! The mihutes of the regular meeting of the COITilllOn Council, held Monday
evening N~rch 13th at 7:30 P.M. The Ineeting was called to order by Mayor Large.
All Councilmen were present. Councilman Baker having moved out of the City since
the last Council meeting and this prevented him from taking part as a Councilman
but he was present in the audience.

~ To amend the charter of the City of Eugene by adding a new chapter
1.,1:, thereto, (which shall take effect as to the levy upon its adoption and
as to the other provisions on January 1, 1945) authorizing, empowering

the duties of the City Manager and authorizing the Council to add to his duties;

N. F.Schnieder spoke regarding the traffic hazard at Broadway and Hilyard
and requested that some change be made in the stop sign at the street or that a
yellow line be placed to direct traffic. W. G. Openshaw requested that a yellow
line be placed in the middle of Fairmount Blvd. He stated there were several
dnagerous places around the different curves on the Boulevard. Both of these
matters v.ere referred to the Police Department to investi[ate and report back at
the next Council m~eting.
The committee appointed by Mayor Large to prepare an amendment to the City
Charter providing for the appo~ntment of a City Manager was presented to the
Council at this time and was read. A motion was made by Crumbaker and seconded
by Farrington that the report of the Charter cO.mmi ttee be a ccepted with thanks to
the cornmi ttee for their work in preparing this report and that the Committee be
discharged from further duty. On vote this motion was carried.
The following resolution and the text of the act was read at this time by
the Recorder:
BE IT RESOLVED BY THE :MAYOR AND COMIv'fON COUNCIL OF THE CITY OF EUGENE,
OREGON, that there be submitted to the elctors of said city for thier approval
or rejection, at a special or general election to be held in the City of Eugene
at a time and place to be designated by ordinance, the annexed Charter Amend-
ments being;-
AN ACT
THE CITY OF EUGENE DOES OHDAIE AS FOLLOWS:
Be it enacted by the electors of the City of Eugene, Oregon
Section 1. That the Mayor of the City of Eugene is hereby authorized,
enpowered and directed to appoint a City Manager, as administrative officer,
and to appoint a Municipal Judge as the judicial officer of the City, all of
which must be confirmed by the Council, and the Council to fix thier respective
salaries and terms of office.
Section 2.. It shall be the duty of the City Manager;
a. to prepare the annual budget
b. to act as purchasing agent for all departments
c. to appoivt and remove with or without cause all employees and
department head including the Recorder and Treasurer, except the
Civil Service employees shall be appointed and removed under the
Civil Service procedure.
d. to enforce all City Ordinances
e. to act as business agent for the Council for the sale of Readl Estate
and other matters relating to franchises, leases, etc.
f. to prepare and furnish all reports as requested by the Council.
g. to perform such other and further duties as shall be directed by
the COlY'.Jllon Council,
h. in his discretion to organize, disband snd reorganize the various
departments of the City government.
Section 3. The duties of the l\.~unicipal Judge shall be those given
to the Recorder ~Q$ing as judicial officer of Section 18, Chapter IV of the
Charter of the City.

by a candidate outside the State of Oregon, provided that during the tenure, he
I shall reside in the City. All other employees must be residents and inhabitants
I of the City at the time of their appointment and during the tenure of thier office

Section 5.
Vacancies shall be filled in the same manner as the original
appointment.
Section 6. The office of Chief of Police and Chief of the Fire Department
are expressly removed from Civil Service. The present incumbents may elects to
resign as department heads, retain such seniority as the Civil Service Commision
shall determine, and remain under Civil Service.
Section 7. The duties of all employees shall be assigned to them by the
City Manager and they shall be responsible and accountable to the City Manager.
Section 8. The powers herein granted to the City Manager shall be sole and
exclusive.
Section 9. The City Manager may be removed with or without cause at any time
by the Cornmon Council, after six months tenure.
Section 10. The Eugene Water Board and the Eugene Library Board and their
respective employees are expressly excluded from the operatdon of this act.
Section 11. Other than as provided herein, the Mayor and Council shall
retain the powers granted in Section 3 of Chapter 11 of the Charter.
Section 12. This act shall take effect as to the levy provided immediately
upon its adoption by the electors; and as to all other provisions of the act of
January 1, 1945.
Section 13. All acts and parts of Acts in conflict herewith are hereby
repealed.
Section 14. The Comrnon Council is hereby authorised and directed in addition
to existing levies to, in each year, levy, assess and collect a tax not to exceed
one mill upon the assessed valuation of all property in the City not exempt from
taxation; which tax shall be in addition to and in excess of the six percent
constitutional limitation upon the City Tax levy and shall be used in support
of the City's domestic budget. .

