I! .....;;.j I Mr. Basil Willi_ was pr~sent and addreased the Council concerning the alley running north ""'~ : end South in the block between 21st end 22nd, end between Potter End University Streets. He ~:~.:' : stated candi tions there were about the same as they had been for the past 19 years and all the f! garages in that block h,ad been built with a view of coming out en the streets rather than having Ii to use the alley. Mrs. Dean Gilbert was present end said the south end of the o.11.:lY was being Ii used as a garden and e lawn; that the lawn was built up so that it was three or four feet higher Ii than the sidewalk. She said it was their understanding when they built in there that i: there was a public alley end that it could be used by the property owners only so long as there U were no objections to the arrangement. A letter from Dr. Alvin S. Sether, addressed to the li Council, regarding this situation was read at this time. Dr. Sether stated in hi's letter that Ii he believed the best way to hfu"1dle the situation was for the City to te,ke charge and assess what- t\ ever costs there were to the property and that he beli'eved the alley should be put in condition " so that it could be used. Dean Gilbert addressed the Council at this time and stated he did not 1 agree W~h what Dr. Sether had said regarding the unsanitary conditions of the alley, but stated ! it was a fact the alley was overgrown with blackberry bushes and other shrubbery. Mr. Matt Yvil- :i helm was preS61i.t ond stated, that when he built his garage he built it so he could use the alley 1 I, and thought the alley would be improved for traffic. Ee stated he he en aggrssment with Wll'. II She lley for the two to us e the driveway from the st reet, but this was not satisfactory. Ne : stated Oil account of the oil shortage this year he had wanted the alley opened up so he call ld I store some wood to help out durinf the shortage. Attorney C~,lkins was asked to give mn opinion " regardiJrng the vacation of this alley and also regard"ing t'he City's right to improve the alley. Ii: Mr. Calkins exploined that for the interested property owners to start vacation proceedings they !I would have to get the signatures of 2/3 of the property owners in this block and also four I' hundred feet north end south from this block. He stated that the City on its own intiiative !'i could vacate if it was Agreeable to allthe property owners in the block, but that one tax payer !l could prevent the City from vacating the alley. Counci lmen Farrington stated h~ i; thought the City had gone about as far as they needed in the matter, end he felt it was up to I'! the property owners in the block to work out a solution. Councilmen Stewa.rt stated he was sure li Mr. Calkins was right in his statement that one property owner coo ld block the va.cation of the I 1,1 alley, for he had had experience outside of the City in the vacation of a road, end it was true I: that one property owner could block the vacc,tion proceed:ings. He stated he believed thet Mr. II Wilhelm would be stisfied if this alley in question was put in useable condition from the north II end as far south as the Gilbert and Williams property so that Mr. Wilhelm could come and go from , his garage to the north and not use the south end of the alley. Mr. Wilhelm said this arrange- II ment would be satis factory to him but that he thought the City should take charge of the matter II end do a first clas::.> job so that it would be in first class conditio.:J. to use. He stated he would I be willing to pay his shere of paving the alley. The matter of the cost of improvement was ;,i brought up arid Attorney Calkins suggested that the property owners get together and raise a 1'1 sufficient amount of money to do the work. A motion was finally made, seem ded, and carried tl that the property owners sh:>uld raise a fund sufficient to cover the oost of the work in the II alley, and that the City Engineer should work with the property owners to represent the City and :' also to make whatever suggestions that the property owners would desire regarding the work. Offer ! of $90.75 for Lot 15, Block 25, City Outlook Addition, submitted by Peter A. Paris rejected end il counter offer of $150.00 met to City made. On moti on m!ide, secon ded.. end carred, the re I: commendation of the Finance Committee was edopted by the Council. I lil Councilmen Farrington, reporting for the Finance Committee, stated that the bills had been II O.K.' d by all members of the committee, end a motion was made and seconded that the bills be paid. Hulegaard, Treas. 