The meeting was called to order by Mayor Large. All Councilmen pre$ent except Koppe and Wiper. ",~ , ....... ......,.4 v'R'IIP-A ,....""';" I, I; I; ! A. West Johnson addressed the Council regarding the recent sign franohise granted the Eugene Hotel. Mr. Johnson stated that as a pDoperty owner adjacent to the intersection, he felt that he had been done an i~justice, that the present pole, for the support chf the sign was unattractive, would look more like a I chimney and he a blot to the City. Mr. Johnson stated that in December, Mrs. Johnson had entered into an oral agreement with Mr. McLean, manager of the Eugene Hotel, that for the rental price of $25.00 a month, they would continue the .' support for the, Eugene Hotel sign. Mr. Johnson stated he thought the Council should reconsider their action. Councilman Farrington stated that the Council knew nothin of the oral agreement between Mrs. Johnson and Mr. McLean and Councilman Crumbaker explained that an add had been carried in the Register Guard and that the Guard had carried news stories regarding the franchise before it was passed by the Council. Mr. Johnson stated he had been out of town at that time and knew nothing about this transaction. Mr. Johnson stated that it had been suggested to him that he say nothing about thisfranchi,se and that he did not ,know whether this was tntended as a threat. Mr. Johnson said that he would like to know whether'thiswas the intention of the Council to grant similiar franohises chr was it exclusively tar the Eugene Hotel. Mayor Large explained tha~ hhe Eugene Hotelhad'made a 'written request for the franchise and that was the way it had been brought to the attention of ,the Council. Mr. Johnson stated he would like a franchise,granting privilieges such as granted the Eugene Hotel and that he would make the Council a yvritten request. Councilman Bar,ette suggested that Mr. Johnson and Mr. ~cLean should get together and he felt that they could adjust their difference. Attorney Calkins stated that he had talke with Mr. Johnson's attorney and the Attorney suggested that it was up to Mr. Johnson and Mr. McLean' to get together and make an adjustment. Mayor Large aSked the Council ir they wished to, take any action on this matter and Counoil Farrington stated that he thought there was nothing further for the Council to do. ' II There was a letter from Paul W. Campbell, Benjamin E. and Helen Irene' Peterson regarding the purchase of the east -110 feet of lot 5 and 6, ,Block 3, Driverton Addition, which had been purchased from the City. - The purchasing parties beleiving the lots were at the northwest corner of 19th and Hilyard and after payment was made they discovered they were on the northwest corner of 18th and Patterson streets and were asking refund of the purchase price of $650.00. It was the recommendation of the Finance Committee that if a refund of the $32.50 commission paid to Mr. Campbell and tQe $17.00 paid by the City for'the cost of the title insurance was refunded to the City, that the deed should be ,caneelled anti a refund of the $650.00 be made, to the purchaser. A moiton was made, seconded and carried that this recommendation of~ the'Finance Commi ttee be adopted,. Street Committee - no report ~ Councilman Stewart reporting for the Fire Committee referred to the recent fire at the Firestone Buildi'ng located at the corner of Ilth,and Pearl~ He stated that the City was confronted with the unusual conditions lnthat theria were piles of truck and passenger tires located at the various vulcaniZing plants in Eugene, and that this was a dangerous situation. He stated: that ther was a huge pile of these tires 'stacked against the north and west wa~l of the Firestone Building and 'that it was almost impossible to put out the fire in this stack of tires. Councilman Stewart stated that these tires had been coll- ected and were awaiting government inspection to be shlpped back to the factory and they thought they should not be allowed to accumulate in large numbers at any of the vulcanizing places. He stated that the City did not yet have a report from the State Fire Marshall regarding the Firestone ,Fire. ,A motion was made, by Stewart and seconded by Crumbaker that no building'permit for reconstruction of this building should be issued until the Council had an opportunity to know just what was being done. Onvoterthis motion-was garried. Coun9ilman Hawn questioned if the Fire Chief had made a detailed report regarding this recent fire and stated that he thought the City was ,slack in inspectipg by the Fire Departing, of the different business firms "in Eugene. A recomL~endation was made by the Council that the Fire Cheif make a detailed wri tten repQrt regard,ing this Fire-Stone Fire and f?tated ih this report the fire hazards that they found there. Councilman Stewart explained that the Fire Department had not been making inspections on account of the shortage of help and Councilman Hawn suggested that it might not be out of place to ask the Fire, Chief to make some of these inspections. A motion was. made, s,econded