The minutes of the regular meeting of the Common Council, held Monday ~':, Iii evening October 23rd at 7:30 p.m. The meeting was called to order by Mayor f;,.~ ~,' Large. All Councilmen present except Hawn. !'j' II ..,., 1'1 Mrs. Charles O. Beitel, representing the Women of the Moose, addressed I' Ii the Council and requested permission for the lodge to take over the offices 1 f in the City Hall on October 27th~ She stated that this was being done in I: other places in the lodges and the lodge here in Eugene wanted to be the first I'I :l in the state of Oregon to make the experiment. A motion was made by Bailey Ij and seconded by Davis that this request be granted. On vote this motion was I, carried. " ;:1 II Mr. Ed.Seigmund, of the Best Cleaners, addressed the Council in regard 1,,1 II to a walnut tree in front of his cleaning plant at 821 East 13th Street. He 2 11 stated that the limbs on the tree inter~epred with his neon sign and was asking II ;I~ to have this removed. The matter was referred to the Parks Committee. il f! Mayor Large explained that on account of the delegation present the 'I i matter of the v~cation of High streets between 19th and 20th and vacation of other streets requested by the School Board would be discussed at this ti@e. I' The majority report of the Planning Commission dated October 23rd, ,I 'If voted 5 to 1 requesting the vacation of these streets was read at this time. I" I!I A minority report signed by Mozelle Hair and R. W. Prescott was presented at I,! this time; this being a 6 page type-written report was read and explained to 1\ the Council by Mr. Prescott.. Engineer Clubb explained that the Planni~g 1.1 Commission had originally mapped out High street as a through street and had ,I provided for a 7 foot set-back on both sides of High street south of 19th but I" " ~i explained that this had no legal bearing as to whether High street could or Ii could not be vacated at this time. Councilman Davis asked if at a special I" I II informal meeting held with the School Board and the members of the Council ,,' II in 1940 had there been any promise made the School Board regarding High Street. II I' Both Councilman Farrington and Koppe stated they had been at this meeting and I 11 there had been no arrangements reached at that time. A motion was made by !,I Davis and seconded by Crumbaker that the Council adopt the majority report of 3 i! " the Planning Commission and that the City Attorney be instructed to bring in i:1 j:! necessary papers for the vacation of High street and other streets requested Ii! by the School Board, reserving for the City the Public Utility rights. Council- t,; man Koppe stated that he felt at the time the School Board took over the I; property that they understood the Council intended to open High street on the jI south and that he was very much opposed to the closing of High street. It ,!! ,1: was pointed out thit the district south of this opening would need a trunk I: sewer line and if these streets were vacated there would be no place for the II line to come thru. It was stated that the matter of placing the High School J ,I building one block further east, extending to Hilyard Street, had been suggested ~: f I' but that no agreement had been reached with the School Board. Councilman Crum- ::1 baker stated that he felt that over a long period of years a school were a very Ii Ii importan~ thing for the City and that he felt a highway on Willamette and Oak , to the west and Hilyard of the east would be able to take care of the traffic. I' Councilman 'Farrington stated that after hearing the discussion he felt that f il !'i further study should be made before the question was dec,ided. At this time IiI Councilman Davis stated that he would be willing to withdraw his motion if t; agree~ble with Councilman Crumbaker, who seconded the motion. Councilman " II Crumbaker stated that this would be agreeaRle with him with the understanding I" I:j that the matter was not to be delayed. Councilman Farrington stated that he I,' 'I felt this matter should not be delayed beyond another Council meeting. Council- ,i, I man Bailey stated he felt they were hea~ing only one side of the controversary "f " and that tee matter should -be referred to a;ppoper committee to get the facts. " , It was reported that Mr. Arthur D. McVoy from Portland would be in Eugene yet " ',I this week and a motion was made, seconded and carried that an arrangement be t; [i made with the Council, the Planning Commission and the School Board to meet Ii with Mr. McVoy while here in Eugene and endeavor to arrive at a solution of I, I ~ i this situation, and make a report at the next Council meeting. .! II ii, Street, Fire and Water Committees - no report :,1 j' :11 I' Councilman Bailey reporting for the Health Committee stated that he had Il investigated the smoke stack on the Foundry at 8th and Ferry and that there ,I was no violation of the City ordinance. 25 II Councilman Barette reporting to the Parks Committee referred to the I Manerud Huntington sawdust fire and stated he felt that it should be declared 26\, annuisance and ordered removed. The matter was referred back to the Parks 1 Committee to make an investigation and to bring in a report. I I Councilman Crumbaker stated that he wished to report that sewer repairs '1' 27 I: for the Dale property above Fairmount Boulevard had not been taken care of as !i ordered by the Council. Police Committee - no report II I The ma tter :)f the proposed annexa tion for the districts lying west of i'l I the City was taken up at this time. The Recorder r~ported that at the meeting t held on October 9th, six petitions carrying about 250 signatues had been pre- I sented to the Council requesting the annexation and that the City Attorney ;1 had been instructed to bring in an ordinance ordering a special elevtion. II Since the last meeting a petition against the annexation of centain parts of I 28 II the district had been presented carrying 109 names; the petiton stating I'll I! after the war they wished to form a Fire and Water District