The minutes of the regular meeting of the Common Counci+, held Monday evening
at 7:30 P.M. All Council members were present with the exception of Councilman
Pennington.
The Judiciary Committee filed a written report concerning the charges of
H. O. Moell tha.t certain articles had disappeared from the City dump after having
been stolen from his pIa ceo This mat ter had been referred to the Jud iciary COIl1...mi t~ee
and the City Attorney at the previous Council meeting. The Committee's conclusion
were as follows: (l) There is no valid proof that the silver was in the garbage
heap at the back of the Church (2) Nor that it was hailed to the City Dwnp (3) Nor
that it was left there (4) Nor that it was taken by any city employee. Sergeant
Bates of the State Police had charged that the City dump was in fact a second-
hand store and the Committee further reported that they did not believe that the
City dwnp could be organized as a second-hand store. which is required to report
all articles received by it. ,The Committee's recommendation was that the Council
appoint a committee to make an inspection of the City dump with a view to its
confirming or disputing the necessity of licensing the dump and making it conform
to the ordinance with regard to second-hand stores. On motion made by Brownson
and seconded by Darette, the recommendation of the Judiciary ~Committee was adopte
by the Council.
An offer of $125.00 for the North 12.5 feet of the s~uth 20 feet of the west
2 100 feet of Lot 8, Block 25, College Hill Park was subfuitted by J. BBsil Burke.
This offer was rejected by the Council and a counter offer of $200.00 was made.

An offer of $575.00 for Lot 7, Block 33, Gross Additiorr and Lot s 11 and 12,
3 Block 1, Mountain View Park, was made by.C. L. Kelly. T~is offer was rejected
by the Council and a counter offer of $900.00 made.
W. W. McDougal offered $200.00 for the north 50 feet of Lot 4, Block 2, Chesh're
4! Second Addition. This offer was acfepted. Mr. Loren Fawver made the same offer
on this property, which was filed after the McEougal Qffer and was therefore rejroUrl.

An offer from Percy D. Bentley for Lots 1, 2, 3, 4, 5, and 6, in Block 4,
Croner's Addition and also the metes and bounds tracts lying adjacent to these on
the west was submitted in the amount of $1025.00 Also received was an offer of
$1125.:::;0 for the some .Qr.operty, su bmi t ted by F. C. Vial tel's. In view of c ondi tions
surrounding these two offers and the fact that there was so little difference
between them, it was the recommendation of the Finance Comrnittee that both offers
be rejected and that P. D. Bentley and F. C. Walters be requested to file new
sealed bids for tjis proferty to be opened at the next Council meeting. On motion
this recon~endation was adopted by the Council.
Mr. F. C. Walters had also made an offer of $100.00 for Lot 5, Block 5,
6 Croner's Addition. This offer was accepted by the Council.

The Finance Committee reported that the bills had been O.K.'d by all members
of the committee, and a motion was made and seconded that these bills be paid. On
roll call all Council members voted aye.
The Street Committee had no report.
Mr. Stewart, reporting for the Fire and It:ater Committee, stated that the wind
during the day had kept the Fir'e Department busy.
The Health Committee, parks Cow...mittee, and the Sewer Cow...mittee had no report.
Councilman Hawn, reporting for the Police Committee, read a written report
from Chief of Poli ce Bergman regarding the parking conditions a t the Bluebird
Packing Company, 629 Oak Street, which had been referred from the last Council
meeting. The Chief of ~olice explained that the south half of the block was taken
7 up by Army cars and that there is a private parking space in front of 643 Oak St.
The owner of the Bluebird Packing Company would like to have a thity-minute parkin~
zone and Chief Bergman thought the request justified. Councilman Hawn stated it
was the recommendation of the Police Committee that this request be granted. On
motion made, seconded, ~hd carried, this recommendation was adopted by the Council.

Councilman Hawn stated that Mr. Dow was negotiating for the purchase of the
Newman Grotto at 764 Willamette Street; that the establishment at the present
time had only a bottled beer license, and that Mr. Dow would like to have an
expression from the Council if' they would be favorable to granting a draft beer
license at this place. Mr. Hawn stated that this was one of the better places
in town dispensing beer and that he w0uld favor giving a license for draft beer
at this place. After some little discussion Councilman Hawn moved that the Council
go on record as not opposed to granting a draft beer license at this place. This
motion was seconded by Davis and carried.

, Councilman Hawn also reported that there had been opposition to placing the
City dog pound on Hilyard between 24th and 25th Streets, and that the proposed
moving of this building to that 10cati0n had been delayed. He stated that he
had contacted the members of the School Board with a view of locating the dog ='~
pound of a 400 foot square tract at the south west corner of the old avi ation field. ::.w
He stated that the school board had just sent ~ord down to him that they were
willing to grant the City the privilege of USlllg this place for the dog pound.
A motion was made by Hbwn and seconded by Stewart that the lTYA building be moved
to this location at the south west corner of the old aviation field. This motion
was carried.
The following letter was read from the Board of Appeals:
"The Board of Appeals has received a letter from the Twin Oaks Builders

I; Supply Company aSking permission to be allowed the use of the lots on
Ii First Avenue between Monroe and Jackson Streets as a wood yard. The
Ii lots in question belong to a Mr. Vigg, and they are already using a
10 ,. tract belonging to Fred C. V:alters. One member of the Board objects to
r the request owing to protests having been phoned into this office.