Councilman Farrington stated that in order to get the proposal before the
Council he would move that the resolution be adopted and that the Charter &TIend-
ment be referred to the people. This motion was seconded by Councilman Hawn.
Councilman Hawn stated that while it was not included in the motion it was the
request of the cOITilllittee that this be put on the May~rprimaries. Councilman Crum-
baker stated he thought there were some changes that should be made in the propos d
act and in the text of the proposal which was a part of the act. He stated that
he did not know whether the Council would be favorable to an amendment but that
at this time he would distribute to the Council copies of an amendment which he
would recommend. This amendment was concerning Section 1 of the proposed draft
prepared by the charter committee on February 14th and again on February 18th mn
which the Cornmittee recommended that the appointing power be in the Council
instead of the Mayor.

Councilman Crumbaker at this time recommended the proposed amendment which
was as follows:
TO STRIKE OUT ALL OF SECTION ONE IN THE PROPOSED AMENDNrENT Al\lD SUBSTITUTE
THE FOLLOVJING:
Section 1. (a). That the Common Council'of the City of Eugene is hereby
authorized and enpowered and directed to appoint a City Managernl as administra-
tive officer, and to appoint a municip81 judge as the judiccial officer of the
City and to fix'their respective salaries and terms of office.
~b), If the Council fails to agree upon a candidate for the office of City,]
Manager, so that the office shall be vacant for a period of two weeks, then in
that event the Mayor shall be enpowered to appoint a manager pro tem who shall
serve as City Manager; provided that the manager pro tem shall not have power
to appoint or to dismiss officers or employees of the City except wit~ the
approval of the City Council provided further that the manager pro tem shall
hold office only until a city manager shall have been agreed upon, in no event
a longer period of time than six months, provided further that the manager pro
tem, shall not be eligible for re?ppointment to the offife of manager pro tem,
for a appointment for the office of City Manager.

(c). (C). The manager shall be administrative head of the City governement, He
shall be chosen by the Council without regard to political consideration and
soley with reference to his executive and administrative qualification.

(d). The manager and such other officers of the City as may be designated
by a vote of the Council shall be entitled to seats with the Council, but shall
not have a vote therein. The Manager shall have the right to take part in the
discussion of all matters coming before the Council.

