All '. .,., Councilmen present except Hawn and Wiper. . In addition to the regular meeting of the Counciili, this was the date I'; set and advertised for the Tax-Payers meeting to consider the.budget for the 1 fiscal year 1944-45. There were no citizen members of the committee present .and the Mayor Large asked if there was anyone present to make a statement for I or against the tax levy and there were no objections. I; " An. Ordinance levying the annual tax levy for the City of, Eugene, for 2 [, the fiscal year beginning July 1, 1944 and ending June 30, 1945 ~as read the I' .first time and passed to its second and third readings by unanimous consent of the Council, by title under suspension of the rules and was placed for I: final passage. On roll call all councilmen present voting AYE, absent Hawn and Wiper. The ordinance was dec.lared passed and nw;r).bered 8796 . I': Councilman Koppe reporting for the Judiciary committee stated that the II i!! committee and the City Attorney held a meeting at which Mr. Manerud was present 3 I: and discussed the saw-dust situation which had been referred from the last meet- \- ing. He said it was agreed at' the meeting that the Fire Department should leave " 1,1 some hose at the saw-dust pile and that Manerud Huntington would hire a man to I: 'look after the fire ,and get the pile burned up as soon as possible and that Mr. I! I, Manerud said that he would gove the saw-dust to anybody that would haul it away. I" Couhcilman Koppe stated that Mr~ Manerud has said he would endeavor to secure Ii Ii some pipe so that the Fire Department would have to furnish only a short length of hose and that it was the committees recommendation that this arrangement I' II be adopted. A motion was made by Farrington and seconded by Crumbaker that the ,i above arrangement be adopted. On vote this motion was carried. .' i! At this time Councilman Hawn entered the Council Chambers. " i Councilman Kopee stated that the Judiciary Committee had a meeting I I' I. regarding the appointment of a committee to interview applicants for the City j: manager position' and report their progress to the Council. He stated it was I I. -the recommendation 6fthe Judiciary Committee that the Finance Committee should 4 " handle this situation. A motion was made by StElwart and seconded by Barette :i f' and carried that the recommendation of the Judiciary committee that the Finance p committee handle the City Manager committee should be adopted. On vote this I' L motion was carried. f II The matter of increased rates for Garbage Haulers was discussed at this I ':1 time. It was pointed out that on the 23rd of March, 1942 the Council had passed I, I, an Ordinance amending Section 5 of Ordinance No. 8265 increasing the rates for 5 Iii I,; garbage collections from 50 ,cents to 65 cents per month" and a 20% increase in j! other rates. The Garbage Haulers were not able to dlncrease their rate at that \; time on account of the ruling of the OPA. The Recorder was instructed to not- I, ify the garbage haulers that this Ordinance was still in force and that since 'i Ii the OPA had relaxed their ruling, that the Garbage Haulers could now make the charge of 65 cents per month for residents and that the Council would not grant I' the garbage haulers request for a 75 cent charge at this time. ,: p " Councilman Farrington reporting for the Finance committee stated that I ~, they had an offers from W. R. TaYior for lot 15 and 16, block 2, Agate Plat. I! That Mr. Taylor was offering $75.00 per lot and that the appraised value was 6 I: $200.00 per lot and the Finance committee recommended that this offer be re- 1'1 jected. Mr. Farrington stated that the committee did not have opportunity I,! to appraise the lot at the southwest corner of 18th and Charnel ton and that an tl :.; offer of Edwim A. Browning for the east 26 feet of lot 5, block 6, Teshners I'i addition had not been received in time to be accepted and that these two would I' II have to be carried over to the next Council meeting. i,l I" Iii II The bills for the month of June were presented to the Council, Council- II 11 man Farrington reported that they had been okay'd by two members of the Finance II 7 i: committee and was recommending that warrants be drawn for same. I ~ ~i Mr. Parker, of the Howard':"Cooper Corporation was present and Mr. Stewart :0 ,: inquired regarding the delay in delivery of the 2i inch fire hose. Mr. Parker ~ ?' ri explained that they were trying to get brass couplings and that this has caused ; 8 I: a delay but that they would be able to make delivery at an early date. . Ii I t; Mr. Farrington reporting for the Health Corumi ttee stated that he and [j Mr. Stewart had a meeting with Dr. C. Lindgren, County Health Doctor and W. J. !i Cloyes, County Sanitarian and that they had no legal authority to ac't as City 9 II Health Doctor and City Sanitarian and that it was the committees recommendation II.! tha t the Council _ should appoint Dr. Lindgren as City Health Doctor and' Mr. Cloyes i as City Sanitarian. A motion to this affect was made by Councilman Farrington Ii and seconded by Hawn and carried. 