' I] The minutes of the regulard meeting of (the, Common Council, held Monday '~ I, evening, Nqvember 8th, at 7 :30 P.M. The meetang was called to order by Mayor eo.J !: Large. All Councilmen present. \ ' I'! I: Mr. R. B'. Bacon, representing the Pacific Telephone and Telegraph Co. I' was present and Mayor Large askeq that the Judiciary Committee make a report Ii regarding the Telephone Franchise, which had been referred to them at the II': last Council meeting. Councilman Koppe reporte.d that the Judiciary Committee ,: has held a meeting at which Mr. Bacon was present. He stated that no desi- ii cision was reached at that meeting but that he felt that it was the Council's I' original intent,ion to grant a franc.hise that would be equitable to both the r Telephone Company and the City. He stated that he had been gi~Dg this matter ;1 a great deal of consideration and after consulting with the other two members l. of the Judiciary Committee he was reporting that the recommendation of the i: Judiciary Comrni ttee was that 'a later franchise ordinance which was more I: favora~le to the Pacific Telephone and Telegraph Company be considered and I' that the committee was asking for a slight change in the new Franchise ~ Ordinance in section 11, in front of the word copporate~ the words "present i: and future" be inserted. A motion was made by Hawn a,nd seconded by Barette : that the recommendation of the Judiciary Committee be adopted. On roll call i: members ~oting Aye; Koppe, Baret~e" Hawn, Crwnbaker and Baker. Those voting I np; Farr~ngton, Stewart, andDav~s. Absent, none. il At this time Councilman Stewart was excused from the mee.ting. .: The proposed new ordinance was read in detail a t this time and the , Recorder was instructed to publish the necessary notice in the Eugene Register ( Guard. Said notice to provide that a hearing shall be held at 7:30 p.m. an I: December 13th, at the regular Council meeting. Counciibrnan Crumbaker raised I I; the question regarding the wording of section 1 where the f~anchise stated !, wires and oth~r appliances, might be installed above ground or at the option !: of the grantee might be laid under-ground. Councilman Crumbaker stated that Ii the city might want some installations to be put under ground during the life - ;! of of this franchise and that wi.th this wording this would be done only at the I I) option of the grantee. Mr. Bacon advised that it was the Telephone Company's 11 policy to make under-€rouhd installations as fast as conditions would permit il and tha t he felt tha t the past recordC"Lofl the Telephone Company would prove ;i that they are willing to cooperate wi th the City and that they would prefer I: making no change in this wording. Attorney Calkins stated that there was Ii no doubt that with the present wording it would be at the telephone Company's option whether under ground installations should be made but that if the ~ words in this seftion 1 "or at the option of the grantee, its Successors I:; and assigns" was eliminated this would leave the matter open for the City i; to act. After some further discussion by the Council a motion was made by II Crumbaker that the words "or a t the option of the grantee, its successors II and assigns" should be eliminated from the new proposed franchise.. The I,! motion was seconded hy Baker and on vote carried. Councilman Crumbaker also JI called attention to the wording in section 3 regarding the ma tter of repairs J. to the streets that had been opened for installation purposes where the I~ ordinance stated that this should be done at the satisfaction of the Street II Commi ttee. He felt that this should read "to the satisfaction 0f the Common il Council" and on motion of Mr. Baker this wording was changed. After some ~ discussion of this ssection the word "street" was inserted before the word !: "broken" and the words "for the purpose of laying underground conduits" was II stricken from the ordinance. This left the meaning that no pavement could !1 be cut or notstreet broken without the Telephone Company had first obtained :: a permit not only for layihg underground conduits but for all other work. I; The former franchise as passed by the Common Council obtained provision for I: the accomodation of Police and Fire alarm equipment of the City to be carried /; on the Telephone Company poles, in thier cables and in underground equipment I, free of charge to the City. This had been eliminated from the new proposed I ordinance. A letter fram the Telephone Company was read in Which they stated f they preferred not to have this in the ordinance granting a franchise but I! that they were willing to give the City this privilege. Attorney Calkins I stated that he thought the Telephone Company wished to enter into a contract '.' with the City to that effect, it would be satisfactory to the City. Mr. Bacon \: stated that the Telephone Company was perfectly Willing to enter into this I r kind of a contract with the City. ,I Ii: Mr. William Mettaur who lives at 39 North Washington street was present ': and made a complaint regarding the placing of saw dust next to his property 2 l; by the LaJoie Wood Yard. Engineer Clubb stated that Mr. laJoie had been I: filling in saw dust in the street and that it was interferring with the water l~ drainage on the Mettaur lot. A ~ot~on was made by B~rette and seconded by It Davis and carried that the Counc~l ~nstruct Mr. LaJo~e to remove this saw(J dust down to the' level of the sidwalk. '~=~====~=,-' ~"~--:::,- . .-~ r '~C. ~- - - Councilman Hawn at this time stated the members of the Active Club and the JuniDID Chamber of Commerce had discussed with him the matter of the Juvenile II ~ situation and it was their recommendation that some adjustment should be made ~ in the Juvenile Ordinance. That the curfew hould should be changed from nine .~ ~,...~ .~ to ten oclock, and the age should be change tp ~~i]~re~ under 16. For the ~ first violation, the chold s~l1. 'be.taRenLho.me;:-by.'