The meeting was called to oder by Mayor large. ,All Councilmen present except Davis and Wiper. Ward Wintermier stated that the house next door to him at 1043 Jackson has just been vacated and that it was in a horrible sanitary condition on the inside and entered a protest against the house being occupied until it is thoroughly renevated inside. A petit~on was presented in protest against the condi tion ,of the house which had 15 signatures'. A Mr. Nelson living across the street was present and confirmed the statements made ~y Mr. Wintermier. Mr. -910ye8, County Sanitarian, was present and stated that'the Health Dept~" had addressed a registered' letter to Mrs. 1.1. J. Estes,. owner of the house at 1043 Jackson instructing that the house must be fumigated and put in a sani- tary' condition before it could be occupied again. Mrs. Estes addressed a lett~r to the Council, dated April 10th, which was read at this time. She stated in this letter that she would renevate the interior of the Building and fumagate ~he premises as directed in the.request of the County Sanitar#an. Couo9ilman Stewart stated that he, Councilman Hawn, City Engineer Clubb, ana Councilman Crumbaker had gone into the house during the afternoon and that the conditions were bad and that the connected wood-shed was a fire-trap and that,it was in no condition to be occupied. A motion was made, seconded and carried that the City Attorney should send a notice to Mrs. Estes that she was ~ot complying ~ith the condition set up in the Ordinance II 8603 and that" ~ hearing for her would be held by the Council on April 24, 1944. Norman F. Schneider inquired about a CitY-CountY,Planning Commission that might have jur~sdiction of proposed tracts outside of., the City limits. Attorney Calkins explained that there was no<Clty-County Planning Commission but ~hat the City Planning Commission'-had jurisdiction for a distance of 6 mi1e~outside of ,the City limits and could stop a plat being filed if within the Q,mile limit. ",> , Councilman Hawn reported that he had talked w~~l1..~s. Wiper during the a~ternoon and she stated that Mr. Wiper was showing ~ome progress. Th~t he was not yet out of danger and it would be at least several weeks before he was' Qut. . The county had been renting this south at $10.00 per month. _A motion was made by Farrington and seconded by Hawn and aarried that the,City would set_the rent price at $15.00 per month. Street Department - no report " i; I, Ii . , Councilman Stewart reporting for the Fire Department stated that Harry Ray and Bryon Barnes, members from the Bethel Fire_ District were present and that they wished to address the Council in regard to taking over.the ,trailer fire equipment received by the City throught. the Office of Civilian Defense. Thes~ gentlemen stated that the department already had a truck with 200 feet of hose, that they had a fire department of 18 men and were putting money in the next budget for the purchase of more equipment. He stated that they were short on equipment and, would like to take over this trailer, that the City had received from the Office of Civilian Defense. -He stated that they would be able to manthe equipment and see that it was prQperly handled and kept in good oondi tion. . Mayor Large explained that the City was. required to furnish a bond for the return of. this equipment when the government requested it. The Council was willing that this pirce of equipment should be loaned to the Bethel Fire District, the only question being how the fire district should protect the City. A suggestion was made by Councilman Stewart that the Bethel Fire District should have a meeting in which they should agree to accept the loan of this equipmeilb trom the,. City and they should agree to return this equipment to the City in as good a condition as it was loaned eoccept for the usual wear and tear and that the Bethel Fire District should furnish the Cit,y wi th a copy of the minut.es from this meeting. A motion was. made by Stewart and seconded by Hawn that this equipement be loaned to the Bethel Fire District on a yearly basis, subject to a recall by the City at any time that the govern- ment might request the re_turn of the equipment and that the Bethel Fire District should furnish the City a bond that the equipment ,should be kept in first class condition at all ti3es. On vote this motion was carried. Councilman Stewart reported to the Council that volunteer fireman that ' might be used by the Fire Chief during any fire would not be covered :by the State Industrial Aocident Commission and Attorney Calkins explained that the City would -not be liable in case a volunteer fireman was injured. Health Department - no report Councilman Barette, rep9rting for the Parks Committee, stated that the Playground Commission had a meeting on Thurs~ay April, 6th and that Mr. Shum- aker had been ,present and acted as secretary. That'Mr. Shumaker