I '~ '~ The minutes of the regular meeting of the Common Council, held Monday evening ;.....~ " r .", at 7: 30 P. M. All councilmen were present except W.L. Davis. Councilman Hawn stated that Mr. Lewis was present and was asking permission to show a trained gorilla the rest of this week and over Sunday. Mr. Lewis proposed to give the" Civilian Defense 20% of the gross revenue and was willing to make a deposit of $100.00 in advance and was aSking that no license be charged by the 1 City for the show. Admission charges to be l5~ adn 25~. The show would be mounted .on a trailer 17 by 28 feet and Mr. Lewis was asking to occupy space in Broadway ju west of Willa~ette Street, either on the North or South side of Broadway. The traf ic hazard for a vehicle of this size at this location was pointed out and other locat- ions were suggested. A motion was made by Hawn and seconded by Brownson that Mr. Lewis be granted permission to show and the location to be satisfactory to the Chie I of Police. On vote this motion was carried. I I A petition was presented by J. E. Leach that the Dog Pound be moved from its I , present location at the southwest corner of the old airport. The signatures on , , this petition were all from out of town residents. It was claimed there was so ., I much barking and howling from the d9gs that it was impossible for the people living 2 I in that neighborhood to get any sleep. Mr. Leach suggested that the pound be moved I '! to the Southeast corner Of the airport. Councilman Hawn explained that there was 0 ly a limited amount of money to spend in locating the pound and that it had to be placed close to the raod and where water could be secured. Mr. Hawn said it would probably take from $400.00 to $500.00 to build a road'- lay a water pipe and move the building to the S. E. corner of the filed. After some discussion a motion was ma de, seconded, and carried that the petition be placed on file. Councilman Koppe, chairman of the Judiciary Committee, reported regarding the new franchise to be granted the Pacific Telephone and Tele~~ graph Company. Mr. Koppe stated that the committee had met with the City Attorney and discussed the situation and that a written majority report had been signed and filed with the City Recorder. The Recorder read the report which provided that instead of the present annual charge of $250.00 that an annual franchise charge of 2% on I the gross earnings of the Pacific Telephone and Telegraph Company be made, , excluding therefrom long distance tolls and also City telephones, making the j charge on the telephone service within the. boundries of the City. Mr. Koppe also suggested that in place of the present seven free phones furnished by the Telephone Company, that there should be one free phone furnished for each 1500 population. Councilman Hawn making a mmnority report for the JUdiciary Committee 3 objected to the idea of a flat 2% charge on the gross earnings of the company. I He stated that he vfavored only a small annual charge in order that the City I could have control over the Company. He cited the fact that the recent legislature , I had placed only a 3%levy on municipal utilities and that they did not pay I taxes while the telephone companYhdoes pay regular tax levies on their assessed , I valuation. He suggested that a 3$ gross revenue charge might be made and then , deduct the amount of taxes paid by the telephone company. Councilman Stewart , said it did not appear reasonable for the telephone company to expect that the I I ! franchise would be renewed under the same conditions as was granted 25 years ago. r Councilman Farrington and Koppe stated they did not think Mr. Hawn's comparison ! w~th the rate charged Municipal Utilities was a fair comparison. Counciiliman ~l Crumbaker stated he thought Mr. Hawn's argument was fair. Councilman Brownson 'I I said he favored some other approach than the flat 2% charge. A motion was made, , seconded, and carried, that the ordinance as prepared by the Pacific Telephone and Telegraph Company be Changed to comply with the written majority report of the Judiciary COmIuittee and also be changed in regard to the free phones from I the suggested seven free phones to one free phone for every 1500 population. Th,e ! ordinance was so changed and was read the first time and laid over and the I Recorder ,was instructed to publish the required three weeks notice in the Eugene , ; Register Guard. I : The Finance Committee reported on the property offers as follows: Offer of P.J. Hanns, $1200.00 for Lots 4 and 5, Block 3, Rughs Addition was accepted, the 4 $1200.00 to be net to the City. Offer of James S. Willcox, $800.00 for Lots 9, 10, and 11, Block 30, Driverton Addition was rejected and counter offer of $1,200.00 made. Offer of J. F. Newman $75.00 for Lot 8, Block 22, City Outlook Addition, $50.00 for