After the Council meeting o~~January 24th, Attorney Dave !vans
representing a group of property owners filed a suit in Circuit Court
alleging that the options on. certain lots grarlted to Arthur M. Gilbert
and George W. Mil tonberger on October ,+8, 1943 had expired. Oh l"ovember
1 '7, 1943 and aSking that the Court bran'1fa temporaryinj unc-cion against
the Council until the case could be hee.r;d. J.. he,aring ViaS held on,
February3rd at 9: 30 A.I\!f. and on the morning of Febru&ry 4th, JUq.ge
Skipworth ruled against the granting of an injunctioh.,X~'"

furtller discussion regarding theo~"tionsabove referred .to~ .

Dave Evans, Attorney for b. grQup oi' property owners'waspr'esent
and addressed the Council. He spoke of Judge Skipworth's ref4-salyto
grant a temporary injunction against the City. He stated it was his
opinion that the options had expired on NOYember l'7th notwithstanding
the attempts .the Council had .made for the extension .of time,.: and that he
felt the Co"uncil had not been ful;Ly informed at. the i11me the~L;pptions
were made, That he i'elt the COl-well 113::1, under the present Ci,fclLl1lstance
a perfect right to withdraw tl1{? offer. for extension of time to February
10th. .:

At this time Councilman Farrington and Hawn entered the CounGd:l
room. Attorney Calkins stated. that kr. Campbell had said th8t i~,tne
City did not want this proposed federal development that they wo~.

should pass "this infor'mation along to the Council.
CouncilmanCrumbaker stated he thought ther8should be some
corrections made in the minutes of the Council meeting of O~tober 18th
an that they did not contain some information that should be included.
After some explanation to the Council .the fallowing motion Vvas made by
Crumbaker and seconded by Baker. That, the original minutes of October
~ ..18, 1943 be corrected-by inserting just before the resolution the
~..3 following;
E; ~ lst- The entire purChase price must be cOIllpleted wi thin twelve months
~A from the date of the co.ntrant.
~ ~ 2nd- 'I'he erection of the. houses must b,e begun, within ~J.inety days after
.~~ the execution of the contract ana that tne erectlon of the houses
zl must be prosecuted with diligence thereafter.. .

After some further discussion"'by the Council regarding th~ sale
of the lots to Gilbert.and Miltonber@6r the following motion wa~' .made
by Hawn and seconded bY' Baker, tha.t tn'~ offer Of. extension Of time
sh<;>uld be rescinded and withdrawn. On vote the motion was c~rJtied.
On motion the meeting'adjourned.
