as soon ,I as they could be secured. He asked permission to leave the present structure t; stand until the glass bricks could be secured, which he said he was informed would !: be between 30 and 90 days. Councilman Brownson said he had looked over the situation and as it was only a temporary arrangement he thought it would do no harm. Engineer Clubb was asked to make a statement regarding the situation and he said the work had been done wi thout taking out a perIni t and that it did extend over the property line four inches. Mr. Leaton explained he thought Mr. Gilbert had taken out the 'I permit for this work. A motion was made by Brownson and seconded by Davis that ~l the present construction be allowed to stand until the glass bricks could be ~secured. On motion made, seconded, and carried, the recommendation was adopted by the Councia Councilman Farrington stated that maybe this was not just exactly the Finance Committee's business, but it had been brought to their attention that two men on the Street Department, W. L. Wood and Roger Bale, were receiving only $116.67 per month, and that it was the Finance Committee's recummendation that they shoWd be I advanced to $126.67, this pay retroactive to April 1st. Councilman Barette stated I he objected to this matter being taken up in this way as he thought the chairman of the Street Committee should have been informed regarding this before any action was taken. Councilman Stewart stated that the matter only came to the Finance Committee's attention today, and that they had not had a chance to talk to Mr. 10 ' Barette in this matter, and it was not the Finance Committee's intention in any was to be discourteous in this matter. Councilman Stewart said he wished to I second the motion made by Mr. Farrington. Councilman Hawn stated he could see Mr. Barette's position and as there would be another meeting before the end of the ; month he thought the matter should be laid over at this time and be considered by i both the Street Commi ttee and the Finance Commi tte'e to report back a t the next :i meeting. Mr. Hawn said he would make this in a form of motion that the matter be laid on the table. Mr. Pennington said he didn't have much of a report ! to make only that the Council members noticed he left the previous meeting Ii hurriedly and that he wished to pass around a box of cigars and report that it was ~ a boy weighing 8 pounds, 7 ounces. He said he had first thought he would have it delivered up to the Council rooms, but later decided that the Street Department would pick up the chair and deliver it to 1,,11'. LeVan. Mr. Barette also reported the gravel trucks were becoming very careless inthe loading of their trucks and considerable gravel was being scattered on the streets and that it was hard for the sweeper to take care of it. He suggested that the Police Dept. should contact the gravel haulers and see if this practice could not be stopped. Mr. Barette stated he wished to make the final report concerning the situation at the Drive-In lVIarket and the Dutch Girl Dairy. He said the committee had finally agreed to reconstruct the curb at the street line and also a curb on the inside of the sidewalk iinetandfleave a 20-footentrance at the north line of the Drive-In Market to allow cars to cross the sidewalk and go in between the sidewalk and the front of the Drive-In Market and the Dutch Girl Dairy and leave another 20-foot opening to come back out on Willamette Street below the south side of the Dutch Girl Dairy~ Councilman Brownson also explained that it was their intention to have one, two, or three parking meters installed in front of these places with only 12-minute privelege. A motion was made by Brownson and seconded by'Hawn that the recommendation of the Street Committee be adopted. On Roll Call councilmen voting aye: Koppe, Barette, Brownson, Hawn and Pennington; no: Farrington, Stewart, and Davis. The motion was declared carried. Mr. Tillman said he had come to the meeting to make a report on this situation but perhaps he had waited too long. He stated he owned the property ajoining the Dutch-Girl Dairy on the south and that this drive-in situation in front of the Drive-In Market and the Dutch Girl Dairy was a hazard and a nuisance and was dangerous; that people would drive up in front of these places and back out on Willamette Street and he could see no reason Why drive-in priveleges should be allowed at these two places. Councilman Brownson said he would like to explain to Mr. Tillman that he thought the action taken by the Council tonight would result in the same kind of use as that now used by Mr. Torrey at the Electric Cleaners, and that the Street Committee had explained to the tennants that if the arrangement as proposed was not satisfact ory, that the entire curb at the street would be replaced. Councilman Stewart, reporting for the Fire and Water Committee, said there was nothing to report only that they had lost one man to take up work at a better paid job. I: I' Councilman Brownson reported that the barn on 4th Avenue West was in good repair and Councilman Farrington stated that he had talked to the manager of the Cooperative Poultry Producer's Association and that they had said they were going to tear down the old barn. I; V Councilman Brownson, reporting for the Health Committee, stated Mr. Hughes i; had taken up with him the problem of the dumping of sludge from septic tanks by Ii: different people handling this class of work and that Mr. Hughes had stated that I:: it did not come from inside the City, but was from outside of the City limits ,: and that it was very hard to handle at the City dump and Mr. Brownson stated he ,! i.' did not feel that the dump tender should be required to handle this sludge without !