23.75 Mountains States Power Company 19.00 I: The Street, Fire and Water.,.and Health Committees had no 'report. 1" (I r Councilman Barette, reporting for the Parks Committee" regarding the proposed flag pole to be , erected on the Butte, said he had been unable to find anyone that could raise the flag pole after r it was delivered to the top of the Butte. He said the expense of digging the holes necessary for ,: 'the pole and its supports would be expensive; that it would probably take a couple cf men 12 or 14 I days. He stated that the Telephone Company wanted $50.00 a day for erecting the pole but they 3 I, did not believe they had equipment heavy enough to handle this size pole. He stated it looked I: like a pole of this kind would be a white elephant on the Ci tJT' S hands and that it would probably .. cost close to $500.00 to make the proper installation. He said he would like to contact Mr. I: Striker, County Bridge Forman, regarding the raising of the pole before turning down the offer of I, the pole entirely. ' I I' Mr. Barette also stated there was a tree in the parking at 550 West 7th Avenue and that a r limb of this tree was resting on the roof of the house and that the property owner had asked the '.. City to remove the limb. !i l: The Sewer Committee had no report. !: Councilman Hawn, reporting for the Police Committee, read the monthly report of the Humane j: Socie1;.y for the months of April, :May, June, and July. He stated the Humane Society had been having 4 I: a. hard time getting started, but he thought they were making satisfactory progress and would be h in mnch better shape before long. A motion was made by Brownson and seconded by Hawn that the Water Board's "u \e;;{). , 5 : proposal to make monthly payments of this amount and an adjustment to be made at the end of the "J.-;; 'I year be accepted by the Council. On vote this motion was carried. W ,i " II The following letter from the Board of Appeals was read: !I "The Board of Appeals has received a request from Walter J. Roeyasking to 1\ ,be allowed to replace the present trailer office on his used car lot at 6 1064 Olive Street by building a new superstructure on the chassis under 't the old office which has become dilapidated beyond repair. The Board I: reconunends that the request be granted." f! On motion made, seconded and carried, the recommendat~on of the Board was adopted by the Council. ri il The reports of the Library, Sewerage Charges, Engineer, Police, and Police Matron were read I: at this time and ordered placed on file. r " A report filed by Chief of Police Bergman and Chief of the Fire Department Nusbaum stated 'I 7 ;1 that the woodshed at 16th and Pearl had been inspected and that the shed was used as a woodshed I': ( and was in good condition and free from rubbish. A motion was made, seconded, and carried, that I'; the Council accept the report. 'I I" " h )1 Engineer Clubb reproted regarding the heights of awnings on Willamette Street and stated !i that part of these awnings had been erected under Ordinance 1362, which was later repealed, and I a part of the awnings were erected under the present building code; that the present building .' 8 I code required that the awnings be six inches higher than in the original ordinance. Mr. Clubb H I: stated he thought these low awnings could be corrected by raising the ~alance of the awnings up , to the bars. A motion was made, seconded, and carried that the building Ins~~ctor notify the , I offending parties to make the proper adjustment. -' I: I: A letter from Mrs. Jake Marguth, 239 East 4th Street, regarding the condition of 4th Avenue " I, I: was read and referred to the Street Committee. I . A letter from Mrs. Glenn A. Wright, 15th and Polk Street, regarding conditions in that i neighborhood was read. It was pointed out by Mr. Clubb that the objections she was making to 9 i certain conditions in that locality were outside the City limits and that there was no violation , \ of any of the City ordina,nces where the property was inside the City limits. The Reocrder was I instructed to notify Mr. Wright regarding the matter. Ii !! A request for the vacation of the alley between 21st and 22nd and Alder and Kincaid was read Ii and referred to the Street Committ~to report back at the next meeting I: I' Mrs. Addie R. Osburn, deceased, bequesthed her books and bookcases to the Eugene Public I Ii Library and the following resolution was read at this time: ii, I; BE IT RESOLVED by the Common Council of the City of Eugene, Oregon, that