The meeting was called to order by Mayor ~.~ , f~ , Large. All Councilmen present except Davis. , i ~~~: " Ii A communication signed by 10 business men in the downtown area which was Ii anded to the Council by C. E. McLean, Manager of the Eugene Hotel, was read. This was emphasing the need of the cooperation of the Council with the Federal ,I ,. Public Roads administration and the Oregon State Highway Commission in completiton 1 i: of the thru arterial highway routes which had been tentatively established for Ii Eugene. Mr. McLean addressed the Council and stated need of oooperation in order to prevent any possible by-passing of the city by the Highway Commission. I'i Mayor Large stated that the matter of annexation would be taken up at I" ,j this time. Councilman Bailey stated that the matter of annexation had been II debated pro and con to a considerable extent at previous meetings and felt that 'I I,' deblates at this time should ~1mited. Mr. Bailey made a motion that debates !;: II be limited to one person for each partmcular group. This motion was seconded by 1'1 Stewart and on vote was carried. At this time a communique from the Central r~ p II Lane Planning Council signed by William S. Fort, vice-president was read. This 1,1 I,' was in explanation to a previous'resolution that had been prese!lted to the Council ,i and brought out facts regarding the proposed Chambers, Westmoreland annexation. 1'1 I.. Mr. Roy Crow addressed the ~ouncil objecting to the annexation. He objected to - i.i sewer assessment being charged'against the property a~d felt :that the district L should be allowed to work out their own water and sewer problems. E. S. Sawyer :;-,,,. '1 addressed the Council, as representing the Industrial District and referred to I" a petition that had been signed by Attorney Dave Evans representing the Industria] i! Ii district on the north end of the proposed tract. Mr. Sawyer objected to this I', 2 1:1 part of the industrial district being included when the north of the railraod 1'1 was not included. He stated that if the other industrial district on the west 1'1 " side going as far north as the sou~hline of Bethel district was included they i: I would make no objections. B. Gard, " i: 1', chairman Industries Committee' of the Eugene Chamber of Commerce'. At a previous !I 1'1 meeting Councilman Calvin Crumbaker, Louis Koppe and E. A. Barette had been !l appointed as a committee to make investigation regarding th~ boundaries of the ji proposed 'tract to be annexed. The Committee filed a tyepwritten report, signed 1:1 by the three members, which was read at this time. The only recommended change I:, II in the boundary of the tract was the first tier of lots on the south side of the " district. ,There had been some suggestions that the annexation proveedings should ii be delayed until after the next season of the legislature on account of some I; proposed legisiat.ion effecting districts of this kind. It was the recommendation II of the Committee that the annexation should not be delayed. A motion was made by l! Crumbaker and seconded by Bailey that the report of the committee be adopted. J,( J. E. Brindle representing the district south of the Amaxon addressed the 'I Ii; Council and objected to the election being held at this time and stated he thought t ~: . this should be put off until'after the legiSlature had. met this next season. ill I: Councilman Hawn at this time stated that he was not at the last' Council meeting f~ and stat~d he had the impression that it was wrong to include 'only the part of it d the industrial tract south of the Oregon Electric and not_include that part north l: I of the Railway and asked Councilman Crumbaker for an expilianation regarding this. I: Mr. Crumbaker explained that this part of the proposed tract belonged to the I, d Bethel District and presented a different proposition~than the land south of the II Oregon Electric. The original qu~stionregarding the.adoption of the Committee ~ It Ii report was c-alled for and on vote "was carried . I', H The ordinance presenting the question of annexation at a special election 11:\ ,I to be held on the 15th day of December, 1944 had its first reading on October ;,i r'l 23rd. A motion was made by Crumbaker and seconded by Koppe that this ordinance I 1'1 should be amended as to the description of the tract to comply with the recommend- i:1 'I ations of the committee. On vote this motion was carried. The amended ordinance Ij had its second reading at this time. A m4>:tion was made ~y Bailey and seconded Iii I: by Farrington that the ordinance be passed to its third reading by unanimous F ' consent of the Council by title under suspension,of the rules and be placed for 'i final passage. . The motion was carr,i,ed and on roll call all councilmen present Ii' Ii voting AYE, absent Davis. >I I. At this time it was pointed out that the amended ordinance could not be I d " adopted in time to hold the election on December 15th and a motion was made by I' .1 Farrington and seconed by Crumbaker that the Council reconsider its action in .. I' passing the Ordinance. On vote this motion was carried. .A motion was made by 1"( Ii Crumbaker and seconded by Hawn that the ordinance be further.amended by changing I: the date of the election from December 15th to December 20th. On vote this motion O'i was carried. The ordinance with the two amendments as noted above has its second 'I 'I reading at this time and was passed to its third reading by unanimous consent of II l .the CounCil, by title under suspension of the rules and was pla~ed for final ,l passage. At the Coun~il meeting on October 23rd,\, arrangements had been made for a meeting of the Council, the school board, and the Planning Commission to be held regarding this proposed v~cation. ,._,T;b,e meeting was held in the Mayors office at 10:90 A.M. on Friday, . October 2?