Lots5 and 6, Block 22, same addition was rejected and counter I offer of $75.00, net to the City, on Lots 5, 6, 7, 8, Block 22, Ci ty Outlook Addition was made. I Councilman Farrington stated an investigation regarding complaints about the ,_ I alley running north and south in the block between Potter and University and between I , i 21st add 22nd Streets had been made. He stated that the alley was partially 5 I grown up with shrubbery and part of it had even been planted to lawns and , , that the recent complaints were justified in that the alley could not be used in .1 its present condition. Mr. Merriam pointed out that the local Defense Council : could order this equipment to go outside the City to fight fires, but that it was I' supposed to be manned by O.C.D. fire volunteers. Corner of 16th and Pearl :i Streets and tha t he was asking that an investigation be made by th e Fire and i.! Police Chiefs and report back at the next Council meeting. ~ . '.: CounCilman Barette reporting for the Parks said he had some complaints re- f! garding tree limbs over the sidewalk but that no tree trimming would be done at i'l thi s time. ::! :] Mayor Large reported he had comp.paints about low awnings on Willamette Street ff and the Building Inspector was instructed to investigate this si tua tion and report It to the Council at the next meeting. i': Ii' S- [] The Sewer Committee had no report. I, !i Councilman Hawn said that he had talked with Mr. Bagan, manager of the employ- Ilment office, and stated Mr. Bagan was willing that a bicycle rack be placed on 'l the si dewalk in front of the employment office and that he was going to suggest Ii to Miss Hendricks that the Library place a sign stating "No Bicycle parking allowed l:lon Library Property." A motion was made, seconded, and carried that a bicycle rack it be installed on the sidewalk in front of the Employment Agency at 1133 Willamette. n . .i.~ 't~( 1.1 At this time Chief Bergman siad that he and Mr. Lewis had been out and had i:i agreed in placing the show referred to earlier in the meeting on Park Street just I I.: back of the U. S. National Bank Building and that Mr. Lewis wanted to be sure he I; could have this location in three or four weeks instead of at the present time. II The Council indicated it was up to Chief Bergman to make the decision. /i The yearly report of the Police Matron was read at this time and ordered .1 placed on file. Mr. Clubb stated he could not possibly; get to this before August 15. I ~ The Recorder reported that the refund from the State on 09soline for the first ;: six months of 1943 had been received in the sum of $423.00. I . CC '1'he Recorder requested that in place of drawing salary warrants on the Parking Meter fund as provided in the budget that the warrants be drawn on the General Fund 9 and that a journal entry be made transferring a like amount from the Parking Meter Fund to the General Fund; this would be much more convenient in regard to the Gov- ernment Withholding tax and other deductions that are necessary to be made from the payroll. On motion made, seconded, and carried, the request was granted. . ., ~ I An ordinance amending section 22 of Ordinance H876lto comply with the State 10 i law in regard to lighting of parked vehicles had its 1st, 2nd and 3rd readings and 1 on raIl caJ-ll,all present voting aye absent Davis. Councilman Hawn said that Ken Proctor had cut a 150 foot pole rneasuring,5 inch s at the top and that he was offering to give this to the City for a flag pole and wo Id deliver it to the top of 'Skinner Butte and would pay for the blacksmithing for 11 supports for the guy wires and also furnish the guy wires. The City to pay for erecting the pole. A motion was made, seconded, and carried that the offer be accepted and the Parks Committee was instructed to make arrangements to raise the : pole. Councilman Hawn said he thought he could interest. the Kiwanis Club in : furnishing a large flag for this pole, but Mayor Large said he thought the City ! should be able to furnish the flag. I I Councilman Crumbaker asked about getting water to the City owned ~ouse on I 1b2 I North Polk Street, which had been ordered some time ago.. Engineer. Clubb I said it would mean stopping paving operations if he undertook to do the job just I now, but that he would get it done as soon as possible. , Councilman Koppe said there had been considerable talk about a stock pile for I post war work and that' he thought the ,improvement of the Amazon should be included I in this work, both inside and outside of the City. He said the Army Engineer's in Portland had been contacted, but there seemed to be no solution at this time. I I It was suggested that a drainage district should be formed inside of the City I and that the County should be aSked to form a drainage district outside of the City I - .