and carried that the Fire Chief be instructed to see that the sidewalks around the 'Firestone Building be cleared up at once. ' Health Department no report, Parks Department - no report Sewers Committee, - no report ,Councilman Hawn reporting for the Police Department stated that I. W.' Parker oft the Naw Aid" AuxilIary had contacted him previous .to tl}e time the meeting was, to be held on April 24th.' That the Navy. Aid Auxilliary had a. captured Japanese Zero' plane that they were exhibiting at various places and had asked permission to exhibit the plane in Eugene for two days) that there was an addmission charge and that~the proceeds were for Navy Relief. Council- man Hawn stated that he had told Mr. Parker that he could not make a committ- ment for the Council but that he would be in favor of this exhibition and when there was no meeting on Arpil 24th he forgot the matter until he received a' letter from :Mrs.. Milton Bren thanking 'the Council for there consent in allowing 't~i's 'plane to be displayed in Eugene. A motion was made. by Davi,s and seconded by Barette that, Mr. Hawn's action in this matter be confirmed by ,the Council. Engi~eer Clubb stated that there would be about 86 lots in this property bounded by Taylor and Chambers street and from 13th to the Amazon which was about 16th street. Councilman Hawn asked if there was any possibility of the old airport, being used later as a private landing field and Mr. Clubb explained , that there would be a distance of H3300 feet south of the Amazon which would be ample for any plane which might be used later. A motion was made' by Hawn and seconded by Crumbaker that the Engineer be directed to survey the plat and the ,north end of the airport as mentioned above. The Sewage charges report of the Eugene,Water Board for the month of March and the Enginner report of the month of Apr.il was r.ead and ordered placed on file. l\.' ..-.. ":J,J :"~,/j "*'..,.~ ~1 A request for transfer of Package class B license of Bell's Basket Grocery 34 we,st 10th to J. F. Williams was granted by the Council. The following letter from the Board of Appeals was read at this time; "The Board of Appeals_has received a request from Charles Williamson for per- missi,on to erect a neon sign:! two feet by, six feet, at hi$ residence and office at~?,6 east 11th, the s'ign to be attached to the house and, would not come out over the 'street. This sign is in excess of the provision in .the Zoning Ordin- ance ~or residential and apartment zones. The Board recommends that the request be granted." "A request had also been received -i'rom P. L. Durkee asking to be,allowed to convert a large house at 954 Th~rdrAvenue west into two apartments. The only c~s required would be the cutting in of an extra door and erecting one part- ition. As this is near the industrial section of the City, the Board Recommends that t~e request be granted." On motion made, seconded and carried the recommendation of the Board was adopted. The report ,of the City Engineer regarding conditions at the lumber yard adjacent to 1255 Moss was read at this time. Margueri te Carpenter on April 10th made, a protest as,,. to the use of the lumber drive-way between her house a d the house directly north by the lumber Company. Attorney Calkins made an explanation,of the conditions there and stated that there was not too much that the Council could do but if the Council wished hom to, he would call tp.e parties in his office and see what hould be done to settle the matter. A recommendation was made by Councilman Crumbaker that Mr. Calkins should see what could be done. A letter from D. F. Mains, 61 west17th, regarding an accident to his auto on August I?, 1942 was read and this matter was referred to the Judiciary Comm- ittee. An Ordinance to regulate the planting and. care of the trees, shrubs, flowers, plants and vegetation on City property, and within the boundaries of streets and alleys, ,and in any place controlled by the City involving traffic hazards, having had its first reading on April 10th was read in detail at this time. i ' Milton A. Kaupal addressed the Council regarding this ordinance and stated that his main interest was in the_ height of the trimnling provided: by the ordinance. He stated that he hoped the Council ~ould make the hieght as low as possible, consistant with the traffic, to be accomoqated. He suggested that the clearance for the street be 10 feet instead of the 12 feet as now provided. - Section 10 of the proposed ordinance contains the emergency clause and Councilman Crumbaker suggested that thi.s should be eliminated. A motion was made by Stewart and seconded by Crumbaker that the Emergency clause should be eliminated from the Ordinance and on vote was.carried. Councilman Hawn made objection to the trimming of the trees '12 feet from the street and only 9 feet over the 'sidewalks and stated that he thought the trimming of the trees should be the same over the walk fJS over the street. There was some discussion re- garding this part of the ordinance. A motion was made that Section 4 of the