1.1 - , i:! Councilman Farrington reporting regarding the resigna tion of the City Ii Board of Health stated that he had been unable to do anything regarding this 1: situation. That he had again today -contacted li1r. Hesse and he stated that the 10 I B'oard had not changed their decision and that the resignation still stood. Mr. II , : Hawn in~uired if the fact that the City had removed Dr. Helterline from the I Court House back to the City Hall had anything to do with this resignation of 'Ii the Board of Health. Mayor La.rge stated that he didnot beleivethat this had ,I much bearing but that the trouble with the Board of 1tealth would have to go !: thru in order to be reelected probably had more than' anything else to do with I; the resignations. No action was taken b~ the Council. Ii Councilman Farrington stated that he had a complaint from Con Dillon II who resides at 1359 Mill'. That 4 trailers were located on the lot back of f! Mr. Dillon's residence. They had reported the matter to the Police Department ll!l had nothing had come of it. Councilman Hawn stated that this matter had come ; to his attention and he had talked' .to the owner who was renting the spaces for I the trailer houses. He stated that she had been in his office this afternoon 'l and that he had told her that the matter would have to be taken up with the '1 Council and that she was asking that she be allowed to continue the renting I if for these trailer houses as at the present time. There was some discussion .: by the Council regarding the condition of this place and whether the trailer !' house ordinance should be enforced. It was the opinion of the Council that I:' the trailer house ordinance should be strictly enforced and Councilman Hawn l; stated that he would notify the owner of the property that she would have to 'I make sewer comnections for the trailer houses. The Building Inspector was II instructed to make inspections and see that all trailer houses were complying Iii strictly with the trailer house ordinance. Ii Cquncilman Farrington stated he and Mr. Cloyes had visited the Central i.1 rooms about a week ago to make an inspection and found the rooms ih very' bad 1:, sanitary condition. This matter had been referred to the Police Department 12 ii e;.nd on July 7th, Attorney Calkins had addressed a letter to Mr. J. G. Harem, I; owner and operator of Central rooms at 862 Pearl notifying him to 'be present Ii at the Council meeting and show cause wh~ the permit for ~erating the Central II Rooms should not be cancelled. This letter had been delivered' to Mr. Harem '.1 by the Police. A copy of the letter was read to the Council by ,the Recorder !'I' at this time. Mr. Harem was present and stated that he was doing the best he I could to keep the places as clean as possible. He stated that it was very hard I: to get plumbers at this time and that there were times when there was plumbing I, work needed to be done when he could not get plumbers. He stated it was com- ii plained that the bedding and mattleesses were unsanitary but that he had been i buying new mattresses on the average of one every 30 days since he had been 11 in business and that he thought about 95% of the charges against the place were I! eronius. Mr. Harem presented 14 letters from different tenants in support of II the contention that the place is not in as unsanitray condition as reported. !I Councilman Farrington said that when he and N~. Cloyes inspected the place they ~ could find only 1 toilet on each floor and only one both on both floors. It Ii was stated that Mr. Harem had lef~' two child~en in charge of the'~lace when he i was out of town. Mr. Harem expla1ned that he had left the place 1n charge of Ii a Marine and that the Marine had been called for an examination. Councilman Ii Stewart stated that he was out of town when Mr. Farrington made this inspection Ii but that Mr. Cloyes reported to him conditions as Mr. Farrington had just out- n lines. A motion was made by Farrington and seconded by Hawn that the place be I II closed one floor at a time tuntil necessary repairs were made and that the re- i!: sponsibility should be on the inanager to see that the place was put in proper - Ill.. condition. Councilman Crumbaker stated he thought the requested work should I' he written out in detail so that Mr. Harem would know just what to do. The I; question was called for and on vote was carried. I' J . There was quite a delegation present at the meeting and Mayor Large stated ! he was sure part of them were present in regard to Rent Control and that this I matter would be taken up at this time. ",I would ask him to make a report. MR. R~eder said he had no written report and '. ~ ~~;)) I only made an oral report. Mr. Reeder stated that the committee had not had '1 ~,.t... much cooperation in their efforts, but that up to about sic weeks ago the ,.