(e). No member of the Council shall in any manner, directly or indirectly
by suggestion or otherwise attempt to influence or coerce the manager in the
makine of any appointment or any removal, or in the purchase of supplies, nor
shall any member of the Council exact any promise relative to any appointment from
any cnadidate for manager of discuss, directly or indirectly with any such
r cnadidate, the matter of appointment to any city office or employments. Any
~ violation of the foregoing provisions of this section shall work a forfieture of
"i:.' the office of the offending member of the Council who may be removed therefrom by
, the Councilor any court of competent jurisdiction. Nothing contained herein,
: however, shall be construed as prohibiting the Council, while in ipen session
from discussing with or suggesting to the manager anything pertaining to City
affairs.
Councilman Crumbaker made some further remarks regarding the proposed
amendment and made a motion that the ,Council adipt the proposed amendment as
presented above. This motion was seconded by Stewart. Councilman Hawn stated
that he was not so much concerned about who should make the appointments as l8ng
as the appointment would be confirmed by the Council and that the Council was to
set the salaries. He stated that he was not favorably impressed by the fact that
other cities had decided to have the Council make the appointment rather than the
Mayor. He stated that he thought Section "E" in the amendment proposed by Douncil-
man Drumbaker had merit but ~ould be impractical to enforce. Councilman Davis
stated that regarding Section "E" he felt that a manaGer VJould be glad to consult
with the councilmen regarding appointments and that he was not favorable to this
section.
Mrs. C. B. Swango, President of the Lane County League of Women Voters,
stated that the League felt there would be some changes in section one of the
proposed alrrandment and that section 9 and 14 should be left out.
Mr. A. C. Dixon stated that he felt there were 3 or 4 sections that might
be changed. One was that he felt that appointment should be made by the Council
in place of the Iv,ayor. That he was in favor of section HEll in the proposed
amendment and that he felt that the six months tenure referred to in section 9
regarding the removal of the City Manager was simply a danger sign to the proposed
manager. He stated he felt that it would be more satisfactory if the six months
tenure was left out of section 9. He stated that he objected to the one mill tax
levy rider as provided in section 14.
Mr. James A. Rodman stated that the Committee had discussed that and'that
there was ample precedent for this mill levy and that he felt that theywere only
making a mountain out of a m~le hill regarding whether appointments should be
made @y the Mayor or the Council as lonG as the Council confirmed the appointments.
Councilman Ha~n explained that there was a 5 mill limitation in the Charter for the
General Fund. That this was not sufficient for the requirements of the general
fund and a proposed changed in this 5 mill levy ahd been voted down three tinles by
the people. That the Co~~ittee had discussed at length the advisability of includi g
this with the manager amendnlent. The co@nittee was convinced there was need for
the extra funds and had recommended that it be included with the manager amendment.
Ed Boehnke, as a member of the Comrdttee stated that he felt that one mill
levy should not be put on with the proposed manager form as he felt that the 6%
limitation was much more flexible than the one mill levy.
Colonel Tierney stated that he had been waiting for the past 15 years for
this charter amendment providing for a,City ~~nager and that he thought this was
qn excellent start and th~t he felt that the matter should be left open now for the
people to consider and hearing held and suggestions for changes be heard.
Christian Jensen, representing the Brotherhood of Local Trainmen stated that
he felt this matter should be left open for further consideration as it had only
been given to the press on Sunday~ He said that he had head pbjections from not
only labor but f~om several business men regarding the removal of the Chiefs of
the Police and Fire Department from Civil service and that the Railroad Unions
would like to have time to have a meeting to consid~ such changes as they might
wish to make to the proposed amendment.

this time stated that Miss Hendricks asked for a change in the wording in sectio

Mr. Elter, of the League of Oregon Cities stated that the City Council could
pass an ordinance setting up a form of amendment and thus shorted the time- requir d
for being on the May primaries. Councilman Farrington stated that at first he
was favorable to the idea of the Council making the appointments rather than the
Mayo:r- but he thought that was rahter immaterial and that he was willing to go
along as presented by the Committee.

Herman Kherli, of the League of Oregon Cities made a plea for appointment
to be made by the Council stated that it was not considered good practise by
most authorities for appointment to be made by the Mayor and confirmed by the
Council in the City ]~ager form of Government.
At this time a vO,te on the proposed amendment by Councilman Crumbaker was
called for, the voice vote being rather indefinite, Councilman Crumbaker asked
for a roll call which was as follows: Those voting AYE, Koppe, Barette, Stewart,
and Crumbaker; Those Voting NO, Farrington, Hawn and Davis and the amendment
to the original amendmentwas declared carried.
The question of whether the proposed one mill levy in Section 14 should be
ooonitted from the proposed City Manager amendment and included as a seperate
amendment was discussed, BothsCouncilman Farrington and Koppe stated they felt
that this one lhiliblevy should be left in as originally proposed. A motion was
made by Hawn and seconded by Crumbaker that in section 10 the word PUBLIC should
be placed. between the words EUGENE and LIBF~"RY making the name Eugene Public
Library. On vote this motion was carried.
Attorney Calkins stated that since the amendment by Crumbaker had carried
that the act as now stated ih the resolution would have to be changed to confirm
with the amendment, and while there was no vote taken on this there was no
objections from the Council.

