January 10, 1944 ,~ ,~ .~~. :Q';: The minutes of the regular meeting of the Common Council, Monday January 10th, 7:30 P.M. The meeting was called to order by Mayor Large. All Council- men were present. I 1 Interest in the Curfew ordinance brought out a large delegation of students and some parents, in fact the Council rool was not large enough to accomodate the crowd. Robert Broderick was present representing the Active Club and the Junior Chamber of Commerce and addressed the Council. He stated that arrangements had been made for a dance at the Eugene Hotel on Friday nights. He stated there was some 300 students in the Eugene Area and that arrangements had also been made to take over a considerable space in the Almack Building and that they would install a $15,000.00 night club for the Eugene, Springfield and Lane County juveniles. He said it was the intention to keep this club open from four P.M. to 10 o'clock P.M. except on Friday and Saturday nights when they hoped to be able to keep open until a short time before midnight. He stated this club would have a dance hall, lounge, ping-pong table, Council room, a coke bar,and other amusements. That they were asking the Council that juveniles 13-14-15 and 16 years old be allowed out until twelve o'clock on Friday and Saturday nights. Mr. Broderick stated that experience in other places showed that a club of this kind would ge self-supporting, that there would be a membership fee and revenue from the coke-bar. He stated the dance at Eugene Hotel and proposed club activities would be closed in time on Friday and Saturday nights in order to allow the students to get home by twelve o'clock. Malcolm Karr stated that he represented the students groups and that if they were given this chance that they would co-operate with the authorities and keep them off of the streets. Councilman Hawn stated that the Police Committee had a meeting and considered this situation and that they had intended to recommend that the Junior High and older students be allowed out on Friday and Saturday nights until twelve o'cloDk if they were at some entertainments, but that they were not to be allowed out on the streets up to that time. He stated that after hearing the arguments presented at this time that he personally would be willing to give them a trial to attend organized parties as outlined. Councilman Davis asked that if it was the intention for the students to elect their own members as supervisors of the- club. Mr. Broderick said that was what the group desired and that was the plan, but that the Active Club and the Junior Chamber of Commerce working together would have a full time man at the Club that could be consulted at any time. Councilman Farrington stated that as a matter of protection to the students and to all concerned that they should be chaperoned by some other than their own group. Harry B. Johnson, Principal of the Eugene High School said he was gaad to see the interest shown by the students and beleived that something now might be accomplished. Dr. Vance Webster stated that there were two or three things that should be given considerable thought before this plan was put into action: First, who was to say where the students could go; second, should 7th graders, mostly 13 years old, be allowed out until eleven thirty or twelve o'clock; third, will the bar be open while the dane is going on. He thought the proposals made tonight would not solve all the difficulties. Mrs. McClosky thought that thir- teen was too young for children to be going to public dances. She stated that she did not believe she was willing for her boy to start out that young and she thought the ages in both the lower and uppe,r brackets should be carefully watched. Councilman Hawn stated that if the plan was given atrial that the parents could still use their own judgement as to who should attend. Councilman Stewart said he did not think it was the Council's province to endorse any particular place. Councilman Barette wanted to know how parents would know that the children were going to these places or some other place. Councilman Hawn said he could not agree with Mr. Stewart and that he would not be in favor of the later hours-if the children were to go down-town indiscriminately. Mr. Kenneth L. Shmaaker of the Youth Council said he was gald to see the students taking hold of the~r own problem and that he beleived it would be worked out quite satiSfactory. Council- man Hawn stated that as a temporary measure he would move that the teen age children be allowed to be out on Friday and Saturday nights up to twelve o'clock provided they were at some entertainment, not on the street and that they were to be home by twelve otclock. This motion was seconded by Stewart and on vote was carried. I 2 3 The matter of permits for juveniles who were working to be out after ten o'clock was discussed. A motion was made, seconded and carried that the Recorder was not to issue permits to applicants unless they could show a wage and hour permit from the Bureau of Labor and that these permits would have to be endorsed on the back by the employer each night as they left from work. Councilman Barette brought ~p the matter of closing hours for the bowling alleys and pool halls and the matter was referred to the Police committee tp report back at the next meeting. ' ! 'The r~~ort stated that the approximate cost for the first six mohths would be $31~0.00 and that the committee was recommending that the City provide $2000pO out of the Emer- gency Fund or other wise, if the Welfare Leage could raise $1100.00 for the project. Mayor Large explained that there was another project under consid- eration that if authorized by the Council would need a considerable part of the emergency fund and asked Councilman Barette to present the matter at this time so that both propositions could be considered together. Mr. Barette explaine that it was the matter of the purchase of the heating plant for the N~Y.A. buildings back of the Butte. Mr. Barette said that he and Mayor Large had a meeting with representatives of the U.S. Treasury Department and that a price a little over $4800.00 had been made the City for all the heating and other equipment connected with the buildings and that this was positive+y the lowest figure that could be secured. Mayor Large explained that Mr. Woodworth of the Army Engineering Department had said the Army would be willing to pay some rent for the building now occupied, but that the Army thought the rental should be based on the $4800.00 valuation which would produce only a nominal rental. The Mayor stated further that just this afternoon he had received a letter from the Army Engineer's in Portland saying that they were anxious to enter into a lease with the City for the use of the building now occupied by them just as soon as a rental figure could be agreed on. Councilman Koppe and Crumbaker thought other valuation than the $4800.00 for the heating plant should be