~h, and at this meeting a committee consisting of-A. C. Farrington, R. W. Prescott, and G. D. MacLaren was appointed to make further investigation .and report to :the Council at this time. A written report of the committee dated November 9th, -' and signed by the 3 members was read at this time: , "We :.recommend that all of the, streets and the alleys in' the proposed High School campus east of the Amazon creek be vacated, reserving to the Oity rights of way for installation and maineenence of all municipal untilities, -/ upon the expressed condition, however, that the public' need for a fUDune 22 arterial North and South along the general line of Pearl street and/or Oak street be recognized 'and -safeguarded, andnthe sme to be available, at no cost of the City for rights of way, but at the'sa~e time with complete regognition that the school district be entitled to use the athletic field and reasonably tu wear the present~sta~uim' out before being required by th~ City to move the same to a new location." At this _tim~a . letter from Mr. Gunn, Superintendant of SChool District #4, dated October' 30th, 1944, was read regarding the 7 foot set-back on pot~ side of High street between 19th and 20th" which had been reserved by the Co~cil at the time the other lots were deeded to' the school board. It was the school boards request that the Council should give a deed to the school board for these two seven foot strips. 'Also a letter from Dr. Gunn, dated November 2, 1944, outlining the ~treets and alleys in this tract which was to be vacated and , referring to a letter from President Orlando Hollis, of the University of Oregon, referring to a previous letter to' the Council on January ~, 1941, by Donald Erb, requesting'the vacation of th~se streets in the. tract south of 20th owned by the University. Also a let~er dated October.31, 1944 from Chance- llor Frederick M. Hunter regarding the attitude of the University upon the need for the street vacation in this area. Also a letter dated'October 20, 1944, from Orlando Hollis to the City Recorder referring to the letter' of January 4, 1941 I from Dr. Erb, requesting the vacation and' stating that no final action w~s ~ver taken upon this reqqe~t.. . :' ,_ . . . A motion was made by Stewart and seconded by Crwnbake~ and 'carried that .' ~ . . ' ." . the report of the C6mm1;tteeregarding then vacation of the st.t~etsfor the_School Board be adopted and, that the-,Ci ty Attorney be instructed to prepare the necess- ary papers for the vacation of the?e streets and a~~eys. Mr'. Bailey ex- \~./i I:: plained that this deed should be issued in advance of the vacationing so that I; there would be no doub~- of the titilie of the School Distriot. On vote this motion ': was oarried. I I: In the event of absence of Mr. Davis, Councilman Stewart reporting for the I~ street department reported that the eves ,of a building on East Broadway leaking ;: on the sidewalk. He stated that this was the building aoross the alley just east 23 II of the Eugene Hotel, known as 258 East Broadway and the leaking of the eves on :: the sidewalk was annoying to the pedestrians. He stated this had been a nuisance i,for two or three years and the matter had beeil oalled to the a ttention of the j' . i; owner and nothing done. Mr. stewart made a motion that the Recorder be instruoted i: to address a letter to the owner of the property asking that this condition be :, oorrected. This motion was seoonded by Bailey and on vote was oarried. I' - II I,: Councilman Stewart reporting for the Fire and Water Committee brought up It the question of salary to be paid to Chet Good, an employee of the Fire Depart- I! mente Mr. Stewart stated that Mr. Good had worked for the Fire Department at :1 different times, oommenoing November 1942 and had worked a total of 12 months; i~ that he had gone back to work on the Department this November 1st; that he was 24:! a more valuable man to the department than a new man and t'hat he was reoommending :: that Mr. Goodts salary be fixed at $166.00. After some disoussion a motion was :i made by Stewart and seconded by Farrington and oa.rried that Mr. Good t S salary be Ii placed at $166.00 per month. . ~ ~ ,: Counoilman Stewart also reported that the rear tires on truok No. 3 were I: worn smooth and were unsafe on, the Slippery streets and th~t the department was 25~; in need to two new casings for this truck.