ordinance be amended as follows: That the clearance over, the sidewalks be level , with that over the street and that the trees be trimmedsymetrically ,all around. On vote this amendment was carried. , A motion was made by Councilman Farrington and seconded by Barrette that the ordina'nce be passed to its third readings by consent of the 'Council by title under suspension of the ru+es and 'was placed for final passage. On roll callt all Councilmen present voting, Aye, absent Koppe and Wiper. The ordinance was declared passed, and numbered 8?89. W. and Louis ~. Kokkeler and a Contract and agreement with the Kokkelers regarding the cross- i+;.. ings from the road to the property. The erection of 3 culverts and a drainage ditch and the moving of the fence was read at this time and a motion was mede, seconded and carried that the Mayor and Recorder be authorized to sign the agreement as read. - The following Resolution for the opening of Fillmore Street from the alley between 6th &0 7th to the north side of 7th was read at this time and on motion. , made, seconded and carried was adopted; RESOLU~ION In the matter of the Opening of Filmore Street from the alley south of 6th avenue West to 7th Avenue West, ih Eugene, Lane County, Oregon. Eugene by ,Resolution duly adopted October 25th, 1943 determined to open, layout and establish Filmore Street from the south line of west 6th St~eet Addition and the South line of Grand Prairie Addition tothe North line of 7th Avenue, And,. WHEREAS, the report and plat of the City Engineer for the opening of said street was duly made and filed and thereafter duly adopted by the Oity 'Council by Ordinance No. 8779, passed by the Gommon Council, December, 13, 1943 and approved by the May December 15, 194,3, , And, Whereas, the Viewers duly appointed by said Ordinance No. 8779, made and filed a report of their findings of benefits and damages to the property benefited and the property damaged by the opening of said ,street, 241 And, Whereas, the due notice of the consideration of said report was duly 'adopted by Or<linance No. 8787, which was passed by the Common Council on March 27th, 1944 and Approved by the Mayor on March 28"lS44, 1 , And, Whereas, the damages sutained in the taking of property in said street opening belonging to Patrick C. Uollin~J was fixed at $875.00 and the benefits to the property of said Patrick C. Collinsrw~s fixed at $117.25, And Wheras, the damages sustained by the property of John R. Davis was fixed at $125.00 and the benefits to John ,R. Davis were assessed at $20.00 that being all the property taken. Collins, damages in the net sum of $757.75, and has paid damages to John R. .Davis in. the net sum of $105.00 being the amount of damages over the benefits, the City having issued General Eand Warrant No.6l481 to Patrick C. Collins and General Fund Warrant No.61482 to John R. Datis1 and the benefits to the remaining owners are ordered assessed to,the property as described in the report of the Viewers and the ordinance adopting the report of the Viewers, and whereas, Patrick C. Collins and John R. Davis have accepted their said warrants. And, Whereas, no objections to said report of Viewers have been filed and the time for appeal has expired. An Ordinance granting to the Southern Pacific Company the right, privilege and franchise to establish, lay down construct maintain and operate a single standard gauge railway spur track over and across a certain portion of Fourth Avenue, west, in the City of Eugene, Oregon, subject to certain conditions and restrictions hereinafter set, having had its first reading on March 27th and its second reading on April lOth, was read the third time and on roll call all Counc~l men present voting Aye, ~bs-e-nt, Koppe and Wiper'. The _ ordinace was declared passed and nUmbered 8790 . A report regarding the II Estes property at 1034 Jackson from the Lane County Health Departmentwas read at this time. Councilman,Stawart stated that he, Fire Chief NusbaUm, Building Inspector S. R. Mosher, and Chief of Police, Bergman has inspected the premises and that they were satiSfactory. Mayor Large asked if the Bethel Fire and Water Distr;i.ct had returned the new pumper that they had borrowed when they were having the Board meeting. Council~n Stewart stated he did not know whether or Bot it had been returned and Mayor Large requested, that they be asked to return the rig at once. A motion was made, seconaed~and carried that the ,City Recorder advertise for bids for 3000 feet of fire hose. Bids to be opened at the Council meeting May 8th. A question was ral,sed regarding the condition of Mr. Wiper and Mayor Large explained that he had called the residence just before coming to the Council meeting and Mrs. Wiper stated Mr. Wiper was much improved but that it would be some time before he wquld be able to be out and Mayor Large stated he could not make a guess as to when~r. Wiper would be able to attend Council meetings. The names of Jack L. Fruitt in the Fir~ Department and Arthur Ward in the Police Department were ordered placed on the pay roilil.