the il ji bequest contained in the will of ADDIE B. The resolution provided that City employees desiring to engage in other 1'\ " 11 II employment should make appUcation to the Council for its approval. I: At this time a letter of resignation from Orren BrO'Wnson(as Councilman of the 1st Ward was :, handed to Mayor Large. Mayor Large asked the Recorder ~o" read the let'ter. Councilman Brownson - stated that certain business changes required that he leave Eugene, a.t least temporarily. He said in turning in his resignation he wished to make a statement which he was hopeful would re- t suIt in better administration of the City e.ffairs. He stated he .thought the present City I, government was antiquated and not in keeping with a modern City administration and that he be- l; lieved a change should be made to a managerial form apd that a Committee should be appointed by 12 i: the Council with the view of seeing what could be done in that direction. Mayor Large said he I. regretted to lose Mr. Brownson from the Council and Councilman Barette said he thought it was , the City's misfortune in that Mr. Brownson had to leave town. Councilman Farrington said it was I; regrettable Mr. Brownson had to leave but under the circumstances there was nothiqg for the I' Council to do but to accept the resignation. A motion was made by Farrington and ~econded by .- j: Koppe that the resignation be accepted with regrets. On vote this motion was~carried. A motion I': was made by Hawn and seconded that the Council express by unanimous approval their appreciation ,: of Mr. Brownson's service to the Council and the community in his efforts toward good government. v I; The motion was unanimously carried. ;1 ~"~ i' Councilman Hawn stated Mr. Brownson had told him a few days ago of the c!rcumstances, and :. that he had told him Saturday that he would present his resignation at this time. Mr. Hawn I. . I'i stated he had been considering a successor for Mr. Brownson and that he woula like to present 13 ',: the name of Carl R. Baker for the consideration of the Y.ayor and the Council. Mayor Large stated ~I 1" Mr. Baker was an agressive young businessman and that he was glad to nominate him for Councilman , i from the 1st Ward to succeed Mr. Brownson. A motion was made by Farrington, seconded by Davis j. and carried that the Council confirm this appointment of Mr. Baker. il Councilman Stewart stated there had been considerable talk a~different form of City Ir government and that he agreed with Mr. Brownson that a committee should be appointed to make ii a study of changes for the City government. Councilman !\loppa stated that he thought thisw~s 14 i; the proper move to make. A motion was made by Hawn and seconded by Stewart that the Mayor appoint t: a committee to :make a study of a change in the present form of City government. On vote this Ii motion was carried. Mayor Large stated he would defer'appointing this committee until the next !i Council meeting. i, !i Councilman Hawn stated he would like to move that an amendment be made to the proposed Pacific !'i Telephone and Telegraph Company's franchise; that he was moving instead of the 2% mentioned in Ii the present franchise that his be changed to read 10~ per ~rear per telephone. He stated he { thought the 2% charge was excessive and that the 10~ per telephone would produce about $1,000.00 1.5 II per year for the City. Councilman Koppe stated he had no objections to a charge being made on 'j the number of phones in the Ci,ty but he thought Mr. Hawn's suggestion was too low. Councilman - ti Crumbaker said he ,felt action should be deferred to allow more time to consider the suggestion. '1...'. Councilman Crumbaker stated he would secorrp. Mr. Hawn's motion but that he wanted the matter de- ,I ferred until the next meeting. Before any action was taken on this motion Mr. Hawn moved his I: motion be laid on the table. No action,was taken by the Council on thes~ two motions. I. jl! At this time a letter of ~Rpreciation from Helen Dodds c.ross for the Beautiful orchid that had i been given her on her return f~ Eugene from the christening of the ship at Long Beach. She I: stated it was a privilege and a great pleasure to represent the City of Eugene at the laQ~chL~g of 16 j~ the u. S. S. Eugene. Mayor Large explained that the ship was what they called a frigate and was II about 300 feet long. Pictures of the launching had been delivered to Councilman Hawn a~d he said !: he would make arrangements to have them displayed in the Cl1ase Gardens on Broadway. I . L'l , I:.