A note on the original question presented by Farrington and Hawn and as
amended by Crumbaker was called for. On Roll call all Councilmen present votingt
AYE.

A motion was made by Crillubaker and seconded by Hawn. On roll call all
Councilmen present voting AYE.

Section 2. This levy shall be in addition to existing levies and in
addition to anddin excess of the six per cent limitation upon the City's tax

Councilman Hawn stated that he thought the proposal was a fine thing and
asked if any computation had been made as to whether the one mill levy would be
sifficient to build the proposed City Hall and Jail. Mayor Large stated no
estimate of the final cost of the building had been prepard, that the City had
been offered $60,000.00 for the City Hall site some time back and that the
proposed one mill levy for five years might not be enough. He stated that the
main reason for the one mill levy at this time w~s that the City should have some
rnoney on hand to correspond with the levy made by the County for a Court House. n
City Attorney Calkins explained that there was an advertisement in the
Eugene Register Guard each week about the proposed five mill taz levy for the
next fiv~ years, ~roposed by the County. A motion was made by Hawn and seconded
by Davis that the resolution and proposed charter amendment as presented be
adopted. Councilman Crumbaker suggested that probably it would be better to
delay this amendment until the November election on accouht of the other two
measures being put on by the City for Ivfay primaries. The question was called fOlDI'
and on ~oice vote was declared carried; no opposing vote could be heard and Mayor

A motion was made, seconded and carried that the Council accept the recommenda-
tion of the Finance Committee.
Councilman Farrington reported that the bills for the month of February had
been okay'd by the members of the Finance Co~rrittee and was recorMlending that
vvarrants be drawn for these. On roll call all Councilmen voting AYE.
Councilman Farrington reported regarding the Southern Pacif~c tract at 25th
and Uni versi ty near the Tviasonic cemetery. This had been pr'esented the Council
on February 28th and an offer had beEn made by the Council of ~100.00 and
refused by the Southern Pacific. At this time Councilman Farrington stated that
the Finance Committee had looked at this property 2gain in ihe afternoon and
there were four lots that the City could ssll after taking a strip for the
street and that it was the recoillrrlendation of the Finance Committee that the City
offer the Southern Pacific the price of ~260.00. A motion was made by Farrington
and seconded by Stewart that the offer of $260.00 be fllade to the Southern Pacific
Company for the pirce of land and on vote the motion was carried.
Councilman Farrington stated the Finance Cornmittee had investigated the
proposal of the Eugene Association of Insurance Agents which was presented to
the Council in the letter dated February 14, 1944, re6arding the change in the
manner of handlin[ the insurance for the City of Eugene. Councilman Farrillgton
stated that it was the recommendation of the Finance COIl1.lllittee that this matter
be deferred until the first of the year. A motion was made by Farrington and
seconded by Stewart and carried that the recommendation be adopted.
Councilman Farrington reported that about a year ago the fWin Oaks Lumber
Co. had been given perfllission for a wood yard on a tier of lots on the south
side of first between Monroe and VanBuren streets. At this time there were
objections by the property owners on the north side of f.irst street and Mr.
Farrington stated that conditions were not very satisfactorily there. A motion
was made by Councilman Farrington and seconded by Barette that further r'equests
for the wood yards by the Twin Oaks Lurrwer Company at this location be not
granted. On vote this motion was uarried.

Councilman farrington also reported that he had the usual complaints about
the condition of the sidewalk on the v..,est side of High where the Walters Bushong
mill is loca ted. !VIr. Farorington sta ted the t the Commit tee after looking at this ~~~;
High street side-walk looked at the 3rd and Lincoln Bituati6n;,owned by the Hyland <q;
mill. He stated that the curb which Mr. Hyland had knocked out without a curb-cut ,...,

permit had never been replaced niether had the parking strip been paved, which the
Council had authorized to be done and that third street was practically blocked by
Hyland trucks. This matter was referred to the street department for investigatio .