of their own. A '! ,I petition signed by the industrial firms on west 6th and west 7th objecting to I the annexation of that part of tee district was read at this time. This was i signed by 25 firms. Also a letter from the Arkley Lumber Company objecting to the annexation was read. An Ordinance which had been prepared by the City 'I Attorney providing for a special election for the annexation of the district I had its first reading in detail at this time. He stated that he felt the districts as outl~ned in the proposed ordinance has 3 different problems. That there was the industrial districts on the I _oj north and the heavily populated districts in West Moreland and outside of 'Jot.JP:: {."t' ol., these 2 districts was the thinly populated sections afid he felt it should '-.Q J be submitted to the people under 3 different measures. He stated he felt '" CWt..." :n it was an injustice to include these districts a single measure. Mr. Leech , ( 28)1 addressed the Council at this time and stated that he thought the south I boundary line should be changed from 24th to 23rd.. That the 24th street I I took in a wooded. district and was not satisfactory for a roadway but that by moving the line one block north a street could be extended to the west I line of the proposed annexation. Paul Deautremont stated that the district ! south of the amazon was only acreage and that he objected to it being included i in the annexation. Mr. Edward S. Sawyer sta~ed objections to included the I I industrial area on the north end of the proposed tract and recommended that r this left out. It was stated that the people objecting to the annexation had no opportunity to discuss the boundaries of the districts to be voted in and Mr. Hayden explained that there had been meetings and'referred to a meet- ing held in the Morman Temple at which the Sanitation means had been discussed and that he felt there had been plenty of opportunity for objections. It was explained that the Council was interested in the proposal only to clean I up the sanitary conditions; that there were open sewers and that something I would have to be done. Mayor Large explained that if this district was not annexed the sewer sanitation would have to be taken care of in some way at an early date either by the County or Federal Authorities as it was a,menace to the public health as it now stands. At this time a resolution signed by W. J. Cloyes, Secretary, and dated October 23rd was Read. This was the unanimous report of the Executive Comm- I itteeand Sewer and Sanitation Committee of the Central Lane County Planning I I Council. Tfuis resolution was in support of the annexation of the outlying j districts on account of sanitary conditions and Mr. Cloyes addressed the I Council calling attention to the sanitary conditions and the open s~wers that need attention. Councilman Farrington stated that he and Councilman Crum- baker had gone over the boundaries of the proposed district during the after- noon and that there was open sewers and that he wished to support what Mr. Cloyes had stated about the sanitary conditions which need.correction. Councilman Davis stated that the matter should be held up to make further I study and Mayor Large stated that both Mr. Cloyes and Dr. Lindgren were , present and would give the Council any information desired and that it was I I his suggestion that a descision should be made at this time. Councilman I I Bailey stated that he beleived some boundary chages should be made and ~avored I referring the matter to an appropraite committee. After some further discussion , a motion was made by Bailey and seconded by Davis and carried that the matter ,i be referred to the Sewer Committee to make further investigation and report :1 back at the next Council meeting. , At this time the resignation of Colonel James H. Tierney as Chairman of the Fair Rent Committee was read. A motion was made by Farrington and 29 : seconded by Koppe that the resignation be accepted and that the Council extend , to Colonel Tierney their sincere thanks for the services rendered. On vote I the motion was carried. Mayor Large stated that at this time he wished to appoint Mr. M. H. , - 30 : Stewart as a member of the Rent Control Committee and a motion was made by Koppe and seconded by Stewart that the appointment be confirmed. On vote the motion was carried. r . I The matter of the resignation of C. C. Ball as a member of the Fire 31 ! Department which had been referred from the last Council meeting was brought up at this time. Councilman Stewart explained that he had met with the Fire Chief and the Asst. Fire Chief in which they had talked over the situation and that the committee wished to clear the Department and the Chief of any wrong doing to regard to the matter and that it was the reoommendation of the committee that the resignation of Mr. Ball be accepted. A motion was made by Stewart and seoonded by Barette and carried that the resignation be accepted. The Recorder reported that the J. H. Baxter Lumber Co., had paid the 32 initial payment of $100.00 for the f.ire protection for the fiscal year ending June 30, 1945. Departmental reports for the month of September 'of the Eugene Water I 33 Board and Eugene Public Lihrary were ordered placed on file. The Curb Cut requests of Harry Osborn, 1825 Washington; L. H. Greene, 039 Monroe Street; and Agnes L. Smith for a waiver of 1\ " set-back on 8th avenue at Washington street. He has a small lot 43 feet by I I 66.8 feet at the northwest corner of the intersection and wishes to erect a 36 1'1 house 28 by 32 feet and can get only a 12 foot set-back on Eighth avenue which Ii does not co-incide with the set-back ib the rest of the ~lock. The Board Ii recommends that the request be granted. n I' I' "The Board has received a request from Dr. A. C. Baronti to be allo~ed to f, Ii convert the garage on the premises at 230 Monroe into an office and an emerg- I' ency operating room on small animals and the animals to be kept not over 24 :1 hours except in emergency when they'would be under anesthesia.