considered for a rental base. After some discussion by the Council a motion was made by Stewart and seconded by Baker and carried that the rental value b~ placed at $200.00 per,month. ~ ~~ :~ There was further discussion about financing the rat situation and the purphase of the heating ~quipment for the N.Y.A. building. It was finally suggested that they could both be financed by taking some money out of the Milk and Meat Inspection budget to go toward the rat situation and some money out of the Park budget to go toward the purchase of the heating plant. Councilman Baker stated he had contacted Judge Hurd and that the County would not furnish any funds for the rat control unless it was a County wide control and not until the next budget was made up. Dr. Lindgren stated that if the project was started now that when the next budget was made up there was a possibility of getting some Government fund to help out. After some discussion of the rat control situation a motion was made by Hawn and seconded by Davis and carried that the recommendation of the Health Committee be accepted for n the six months period and that the City furnish not to exceed $2000.00 as its ;:: share of the costs. III At this time Mayor Large stated he wished to make the appointments for I the caaendar year 1944. Councilman Koppe reporting for the Judiciary Committee stated that the committee and City Attorney had made a settlement in the CaE of Alice Stewart who fell on a sidewalk on east 19th street between Mill and Ferry streets. The Committees recommendation was that the claim should be settled for $200.00. Councilman Crwnbaker questioned the Council's right to make a settlement before a court order had been issued and thought it was a dangerous power to lOdge in the Council hands. An explanation was made by City Attorney Calkins and his opinion was that the Council had a right to use its own discretion in making a settlement. A motion was made by Koppe and seconded by Stewart that the Commi- ttees recommendation of a settlement for $200.00 should be adopted. On vote the motion was carried. Appraisal: $650.00 Hold for Appraisal On motion made seconded end carried the recommendation of the Committee was adopted. Councilman Farrington also read a letter from Paul W. Campbell asking a further extention of thirty da~s from this time of his option for certain city lots. This option had already been extended from November 18th, but it was the recommendation of the Finance Committee that a further extent ion to February lOth be allowed, with the strict understanding that no further extent ion of time be allowed. On motion made, seconded and carried the recommendation of the committee was adopted. Councilman Baker reporting for the Health Department said the Committee had made a study of the ordinance concerning Food and Restaurant inpsection dating back as far as 1909 and only up to 1922 and that none of these were fit for present day regulations. He stated the cOfrunittee had conferred with the County and City Health Department and had prepared an ordinance which he wished to present at this tinle. A copy of the proposed ordinance was given each of the Council lllembers and one'to the Mayor. The ordinance had its first reading and was open fur discussion. Dr. Lindgren was present and stated there was now now adequate ordinance and he thought this was a step in the right direction. He said that later it might develop that the city would need a full time insp- ector of food and restaurants. Dr. Helte;rline stated that as long as Mr. Young was handling the restaurants there had been very few complaints but that since he had quit there probably was work for full time inspector. Mr. Cloyesn manager of the Health Department said this form of ordinance had been prepared by the same organization that had prepared the form of Milk Ordinance that Eugene is novv- using. That the proposed food and restaurant ordinance is ,the same as used by other cities in the state. After a question of Councilman Crumbaker, Councilnlan Baker explained that a graduated license fee between $10.00 and $25.00 had been worked out by the committee based on the seating capacity of the place of business. On motion of Farrington the Ordinance was passed to its second and third readings by title under suspension of ' the rules and was placed for final passage. On roll call all members present voting Aye, absent none. The Ordinance was declared passed and numbered 8783. At this time Mayor Large stated we had a hard working Health Committee and that he was recommending that the COITilllittee make a study of a garbage incinerator for a post-war project and to report back at some future date their findings. Parks Committee; no report. Sewer Committee, no report. Police Comrnittee asked for further time regarding the traffic hazard at 13th and Charnelton Streets; Also reported that the curfew had eliminated the trouble of lights on the east Broadway bridge. Mr. Hawn also reported that Mr. Moxley owned the apartment house facing south on 13th and west Olive street, that there was no time limit parking south on 13th street side and that Dr. Moxley was asking for a time limit on the 13th street side. He stated that it was the recommendation of the committee that two one hour parking spaces be allowed on 13th street to accolnodate Dr. Moxley. On motion made, seconded and carried the recommendation of the co~~ittee was adppted. Councilman Hawn reporting for the Police brought up the question of issuing bicycle licenses for the year 1944. He said the committee was recommend- ing that the issuing of licenses for the year 1944 be discontinued, but that the rest of the bicycle ordinance be in full effect. Williams, 174 north Van Buren Street in regard to ppor conditions of the street and asking that the street be garveled was read. This is an unimproved street and there is nothing that the city can do to releive the situation. A letter from the Hotel Eugene Inc., asking for a franchise for the maintenance of a sign at the intersection of Broadway and Pearl Street was read at this time. An ordinance granting a franchise' to the Eugene Rotel Inc., had its first reading at this time and was laid over, in the draft of the ordinance the charge to be made was left vacant and after some discussion by the Council the sum of $10.00 per month was ordered inserted in the Ordinance. A letter from Florence D. Alden regarding a clogged sewer at 1282 east 18th street on January 7th and asking a refund from the City for a bill in the sum of $16.00 was read ,at this time. Also a bill of the Chase Plumbing Co. from Miss Pauline Walton for a clogged sewer at 433 east Broadway in the sum of $64.65 was read at this time. Both of these bills were referred to the Sewer Committee to report back at the next Council meeting. I Bids for the Grading and Gravelling of t~e alley between Pearl and High streets frow 16th to 17th street had been called for to be opened at this meeting.