~ rent situation was in fairly good shape but that since that time in some cases . ~ the situtation had got out of control. He stated he did not feel that the CI present committee could accomplish any further satisfactory results and that the Council should adopt a rent control 6rdinance~nd discharge the present committee. At this tim eht letter from Mr. Culp, secretray of the Real Estate Board was read and the resolution passed by the Real Estate Board was as follows: "The Eugene City Council be requested without further delay to forestall Federal Rent Control by any neccesary ordinance for local control. " Mr~ Chris, ~ensen, a member of the rent control committee and a representative of the Railroad Brotherhood took exceptions to statements made by Mr. Reeder and accused the Realty Board of delaying the setting up of rent control. Mr. Jensen stated he did not think the rent control committee had been a fair com- mittee to ,handle the situation. He stated that back as far as February the (13~ Brotherho6<;l, had asked that 'Some, action be taken to control rents in Eugene. I There were 12 or 15 members of the Realty Board present and Mr. Jensen accused I them of appearing in a body to try to influence the Council to adopt a local rent control ordinance in order to avoid OPA control. He stated there was an OPA representative in Eugene now making investigation. J. E. Davis, also re- presenting the Railroad Brotherhood made quite a lengthy statement against the rent control committee and the Realty Board gave his reaso~~3 why he favored OPA rather than local control. Councilman Hawn inquired of Attorney Calkings if the OPA had a right to move into this territory and if the Council could pass a legal ordinance regarding rent control. 'Mr. Calkins stated he was sure OPA had a right to move in if they' wished to, but that he did not think the City could pass a valid rent control ordinance any more than they could set the price of cigars or neckties. ' There was some arguments bg<tween Mr. Jensen and Mr. Reeder.and other members of the Realty Board and Mr. Clifton Culp arose on a point of order and stated that he thought statements ~hould be directed to the Mayor and not agruments between different factions. Statements were made by various members of the Realty Board favoring the local rent con- trol ordinance. Mr. H. C; Johnson was present and stated that he had rented I property in Eugene since 1922. , .He stated that he had been a rent direotor of the OPA for two Oregon counties and that the OPA rent control was a terrible '.' , thing to have visited on any locality. He said it was purely a machine' and t that he felt the OPA was not what Eugene should have. After much discussion a motion was made by Crumbaker and seconded by Farrington that this matter should, be referred to the Judiciary Committee and the ,City Attorney to prepare a City rent control ordinance similiar to Bend's ordinance whihc would be . suitable to Eugene and to present such an ordinance at the next Council meet- ing. Councilman Barette 'stat~d that he had received a letter of thanks for I courticies' extended to the Girl Scouts by the Park Superintendant. He also stated that the Park COmmittee had a meeting and was recommending that a tax levy should be made in connection with a cottage for Hendricks Park and other 14 improvements there, and for further development of the city parks. Mayor Large stated that as long as they were talking about tax levy they might as ! well consider the swimming pool. ,He stated it was doubtful that the City could I get any money thry the Lanham A~t and possibly the only way for the City to finance a swimming pool would be to make an additional tax levy and that the tax levy should be so that the City could secure money in time for a pool to be ready for use next season. Councilman Hawn explained that the City would i have difffuculty in negotiating a loan on a .t.ax levy, but that if short time I bonds were voted the interest rate would be very low and then a tax levy could ; be'made to redeem the bonds. A motionwas made by Davis and seconded, by Crum- baker that the matter of drawing a measure to be put on the November ballot for additional funds for a swimming pool should be left in theehands of the Judiciary committee and the City Attorney, The amount to be levied to be determined by the City Engineer. ,On vote this motion was carried. I r: ' A motion was made by Davis that there be referred to the JUdiciary )1 Committee and City Attorney the matter of drawing of a- measure to be put on ~! the Movember election for Park purposes; - ore mil for two years and a contin- 151 uing levy after that of i mill for the Par,ks development. This motion was I seconded by Crumbaker and on vote was carried. : Sewer Committee - no report - i The Police committee'reported that they were not ready to make a ': report on the necessary budget for the Humane Society andconcerning the licens- ing of bicycles but that they would have a report for the next Council meeting. It Ii On motion made, seconded and carried the recommendation was adopted. ' ,I I: . A request from Fred Swain to be allowed to make a permanent building 19 I' out of a lOx 12' utility room at 1452i west 11th was denied. ~l An application from Tad Luckey and' ,Lucinda Deburgh to add another partner 'I' Tad Luckey, Jr., at the Club Cigar Store carrying Class B Retail Beer and Package 20\ Store Class B Beer license was approved, by the Council. I, 11 I,' A letter of resigna tion from A. L. Strickland regarding his appointment ! as E.l.ectrical Inspector was read. The question was raised as to why Mr. Strick- 211! land was resigning and Mayor Large asked the Recorder to read a protest Signed (I by 14 local Electrical Contractors protesting the 'hiring, of