Councilman Barette asked that the Tree Trimming Ordinance be left in the
Park COll~ittees hands to make further changes.
Sewer and Police Committee- no reports.
The Departmental reports: Police ,Police Matron, Eugene VJa tel' Board, City
Engineer, for the month of February were ordered placed on file.
A curb cut ~e~uest from L. P. Curtsinger, 257 Van Buren streets for a 50
foot cut and a request from J. A. Morgan, 1692 Charnelton for a 12 foot cut, for
a fuel drive~ay were read and recomrnended by the City Engineer, W. C. Clubb.
A rooming house permit of Edward L. Temple, for the Hanpton Hotel, 60
east 7th street was granted by the Council.
A request for a transfer of beer ,license at 860 Olive street, Snappy Service
No. 1 from Hulse and fucKay to Kenneth L. Hulse was approved by the Council.
A request from Pearl Forncrook asking that George K. Schmidt and Lawrence
Jorgensen he deputized as bouncers at the Wintergarden Dance Hall was read. A
motion was read by Councilman Hawn and seconded by Koppe and carried that the
request be denied.
A request from George Clark asking that Harry Nelson be appointed as special
Policeman while on Mr. Clarks property at 282 ~an Buren was reaQ. This matter was
referred to the Police Committee to report back. \
A request from Arthur Warren, 2615 Columbia street asking the Council to
vacate 26th avenue east from Colu~mbia street a distance of 150 feet was read at
this time. This matter was referred to the street committee for investigation
and to report back at the next meetihg.
A letter from L. P. Curtsinger regarding a Sflven foot set-back on lot 7,
block 9, Sladdens 3rd Addition at the corner of 3rd and Van Buren was read at
this time. He stated that this set-back would prevent use of a seven foot strip
!60 feet long and asked that an investigation be lnade with a view of doing away
N with the seven foot set back in this locality. This matter was referred to the

A letter from C. E. McLean, Manager of' the Eugene Hotel asking for a ten
day extention in which to accept a franchise granted the Eugene Hotel under
ordinance # 8785 was read. A motion was read, seconded and carried that this
request be granted.
The following resolution was read at this time:
HESOLUTION
Be it resolved by the Common Council of the City of Eugene that the
hereto attached lease between the City of Eugene and the United
States of America, which lIas been presented by the United States of
Arnerica to the City for execution, shall be executed by the Mayor
and the City Recorder, and by the Recorder delivered to the Govern-
ment for the~r signature.
A motion '"was made, seconded and carried tha t this resolutioh be adopted.
An Ordinance accepting the report of the viewers on the proposed openrumg
of Filmore street from the south of 6th avenue west to 7th avenue west had its
first reading and was laid over.
The resignation of Carl R. Baker as Councilman frolll the 1st Ward was
read at this time. Mr. Baker stated that he had sold his home and business and
moved out of Eugene and was no longer eligible to serve on the Council, Mayor

Large stated that he was sure that the Cmuncil regretted to accept the resign-
ation but there was not much that could be done under the circumstances. A
Illotion was made by Hawn and seconded by Davis that the resignation be accepted
and that the Council express tu IvIr. Baker their appreciation for the services
rendered. Councilman Hawn stated that the resignation of Mr. Baker left a
vacancy on the Council and in view of the heavy work to be done by the Council
the vacancy should be filled. Councilman Hawn stated that he was recommending
to Mayor Large the name of Charles Wiper as Councilman of the First ward to ta'ke
the place of Councilman Baker. Mayor Large stated that he was glad to make the
appointmept of Mr. Wiper as Councilman from the first ward. A motion was made
by Stewart and seconded by Barette and carried that the appointment of Mr. Vaper
as Counciilinlan from the first ward be confirmed, and the Recorder was instructed
to notify Mr. Wiper of his appointment.