had presented a copy of the minutes of this meeting and Mr. Barette requested that the Recorder read the minutes at this time. The report was that those present were J. D. MacLaren, E. A. Barette, and Louis Koppe, representing the Youth Council present were Mrs. E. G. Boehnke, Mrs. W. S. Love, E. V. Duke,A. F. Loman R.D. Clark, W. R. Baker, Rev. W.R. Nicholson and L. K. Shumaker. The report was that the school board was willing to help'in any way possible to further the recreational program, was willing to allow teachers to cooperate, to provide for the use of the school ,greunds and equipment, but. that the school board refused to accept the financial responsibility of the program either by devoting more of its operating budget to public recreation or by assuming the oollection of any special levy for such purpose. A request was made that ,the City continue to make the yearly three tenths of a mill levy for recreational purposes. Councilman Barette recommended that the City make the levy and turn the money over to the School Board to be distributed by ,them. Councilman Stewart stated that the prople had voted the levy outside of the 6% limitation and that ~e thought the levy should be maintained by the City, Attorney Calkins explained that the money could not ~e turned over to the school board but that the disbursement of the money would have to be done -by the Council. He stated that the activities could be carried on at the direction of the school board but that the disbursement of the money would have to be done by , the Council, He stated the report had requested that a new playground comm- ission should be appointed consisting of one Councilman, one school board member, one member from the Eugene Youth Council, and two members at large and that the Playground Commission should act ih and advisory 'capacity on all the 'I I I :1 I, I !: Ii I. A motion was made by stewart, and seconded by Barette and carried that the Council accept this report of the C0mmittee., The report had made reference to' a swimming pool and pointed out that the Willamette River had been condemmed, that there was little possibility that the Anchorage Pool would be opened this year, that there was no possibility of the pools at the University of Oregon being used this summer and the prospects were trhat there will be no SWimming in EU@ene this ,year except as people swim in the River at their own risk. It was the recommendation that no pool would' be , contemplated in Eugene unless $73,000.00 could be raised for the project. Ward Wintermiew at this time suggested that the City could prepare the old resevior on Skinners Butte for a swimming pool. ,He stated that he,did not think the cost would be excessive. SheriffO. E. Crowe was present at the Council and stated at this time that he came as a representative of theo Kiawanis and that the Kiawaniswanted the Council to know that they were vitally interested in a recreational program this summer. There was further discussion by the audience regarding a SWimming pool for the City and Mr. , Wintermier stated that he thought the City-would be wise in putting as much as $5,000.00 on the old resevoir on Skinners Butte, to put it in ,shape for the season. I ~ ,Councilman Hawn made a lenthly explanation regarding the investlgatio~ that the Playground Commission had made for a swimming pool. He stated that the $25,000.,00 required for the swimming pool was not ample to c'onstruct thee kind of a pool Eugene should have. He stated that he thought that additional money could be raised by prmvate. subscription but that the war conditions had made it necessary that the progr~ be delayea. . Mayor Large stated that the public seemed to have the impression that the ,Council was delaying the construction of the swimming pool but that this was not a fact. He stated that at one time the $25,000.00 was offered to the school board if they could find a way to construct the sWimming pool and administer ~t. He stated that he did not believe the Council wantedto delay the matter but simply could not construct the pool on account of the war situation. Engineer Clubb explained that the department ,had been working on plans for a pool 60 by 122 feet but that no estimate had been assembled regarding the cost for a pool for that size. A motion was made by Hawn that the,Enginner, as he had time, complete an es,timate of the cots of this pool that they had been working on, and that he should make an estimate on the probable cost of putting the old resevoir in condition for use as a swimming poot this year. This motion was,seconded ,by Crumbaker and carried., lIIfr. Shumaker asked if the Playground Commission as requested .in the report could be appointed at this time so that activities could be started at once. Councilman Crwnbaker stated that Ordinance #6187 provided. for the Playground Commission and he thought there were