Mr. Strickland. [',. The protest was read _and Councilman Hawn stated he fet the requirements mentioned I' were reasonable. Councilman Davis and Crumbaker inquired why it was necessary r1 tha t the Electrical dealers should be contacted when an appointment was being [I made by the City and Mayor Large. explained that there was no reason why it was :: necessary, but .that the electrical dealers cO,yt.ld make it so hard that it would I; be impossible to make a s.ucess o+' the job. A motion was made. by ,Davis and sec- I: onded by Barette that the resignation of Mr. Strickland be accepted. On vote ~ this motion was carried. , !1 A letter from the Obsidians stated that they had bought a lGt from the If: City and had understood encroachments by -the Amazon would not be much over 10 ~ fe~t and they could not accept the deed for the lot with the provision that 2~: had been. inserted. The FinAnce- Committee explained that this matter had been l'i'~ talked over at the time of offer and that. they felt nothing more. could be done ! in regards to this matter. A motion was' made by Farrington and seconded by II Crumbake~ that the Obsidians be allowed to choose another lot and-apply the 11 purchase price on the new lot or they could be refunded their money on this lot, Ii except any expenses that, the Coty might have been to. On vote this motion was !Ii carried · ~ ! ;,: A letter from George C. Stanley requesting he be allowed to erect his I'i building at the northwest corner of 13th and Oak street on the 7 foot set-bacl I: on the corner of 13th side. The letter stated that he would construct the build... 23 Ii ing with cold joimts at this 7 foot strip and if and when 13th street is widened, I;~ they will vac'a te . the 7 feet and remodel the puilding to cop,form to the Ordinance :: at no cost to the City. A motion was made by Barette and seconded by Far;rington \.1' that .this request b.e granted and that the City Attorney be instructed to draw ;, up the necessary contradt.. On vote this motion was carried. Ii The Mayor and Recorder were authorized to sign the 1944-45 contract with 24 ~ the River Raod Fire District which had already been signed by the Fire District. Ii The Recorder explained'th~t the Rural Fire District #1 (College Crest) I had reported that Joseph Muir was out of town and the contract had not been Ii returned to the City. The Recorder was instructed to furnish the district 25 ,t with a nontra.ct and advise them if the contract was not signed by the proper " officials and returned to the City by the end of July, fire protection would ~ be discont{nued as of July 31st. [i J $ :' The Recorder also reported that, 3 mills that had not paid the 100.00 :; initial payment that was due on July 1st for the year 1944-45. The Recorder 26 II was instructed to contact these mills at the middle of the month, stating that :,: services would be discontinued as of July 31st unless payment had been received. I. A bmd from the 'I ColU{t,lbia Equipment Company for an Aust~n Western Patrol Sweeper at a cost of : $4250.00 with an additional charge of $100.00 for broom filling machine to : fill rear broom, and another additional charge of $125.00 for leaf rake to 3211 work on front of sweeper and another' additional charge of $250.00 for an en,closed babe \, A bid from the Heward Cooper Company for an Elgin Jr. Sweeper at a cost of $7,000.00 with an additional charge of $95.00 for broom filling machine These bids were referred to the ,street Department for consideration, to report back at the next Council meeting. At this time Councilman Farrington stated the request for a new car .! for the Police Matron." hadheen elimina.ted from the Budget;- that she was still I i using the ,-old car and had used 33i gallons of gas for the month of June. He ! stated that the Police Matron was using this car to go and, come from work and 33: that no other City employee had this privilege and that he did not beleive she was in need of a car. That the Police Department could take care of her in I cases where it was necessary for her to use a car. A motion was made by Mr. : Farrington that the use of this car be discontinued by the Police Matron and i put to whatever use the Police might use or be sold. This motion was seconded I by Crumbaker. Councilman Hawn stated that he was not certain what use the ! Police Matron had for a car and that it was agreeable with him if the Council wished to take this action. Chief Bergman was asked by Councilman Hawn whether the Police Matron need this car and the Chief reported that her inspection work was only 3 or 4 blocks from the City Hall. 'Councilman Hawn stated that if the Council would like, he and the Chief of Police would discuss the matter with the Police Matron. The motion was withdrawn by both Councilman Farrington and Mr. Crumbaker and Mr. Hawn and the Chief of Police were instructed to meet with the Police Matron and bring in a report at the next m~eting. Councilman Farrington stated that the Health Committee had been with- out a Chairman for quite some time and he felt that something should be done to provide a chairman. He inquired regarding the condition of Mr. Wiper and 34 asked if he was not going to be able to come back, if some other arrangement . could be made at an early date.