Ii The recommendation of the two members that the request be allowed with a time limit
~ to this year was adopted by the Council.

Mr. William IJiugman at t.his time stated that he had a communication from
Paul Morriss, director of the C.A.A. regarding the naming of the new airport, and
that the suggested name was acceptable with them. Mayor Large explained that there
had been a request made that the new airport be named the "Mahlon Sweet Fieldlt; thatJ.
he had a letter from General Arnold stating that there was no objection to this
name for the field. A motion was made by Stewart that the Council designate the
name of "Mahlon Sweet Field" for the new airport. This motion was seconded by
Hawn and on vote unanimously carried. Councilman Hawn stated he thought some sort
of a marker to the. approaches of the field and at the Administration Building should
be posted showing the name of the field. Councilman Barette siad he would like
to see some sign on the road leading from the highway to the Airport showing the
!i new name of the field. CouncilmanStevvart stated tha t perhaps the Chamber of
1,,1 CO:l11.m.erce might have some good suggestions along this line and the Recorder was
II instructed to address a letter to the aviation comm.ittee of the Chamber of Corrunerce
~ to see what they could wbrk out for these signs.

The following departmental reports were read and ordered placed on file:
Engineer, Sewage Disposal, Police, and Police Matron.
A petition signed by twelve property owners concerning the conditions of the
lot on Kincaid Street just;horth of 1945 Kincaid was reed. This petition was a
protest to the way the basement of this vacant lot had been drained into Kincaid
Street, and also complaining about the berry vines still on the lot. This petition
was referred to the Health Committee for further study.
A resolution to the Eugene Water Board was read.

Be it resolved by the Common Council of the City of Eugene that
Whereas, durinb the last legislative session, an act was passed direct-
ing the municipal utilities to contribute not less than 3% of their
gross earninL to the City i~ the nature of a franchise, and
Whereas, information has come to the Council that the ,-'Jater Board
contemplates raising the rates charged the City of Eugene, to some
extent nullifying the effect of the legislat~~n',
Therefore, the City Recorder be and he is hereby directed to
deliver one copy of this resolution to the Eugepe water Board with a
request that the rates shall remain as heretofore, thus permitting
the city goverrooent to realize the benefits sought to be granted by
the legislative act.
I hereby certify that I am the City Recorder of the City of
Eugene; that the foregoing resolution was adopted by the Common
Council at its meeting of May 10, 1943, and pursuant thereto I hereby
transmit the resolution to the Eugene Water Board with the request
that the rates reITBin as heretofore and that the city government
receive the three percent granted by the legislature.

An ordinance adding Section 35~ to Ordinance No. 8761, which controls
parking and bicycles, was read the first tline and passed to its second and third
readings by unanimous consent of the Council by title mnder suspension of the

nwnbered 8767.
The Recorder reported that Eugene Rural Fire District No. 1 had not made any
payments on their contract since August 3, 1942, and that there was an amount of
approximately $2,945.04 due the City. A motion was made by Brownson and seconded
by Stewart that the City Attorney be instructed to write a letter to the 'Eugene
Rural Fire District No.1 stating that if payment was not made within a reasonable
length of time the service would be discontinued by the City.

Mayor Large at this time stated he had a distinguished guest and introduced
Mayor Eaton of Astoria. Mayor Eaton said it seemed like old home week to hear
about the dogs and victory gardens and other things, but that he did not hear the
curfew mentioned. He stated Astoria had a new curfew ordinance requiring that
all children under 18 should be off the streets at 10 P.M., and that it seemed
to be working out very well. He said at this time he was visiting different citie
with a view of trying to find out their experience with curfew ordinances. He
said that he was glad to be present at the meeting and extended greetings from
Astoria. Mayor Large said he had a memorandum to ask Mr. Hawn, chairman of the
Police Committee, what progress was being made in regard to a curfew ordinance.
Mr. Hawn stated this curfew discussion had been up beofre he was on the Police
Committee, but that he would be glad to receive a visit from anyone interested
in the curfew ordinance, and asked that the Recorder furnish him information from
the minutes as to who was promoting the curfew control.
Mayor Large at this time brought up the question of the Juvenile Officer.
He asked the Chief of Police if the Police Matron was cooperating with Mr. Dietz,
the Juvenile Officer, and Chief Bergman stated she was. Mayor Large asked it
it would be wise for the City to have a Juvenile Officer full time. Judge Hurd
was present and stated that whenever the Juvenile Officer picked up any girls that
they had to have a matron and that the County was expecting to hire a matron and
that they already had a stenographer in the Juvenile office as it was necessary to
keep very complete records regarding these girls. He stated that he believed that
the County Matron, the stenographer and the Juvenile Officer could handle the
work both for the County and the City, and the County was asking the City to make
an appropriation of $1,000.00 for the coming year. This matter was referred to
the Police Committee for further investigation.

Attorney Calkins stated that in the recent trial regarding the accident with
the fire truck that the City had been discharged from any liability regarding this
accident and that the jurors had found for the driver in this case, so that there
were no damages either for the driver or the City to pay. Mayor Large suggested
to Councilman Stewart that he should caution the drivers of the fire trucks to be
very careful in returning from the fires, and Councilman Stewart said he believed
the boys had learned a lesson from this accident.
On motion the meeting adjourned.