~ extra compensation. He said he did not know exactly what would be a reasonable II charge, and after some discussion it was decided that there should be a charge of $2.50 per load paid to the dump tender, and this should be paid at the time of the trucks making the delivery. The following resolution was read and on motion, ado~ted. I t Mr. Brownson stated that Mr. Barette had mentioned the gift to Mr. LeVan and stated he did not realize the Street Corrunittee was going to do anything, but that he thought a report was to be made back at this meeting. He said that the purchas- ing of the chair was all right but that he did not consider that sufficient and that he thought in addition to the chair Mr. LeVan should be granted one months pay; Mr. Davis stated that 30 years was a long time to be with one concern and they were the best years of I~~I'. LeVan I s life, and he thought he was entitled to at least a month's pay. Councilman Hawn stated that the Council knew how he stood on the situation from the statement he had made at the last meeting and that an extra month's pay would only be one day a year for the time he had put in and that he thought Mr. LeVan was entitled to at least the difference between the month's pay and the cost of the chair, if the Council did not feel like giving a full month's pay in addition to the chair. After some further discussion, a motion WES made by Brownson, seconded by Stewart, and carried, that Mr. LeVan be given a full month I s pay in addi tion to the cha ir purchased by :Mr. Bar ette. I At this time a letter addressed to Mayor Large from Mr. Cloyes of the Lane County Health Department was read. 'l'his letter was in regard to mosquito control : in Lane County, and the possibility of mosquitoes transmitting malaria from 18 i infected persons to well individuals. Mayor Large explained that the worst sit- I uation was at the Fern Ridge Dam and that the most of the places infested by mosquitoes were outside of Eugene, but that he would refer this matter to the Healt Corrunittee to be reported on at the next meeting. ' Councilman Pennington, reporting for the Parks Committee, brought up the question of the location for a site for the swimming pool. He said it was the intention of the committee at the last Council meeting to recow~end that the five ecre tract inside of the fair grounds, south of the Amazon, be purchased from Lane County at $200.00 per acre, making a total price of $1,000.00. He said there seemed to be some objection to this location and that he would like to have an expression from the Council regarding the location. He said in fact a couple of 19 l members of the committee had preferred the site back of the vutte. It was pointed out that a ci.tizens commi ttee previously had made a study of the si tuation and that they had recolnmended the purChase of the site referred to inside of the fair ~unds. Mr. Frank Hill stated that he would like to see the purchase of this site and that ! he would be in favor of building the pool this year. After some discussion by : the Council a motion was made by Pennington, seconded by Hawn, and carried, that the City should Rurchase from the County the five acre tract inside of the fair grounds for the ~1,000.00 I CounciDnan Pennington stated that the Playgrounds Commission was to have a meeting this week and that he would like to have an expression of the Council at this time regarding the playground activities for the coming year. He said he did not know whether it was the intention of the Council that the playground activities 20 should be curtailed or w;",ether they should be continued as in the past. Councilman i Brownson stated that he thought this would be a poor time to curtail the activities, in fact, he thought they should be expanded if possible. Councilman Barette said he felt that the full time program should be carried out. There were no objections from the Council as to the carrying out of the full time program. Councilman Davis, reporting for the Sewer Committee, said that they had re- 21 ceived a letter from Mr. Woodson regarding a crack in the sewer at the foot of Agate Street. He said he and Mr. Clubb had examined this and repairs would be made. Councilman Hawn, reporting for the Police Department, said he had a request I from the Alaska Junk Company for permission to rent space for a truck in front of their place of business on 5t_~ Street. He said they claimed that a certain party , parked a car there each day and left it standing all the time. Councilman Hawn suggested that a sign similar to other loading signs might be placed in front of 22 , the Alaska Junk Company allowing 24 minute loading time. Councilman Farrington