.tlie'~Police Officer, and for the second vioaation, the child shall be held at the Police office and -the parent notified to come and get the child, for the thirfr offense, the 3 parent or guardian to be fined ten dollars. The following two members of the Active Club were present, Mervin Vater and Boa Broderick, and from the Junior Chamber of Commerce, Edward V. Duke. These member eocp~ained that they were .ver much interested in the' Juvenile situation and would like very much t,o see some improvement. They stated that last winter they held athletic programs at the University High School and the St. Mary's High School, in the evening and that this year they wanted to enlarge it .to two high schools on the east side and two high schools on the west side, and that the nine o'clock curfew did not give Imng enough time for the programs. They stated that both the Active Club and the Junior Chamber of; Commerce had offered their services to the City Police either in the prowl cars or to patrol the streets. After some discussion the matter was referred to the Judiciary Committee and the City attorney to bring in an ordinance at the next Council meeting regarding the Juvenile situation. Mayor Large stated that he was sure both the Council and the Police appreciated the offer of the two clubs to help and he wished I to thank them for offering their services. . J. F. Grimes addressed the Coun~il regarding the location of a garage on his property at 212 east 14th which was denied by the Boare of Appeals at 4 the previous meeting. He said that he could make some change and would like to have the matter reconsidered. Mayor Large asked that he make his new proposition to the Board of Appeals and that they report back at the next Council meeting. COMMITTEE REPORTs: Judiciary Committee, nothing further. II Finance Committee reported on the property offers as follows: George Lammers submitted an offer of $25.00 for the house at 5 974 Taylor Street and will move a t ,one or wi thin 3 days from notice from City to move. Offer Rejected. W. L. Seward will pay $450.00 plus $15.00 for title insurance 6 for lot 10, block 2, Hollenbeck Addition. N.W. corner 14th and Washington. Counter offer: $475.00. . A.. H. Norton submitted an offer of $1050.00 cash for lot 1, 7 block 26, College Hill Park, S.W. corner 23rd and Charnelton Streets. Offer Accepted. Paul Campbell submitted an offer for client, L. S. Newland 8 $390.00 for the south 53 1/3 feet of lot 10, block 4, Driverton Addition providing the City can get from the County the south 53 1/3 feet of lot 11 and give title insurance for both parcels. (east side between 17th and 18th). (The City has no assessments on that part of lot 11). Counter Offer $415.00. C. A. Mr. Campbell's option on these lots [1 expires on November 18th and there will not be another Council meeting until November 22nd. He -1 16 I stated that Mr. Good had previouslyworkea for the fire department for six months and had left to go deep-sea-fishing fo~ about thr~e mQnths and that I I lie went 'back with the Fire Department on Nove~ber 1st, a~d had requested that I I he be granted his raise in sal~ry.as if he haq beem employed for the full nine I months. It was the recommendation of the Cou~cil that Mr. Good would have to I work for the additional three months before r~ceiving the regular salary for i ~he nine-months employee. I I , I Councilman Baker stated that he wisheq to report that they did not 17 intend to deroof the Comfort Station pe~manen~ly and that the roof had been left open to find out if there were any more ~eaks and th~t the tile would be replaced at an early date. , , . Councilman Barette reporting for the iarks stated that L~ D. Smith, 167 Adams Street has beem paturing his cow in,Sladdens ~ark and that there were others using'the park. Mr. Barette explained the park was full of weeds and brush and Mr. ~mith had said that he was ~illing to clean up the park,. with 18 tne understanding that he was to have the exclusive use of the park. as he wished to pasture his cow there. The motion was mad~ by Farrington and secondeddby I Barrette that Mr. Smith.be given the exclusive use of the ,park with the under- 'I standihg that he keep it up. This provision ~o be good only as long as the City wishes to grant it. . . Sewer Committee~ no report. 19 Councilman ,Hawn reporting for the Police Committee recommended a transfer of class B Beer license for Snappy Service at 86Q Olive street from Harry Learon to Kenneth L. ,Hulse and Kenneth E. '~I 21 The following departmental reports were read and ordered placed on file; Police Department, Eugene Water Board, Police Matron and Engineer Department. ! . , A letter from the Board of Appeals was read regarding constructing a 22 : burner for planer shavings, just G~nside the City limits. The planing mill is located just outsdie the City limits, owned by G. E. Owen Lumber Company This letter was received by the Board of Appeals too late to make a report. to the Council. The matter was referred back to the Board of Appeals to i report to the next Council meeting. , , An ordinance levying' an assessment of $115.68 for the south side of I I , , west Broadway and east side of Polk Street for the north 100 feet of lot 1, ! in block 2, of Lill's AdditiDn, was read the first. time and passed to the 23 : second and third readings b1 unanimous consent of the Council by title under I suspensimn of the rules and was placed for final passage. All Councilmen I voting Aye. Councilmen absent, Stewart. Calkins stating that the Planning Commission approved the opening of 25 ,11 the street and alsp recommended that the opening include Fil~ore Street for i onephalf block south of 7th avenue west. On re~uest of Councilman Davis, jl " this matter was referred back to the Street Dept. for further consideration. :r I Councilman Davis asked Mayor Large for more time in whicn to make 26 a report regarding a petition for improving the alley on the south side of east 16th street between Pearl and High street.