nothing further that the Council need to do in order that the activities could be carried on. Mayor Large explained that he did notsee the reason of a new Playground Commission but thought the old commission would be able to do the work., - Councilman Barette stated that he had a tree trimming ordinance which -would be presented later in the meeting. He also referred to the article in the Register Guard regarding the condition of the buildings in the Hendricks Parks. He stated that the building was in a very bad condition and tha~3 sides of it had been demolished and that the front had been, started on'. ,He stated that he thought the only solution to this problem was for some of the Park. employees to live at the park., He stated that the park was to be used by the Girl Scouts during the summer and that. Mr. Lamb would make what ever repairs that were necessary for their use when they were ready to move in. Sewer and Police Committee - no report The following departmental reports for the month of March were read and ordered placed on file:. Police Matron, Police Department, Milk.and Meat Inspector, City Engineer, ~nd Eugene Public Library. The following letter from the Board of Appeals was read; "The Board of Appeals has received a request from Charles D. Byrne for a permit to build a duplex residence on Lot 3, block 1, Maplecrof~ Addition, being on the north side of 22nd'agenue between Willamette and McMillan streets. He is also asking for a waiver of the "set-back" ordinance. As this location is practically four and one-half blocks outside of the apartment zone, :the Board is recommending that the Council refer the request to the Planning Commission." On vote of the Council the recommendation was adopted. Ii " i: I; I: A letter from Margueite Carpenter, 1255 Moss protesting the establish- ment of a lumber yare east of her house was read. The City Engineer was instructed tQ make an investigation regardihg a lumber yard in this location and report ba'ck at th.e next meeting. ' A letter from'H~Meriam, Coordinator of the Lane County Defense Councim, was read. This letter explained that the Telephone Company was moving the defense telephone system from the Armory Building and placine it in the 'Fire Department in the City Hall. ' An amended ordinance to regulate the planting and care of all trees, flowers and plants and vegetation on City property, and within the boundaries of streets and alleys, and in any place controlled by the City involving traffic hazards, had its first reading and was laid over. , An ordinance ordering a special election for submitting to the electors of the City of Eugene, Oregon at such special election, '" to be held on the 19th day of May, 1944, concurrentlyw~th the.State General Primary Nominating "Election, the following amendment to the Charter of the City of Eugene, " referred to the electors 'of said City by the Common council for their approval or rejection and adopting the polling places and using the judges and clerks provided Jina appointed by the County for the said State General Primary Nomi- mating election, and providing for all acts necessary for the carrying on of siad election, and declaring anemergehcy, was read and,-passed to its second and third readings by unanimous consent of the Council by title under suspension of the rules and was placed for final passage. Councilman voting Aye, Farrington Koppe, Barette,Hawn and Crumb~ker. Councilmen votihg ,No, none. Councilmen absent, Davis and Wiper. The" Ordinance Was declared passed and numbered 8788. Councilman Stewart reported regarding the polce to be erected at the northwest, corner of Broadway and Fearl, to support the ornamental lights and the Eugene Hotel sign. He stated that only two members of the Fire and Water Committee had looked at the pole and asa committee had no report to make. -" ' He stated that perhaps after the ornamental lights had been put on the pole and a cap-put on the top that the complete pole would not look 80 bad. Council- man Crumbaker suggested that if Mr. Johnson would consent to the present arrangement for the support of the Hotlel Sign that the'erection of'the pOle might be deferred for the duration of the war with a view of~tting a better looking pole after the war. Aftersomedmscussion a motion was"made by Hawn and seconded by Koppe and carried that the pole in que~tion be erected and"' that the Recorder notify the Eugene Water Board that the Council had granted its cons~ntforthe erection of the-pole~ Mayor, Large stated that w~en he named the members ,of the bUdget committe he had used'the, name of Charles Wiper but that since Mr~ Wiper had been appoin- ted as a Counciaiman, this left"a vacancy on the bUdget-'comID.ittee, and that he wished to appoint Earl Peterson at this'time to fill the:vaeancy on the budget committee~ A mQtion was made, seconded'and carried that this appointment be confirmed by the Couneil.