stated he did not thinl-c this would be satisfactory to the Alaska Junk people as wha ' ! they really wanted was permission to park in front of their place all day. It was suggested that this matter be referred back to the Police Committee for further study, ahd Councilman Hawn stated he had already put in two weeks time on it and did not know what was the solution, but that he would make further attempts to a I solution and report back at the next Council meeting. Councilman Hawn said that he had something to report on that was m real problem and that was the dog situation. He read a letter from the Humane Society and stated that the Police Committee had had a meeting with the Wociety and that in order to handle any kind of proper dog contro+, the City would have to spend : a considerable sum of money. He said the best estimates obtainable were the : monthly charges would be about as follows: $150.00 for dog catcher's salar~; : $10.00 light and water; $20.00 food; $25.00 for expense of an automobile, ~5.00 heat . $6.75 telephone, $25.00 veterinary and medical services, or about an annuaJ cost of $3,000.00 He said it had been suggested that one of the NYA buildings should be removed from back of the butte and that they be placed on a City lot in the vicinity of 25th and Hilyard or 25th and Alder, which would be close to Dr. Swan- gaard's veterinary hospital. Ii Ii 'I I) 11 I: " t II 1:' j: !~ This matter coming on to be heard upon the application of the Lane County Humane Society for suttable provisions for the enforcement of the licensing law and also for the ordinance prohibiting dogs running at large; Be It Resolved by the Common Council of the City of Eugene tha t the Common Councilhereby agrees to cause to be appropriated to a fdnd for the support of the Lane County Humane Society the $800.00 of license money now on hand, together with additional appropriations which shall; to- gether with receipts from the enforcement of the licensing law and the dog ordinance, make a total of $3,000.00. Be It Further Resolved that the Council further agrees to appropriate funds sufficient for the removal of the NYA building and the placing of the same upon a lot now owned by the City, ready for occupancy at a cost which is estimated at $500.00 This appropriation is for the fiscal year corr~encing July 1, 1943 and ending June 30, 1944, and is made in con- sideration of the Lane County H~ane society taking over and with the use of the appropriated funds and equipment enforcing the State Licensing Law and also the ordinance prohibiting dogs running at large. At a previous meeting of the Council it had been decided that the IncA building should be moved on a City lot at the corner of Lawrence and Ches ire Streets. On motion made, seconded, and carried this action was rescinded in order to allow the building to be moved for the use of a dog control officer. The following departmental reports were read and ordered placed on file: Police, Police Matron, Eugene Pulbic Library, Engineer, Sewage Disposal, and Fire Department. An application for a curb cut had been received from F. H. Taylor at 1832 Columfuia Street, and the City Engineer recommended that this cut be granted, and on motion made, seconded, and carried, the recommendation of the Engineer was adopted. A letter from W. C. Clubb, City Engineer, aSking that Winfred Mullins be promoted to the position of Street Foreman to take the place of Mr. LeVan who had resigned, was read. On motion made, seconded, and carried this request was granted and Mr. Mullins pay was raised to $150.00 per month beginning April 1st. The matter of passing an improvement ordinance for the work on the R. S. Shell y lot on the east side of Kincaid between 19th and 20th was brought up. Mr. Shelley had been notified to be at the Council meeting on March 22nd and also at the Council meeting tonight, but had not appeered either time. Councilman Brownson explained that he had promised Mr. Shelley he ~ould take the matter up with the Council at the previous meeting but that he failed to do so and that he did not believe that Mr. Shelley understood just what the Council intended to do in regard to this lot and Mr. Brownson said he would like to see definite action eeferred until the matter could be taken up further with Mr. Shelley. It was decided that Attorney Calkins should consult with W. C. Clubb, Engineer, at once and notify Mr. Shelley in writing just what was necessary to be done and ask Mr. Shelley to reply by letter before the next Council meeting what he wished to do in this situation. A letter from Edith Ward, 894 West 4th Avenue, requesting that the City commence demolition proceedings on a barn at the rear of the property at 864 West 4th Avenue was read, and this matter was referred to the Health Committee. A letter from the Oregon and California Revested Lands Administration asking for a lease on a part of the City lot at 5th and Olive Streets was read. The Department had prepared a lease which was read to the Council. This lease was to begin as of April 15th, 1943 and ending June 30, 1943 at a rental price of $17.50 per month with the provision that this lease might be renewed from year to year until the end of June, 1945.
